Introduction:
Section 607.09 Subdivision 5 of the City Code authorizes the abatement of Nuisance
Code violations. Staff seeks approval of a resolution authorizing abatement to remedy
Nuisance Code violations present at 8217 Long Lake Rd.
Background:
On November 14, 2008 staff responded to information regarding an auto repair business
operated at a single family residence at 8217 Long Lake Rd. Staff made contact with the
occupant, Tony Preciado, who explained that he closed his auto repair shop in Columbia
Heights and had brought home vehicles that were at his shop that belonged to customers
so they could be picked up. This order explained that the exterior accumulation of
inoperable vehicles, and vehicles parked off an improved surface would need to be
removed from the exterior of the premises or otherwise brought into compliance no later
than November 21, 2008 to avoid further remedial actions.
During the following weeks little progress was achieved. Follow up inspections on
November 27, 2007 and December 4, 2007 revealed little to no progress. Ramsey
County Court Citations were issued December 4, 2007 for violation of the following
sections of City Code 1) Section 607.07 Subdivision. 2a (2-counts): Abandoned, junk,
and unsafe vehicles; 2) Section 607.06 Subdivision, 2c (2) (4-counts): Vehicles parked or
stored outdoors shall be registered to a legal resident of the property; 3) Section 607.03
Subdivision 3c: Outside accumulation of junk, rusting metal, inoperable equipment and
household furnishings prohibited; 4) Section 607.06 Subdivision 2c (1) (4-counts):
Vehicles parked or stored outdoors shall be on an improved surface of asphalt, concrete,
brick, or gravel; and 1106.03 Subdivision 3f: 5) Section 1106.03 Subdivision 3f Home
business occupation in a residential area shall not violate provisions of Chapter 607.
Despite these efforts the property remains in violation to date and staff seeks approval of
an abatement to bring the property into compliance.

Discussion:
Section 607.09 Subdivision 5 of the Nuisance Code provides the City the opportunity to reach
compliance by abating (correcting) items in violation of the requirements contained within
Chapter 607. In non emergency cases where no immediate threat to the public health and
safety exists the City code requires that staff obtain City Council authorization prior to
abatement of violations and notify the property owner of their opportunity to be heard before
the council, provided however, that at least 10 days notice is provided.
The property owner, Maria Preciado, resides at 8030 Long Lake road and was notified in
writing on January 14 2008. Ms. Preciado contacted City staff on January 23, 2008 and
explained that her son who resides at 8217 Long Lake Rd, Tony Preciado, is ill with serious
complications related to diabetes and will be spending time at the Mayo clinic. Ms. Preciado
explained that several other family members are ill and she has been taking care of them and
this has left her with little time to correct code violations at 8217 Long Lake Rd. Ms. Preciado
expressed a desire to speak before the City Council during discussion of this item.
Recommendations:
Staff recommends consideration of Resolution 7216 7174 authorizing abatement of
Nuisance Code Violations present at 8217 Long Lake Rd. Consistent with past council
directive; this resolution would authorize abatement no sooner than 5 days from the date
of approval and the abatement action would be completed no later than 10 days from the
date of approval.

Unbelievable. Yes, the City cares, and Yes, we will follow up on this. As for the tree
removal, we'll try to ascertain the limits of the property lines and respond accordingly.
As of right now, however, any property owner can clear trees--we have no prohibition
against this. Naturally, they can't clear OTHER people's trees ... And the regs relating
to vehicles is such that (a) any vehicle shall be parked on an improved surface, (b) any
vehicle parked outside shall be operable, (c) shall display current license tags and (d)
shall be registered to the property owner or resident.
Suffice it to say we will be out there as soon as I can get a hold of the nuisance code
inspector.

Not sure if this is a topic you can take care of and if not can you please get this email
to the police or who ever can take steps in solving this problem:
My neighbors and I have been having some real problems with the 8217 address on Long Lake
Road in MoundsView. Who ever lives there has well over 20 different vehicals parked in
the front and in the back yard. Mainly junkers in the back yard. The last few nights
they have had a chain saw going and have been cutting into the woods behind there property
(and i know the woods there cutting down is not there property) than they take a truck
with a plow and ram all the bruch and trees they cut deeper into the woods, after they
have done that they bring in junker cars on a flat bed and drop them into the woods. I
thought you could not have more than 4 or 5 vehicals on your property? This house seems
to really attract dirt balls, prob due to the fact it is a junker of a house. Does the
city not care about any of this? I would think they should. Please let me know what can
be done. Thank you very much!

STATE OF MINNESOTA
RESOLUTION AUTHORIZING ABATEMENT OF NUISANCE CODE
VIOLATIONS AT 8217 LONG LAKE RD, MOUNDS VIEW, MINNESOTA, 55112.
WHEREAS, Maria J. Preciado is the owner of property located at 8217 Long Lake Rd,
zoned R-1, Single Family Residential, legally described as follows:

WHEREAS, on November 15, 2007 a notice of violation was issued to Maria Preciado
and requested corrective actions completed to bring the property into compliance with the City
Code by November 21, 2007; and
WHEREAS, on November 27, 2007 staff performed a follow up inspection of the
property located at 8217 Long Lake Rd and found that corrective actions had not been
completed; and
WHEREAS on December 4, 2007 staff performed a follow up inspection of the property
and found that corrective actions had not been completed, photographs of the exterior were
obtained at that time; and
WHEREAS, in a letter dated January 14, 2008, staff notified Maria Preciado of its intent
to appear before the Mounds View City Council on January 28 2008 to request authorization to
abate violations cited in the notice of violation dated November 15, 2007; and
WHEREAS Maria Preciado and Tony Preciado are responsible for maintaining Nuisance
Code violations on the exterior of the above-said property that include, but are not limited to:
1. Abandoned, inoperable vehicles parked on the exterior of the property.
2. Vehicles parked on the exterior of the property do not display current license.
3. Vehicles are parked off an improved surface.
WHEREAS, the City Council finds that the Nuisance Code violations at 8217 Long Lake
Road constitute a Public Nuisance under Section 607.03 Subd. 3c and the City may abate and
assess the costs of said abatement against the property pursuant to Minn. Stat. 429.101; and
WHEREAS, the City has complied with the notification requirement for nuisance
abatement as stated in 607.09, Subd. 5b. of the Mounds View Municipal Code; and
WHEREAS, Maria Preciado, property owner of 8217 Long Lake Road, will be personally
liable to the City for the costs of such abatement, including administrative costs pursuant to
Section 607.09, Subd. 7 of the Mounds View Municipal Code; and

WHEREAS, if the property owners fail to pay the cost, after being duly notified, of the
abatement of Nuisance Code violations at address within 30 days after the date of the invoice, the
City may certify the unpaid costs against the property pursuant to Section 607.09, Subd. 8 of the
Mounds View Municipal Code.
NOW THEREFORE, BE IT RESOLVED THAT:
The City will abate violations of Chapter 607 of the City Code no sooner than 5 calendar days
and no later than 10 calendar days as follows.
1. Section 607.07 Subdivision. 2a (2-counts): Abandoned, junk, and unsafe vehicles;
Section 607.06 Subdivision, 2c (2) (4-counts): Vehicles parked or stored outdoors shall
be registered to a legal resident of the property; Section 607.03 Subdivision 3c: Outside
accumulation of junk, rusting metal, inoperable equipment and household furnishings
prohibited; Section 607.06 Subdivision 2c (1) (4-counts): Vehicles parked or stored

3. Any unpaid portion of the abatement costs after 30 days of the date on the invoice may be
certified as special assessments against the property upon a duly called hearing and
pursuant to Section 607.09, Subd. 8 of the Mounds View Municipal Code.

Preliminary Feasibility Report and Consultant
Selection for the 2008 Street Maintenance Project
(Seal Coat Project)
Background:
Seal Coating is a common preventative maintenance activity in Minnesota,
performed by most cities, counties, and rural Mn/DOT districts. It involves
spraying asphalt cement on the surface of an existing pavement followed by the
application of a cover aggregate. The asphalt cement is usually emulsified
(suspended in water) to allow for it to be applied without the addition of extreme
heat. The cover aggregate is normally either naturally occurring gravel or
crushed aggregate such as granite, quartzite or traprock (basalt).
The primary reason to seal coat an asphalt pavement is to protect the pavement
from the deteriorating effects of sun and water. When an asphalt pavement is
exposed to sun, wind and water, the asphalt hardens, or oxidizes. This causes
the pavement to become more brittle. As a result, the pavement will crack
because it is unable to bend and flex when exposed to traffic and temperature
changes. A seal coat combats this situation by providing a waterproof
membrane, which not only slows down the oxidation process, but also helps the
pavement to shed water, preventing it from entering the base material.
The secondary benefit of seal coating is an increase in the surface friction it
provides. This is accomplished by the additional texture the cover aggregate
adds to the pavement. With time, traffic begins to wear the fine material from the
asphalt pavement surface. This results in a condition referred to as raveling.
When enough of the fine material is worn off the pavement surface, traffic is
driving mostly on the course aggregate. As these aggregate particles begin to
become smooth and polished, the roadway may become slippery, making it
difficult to stop quickly. A seal coat increases the pavement texture and increases
the surface friction properties.
In most cases, seal coating is done on roadways with low to moderate traffic
volumes (up to several thousand vehicles per day). This is due to the increased
chance of windshield damage to vehicles during and immediately after
construction as traffic volume and speed limits increase. Roadways to be seal
coated should also be in relatively good condition. This means that there should
be little, if any, load-related distress such as alligator cracking, rutting and
potholes. If these conditions exist, the road should not be sealed unless it is
repaired first.
Discussion:
The 2008 Street Maintenance Project, as proposed, includes seal coating various
street segments and parking lots within the City. The majority of the streets
proposed for seal coating include those streets that were reconstructed as part of
the County Road H2 and 2003 Street and Utility Improvement Projects.
Parking lots proposed for inclusion in the 2008 Street Maintenance Project
include: City Hall (both general and police lots), Mounds View Community
Center, Lakeside Lions Park, Silver View Park, and Greenfield Park.
As per the City’s current Pavement Management Plan, this will be the last seal
coat project until the year 2014, when these streets and parking lots, along with
the street segments that were seal coated last year, are considered for another
seal coat. A program to seal coat street segments reconstructed as part of the
City’s newly adopted Street and Utility Improvement Program will not commence
until the year 2016.
Preliminary Report - The first step in a public improvement process is the
preparation of a preliminary engineering report. It is recommended that the
preliminary report be ordered at this time to determine the need and feasibility,
both physical and economic, of providing the necessary public improvements.
Consultant Selection – There are several engineering consultants within the
City’s “consultant pool” from whom services could be obtained. Staff
recommends that the Council retain the services of the engineering firm of
Bonestroo, Rosene, Anderlik, and Associates (BRAA) to assist in the preparation
of the preliminary engineering report and other aspects of this project, as directed
by City Council.
As with the 2007 Street Maintenance Project, Staff will be seeking to facilitate the
partnering with the City of Spring Lake Park on the 2008 Street Maintenance
Project in an effort to minimize administrative cost and perhaps to receive more
favorable bids due to having a larger project. As a further note, Lakeside Lions
Park parking lot will also be seal coated as part of this project; maintenance of
this lot is shared by both cities.
Budget – The adopted 2008 budget has $215,000.00 allotted for this project:
• $170,000 in the Street Improvement Fund (account 285-4470-
7050) for the overall project, including City Hall parking lot.
• $23,000 in the Special Project Fund (account 280-4180-7050) for
the Mounds View Community Center parking lot.
• $22,000 in the Park Dedication Fund (account 251-4470-7050) for
Silver View and Greenfield Park parking lots.
Recommendation:
It is recommended the City Council adopt a resolution authorizing the preparation
of a preliminary feasibility report and the selection of a consultant for the 2008
Street Maintenance Project (Seal Coat Project).

report shall include an analysis as to whether the proposed
improvements are necessary, cost effective, and feasible.
2. The services of the engineering firm of Bonestroo, Rosene, Anderlik,
and Associates (BRAA) shall be retained to assist in the preparation of
the preliminary engineering report and other aspects of this project, as
directed by City Council.
3. Expenses associated with the 2008 Street Maintenance Project will be
financed based on the following schedule:
79% from the Street Improvement Fund (account 285-4470-7050)
11% from the Special Project Fund (account 280-4180-7050)
10% from the Park Dedication Fund (account 251-4470-7050)
Adopted this 28th day of January 2008.
