The City of Mounds View issued an intoxicating liquor license for ABC Liquor in June of 2007, and their renewal is before the Council for consideration. ABC Liquor’s Intoxicating Liquor License will expire June 30, 2008. The notice of this public hearing was sent out to residences within a 350 feet radius, and the Notice of Public Hearing was published in the Mounds View/New Brighton Bulletin. Property taxes on this property are current. ABC Liquor has submitted their city liquor license application materials and the applicable fees. The following investigations and inspections have been conducted to determine whether there is cause for the City to the above referenced intoxicating liquor license application: Police Inquiry and Investigations (Mounds View Police Department) The Mounds View Police Department has issued a satisfactory report for ABC Liquor. Staff has submitted a background check application on the owner of ABC Liquor to the Minnesota Department of Criminal Apprehension. The liquor license will be contingent on a satisfactory background check. Utility Billing Inquiry (City of Mounds View) The Finance Department has issued a satisfactory report for ABC Liquor. Fire Inspection (City of Mounds View Fire Marshall) The City’s Fire Marshall is in the process of conducting final inspections on all liquor establishments. This license will be contingent on a satisfactory fire inspection. Recommendation Staff recommends that the City Council open the Public Hearing for public input. Staff recommends approval of this business license contingent on a satisfactory background check and a satisfactory fire inspection. If this renewal is approved, the time period of this license will be July 1, 2008 to June 30, 2009. At that time, the City Council gave direction that the City should proceed with two segments of trailway along the County Road 10 corridor: 1.) The segments on the north side between County Road H and Red Oak Drive (Silver Lake Road): Segments 1-5 and; 2.) the segments on the south side between Long Lake Road and Silver Lake Road: Segments 9 & 10. On August 28, 2006 the City Council approved Resolution 6930 authorizing the preliminary design of landscape architecture elements along the County Road 10 Trailway Corridor. During the remainder of 2006 and 2007, the project for Trail Segments 9 & 10 was implemented, with construction essentially now complete. During 2007, the Feasibility Report for Trails 1 – 5 was developed in anticipation of 2008 construction. The completed Report included the landscape architectural elements identified in the preliminary landscape architecture design. A copy of the Executive Summary from the completed Feasibility Report is included with this Staff Report for reference. On November 13, 2007 the City Council reviewed the Feasibility Report for the County Road 10 Trailway Project: Segments 1-5 and held a Public Hearing on the project. The City Council chose not to proceed with the project at that time for two primary reasons. The first was the increased project cost relative to the estimated project cost included in the City Capital Improvement Plan (CIP). The second reason for not proceeding with the Trail 1 – 5 Project was the revised financing plan for the Street and Utility Improvement Program that was approved in October 2007. The revised financing plan for the Street and Utility Program utilized existing funds from the City TIF account, which was also to be a funding source for the Trail Segments 1 – 5 project. Council directed Staff to perform an analysis of the TIF fund to verify that sufficient funding existed for the anticipated projects identified in the CIP. The analysis was performed in January 2008, and the issue was discussed at the City Council workshop on March 3, 2008. Based on the results of the CIP and TIF analysis, Council directed that Staff proceed to develop the Trail Segments 1 – 5 project with a revised scope. The revised scope was to include: grading necessary only for the trail and to ensure drainage, trail construction, lighting, and basic turf restoration. Landscaping and other amenities were to be eliminated or reduced to a bare minimum. Discussion: Based on the previous action and current direction of the City Council, Staff has revised the project scope for Trail Segments 1 – 5, along with the associated cost estimates. A summary of the review is provided in this Staff Report. Federal Funding The City of Mounds View has secured $525,000 in Federal Transportation Enhancement funding for the Trail 1 – 5 project. The project is programmed in the State Transportation Implementation Plan (STIP) for 2009. A copy of the signature page from the City application for federal funding is included with this Staff Report for reference. Please note that the project description under Item 7 of the application states that the project “will include lighting, landscaping, and interpretive and educational signage.” If any of the project elements identified in the federal funding application were deleted entirely from the project, the federal funding would be jeopardized. In order to satisfy the requirements of the federal funding secured, the project will need to provide the full length and width of paved trail as described in the Preliminary Report. The project will also need to include minimal landscaping and educational signage. A brief description of the current proposed scope for each project element follows. Elements Unchanged from the Feasibility Report The following elements of the project are still proposed to be implemented to the full scope identified in the Nov. 2007 Feasibility Report for Trail Segments 1 – 5: x Trail construction x Drainage improvements x Lighting Elements with Reduced Scope from the Feasibility Report The following elements of the project have been significantly reduced in scope from what was proposed in the Nov. 2007 Feasibility Report: x Landscaping The reduction in scope of the landscaping proposed for the project includes the following: - Elimination of all grading / creation of aesthetic mounds - Elimination of all large limestone landscaping blocks - Elimination of all trees (119 had been proposed) - Elimination of over 90% of proposed plants and shrubs x Site Amenities The reduction in scope of the site amenities for the project includes the following: - Elimination of all benches - Elimination of all waste receptacles - Elimination of the informational kiosk In order to meet the interpretive and educational signage requirements of the federal fund application, two smaller informational signs are currently proposed for the project in place of the more significant kiosk that had been included in the Feasibility Report. Elements with Increased Scope from the Feasibility Report The following elements of the project have been increased in scope from what was proposed in the Nov. 2007 Feasibility Report: x Turf Restoration Due to the significant reduction in proposed landscaping from the scope identified in the Feasibility Report, areas that had previously been proposed as planting beds will need to be restored with turf restoration under the revised project scope. This results in an increase of approximately 12% in the scope for the turf restoration element. x Modular Block Retaining Walls A small amount of modular block retaining walls have been added to Trail Segments 1 and 2 of the project based on additional field review of the proposed trail alignment. The purpose of the walls is not aesthetic, but rather to maintain drainage in areas with steep slopes. The walls are considered necessary for the drainage and trail construction. No modular block retaining walls were included in the Nov. 2007 Feasibility Report. Cost Estimates: Detailed cost estimates for the project based on the current proposed scope have been performed, and are included as Attachment A to this Staff Report. Lighting: Decorative Lighting As was constructed on Trail Segments 9 & 10, the proposed lighting for Trail Segments 1 – 5 includes standard pole-mounted lighting for a majority of the project length, with decorative lighting provided at key locations, such as intersections. There are 11 locations where a decorative light fixture is proposed to be installed along Trail Segments 1 – 5. The decorative lights are more expensive than standard lights. Therefore, further reduction in project cost could be achieved by reducing or removing the decorative lighting if the City so wished. As estimated in the November 2007 Preliminary Report, the cost per light is approximately $1,800 for the standard shoebox lighting unit and approximately $4, 300 for the decorative lighting units. If all 11 proposed decorative lights were replaced with standard units, the project cost could be reduced by an additional $27,500. This represents only 2% of the total estimated project cost of $1,274,512. Given this small relative savings, it is the recommendation of Staff that the decorative lights be used on the Trail Segments 1 – 5 project, for consistency with the previous and future trail projects that will be performed along the County Road 10 corridor. LED (Light Emitting Diode) Lighting The City Council had previously asked Staff to look into the costs and benefits of LED lighting along the trail corridor. LED lighting is still a developing technology and options for overhead lighting are limited. Local distributors have estimated that overhead LED fixtures will cost approximately $4,200 per unit and that the light produced may be less than a standard lighting unit, possibly requiring additional lights. This increased cost and restricted budget do not make it feasible to include LED lighting in this project at the time of construction. However manufacturers are beginning to develop products for the retrofit of existing lighting fixtures with LED lights. Therefore if standard lighting units were installed on the Trail Segments 1 – 5 project with initial construction, it would be possible to retrofit the units with LED lights at a future time. As the LED technology continues to develop, it is likely that the cost will decrease. Project Schedule: A detailed project schedule is included as Attachment C with this Staff Report for reference. Provided below is a summary of the project schedule. The public hearing notice and information was published in the official City newspaper, as well as being posted on the City’s web site. A public improvement hearing notice, along with a copy of the draft executive summary of the feasibly report, was sent via direct mail to all owners of property adjacent to this proposed project – north side of County Road 10 from County Road H to Red Oak Drive (Silver Lake Road). This was done utilizing the County Tax Record Database. The hearing notice was also hand-delivered to the aforementioned properties, which according to Ramsey County records, has an address other than County Road 10. Since the official public hearing for this project was held in November 2007, it is not required to hold another public hearing at this time. Therefore no publication of notice on this item was performed. However, Staff did perform a direct mailing to all properties adjacent to the proposed project, as was done in November 2007, to make them aware that this project would be considered by the City Council on June 9, 2008 under the revised scope. (ATTEST)____________________________________ Rob Marty, Mayor (SEAL) ____________________________________ James Ericson, City Administrator County Road 10 Corridor Improvement Program Trail Segments 1-5 Report City of Mounds View City Number: 2006-004 CITY OF MOUNDS VIEW – COUNTY ROAD 10 TRAIL SEGMENTS 1-5 Executive Summary The City of Mounds View has developed the County Road 10 Corridor Improvement Program. The Corridor Improvement Program has multiple goals: to revitalize the corridor to create a sense of space and identity within the community and to improve the safety and operation of traffic and pedestrian activities along County Road 10. The Corridor Improvement Program includes the development of a multi-use trail corridor along County Road 10. Eleven trail segments are proposed along County Road 10. Segments 1 through 6 are located on the north side of County Road 10 from County Road H to Pleasant View Drive and Segments 7 through 11 are on the south side between Pleasant View Drive to County Road H. Existing trail segments, defined as Segments A-C, are located at three locations among the proposed Segments 1-11. See Figure 1. The proposed improvements would provide a multi-use facility that is safe and convenient for users along the corridor, provide connectivity between the City and County’s pedestrian routes, and create a sense of interaction with the surrounding landscape. Currently, users can only use the existing shoulder of County Road 10, or find alternate routes to cross at the existing controlled intersections at Silver Lake Road/Red Oak Drive, County Road I, and Long Lake Road. A Feasibility Report was completed in August 2006 regarding Segments 9 and 10, from Long Lake Road to Silver Lake Road on the south side of County Road 10. That project is currently under construction with completion anticipated by fall of 2007. As the next step in the Corridor Improvement Plan, the City of Mounds View has directed that a Feasibility Report be completed for Segments 1 through 5, including existing Segment A, along the north side of County Road 10 from County Road H to Silver Lake Road/Red Oak Drive. The total length of the area to be investigated is 8960 feet. This includes 950 feet of existing trail along Segment A, and 8010 feet of new trail that would be constructed as part of this Project. For discussion and investigation purposes, the project for Trail Segments 1-5 has been reviewed in three distinct sections. The first section includes Segments 1 & 2 from County Road H to County Road H2. The second section includes existing Segment A, located between proposed Segments 2 and 3. The third section includes Segments 3 through 5 from Edgewood Drive to Silver Lake Road/Red Oak Drive. Additional alternatives are also discussed which may provide connections to the trail corridor at key locations discussed through the corridor improvement program process. A paved off-road trail currently exists on the north side of County Road 10 between County Road H2 and Edgewood Drive. No other pedestrian facilities exist along the north County Road 10 right of way between County Road H and Silver Lake Road/Red Oak Drive. From County Road H to Silver Lake Road/Red Oak Drive, the project would consist of placing a continuous bituminous trail within the current right of way and incorporating themed landscape elements as outlined by the corridor improvement program. Additional opportunities are present for connections to existing businesses and creating interesting focal points along the corridor. The Feasibility Report will investigate these options for consideration. Although a majority of the proposed trail would be constructed within the existing right of way along County Road 10, some right of way acquisition and temporary construction easements will be necessary. No flood plains are identified by the Federal Emergency Management Agency (FEMA) within the project area. The proposed improvements will impact five of the twelve delineated wetland complexes that exist within the project area. The impacts would require permits from the appropriate agencies, along with necessary mitigation. The issues of property acquisition and easements, as well as impacts to the wetlands and the associated mitigation, are described in detail in the Report. Estimated costs for the improvements have also been prepared and are included in the Report. The estimated costs include construction activities and associated project costs. However, no costs for property or easement acquisition are included. Such costs are beyond the scope of this Report. Based on this information, estimated costs for the proposed trail improvements and alternative trail connections are included in this Report for consideration. The total estimated cost for new trail Segments 1 through 5 and improvements to existing Segment A, between County Road H and Silver Lake Road/Red Oak Drive, is $1,676,230. It should be noted that this amount includes construction as well as an allowance for associated project costs such as administrative, fiscal, and engineering. However, it does not include any costs for land acquisition or easements. Approximately 30% of the project cost will be provided by Federal funds received through the Federal Transportation Enhancement Program. The remainder of the project cost will be funded by the City, through the use of the existing Tax Increment Financing (TIF) Fund. It is not anticipated that any portion of the costs would be assessed against adjacent properties, nor is it anticipated that any funds would need to be borrowed for financing of the project. The City will need to take all factors into account to determine the appropriate location for the trail and site amenities. In addition, careful consideration will need to be made as to which trail connection alternatives will be chosen for implementation. These will include, among other things, the goals of the project and the County Road 10 Corridor Improvement Program, perceived benefits of each connection, impacts to landowners, public input, and sources and availability of financing. It is recommended that the City Council consider this Report, and provide further direction for proceeding with development of the County Road 10 Corridor Improvement Program Trail Segments 1 through 5. Discussion: Before the moratorium was set to expire, staff brought the issue back to the City Council for consideration at the May 5th worksession. The Council members in attendance expressed a desire to make permanent the ban on ultimate fighting and other martial arts fighting events and directed staff to prepare the necessary documentation. Ordinance 807 has been prepared which amends the City Code to include the ban on such ultimate and martial arts fighting. Exempted from this prohibition are officially sanctioned boxing and wrestling meets or other team sports in which physical contact is incidental to the primary purpose of the game. Recommendation: Staff recommends approving the introduction and first reading of Ordinance 807, an ordinance adding a new chapter to Title 600 entitled “Ultimate Fighting”. The second reading and adoption of the ordinance is currently scheduled for June 23, 2008. The City Council of the City of Mounds View hereby amends Title 600, with a new Chapter 610 to the Mounds View Municipal Code by adding the underlined material as follows: CHAPTER 610 ULTIMATE FIGHTING SECTION: 610.01: Findings of Fact 610.02: Definitions 610.03: Prohibited Conduct 610.04: Unlawful Act 610.05: Right of Injunction 610.06: Violations; Penalty 610.01: FINDINGS OF FACT: The City Council finds that the practice of Ultimate Fighting is dangerous and puts the public health, safety and welfare at great risk. 610.02: DEFINITIONS: As used in this Chapter, the following words and terms shall have the meanings ascribed to them in this Section: Subd. 1. ULTIMATE FIGHTING: Any organized activity or event, regardless of how named or described, or any other form of entertainment, where the primary practice involves individuals engaged in physical contact by striking or touching an opponent with the hands, feet, head or body. This shall include, but not be limited to, any contest or event where kicking, punching, martial arts or submission holds are permitted. Officially sanctioned and regulated boxing and wrestling and team sports in which physical contact is incidental to the primary purpose of the game, including, but not limited to, football, basketball, volleyball, soccer, baseball and softball are not included among activities prohibited by this Chapter. Martial arts training or contests governed and sponsored by schools of martial arts are also not included among the activities prohibited by this Chapter. 610.03: PROHIBITED CONDUCT: It shall be unlawful to promote, host, organize, stage, conduct or participate in the practice of Ultimate Fighting as defined above in any public or private building or place. 610.04: UNLAWFUL ACT: No person shall permit, promote, or allow participation in Ultimate Fighting in any establishment licensed by the City pursuant to Title 500 of the Municipal Code or any adjoining property owned or leased by the licensee. 610.05: RIGHT OF INJUNCTION: The City or its designated representative may institute a lawsuit in district court seeking injunctive relief against any individual that is violating this Chapter. 610.06: VIOLATIONS; PENALTY. Introduction: At the May 27 special City Council work session and at meetings previous, the Council has expressed a desire to review the City’s compensation policy and to conduct a market analysis of the positions consistent with the policy. While staff is able to generate some of the information and to compare some of the salaries, due to time constraints and incomplete data sets, it has been expressed by staff that a consultant would be needed to conduct a comprehensive study consistent with the requirements of the Personnel Manual.. The City Council agreed and directed staff to bring back for consideration a scope of work. Discussion: Staff requested proposals from three firms who specialize in compensation matters. The proposals received back range in cost from $5,800 to $31,000. Springsted responded with the lowest cost proposal, and given their familiarity with the City and our previous experience with them, staff feels choosing Springsted would be the best course of action. Springsted’s compensation services work plan identifies six distinct tasks which could take eight to ten weeks to complete. The study will also involve the review of the City’s compensation policy with findings noting aspects of the policy which could inhibit the City’s ability to attract and retain employees and suggested revisions to the policy that could be considered by the City Council based upon standard compensation policies and practices. Recommendation: Staff recommends approval of Resolution 7281, a resolution authorizing Springsted to conduct a compensation study consistent with the terms identified in the attached work plan. Background: The City Council asked Staff to research policy considerations for outdoor special events. Many businesses have requested to hold outdoor special events, most recently Moe’s. Staff was directed to research what other cities did in regard to such outdoor special events. Many cities responded with their policies which provided a full spectrum of regulatory possibilities. The special event policy was discussed on June 4, 2007; October 1, 2007;February 4, 2008; March 3, 2008; April 28, 2008 and again on May 5, 2008. Many policy iterations were presented and discussed with a resolution brought forward on April 28. It was later determined that the proposed special event regulations should be presented in ordinance format. Discussion: Staff was directed by the City Council to come up with draft policy language that would include a parking plan, security plan, clean up plan, and statements pertaining to toilet facilities, entertainment or stage locations, and proof of workers compensation insurance. It was discussed whether a fire inspection would be necessary and whether the applicant would be responsible to notify neighboring residents of the event. It was also discussed that there may be exceptions or exemptions to the permit or license which would also need to be articulated. Ultimately, the Council felt that the policy should apply to events at which the general public is invited and at which alcohol would be consumed or offered for sale. Based on this clarified direction, staff asked Kennedy & Graven to prepare the necessary ordinance language for the Council’s consideration. Recommendation: Staff is recommending the approval of the introduction and first reading of Ordinance 808, an ordinance amending Title 600 of the Mounds View City Code by adding a new Chapter 611 relating to Special Events. Additional minor revisions may be necessary before the second reading and adoption, which is currently scheduled for June 23, 2008. It is not the intent of the City Council by enacting this Chapter to regulate in any manner the content of speech or infringe upon the right to assemble, except for regulating the time, place and manner of speech and assembly and this Chapter should not be interpreted or construed otherwise. 2 611.02: DEFINITIONS: As used in this Chapter, the following words and terms shall have the meanings ascribed to them in this Section: Subd. 1. SPECIAL EVENT: Any concert, fair, show, festival, carnival, rally, party, tournament, street dance or other attended outdoor entertainment or celebration that is to be held on public or private property that involves the sale or consumption of alcohol. 611.03: PERMIT REQUIRED: Any person or organization desiring to conduct or sponsor a Special Event in the City shall first obtain a Special Event permit from the City. 611.04: SPECIAL EVENT PERMIT NOT REQUIRED: Subd. 1. A Special Event permit is not required for the following types of events: a. Weddings; and b. The use of traditional public forums as alternative channels of communication by the public, provided that such use is for the free exercise of constitutionally protected activities and does not disrupt or interfere with traffic on public streets or the use of public places by other members of the public. 611.05: SPECIAL EVENT PERMIT APPLICATION: Subd. 1. Any person or organization desiring to sponsor a Special Event that is not exempted by this Chapter must apply to the City for a Special Event permit. The Special Event permit application must be filed not less than 30 days in advance of the date in which the event is to occur. Subd. 2. Application Information: Special Event permit applications must include the following information: a. Type and description of the Special Event and a list of all activities to take place at the event; b. Name of the sponsoring entity, the names of at least two contact persons and their addresses and phone numbers, along with phone numbers where they can be reached on the date(s) of the event; c. Proposed date(s) of the Special Event, together with the beginning and ending times for each date; d. Proposed location of the Special Event, including a diagram of the proposed area to be used showing the location of any barricades, perimeter/security fencing, entertainment, stages, portable toilets, parking areas, trash containers and any other items related to the event; 3 e. Estimated numbers of Special Event staff, participants and spectators; f. Any public health plans, including supplying water to the site, solid waste collection and the number of toilet facilities that will be available; g. Any plans for first aid facilities and the name of the person or entity providing these services; h. Any fire prevention and emergency medical service plans; i. Security plans; j. Parking plans; k. Cleanup plans; l. The admission fee, donation or other consideration to be charged or requested for admission to the Special Event, if applicable; m. Whether any sound amplification or public address system will be used or if there will be any playing of any music or musical instruments; n. Whether food or alcohol is to be served or sold at the Special Event and what types of food or alcohol will be available; o. Copy of a letter to be sent by the applicant to residents within 500 feet of the Special Event informing them of the event; p. Signature of the applicant; and q. Any other information requested by the City, that it deems reasonably necessary in order to determine the nature of the Special Event. Subd. 3. Permit Fee: An applicant for a Special Event permit must pay a nonrefundable permit fee in the amount established from time to time by the City’s fee schedule. 611.06: PERMIT REVIEW: Subd. 1. The City Council shall review the Special Event permit application and make a determination on whether to issue the permit or deny it. Subd. 2. Inspection: Prior to City Council review, the site of the Special Event shall be inspected by the City Fire Marshal. Subd. 3. Permit Denial: The City Council may deny an application for a Special Event permit if it determines from a consideration of the application or other pertinent information, that: 4 a. The information contained in the application or supplemental information requested from the applicant is false or nonexistent in any material detail; b. The applicant fails to supplement the application after having been notified by the City of additional information or documents needed; c. The applicant fails to agree to abide or comply with all of the conditions and terms of the Special Event permit; d. The time, route, hours, location or size of the Special Event will unnecessarily disrupt the movement of other traffic within the area of the Special Event; e. The Special Event is of the size or nature that requires the diversion of too many law enforcement officers to properly police the event, site and contiguous areas that allowing the Special Event would unreasonably deny law enforcement protection to the remainder of the City and its residents; f. Another Special Event permit application has already been approved to hold another Special Event at the same time and place requested by the applicant or so close in time and place as to cause undue traffic congestion, or the City is unable to meet the needs to provide for law enforcement and other City services for both Special Events; g. The location of the Special Event would cause undue hardship for adjacent businesses or residents; h. The location of the Special Event will substantially interfere with any construction or maintenance work scheduled to take place upon or along public property or right-of-way; i. The Special Event would endanger public safety or health; j. The Special Event would seriously inconvenience the general public’s use of public property, services or facilities; k. The applicant fails to comply with the liability insurance requirements or the applicant’s insurance lapses or is canceled; l. The Special Event would create or constitute a public nuisance; m. The Special Event would be likely to cause significant damage to public property or facilities; or n. The Special Event would engage in or encourage participants to engage in illegal acts. 5 Subd. 4. Permit Conditions: The City Council may condition the issuance of a Special Event permit by imposing reasonable conditions concerning the time, place and manner of the Special Event, and such conditions are necessary to protect the safety of persons and property, and the control of traffic; provided that such conditions shall not unreasonably restrict the right of free speech. Such conditions may include, but are not limited to: a. Alteration of the date(s), time(s), route or location of the Special Event proposed; b. Elimination of an activity at the Special Event which cannot be mitigated to a point as to ensure public safety and welfare, or which causes undue liability to the City; c. Requirements concerning the accommodation of pedestrian or vehicular traffic; d. Requirements for the use of traffic cones or barricades; e. Requirements for the use of City personnel and equipment; f. Requirements for the provision of first aid or sanitary facilities; g. Requirements for the use of event monitors and the providing notice of the Special Event permit conditions to the events’ participants; h. Requirements on the number and type of vehicles, animals or structures to be allowed at the Special Event and the inspection and approval of structures by the City for safety purposes; i. Compliance with animal protection ordinances and laws; j. Requirements for the use of garbage containers and the cleanup and restoration of the property; k. Restrictions on the use of amplified sound and compliance with noise ordinances, regulations and laws; and l. Restrictions on the sale or consumption of food and alcohol. 611.07: PERMIT ISSUANCE: The City Administrator shall issue the Special Event permit once the application has been approved by the City Council and the applicant has agreed to comply with the terms and conditions of the permit as well as the requirements of this Chapter. 6 611.08: INDEMNIFICATION AGREEMENT: If the Special Event, or any portion of the event is to be held on City property or right-of-way, prior to the issuance of a Special Event permit, the permit applicant and authorizing officer of the sponsoring organization, if any, must sign an agreement to indemnify, defend and hold the City, its officials, employees and agents harmless from any claim that arises in whole or in part out of the Special Event, except any claims arising solely out of the negligent acts or omissions of the City, its officials, employees and agents. 611.09: INSURANCE REQUIREMENTS: Subd. 1. Liability Insurance Required: The applicant or sponsor of a Special Event must possess or obtain liability insurance to protect against loss from liability imposed by law for damages on account of bodily injury or property damage arising from the Special Event. A certificate of insurance must be filed with the City prior to issuance of the Special Event permit. The certificate of insurance must name the City, its officials, employees and agents as additional insureds. Insurance coverage must be maintained for the duration of the Special Event. Subd. 2. Minimum Limits: Insurance coverage must be a commercial general liability policy. The minimum limits must be at least $1,000,000. The policy must also include an endorsement for liquor liability. The City Council may require additional endorsements depending upon the type of Special Event and proposed activities. Subd. 3. Waiver or Reduction of Required Limits: The City may waive or reduce the insurance requirements of this Chapter under the following circumstances: a. The applicant or officer of the sponsoring organization signs a verified statement that it believes that the Special Event’s purpose is First Amendment expression and that the cost of obtaining the insurance is so financially burdensome that it would constitute an unreasonable burden on the right of First Amendment expression; b. The applicant or an officer of the sponsoring organization signs a verified statement that the insurance coverage required by this Chapter is impossible to obtain; or c. The City Council determines that the insurance requirements are in excess of the reasonable risk presented by the proposed Special Event. 7 611.10: CLEANUP DEPOSIT: The applicant or sponsor of the Special Event involving the sale of food or beverages for immediate consumption, erection of structures, horses or other large animals or another activity likely to create a substantial need for cleanup may be required by the City to provide a cleanup deposit prior to issuance of the Special Event permit. The cleanup deposit shall be in an amount set by the City Council. The cleanup deposit will be returned to the applicant/sponsor if the area used for the Special Event has been cleaned and restored to the same condition as it existed prior to the event. If the property used for the event has not been properly cleaned or restored, the applicant/sponsor will be billed for the actual cost by the City for the cleanup and restoration. The cleanup deposit will be applied toward payment of the bill. 611.11: SECURITY REQUIREMENTS: A security team of a minimum of at least two persons, one of which must be an off-duty police officer per 100 persons expected at the event shall be present at all times during the event. The security team shall wear a uniform or shirt that identifies them as security for the event. The applicant shall be responsible for reimbursing the City for the cost of any off-duty police officers used during the event. The City Council may require that there be additional security personnel for the event, if it is deemed necessary for public safety reasons due to the nature of the event. 611.12: PERMIT REVOCATION: Any Special Event permit issued pursuant to this Chapter may be summarily revoked by a City law enforcement officer at any time when, by reason of disaster, public calamity, riot or other emergency, the law enforcement officer determines that the safety of the public or property requires such revocation. The City Administrator may also summarily revoke any Special Event permit issued pursuant to this Chapter if he or she finds that the permit has been issued based upon false information or when the permittee exceeds the scope of the permit. Notice of such action revoking a permit shall be delivered in writing to the permittee by personal service or certified mail at the address specified by the permittee in its application. 611.13: VIOLATIONS: Subd. 1. Unlawful to Sponsor a Special Event without a Permit: It is unlawful for any person to sponsor or conduct a Special Event requiring a permit pursuant to this Chapter unless a valid Special Event permit has been issued for the event. Subd. 2. Unlawful to Exceed the Scope of the Permit: The Special Event permit authorizes the Special Event permittee or sponsor to conduct only such a Special Event as is described in the permit, and in accordance with the terms and conditions of the permit. It is unlawful for the permittee or sponsor to willfully violate the terms and conditions of the permit. Subd. 3. Misdemeanor. Any person convicted of violating this section shall be guilty of a misdemeanor and shall be subject to a fine or imprisonment as specified by state statute. Each day in which a violation continues to occur shall constitute a separate offense. Violation of any provision of this section shall also be grounds for revocation of the Special Event permit. 8 SECTION 2. This ordinance shall take effect and be in force 30 days from and after its passage and publication, in accordance with Section 3.09 of the City Charter. Finance Director Beer indicated that there are outstanding issues with Bronson 36 Drive settling. Joe Rhein explained that they are monitoring the area but they were concerned 37 but it appears to be a short-term issue and it will be fixed this spring. 38 39 Council Member Mueller asked what properties the weed killer is used on. Reports of Mayor and Council 37 38 Mayor Marty noted that the Citizen of the Year, Don Hodges, submitted a card to the City. He 39 then read it for Council and those in attendance. 40 41 Mayor Marty said that he has been contacted regarding light pollution and energy consumption 42 by Medtronic. He then said that he contacted Mr. Ericson regarding this matter and he said that 43 the lights are turned down but there were still complaints about the light pollution. Mayor Marty 44 said that he called Staff back because the lights that were left are for fire code requirements. 45 Mounds View City Council May 12, 2008 Regular Meeting Page 6 1 Mayor Marty noted that Heidi Steinmetz and he attended a function at the Medtronic facility last 2 Thursday and he spoke with Steve Molly and Jim Dresen about this issue and, they stated that 3 they had been approached again and they have installed curtains and all employees on the south 4 side are to close curtains at night to cut down on light pollution. He then said that they are open 5 to other alternatives that would meet the fire code because they would prefer to turn the lights 6 off. 7 8 Mayor Marty said that Council other than Council Member Hull attended the Totino’s Grand 9 Opening last Friday. He then welcomed Totino’s to the City and said the food is good. 10 11 Council Member Mueller provided an update on Festival in the Park on August 16 and 17, 2008. 12 The car show is on Saturday with the parade on Sunday. There are fireworks both Saturday and 13 Sunday evening sponsored by Medtronic. Some exciting things this year are the fine art show, 14 battle of the bands, and entertainment groups. The 50th Anniversary Cookbook is for sale at the 15 Festival. 16 17 Council Member Mueller noted that the Anoka County Airport is celebrating Aviation Days May 18 17 and 18, 2008. Proceeds from the event sponsor the aviation museum. 19 20 Mayor Marty indicated that the Welcome to Mounds View city signs are being installed and he 21 likes the blue now that it is up. Mayor Marty would like public works to look into the location 22 for the sign on the left on Silver Lake Road as it seems out of place. 23 24 B. Reports of Staff 25 1. Meeting Date: June 9, 2008 City Administrator Review: ____ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Vanessa Van Alstine, Cable Television Coordinator Item Title/Subject: Cable TV - EDC Meeting Background: At the May Work Session, the Cable Committee suggested that the City could free up approximately 24 hours of CTV staff services from the “100 hours” program by not having a CTV master control operator on duty for the Friday morning EDC meetings. The City Council suggested bringing the item to a future Council Meeting. Discussion: Below is the language of the January 2008 contract with the North Suburban Access Corporation regarding city meetings and the times a master control operator is on duty: 1. CTV Agrees that it will: b. Have a master control operator on duty Monday through Thursday from 3 p.m. until 11 p.m., or until the end of the last live event that evening. On Fridays , the master control operator will work from noon until 7 p.m. If the city requests the playback of a live event on a Saturday on which a master control operator is already scheduled to work, there will be no additional charge for that programming event. If, however, the city requests the playback of a live event on a Friday or Saturday evening or Sunday or any other time that a master control operator is not scheduled to work, CTV may deduct the time involved from the city’s “100 hours” allotment of CTV staff services. (note: Bold notation mine.) EDC meetings start at 7:30 a.m. on the third Friday of the month, which is outside of the time that a master control operator is scheduled to work, thus CTV can count the time against the City’s “100 hours.” Assuming twelve meetings per year, and that the master control operator works for two hours (7:00 a.m. – 9:00 a.m.) per meeting, this will consume about 24 hours of the 100. The time could otherwise be used for assistance with creating programming, technical support, improvements to the control room, and other projects. Item 11. B. 1. June 9, 2008 City Council Meeting Page 2 2 Staff consulted with Staci Skoog-Bownik and Terri Schultz, the master control operators at the North Suburban Access Corporation (CTV) about the implications of not having a master control operator on duty for the Friday morning EDC meetings. Our conclusions: 1. The meeting will be seen live on Mounds View Channel 16 since the signal source comes from the Mounds View control room unless there is a scheduled playback occurring. 2. CTV master control will set up the equipment the night before the EDC meeting to automatically record and encode Friday morning without the need for CTV staff to be present in the morning. If all goes normally, CTV staff will trim and process the file for playback and web streaming when they come on duty later in the day. There should not be an interruption in the schedule for playbacks on Mounds View Channel 16 or the web stream availability. 3. In the event that there is an equipment malfunction, Mounds View staff will bring a recording of the meeting to CTV’s facility in Roseville to be encoded and processed. Staff already records all meetings as standard procedure to protect against such problems. There might be a day or two delay in having the meeting available for playback and web streaming based on the time to get replacement copies to CTV and their staff availability. Not having a master control operator on duty for the Friday morning EDC meeting should not cause an impact for viewers of Channel 16 and will free up approximately 24 hours of the “100 hours” program with CTV for other projects. The Council expressed concern about being charged through the “100 hours” program if City meetings continue past 11 p.m. According to the contract language above, CTV staffs a master control operator until the end of the last live event of the evening, so the City should not be charged though the “100 hours” program should a meeting end after 11 p.m. Staff spoke with Terri Schultz of CTV who confirmed this interpretation, saying that they had not billed the cities for long meetings in the past. Recommendation: The Cable Committee and staff recommend that the City not require CTV to schedule a master control operator for the Friday morning EDC meetings.
