Introduction:
Charlie and Dan Hall, owners and representatives of The Mermaid, have applied for a major
subdivision to subdivide their existing 8.93 acre site into three lots. On September 22, 2008,
the Hall’s submitted a revised plat to the city showing three proposed lots instead of two. The
Hall’s planning requests were scheduled to be heard at the September 22, 2008 City Council
meeting, but due to the last minute submission of the new preliminary plat, the Council opted
to table the planning requests in order to give staff time to review the new plat and to meet
with the Halls.
The revised preliminary plat shows that Lot 1 would be the Mermaid entertainment center
(6.1 acre), Lot 2 would be a new lot for retail (1.4 acres), and Lot 3 would be for the existing
hotel (1.42 acres). The Halls have also requested an amendment to the Mermaid property
Planned Unit Development (PUD). This PUD is on the northwest corner of County Highway
10 and County Road H and currently only allows for bowling lanes, hotel, banquet center,
night club and lounge, and restaurant uses. They are requesting an amendment to their PUD
to add retail as an allowed use. Their intention is to sell the proposed 1.4 acre retail lot to a
developer who plans to build a small retail center.
Major Subdivision Discussion:
Comprehensive Plan: The 1998 Comprehensive Plan Existing Land Use Map shows the
County Highway 10 and County Road H corner as four parcels, thus was the case until 2000
when the Mermaid purchased the Rent-All building and the four existing parcels were replatted
for the hotel addition and rezoned to a PUD. The 1998 Future Land Use map designates the
entire Mermaid corner as Regional Commercial PUD, and staff is proposing to keep this
designation in the 2008 Comprehensive Plan update. The proposed subdivision would be
consistent with that designation and consistent with the goals and policies as articulated in the
Land Use section of the Comprehensive Plan.
Drainage Plan: In 2002, a new regional stormwater pond was constructed along County
Road H, at the southeast corner of the Edgewood Middle School property that would treat the
stormwater runoff for the Mermaid, along with several other nearby properties and the
completed County Road H reconstruction. It can be assumed that little additional stormwater
treatment would be required by Rice Creek Watershed District for this subdivision or when a
new building is constructed since no additional impervious surface would be added. When a
development review for the new retail center is applied for, the applicant will need to have
their plans approved by Rice Creek Watershed District. There are no wetlands on this site.

Easements: The City’s Subdivision Code requires that plats dedicate perimeter drainage and
utility easements for each lot in the subdivision. This plat already has the required perimeter
easements around the current Mermaid property, and staff does not believe that adding
additional easements along the new property lines lot are necessary.
Park Dedication Requirements: The Subdivision Code indicates that any subdivision of land is
subject to a park dedication fee. For a major subdivision, the City typically sets the fee as
equal to 10% of the market value of the land. Staff uses Ramsey County assessed values as
the basis for dedication computation. When the Halls replatted the property in 2000, they paid
a park dedication fee of $92,306. The City determined this fee based on the land value of the
entire property in 2000. Chapter 1204.02 Subd. 5 addresses park dedication fees for a re-
subdivision:
Subd. 5. Dedication for Re-Subdivision: For any subdivision of a parcel on which a cash
dedication for parks has previously been made but on which an additional cash
dedication is required due to re-subdivision, the amount of cash dedication required on
the re-subdivided parcel(s) shall be based on the market value of the land at the time of
re-subdivision and the factors set forth in subdivision 4 of this Section less any
applicable credit for the prior cash dedication.
Based on the Ramsey County land value for the Mermaid site, the 2008 value per square foot
is $4.66 ($1,814,400 land value divided by 389,300 square feet). In 2000, the value per square
foot was $2.37 ($923,057 divided by 389,300 square feet). Since the Halls have already paid a
fee on the entire Mermaid parcel, city staff proposes the fee be based only on the new 1.4 acre
parcel and be figured using the difference between the 2000 and 2008 land values. The
difference between the land values is $2.29 per square foot. The proposed park dedication fee
would be based on 61,000 square feet x $2.29 = $139,690 x 10% = $13,969. The City Council
should determine the park dedication fee.
Streets and Traffic: No new or altered streets or access drives into the site are being
proposed. The traffic from the retail center would exit by a right turn only onto County Highway
10 or onto County Road H, which is designated as a collector street. Both roads have
adequate capacity for the additional traffic that five stores in the retail center would generate.
Vegetation: Most of the new lot area is currently an asphalt parking lot with a few landscaped
medians that will be removed or moved with the new development. When a new building is
proposed, the City Forester will comment on the new landscaping plan at that time.
Major Subdivision Summary: The Mermaid is currently zoned PUD, Planned Unit
Development, and the proposed subdivision would be consistent with the existing zoning of
the property. The submitted plat appears to meet city code requirements and is currently
undergoing a review by the city attorney. There are currently easement agreements in place
that address the shared parking and access for the entire site. The Halls intend to keep
these in agreements in place and they would be amended to include the new retail lot.

The majority of the Mermaid property is currently located in TIF District #1. After a
discussion with financial consultant Ehlers & Associates, the City Finance Director
recommends the Mermaid property remain in the TIF District so the city would continue to
capture increment funds. The financing details are planned for further discussion at the
October 27, 2008 EDA meeting.
Another issue that arose from the revised 3-lot plat, is the fact that there would now be a
property line running through the building, formally separating the Mermaid from the hotel.
This is an issue because the fire code does not allow for any openings where the property
line runs through the building. There is currently a hallway and a set of doors that connects
the Mermaid to the hotel. The fire code would require this opening to be permanently closed
off, but the Department of Labor & Industry has allowed openings if each building/property
owner signs a “Hold Harmless Agreement.” By not allowing openings between separate
buildings, the fire code is trying to prevent or reduce the fire spread or damage done to the
adjoining building if there were to be a fire. The Hold Harmless Agreement would
acknowledge the additional liability due to the opening between the buildings. City Attorney
Scott Riggs has also agreed that the agreement could be an alternative as long as the
document has adequate protective language running in favor of the City.
PUD Amendment Discussion:
The City originally approved the Mermaid PUD in 2000 when the hotel addition was
proposed, and specified that bowling lanes, a hotel, banquet center, night club and lounge,
and restaurant were the only allowed uses on the site. The Halls are now proposing to
subdivide and sell a piece of their property to a developer who plans to build a 14,000 square
foot, five store retail mall. This proposed addition of retail to the site requires the City to
amend the Mermaid’s PUD Agreement to allow this new use.
The addition of a retail center to one of the most prominent corners in the city would initially
seem to be a good fit. The primary issue with this proposal is parking – both for the existing
Mermaid and the new retail building. By adding a building to the site, many of the existing
parking spaces will be lost and the new stores will generate additional parking needs.
Staff required that a parking study be included with the application for this PUD Amendment.
The Mermaid has made some interior changes since the PUD and parking requirements
were originally approved in 2000. In the last few years, the downstairs night club has been
removed with additional banquet space put in its place, and the size of the restaurant was
reduced and an arcade area added. The city code does not address complementary uses
when determining parking requirements. The code only states “this specific use requires this
number of parking spaces,” whereas staff realizes that in this situation for example, people
staying at the hotel also may be using the banquet room and the arcade. The parking study
is included in this staff report.

There also are other issues to keep in mind when determining whether the parking would be
adequate for the new retail use. The Mermaid sets up a 4,200 square foot temporary tent for
180 days each spring through fall as additional banquet space. When the City approved the
Interim Use Permit for the tent in March 2005, it was determined that the existing parking
available on the site was adequate. This IUP was only approved for five years, which means
that they will need to reapply for another IUP in March 2010. The consultant who did the
parking study included the temporary tent (called the “courtyard”) into the parking
requirements, whereas the City approved the IUP without requiring any additional parking.
Another issue is that the Mermaid is currently leasing a number of their parking spaces near
County Highway 10 to Metro Transit for a Park & Ride. The parking study does not address
this as an existing use, so one could assume that the Mermaid will be discontinuing the
leasing agreement if the city approves the subdivision and PUD Amendment.
In 2000, when the PUD was approved for the hotel addition, the PUD Agreement stated that
808 parking stalls were required for the site. There are currently 760 stalls existing on the
Mermaid site. The proposed 1.4 acre lot would remove 193 stalls from the Mermaid’s
property, but the new retail construction would add 87 stalls back. This would equal a total of
654 parking stalls on both the Mermaid and new retail center property. The developer is
proposing to share parking with the Mermaid, and is using 87 of the Mermaid’s remaining 567
stalls as shared parking in order to meet the retail center’s 174 parking stall requirement.
The parking demands for this entire site, including the new development, will vary throughout
each day. All of the uses on the site will not have their peak parking demands at the same
time or even on the same day of the week. The Mermaid is currently 48 parking stalls short
of what was required in 2000, and also has been able to lease unused daytime spaces for
Park & Ride parking, and yet the owners state that the parking lot has still never been filled to
anywhere near capacity.
Amendment Process:
An amendment to a Planned Unit Development is processed as an amendment to an
approved Conditional Use Permit. That means that the City follows the procedural
requirements of Section 1125 of the Zoning Code. Section 1125 requires that the Planning
Commission and City Council review the request, taking into consideration any and all
potential adverse effects of the proposed amendment.
Relationship to Comprehensive Plan. Mounds View’s adopted Comprehensive Plan identifies
the Mermaid property PUD site as a Regional Commercial PUD. The proposed retail mall would
be consistent with the Comp Plan.
The geographical area involved. The new parcel would be right at the corner of County Highway
10 and County Road H, with the Mermaid adjacent to the north and west.
Neighborhood Impact. The neighborhood should not be impacted by adding a new retail
building. There is a traffic signal at this intersection and this area is not near any residential.

The character of the surrounding area. The proposed retail center would be in keeping with the
character of this area as County Highway 10 is the main commercial corridor in the city, and
there is another retail center to the north, along with a gas station and four restaurants directly
across County Highway 10.
The demonstrated need for such use. The Hall’s have a purchase agreement with a developer
to purchase the proposed 1.4 acre parcel to redevelop into a retail mall. The developer has
indicated to city staff that there are already tenants interested in leasing this space.
PUD Amendment Summary:
A PUD offers the flexibility necessary to make a good project feasible when it would
otherwise be difficult to meet city code requirements. Staff agrees that the parking
requirements as indicated in the city code are excessive for this site, especially with the
amount of complementary uses, and the relatively small amounts of individual retail space. It
appears that amending the PUD to allow retail uses should have no adverse impacts and
would be consistent with the Comprehensive Plan. Staff supports the amendment to add
retail as an allowed use in the Mermaid PUD.
Deadline for Action: This original application was accepted by the City on August 25, 2008
and in accordance with MN Statute 15.99, a decision shall be made within 60 days of
application acceptance. The 60 day deadline for action for this request is October 24, 2008,
but the City has exercised its option to extend the timeline for making the decision for another
60 days to December 23, 2008.
Planning Commission Action: On September 3, 2008, the Planning Commission
unanimously (6-0 vote, Walsh-Kaczmarek absent) recommended approval of the preliminary
plat and PUD Amendment. The Planning Commission also recommended approval (6-0
vote, Cramblit absent) of the revised 3-lot plat on October 1, 2008.
Alternatives:
The City Council may take one of the following actions related to the Preliminary Plat and PUD
Amendment requests:
1. Approve the Preliminary Plat and PUD Amendment as requested.
2. Deny the request. To consider this option, the Council will need to direct staff to prepare
a resolution with findings of fact to support the denial recommendation.
3. Table action on the request. This option would be appropriate if the City Council should
need additional information or more input before a decision can be made.

Attached is our report regarding the parking needs at the Mermaid Event Center in Mounds View,
MN. We found that the site appears to have adequate parking available to support additional retail
development. To reach this conclusion it is necessary to consider what is the realistic peak parking
need for the center, rather than blindly adding the peak use of each facility individually.
This peak would occur when all of the event rooms are booked to advertised capacity and other
facilities are utilized to a reasonable level. As discussed in the report in a unique situation where
even more required parking need was anticipated it would be possible to utilize a shuttle to the
nearby park and ride.

Purpose
The purpose of this report is to determine if there is sufficient parking available on the Mermaid
Event Center and AmericInn Hotel and Suites site to develop additional retail uses in the eastern
corner of the existing parking lot. This development will eliminate parking stalls while at the same
time create additional parking demand.
The site is located in the northwest quadrant of County Road 10 and County Road H in the City
of Mounds View, Minnesota.
Resources used to prepare this report include the City of Mounds View’s off-street parking
ordinance as obtained from the City’s website, an aerial photo from Google Maps, CIC 598
provided by City staff, advertising literature from the Mermaid and interviews with Mermaid
Event Center staff.
Existing Building Uses
The Mermaid Event Center and AmericInn Hotel and Suites provide a number of opportunities
for its guests. There are three large and three small spaces available for seminars, wedding
receptions, conventions and meetings. There is a 32 lane bowling alley, with a pro-shop and snack
bar. There is a full service cocktail lounge and restaurant, with an adjacent game room. The Hotel
has 70 rooms and an indoor pool.
According to the Mermaid’s event staff there are occasions when all three event rooms are booked
at the same time especially during the wedding season of May thru January. Maximum occupancy
during this time is around 800 to 850 people, although advertising literature states the capacity at
990. It is reasonable to assume that wedding attendees average 2-3 people per vehicle. While
events are held throughout the week, these peak occupancy wedding receptions start at 5-6:00 pm
on Saturdays.
Another use for the event rooms is for meetings where they are set up theater style. In this case
the total advertised capacity is 1560 people. While unlikely this is an event possibility that should
be considered.
Bowling leagues provide the peak use of the bowling center. League bowling happens weekday
evenings and Saturday afternoons. Specials are offered on Saturday night to promote business on
this otherwise typically slow evening.
The Mermaid has a dedicated group of restaurant, game room and bar patrons. These uses peak
on the weekend nights during the winter months.
The motel has 70 rooms available for rent. When there are events held on site these rooms are
frequently rented by attendees. Weddings parties take on average 10 to 12 motel rooms the night
of the event. Likewise out of town seminar attendees would book rooms.
During the busiest times there are 30 to 35 employees on duty.

Code Requirements
Section 1121.13 of Mounds View’s Zoning Code requires that parking spaces be provided at the
following rates.
Bowling Alley - At least five (5) parking spaces for each alley, plus additional spaces as
may be required herein for related uses contained within the principal structure.
Motel - One (1) space per each rental unit plus one (1) space for each ten (10) units and one
(1) space for each employee on any shift.
Restaurant, Bar, Game Room - At least one (1) space for each forty (40) square feet
of gross floor area of dining and bar area or one (1) parking space per three (3) seating
spaces, whichever is greater, and one (1) space for each eighty (80) square feet of kitchen
area or one (1) space per employee, whichever is greater.
*Meeting Room (Auditorium) - At least one (1) parking space for each four (4) seats, based
on the design capacity of the main assembly hall. Facilities, as may be provided in
conjunction with such buildings or uses, shall be subject to additional requirements which
are imposed by this Title.
*Meeting Room (Private Club serving food and/or drinks) - At l east one (1) space for
each forty (40) square feet of gross floor area of dining and bar area or one (1) parking
space per three (3) seating spaces, whichever is greater, and one (1) space for each eighty
(80) square feet of kitchen area or one (1) space per employee, whichever is greater.
*The Mermaid Event Center serves a variety of purposes from weddings to seminars. The
parking requirements for each use is examined on the next page.

Shared Uses
As can be seen above by strict interpretation of the code there is no extra parking on the Mermaid
site. However as discussed earlier, the peak parking uses do not coincide. League bowling is held
at different times than the receptions. The peak season for the bar/restaurant is winter where as
reception season is in the summer and fall. Reception users frequently occupy the hotel rooms,
bar and game room. Using numbers provided by the event staff one could assume that a realistic
peak parking demand would be on a Saturday night with 340 stalls for the event rooms (850 guests
/ 2.5 guests per car), 80 for the bowling alley (half capacity), 150 for the bar/restaurant/game
room (2/3rds capacity), 40 for the hotel (balance are event goers) and 35 for staff, for a total of
645 stalls.

Joint facilities
The City’s code allows “a conditional use permit for one (1) or more businesses to provide the
required off-street parking facilities by joint use of one or more sites where the total number of
spaces provided are less than the sum of the total required for each business should they provide
them separately… when the following conditions are found to exist.”
“Up to fifty percent (50%) of the parking facilities required for a …bowling alley, …bars or
restaurant may be supplied by the off-street parkin g facilities provided by types of uses
specified as primarily daytime uses...”
“Up to fifty percent (50%) of the off-street parking facilities required for any …primary
daytime uses may be supplied by the parking facilit ies provided by the following:
nighttime … uses, … bowling alley, …bar or restaurant.
“…The following uses are considered as primarily daytime uses: banks, business offices,
retail stores, personal service shops, household equipment or furniture shops, clothing
or shoe repair or service shops, manufacturing, wholesale and similar uses.”
“Other joint use of parking facilities that may be found to be in keeping with the intent of this
Chapter; provided, that the conditions … below and any other imposed by the City Council are
met.”
“The building or use for which application is being made to utilize the off-street parking
facilities provided by another building or use shall be located within three hundred feet
(300') of such parking facilities and not separated by a public way.”

Proposed Land Use
It is proposed to convert a portion of the existing parking lot to retail uses meeting the “primarily
daytime uses” listed above. This would result in the loss of approximately 108 parking stalls. The
additional 14,000 square feet of mixed retail and food uses would require approximately 174 stalls.
A conceptual site plan is attached which indicates the location of the proposed retail buildings.
The retail site would meet the joint use requirement with 87 onsite on-site parking stalls and more
than 87 shared.
The Mermaid would retain 570 on-site and 87 shared stalls for a total of 657 parking stalls; twelve
more than the assumed realistic peak parking required as described above.
It should be noted that 650 feet to the east of the Mermaid site is a public 210 car park and ride
lot. See Exhibit. During the times of peak use at the Mermaid this lot will likely be empty. This
lot does not meet the code requirement for joint facilities because is over 300 feet away and is
separated by a public way. However, in the case of an extraordinary event it would be possible to
establish a shuttle service from the event center.
Summary
Based on the assumptions made herein regarding a realistic parking requirement for the shared
uses at the Mermaid Event Center and AmericInn Hotel and Suites it appears that the site has
adequate parking to develop additional “daytime” uses within its parking lot.

WHEREAS, Charlie and Dan Hall, representing the Mermaid, have requested
approval of a preliminary plat for a major subdivision, and an amendment to the Mermaid
PUD Agreement to allow “Retail” at 2200 County Highway 10, legally-described as
follows:

WHEREAS, Charlie and Dan Hall have submitted a Preliminary Plat for a major
subdivision which combines the 2 existing lots and creates 3 new lots; and,
WHEREAS, the community development staff have reviewed the preliminary plat
and finds that it satisfies the minimum subdivision requirements as articulated in Titles 1100
and 1200 of the Mounds View Municipal Code; and,
WHEREAS, in accordance with Section 1204.04, Subd. 4, the major subdivision is
subject to a $13,969 park dedication fee; and,
WHEREAS, the proposed subdivision is not within a designated wetland area; and,
WHEREAS, the Mounds View City Council approved the Mermaid Planned Unit
Development (PUD) Agreement on October 10, 2000; and,
WHEREAS, the Mermaid PUD currently does not allow retail uses; and,

WHEREAS, the property located at 2200 County Highway 10 was approved by the
City Council for bowling lanes, hotel, banquet center, night club and lounge and restaurant
uses; and,
WHEREAS, the property owners wish to amend the PUD Agreement by adding
“retail” as an allowed use for the site in order to redevelop the proposed 1.4 acre Lot 2 into
a retail center; and,
WHEREAS, the Planning Commission reviewed this request on September 3, 2008
and October 1, 2008 and examined the potential adverse effects that could result from such
an amendment, and recommended approval; and,
WHEREAS, the Mounds View City Council has reviewed the following documents
regarding these requests:

NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council
approves the Preliminary Plat date stamped September 25, 2008 as submitted by Charlie
and Dan Hall subject to the following conditions:
1. The applicant shall satisfy all requirements made by the City Attorney as stated in the
plat opinion.
2. The applicant shall pay a park dedication fee to the City of Mounds View in the amount
of $13,969.
3. The applicant shall submit to the City in writing, their proposal for dealing with the TIF
District and Minimum Assessment Agreement issues. Any changes to the TIF plan or
the Minimum Assessment Agreement must be approved by the City.
4. The applicant shall either meet the fire code requirements in regards to no openings
between buildings along common property lines, or sign a “Hold Harmless Agreement”
that will be recorded as part of the property records with Ramsey County.
5. The applicant shall apply for Final Plat approval no later than 6 months after the date of
approval of the preliminary plat, or the Preliminary Plat approval will become null and
void.
NOW, THEREFORE, BE IT FINALLY RESOLVED that the Mounds View City
Council makes the following finding of fact and approves this PUD Amendment request:
1. The property in question, 2200 County Highway 10, described by the PUD
Agreement as the “Mermaid” is zoned Planned Unit Development (PUD).

2. The Mermaid appears to have excess parking, and as such, the owners have
requested an amendment to the PUD to allow for retail to be allowed on the site in
order to redevelop 1.4 acres of the property into a retail center.
3. The Mounds View Comprehensive Plan Future Land Use Map designates this area
as a Regional Commercial Planned Unit Development.
4. The property at 2200 County Highway 10 is within the City’s primary commercial
corridor and as such, redevelopment and new businesses are desirable.
5. The property is at the corner of County Highway 10 and County Road H, one of the
main commercial corners in the city. The construction of a new retail center would
have no depreciatory affects upon the surrounding area, and would be consistent
with the character of the area.
6. Any new development on the site must apply to the City for a development review.
7. There do not appear to be any adverse effects associated with this proposed
amendment.

The City Council consulted the City Attorney and has been advised that reassessment is only
appropriate for active assessment projects pursuant to §429.071 subd. 2. As a result of changes to
the City’s Street and Utility Improvement Program, the City Council has determined that reassessment
of the H2 and 2003 Street and Utility Improvement Projects meet the requirements set forth in
§429.071. The H2 project area will have their assessments reduced by 50% of the original amount.
The 2003 project area will have their assessments reduced by 60% of the original amount.
Those property owners that chose the payment plan will have the remaining assessment amounts
removed from the tax rolls for 2009 and forward, there is nothing further they need to do. Those
property owners that paid in full will receive a refund and should submit their refund request to the
City by March 13, 2009. A refund request was included with the public hearing notice and the first
refunds would be processed with Just and Correct Claims on October 27th. The City Council
would need to increase the budget in the Street Improvement Capital Project fund account 285-
4470-3810. The maximum expected refunds are $120,067.

a result of changes made to the City’s overall Street and Utility Improvement Program are
excessive and should be reassessed as adopted in resolution 7217.
2. Such proposed reassessment roll, a copy of which is attached hereto and made a part
hereof, is accepted and shall constitute the reassessment against the lands named therein,
and each tract of land therein is hereby found to have benefited by the H2 and 2003 Street
and Utility Improvement in the amount of the reassessment levied against it.
3. The reassessments as adopted and confirmed shall reduce the previous assessments for

4. City staff is authorized to process refund requests for six months ending on March 13, 2009
and the Street Improvement Capital Projects Fund budget shall be amended to increase

quarters delinquent as of August 31, 2008.
Some of the property owners already have paid, or will pay, the amount due by 4:30 P.M. on Monday,
October 13, 2008 in order to avoid the $35.00 administrative fee. Others will pay after the roll is
certified Monday night, but before the roll is forwarded to Ramsey County. In that case, they will pay
the total due, including the administrative fee.
Owners may prepay the assessment between October 14, 2008 and November 13, 2008 without
paying additional interest. After that, interest at the rate of 5.5% will accrue from October 13, 2008
through the payment date. The interest rate and administrative fee were set by the City Council in
Resolution 7135.
On or about November 28, 2008, we will forward the assessment roll, minus any prepayments, to
Ramsey County for collection with the 2009 property taxes.

1. Such proposed assessment roll, a copy of which is attached hereto and made a part hereof,
is accepted and shall constitute the special assessment against the lands named therein,
and each tract of land therein is hereby found to be benefited by the public utility services in
the amount of the assessment levied against it.
2. The assessments as adopted and confirmed shall be payable with ad valorem taxes in
2009, in one annual installment with interest thereon at five and one half (5.5) percent per
annum, and shall bear interest on the entire assessment from October 14, 2008 through
December 31, 2009.
3. The owner of any property so assessed may at any time prior to the certification of the
assessment to the County Auditor pay the whole of the assessment, with interest accrued to
the date of payment, to the City Treasurer, except that no interest shall be charged if the
entire assessment is paid within 30 days from the adoption of this resolution; and the owner
may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment,
with interest from the date of adoption of this resolution through the date of payment, such
payment must be made before November 28th, or interest will be charged through
December of the succeeding year.
4. The City Clerk-Administrator shall forthwith transmit a certified duplicate of this assessment

Item Title/Subject: Resolution 7346, Consideration of Adopting a
Resolution Establishing an Absentee Ballot Board.
Background:
Section 203B.13 of the Minnesota Election Law (attached), allows the City by resolution
to establish an Absentee Ballot Board. The purpose of the Absentee Ballot Board is to
allow election judges to reject or accept absentee ballots that are received within 30
days of the election. In the presidential election of 2004, the City received
approximately 400 Absentee Ballots, which were processed on election day. With the
heavy voter turnout generated by the presidential election, it is more efficient to process
the rejection or acceptance of the absentee ballots prior to election day. According to
the County Auditor, the City must adopt a resolution establishing the Absentee Ballot
Board for each election the Board is utilized.
Discussion:
Since the general election is very hectic and demanding, any duties that can be
accomplished prior to the election, makes it easier for judges to focus on voting
activities on election day. Staff is requesting 2 election judges (each from a different
political party) in each precinct for a total of 8 election judges. These judges will need to
be compensated for this service. Head judges are paid $8.78 per hour and all other
judges are paid $8.15 per hour. Staff would like each precinct head judge to be present
(4 total), along with 4 regular election judges.
Recommendation:
Because of the high number of absentee ballots received in a presidential election, it is
staff recommendation that the City Council adopt Resolution 7346, establishing an
Absentee Ballot Board. By allowing the Absentee Ballot Board (comprised of trained
election judges) to review and mark the absentee ballot envelopes, it will ease the work
load of election judges in that some of the duties of conducting the election can be done
in part prior to election day, thus allowing the judges to focus on all other duties they
must perform on election day. This should reduce the length of time on November 4th
that it takes to process to ballots and get the results to the public.

A RESOLUTION ESTABLSHING AN ABSENTEE BALLOT BOARD FOR THE
NOVEMBER 4, 2008 GENERAL ELECTION
WHEREAS, the Minnesota Election Law provides authority to a municipality to
establish an Absentee Ballot Board in accordance with the provisions of the law; and
WHEREAS, this will ease the work load for election judges to perform this
technical and time consuming task on election day, wherein the Absentee Ballot Board
can begin the process 30 days prior to an election; and
WHEREAS, this will speed the processing of accepted absentee ballots
delivered to the precincts to be incorporated into the vote counts on election day; giving
election judges more available time for voters at the polls.
NOW, THEREFORE BE IT RESOLVED that the Mounds View City Council
authorizes an Absentee Ballot Board for the purpose of reviewing all absentee ballots
and marking the absentee ballot envelopes as “accepted” or “rejected” with the board to
consist of two (2) election judges (each from a different political party) in each precinct
for a total of 8 election judges.

Item Title/Subject: Consideration of Ordinance 815, an Ordinance Amending
Section 702.01, Subdivision 13 Relating to Crimes Against
Public Safety and Health
Background
The City of Mounds View prosecuting attorney advised that the above referenced section of
City Code does not clearly prohibit discharging a weapon or air gun in the city. To correct
this deficiency the prosecutor recommends adding the following phrase to Subd. 13b (2):
“and it shall be unlawful for any person to aim or discharge a weapon or air gun within the limits
of the municipality.
This amendment would satisfy the intention of the ordinance by prohibiting any discharge of a
weapon or air gun within the city limits, regardless of whether the discharge had an immediate
endangerment to anyone. This amendment will also allow successful prosecution of cases
where weapons or air guns are pointed or discharged at people, animals, houses, cars etc.,
The City Council first considered the amendment above it its meeting on September 22,
2008, at which time the first reading was approved unanimously. The second reading,
scheduled for October 13, 2008, would result in the adoption of the amendment. Approval is
done by roll call vote.
Recommendation
Staff recommends approval of the second reading and adoption of Ordinance 815 as
presented.

TO CRIMES AGAINST PUBLIC SAFETY AND HEALTH
The City of Mounds View ordains:
SECTION 1. Section 702.01, Subdivision 13b(2) is hereby amended with the proposed
additions underlined:
(2) It shall be unlawful for any person within the limits of the Municipality to handle or
have in their possession or under their control any weapon, air gun, switchblade knife or any
other dangerous or deadly weapon and it shall be unlawful for any person to aim or discharge a
weapon or air gun within the limits of the municipality.
SECTION 2. This ordinance shall take effect thirty (30) days after the date of its publication
in the official City newspaper.

Item Title/Subject: Approval of Lease Agreement Amendment #3 with
Verizon Wireless for the Installation of a Generator at
the Water Tower Site
Introduction:
On September 24, 2007, the City Council approved a Lease Agreement Amendment#2 with
Verizon Wireless to allow them to install a diesel powered generator to supply emergency
power to their facilities located on the water tower site. Subsequent to this approval, Verizon
opted instead to install a natural gas generator which will necessitate installation of a natural
gas line through the City property to serve the generator.
Discussion:
Because of the nature of the change from what had been proposed in Amendment #2,
another amendment to the lease agreement was required. Amendment #3 provides for the
allowance of a non-exclusive right of way over City property for a gas service line to be
installed to the emergency power generator. Because of the costs associated with the
preparation and review of this amendment, Verizon has agreed to provide the City with
additional compensation in the amount of $2,000. All other terms of the original lease
agreement and amendments thereto remain in effect. The City Attorney has reviewed the
Amendment and Memorandum on the City’s behalf and finds them acceptable.
At the Council’s September 22, 2008 meeting, action on this item was tabled after questions
were asked whether additional compensation would be received to allow the gas line to be
installed ion City property. The attorney representing Verizon responded that compensation
for a service line to a subject facility would be highly out of the ordinary and unreasonable
and Verizon would not consent to such additional compensation above what they have
already offered (the $2,000.)
The attorney further states that the reason they installed the generator in the first place was
to comply with federal regulations relating to emergency management to ensure
communication lines remain operable in the event of a natural disaster that would otherwise
disrupt the power supply. The Verizon Attorney’s letter is attached for the Council’s review.
The City Attorney’s office reviewed the attorney’s letter and agreed that requiring
compensation to install the gas line would seem unreasonable.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds
View, Ramsey County, Minnesota as follows:
1. The City Council approves an amendment to the Verizon Wireless contract for
antennas on the water tower.
2. The City Council authorizes the Mayor and City Administrator to execute said
contract amendment.

Background
Northwest Youth and Family Services (NYFS) is planning an expansion of their facility
by adding on space that has been identified as the “Discovery Center.” The Discover
Center will be a 10,000 square foot multi-purpose facility focused on wellness and
physical activity, addressing critical local issues of school success, mental health, family
and community connection, and obesity prevention.
Discussion
At the City Council’s October 6, 2008 work session meeting, Kay Andrews, NYFS
Director, and Jerry Hromatka, NYFS Associate Director, provided an update regarding
services that NYFS provides and described their plans for the Discovery Center.
Ms. Andrews and Mr. Hromatka asked the Council to show its support for the expansion
by adopting the attached resolution.

WHEREAS, the Northwest Youth & Family Services mission is to prepare youth
and families for healthy lives; and
WHEREAS, the City of Mounds View greatly values the contributions Northwest
Youth & Family Services has provided for Mounds View residents for over 30 years; and
WHEREAS, Northwest Youth & Family Services of Minnesota is constructing the
Discovery Center to provide hands-on, experiential learning and physical activity; and
WHEREAS, Northwest Youth & Family Services will utilize the Discovery Center
to better meet the needs of its clients; and
WHEREAS, the Discovery Center will be a community resource for youth sports,
meetings, festivals, and family celebrations; and
WHEREAS, an estimated 9,000 participants are expected to utilize the Discovery
Center annually.

Mike Guck 8045 Groveland Road said that he was required to maintain the 75 foot setback from 41
the road and he feels that they should be required to meet that also. He then said that the homes 42
would be forward of his shading his house. He further said that with the location of the driveway 43
on Groveland Road the headlights would shine into someone’s home, so it should be relocated. 44

Mr. Guck said that he does not mind the senior housing, but feels this is being squeezed in and 1
will be obtrusive. 2

Mr. Guck said that this is one of the few areas left in the City with low crime and he is not sure 4
that the city needs this much housing, because he fears that existing residents will sell out and 5
that will increase crime. 6

Planner Heller explained that the Planning Commission has recommended limiting deliveries to 8
6:00 a.m. to 6:00 p.m. for deliveries. 9

Jerry Bankston of 8025 Groveland Road, which would be straight across from 8020 Groveland 11
Road. He then said that he would have the removal of trees and the addition of a 50 foot 12
building that he would have to look at. He further said that the driveway concerns him and he 13
would like the deliveries to come in the front door. 14

Mr. Bankston said that he feels the building is too big for this lot. Mr. Bankston said that he 16
feels that going from single family to high density concerns him, and he is worried about his 17
property value. 18

Mayor Marty said that for this type of facility there is usually a waiting list, so he does not feel 20
that there would be an issue with not being able to fill the units. 21

Kathy Guck of 8045 Groveland Road said that she is against the rezoning of this because back in 23
1965 her parents bought the property. and she has purchased it from them. They have built a new 24
house and they would not have done that if they had known there would be a three story building 25
next to them. 26

Mrs. Guck said that part of the beauty of living in Mounds View is the big lots and mature trees 28
and adding this three story building will greatly detract from that. 29

Greg Baldof of 8030 Groveland Road said that he does not want to rehash the things already 31
brought up. He then said that his wife and he share the same concerns about this project and 32
further, that this seems rushed to get it in the ground before anyone realizes this is a bad idea. He 33
further said that the lot is too small for the proposal and that is evidenced by the requested 34
variances. 35

Mr. Baldof asked whether the fence could be higher to protect them and whether the fence would 37
be maintained. 38

Mark Schnor of 2949 Highway 10 said that this is a PUD and that is what residents were told a 40
few years ago. He then said that some Council Members were worried about the developer going 41
away but he failed to come through. He further said that this building is too big for this area, 42
with the traffic and deliveries. 43

Mr. Schnor said that it feels like the building is being crammed into a space that is not large 1
enough, making the building look out of proportion on the site. 2

Cindy Carvelli asked how many parking spots would be included for the building. 4

Staff indicated that there are approximately 28 parking stalls. 6

Ms. Carvelli said that there would be caregivers and family members that come to visit their 8
loved ones this means that there will be a need for more parking to accommodate the visitors. 9
She further said that there will not be enough parking as shown, and that means that people will 10
park on the street further affecting the neighbors. 11

Linda Bankston of 8025 Groveland Road said that she thinks senior housing is a valid operation 13
but, if you look at Oakcrest, in Spring Lake Park, there is a nice lot filled with trees that the 14
neighbors have really appreciated. 15

Mayor Marty noted that Mr. Schnorr had suggested moving west. He then said that they were 17
not able to work out any deal on the property to the west. 18

Andrea Bode of 8020 Groveland Road said that she was really hoping that this would be a win-20
win situation for everyone. 21

Mr. Schnor asked what Council would expect to go in farther west. 23

Mayor Marty said that would be up to Integra Homes, as they own the property. 25

Hearing no further public comments, Mayor Marty closed the public hearing at 8:07 p.m. 27

Council Member Flaherty said that this is a large building for this property, and it truly does 29
seem like they used a shoe horn to fit it in. He then said that he would like to have more input 30
from the Developer as to why 96 units are necessary, and why this could not be reduced to a two- 31
story facility. 32

Joel Larson of Select Senior Living addressed the Council and said that they planned to match 34
the existing fence, and would be willing to transplant pine/evergreen trees that are 12 to 15 feet 35
high to further buffer the facility from neighbors. He then said that they do not feel that they 36
would need any more parking as, sad as it may be, they average 20 visitors at a time with a 90 37
unit building in West St. Paul as people do not visit their loved ones. 38

Mr. Larson said that the people using this building will not be driving, using the parks, or school 40
district as would residents of an apartment building or townhome building. 41

Mr. Larson indicated that he has talked with Integra Homes in an attempt to work out a deal but 43
that was not possible. 44

Council Member Mueller asked whether the drive from the underground parking could be 1
continued around back for the fire access to avoid the need to have a driveway along the adjacent 2
property line. He said that the grade was too great and it would not be possible. 3

Mr. Larson said that he would be able to shorten the delivery times and only allow deliveries 5
between 8:00 a.m. and 4:00 p.m. 6

Council Member Mueller asked how many jobs this project would bring to the community. 8

Mr. Larson suggested that there would be approximately 15 to 20 positions. 10

Council Member Stigney said that he would like designated parking stalls for Staff, as he is 12
concerned with Staff shift change and parking. 13

Council Member Stigney asked if the parking is level or inclined underground. He then asked 15
about the logistics of trash removal and pickup. 16

Mr. Larson explained that the truck would drive down and pick it up after it is pushed out of the 18
building. 19

The Council asked Mr. Larson to consider adding more screening with taller trees. 21

Terry Bangston of 8025 Groveland Road said that Joel has been very receptive to listening to 23
residents. He then said that this is not St. Paul and lots are bigger. He further said that the other 24
home discussed in Spring Lake Park is different as there is an empty lot in front of it and there 25
would not be at this location. 26

Jonathon Thomas of 8040 Groveland Road said that he would like to know what approvals are 28
required and what an approval means to residents. He then said that he would like to know 29
whether any changes could be made yet to the plans, as he would like to move the entrance as far 30
to the south as possible to provide a buffer to residents. 31

Mayor Marty noted that the City had 60 days from July 17, 2008. 33

Planning Associate Heller indicated that final plat approval would be next in the process if 35
approved tonight and there is an option for extension for another 60 days. 36

Clerk Administrator Ericson suggested tabling this to September 8, 2008 to allow time to amend 38
the plan as discussed for the 8 foot fence, more trees, and moving the driveway, and to allow 39
time for the input from Rice Creek and Ramsey County. 40

Council Member Stigney said that he would like to know the highest and best use of the property. 42
He then said that he feels this is not a good location on Highway 10. He further said that this is a 43
big mammoth building that does not fit in this location, and his preference would be to scale the 44
building down to half this size. 45

Finance Director Beer explained Ordinance 811 establishing the Franchise Fee on CenterPoint 22
Energy natural gas operations. Staff is suggesting extending the sunset to December 30, 2012. 23

Mayor Marty opened the public hearing at 9:10 p.m. 25

Charlie Hall of the Mermaid handed out information to Council. Council reviewed the 27
information. 28

Charlie Hall said that their business is down due to the smoking ban and the $12,000 in 30
franchise fees affects them. 31

Mr. Hall said that the fee that is so easy for Council to extend, drastically affects his business. 33
He then asked Council to consider eliminating the fee. 34

Tim Roche, President of the Twin Cities North Chamber of Commerce addressed the Council 36

Richard Sonterre of 5060 Red Oak Drive addressed Council and said that he chairs the public 1
policy committee for the Chamber, and one of there concerns is that the tax is unfair, 2
unwarranted and they would like a phased elimination. 3

Hearing no further public comments, Mayor Marty closed the public hearing at 9:57 p.m. 5

Council Member Flaherty indicated that it is 4% for everyone whether they are a resident or 7
business owner. He then said that he would like the City to look at this annually and review to 8
see what happens if the City drops the franchise fee by .25% year by year. 9

Council Member Mueller said that times are tough all over and she would like to support the 11
businesses, however, there are needs that have to be funded so the City needs to come up with 12
other ideas as to how to make up for the difference in franchise fees. 13

Council Member Hull indicated that Council discussed this topic at a work session. He then 15
said that he would like to go down to 3.5% and slowly wean the City off this tax. He further 16
asked if it would be doable to come up with the $77,000 in the budget somewhere. 17

Ordinance Implementing a Franchise Fee on CenterPoint Energy Natural Gas Operations within 20

Council Member Stigney indicated that he would like to wean the City off this tax but it is not 23
going to be resolved at this meeting. 24

Council Member Flaherty would like to see it decrease to 3.75%.. 26

Mayor Marty indicated that he asked the business owners and concerned residents to work with 28
staff to see what they could come up with to run the City and pay for the street program instead 29
of using a franchise fee. 30

Mayor Marty noted that Staff discussed capping the fee because of increasing energy costs. 32
