PLEDGE OF ALLEGIANCE The Pledge of Allegiance was said. ROLL CALL MEMBERS PRESENT: Mayor Linke, Councilmembers Quick, Wuori, and Blanchard. ALSO PRESENT: Samantha Orduno, City Administrator; Paul Harrington, City Planner; Jim Thomson, City Attorney APPROVAL OF MINUTES: MOTION/SECOND: QUICK/WUORI approve minutes of June 28 , 1993 Council Meeting as presented. VOTE: 4 ayes 0 nays Motion Carried SPECIAL ORDER OF BUSINESS There was no special order of business scheduled for this meeting. RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR Frank Gabrysh, 2832 County Road J, stated that he had received a letter from the Mounds View Public Works Department regarding the use of pumps. Mr. Gabrysh thanked Mike Ulrich, Public Works Supervisor and the Public Works lCrew for the fine job that they have done in handling the water problems for the residents of the City. 4 Mounds View City Council Page Two Regular Meeting . July 12 , 1411 CONSENT AGENDA Samantha Orduno, City Administrator, read the Consent Agenda. Mayor Linke asked if there were any items the Council desired removed from the Consent Agenda. There were no items removed. MOTION/SECOND: Wuori/Blanchard to adopt the Consent Agenda as presented. VOTE: 4 ayes 0 nays Motion Carried PUBLIC--HEARINGS Mayor Linke opened the Public Hearing to consider a request for a variance and conditional use permit (car wash) at 2390 Highway 10 Planning Case No. 362-93 at 7 : 05 p.m. Paul Harrington, City Planner, reviewed Staff Report No. 93-555C regarding a request for a conditional use permit at 2390 Highway 10 . Harrington explained that Gateway Foods had made application for a conditional use permit to allow the placement of a fully automated car wash facility on their property at 2390 Highway 10. Harrington reported that during the review of the request, it was discovered that the placement of the facility on the property would not meet setback requirements as outlined in Chapter. 40 of the Municipal Code and would require that a variance be granted in order for the project to take place. Harrington further reported that the Mounds View Planning Commission reviewed the project plan and denied the variance request based on a lack of sufficient hardship. Harrington stated that the applicant has appealed the Commission's decision to the City Council level as allowed by Municipal Code. Harrington read the following letter from Jerome J. Simons, Jr. , dated July 12 , 1993 , regarding the. Gateway Foods Variance Request into the minutes and asked that it be attached to the minutes as part of the permanent record of this request: "July 12 , 1993 Mr. Paul Harrington City Planner City of Mounds View RE: Gateway Foods Variance Request Dear Mr. Harrington: I am one of the owners, along with James McDonnell, of the apartment building located at 5284 Greenfield in Mounds View. I have been provided . with a copy of the Notice of Public Hearing to be held tonight to consider• the request of Gateway Foods for an automated car wash on their property along with a request for a variance. Mounds View City Council Page Three • Regular Meeting July 12 , 1993 Because of conflicts in both Mr. McDonnell' s and my schedule, neither one of us will be able to be physically present at the hearing. However, we would like to formally place our opposition and objection to the variance which would allow the erection of a car wash within twenty feet of our property line. We strongly believe that such a variance will interfere with the quality of life of the present tenants in our building. We also believe that the variance would result in the creation of certain vacancies and inhibit our ability to rent the units in the building. We would ask that you formally submit this written objection at the hearing. Simons, Jr. kra" Harrington introduced Terrie Groen of the Rider Bennett law firm, representing Gateway Foods with regards to their request for a conditional use permit for 2390 Highway 10. Ms. Groen presented the background of the "'business as well as described the type of car wash being proposed for the site. Ms. Groen stated that the property is of irregular shape, a large portion of the property is easement and there are two small wetland areas on the property. Also, the access points are off the highway. Ms. Groen stated that with regards to the apartment complex, per the Municipal Code, the building would have to setback 80 feet from the dwelling and the proposed plan of placement would have the building exceeding the setback requirements by an additional 12 feet. Ms. Groen introduced Tom Boulay, Vice President of Husky Manufacturing, builders of the automated car wash facility under consideration. Mr. Boulay commended the Planning Commission in their efforts to have the building conform to the 40 foot setback requirements. Mr. Boulay explained that the car wash would be a touch free, automatic car wash where there is no contact or friction to the vehicle. Mr. Carlson, representative of Gateway Foods, commented that there had been a concern regarding screening and that four pine trees placed in the proper position would provide good coverage from headlights. Mr. Carlson pointed out that the route of traffic had been driven to see which homes the headlights would effect, and there was only one home that could be detected that would be affected from the lights. Mounds View City Council Page Four Regular Meeting July 12 , 1411 Mayor Linke stated that a variance request has to prove that there is a hardship unique to the property in existence and there is no hardship on this property that is unique to the property itself. Jim Thomson, City Attorney for the City of Mounds View, cited state law that is applicable to variance requests and the property in question does not meet the criteria for the granting of a variance. Mayor Linke reviewed the proposal and stated that he would have to go along with the recommendation of the Planning Commission in regards to the fact that-the -car wash is not part of theprimary use of the property. Linke- stated inkestated that almost all of the properties along the Highway 10 corridor face the same hardship as this parcel.. MOTION/SECOND: Linke/Wuori to recommend denial of the variance request for 2390 Highway 10 (car wash) and have the City Attorney draft the proper language for this denial. Councilmember Wuori stated that she was in concurrence with the Mayor's comments and the Planning Commission's recommendation regarding the variance request. Wuori stated that almost all properties on Highway 10 have this shaped property and have reasonable use of this property. VOTE: 4 ayes 0 nays Motion Carried • Mayor Linke stated that the City must adhere to state law. Mayor Linke stated that he is a planner for Kraus Anderson and, when he was looking over the property, wondered if the business would be interested in joining forces with the car wash close in proximity in maybe giving out tokens for car washes or something similar to that. Mayor Linke thanked the applicants for attending the meeting and explaining their request. COUNCIL BUSINESS A. Michele Severson, Administration Secretary, reviewed Staff Report No. 93-557C regarding Resolution No. 4386 Approving a Charitable Gambling License for a One-Day, Off-Site Lawful Gambling Permit. Severson stated that the North Suburban Chapter of the Minnesota Deer Hunter's Association had submitted an application for a one-day, off-site gambling permit. Severson explained that this group is having their annual banquet at the Bel-Rae Ballroom and will be holding four raffles for various hunting accessories and art prints during the banquet. Proceeds from the banquet will be used for educational hunting skills programs. Samantha Orduno, City Administrator, reviewed Staff Report no. 93-558C regarding setting a date of July 26, 1993 at 7 : 06 p.m. for a public hearing on the Surface Water Management Utility. Orduno reported that at the April work session regarding the Surface Water Management Plan, it was the Council's plan to conduct an informational meeting on the concept of a Surface Water Utility. The info meeting was to be held prior to any action taken on the implementation process of the Management Plan such as moving forward with the Utility concept. The informational meeting was held on June 21. The Council determined at their July 6, 1993 work session that the public hearing should be set for July 26, 1993 . MOTION/SECOND: Blanchard/Quick to set public hearing for the Surface Water Management Utility for 7 : 06 p.m. on Monday,. July 26 VOTE: 4 ayes 0 nays Motion Carried C. Samantha Orduno, City Administrator, reviewed Staff Report No. 93-559C regarding the introduction and consideration of Ordinance No. 527 Regarding Mayor and Councilmember's Compensation. Orduno stated that during the 1993 budget process salary adjustments for Mayor and Council were budgeted for and informally approved. Orduno further reported • that, although these funds were available, they had not been utilized because state law and municipal code states, "a salary increase cannot become effective until after the next municipal election. " With the Special Election scheduled for August 24 , 1993 , it is proposed that Ordinance No. 527 be adopted approving compensation increases for Mayor and Council. Orduno stated that the proposed increase for the Mayor is $125 per month and $100 per month for Councilmember. Orduno further reported that the Mounds View City Council is still one of the lowest paid in the Twin Cities Metropolitan Area. MOTION/SECOND: Quick/Blanchard to approve the introduction of Ordinance No. 527 Regarding Mayor and Councilmember's Compensation and waive the reading of the same. VOTE: 4 ayes 0 nays Motion Carried REPORTS 1. Report of Councilinembers: Councilmember Blanchard - No report. Councilmember Quick - "Hope it quits raining! " Councilmember Wuori - "Hope it quits raining long enough for the Festival In the Park to take place." Councilmember Wuori extended 411 an invitation to everyone and hoped that she would see many people at the Festival. Mounds View City Council Page S? Regular Meeting July 12 , 1 2 . Report of Mayor: Mayor Linke read a poem written by Daniel Lee, a 9 year old from Toronto, that was published in the National League of Cities magazine entitled, "My World" . Mayor Linke stated that this poem reminded him of the upcoming FOCUS 2000 process that will be taking place in Mounds View where the residents of Mounds View would decide their future and decide what they want Mounds View to be. Mayor Linke stated that FOCUS 2000 is a process which will attempt to make dreams come true. Two forums will be - held, one on July 21 and another on July 22 from 6: 00 - 10: 00 p.m. at Edgewood Middle School Cafeteria and all "stakeholders" (residents and those who work in the City) are invited to attend. Mayor Linke explained that all residents should have received a FOCUS 2000 brochure in the past couple of weeks. This brochure described the FOCUS process and had a comment card attached for those who would not be able to make the Forums. Mayor Linke encouraged those persons who cannot attend the meetings to fill out the comment card and return it to City Hall. Mayor Linke also stated that the City Newsletter should have been received today, and if not, tomorrow. In the newsletter is also a card regardi the FOCUS 2000 process. Mayor Linke asked the residents to fill out and return the card to City Hall if they cannot attend the forums and have not already returned a card. Mayor Linke also stated that there is an article in the newsletter regarding the upcoming Special Election scheduled for August 24, 1993 . Mayor Linke announced that Mounds View City Hall will be open from 1: 00 - 3 : 00 p.m. on August 21, 1993 for absentee voting and also on Monday evening, August 23 , 1993 from 5: 00 p.m. until 7: 00 p.m. for absentee voting. Report of Administrator Samantha Orduno, City Administrator, reported that the City is interested in placing signs regarding the FOCUS 2000 process at various locations within the City. Orduno reported that Resolution No. 4392 Granting Special Council Approval for FOCUS 2000 Signs had been drafted and for Council's review and consideration. MOTION/SECOND Wuori/Linke to adopt Resolution No. 4392 Granting Special Council Approval for FOCUS 2000 Signs Councilmember Quick asked Orduno to read Resolution No. 4392 . Please note that Resolutions of approval and denial have been prepared To review, Gateway Foods has made application for a Conditional Use Permit to allow the placement of a fully automated Car Wash facility on their property at 2390 Highway 10. During the review of the request, City Staff discovered that the placement of the facility on the property would not meet setback requirements as outlined in Chapter 40 of the Municipal Code and, therefore, would require that a variance be granted in order for the project to take place. The Mounds View Planning Commission reviewed the project plan and denied the variance request based on a lack of sufficient hardship. The applicant has subsequently appealed the Commission's decision to the City Council level as allowed by Municipal Code. In reviewing and acting upon the request the Council should bear in mind the following: 1) The issuance of a Conditional Use Permit is contingent upon the applicant meeting the criteria set forth in Chapter 40. 25 Subdivision C (2) of the Mounds View Municipal Code. All items listed should be addressed to the satisfaction of the City Council. A copy of those criteria are attached for your review. 2) All variance requests are subject to the criteria outlined in Chapter 40. 26 Subdivision D of the Mounds View Municipal Code. All circumstances listed in that section of the Code must exist for the variance request to be granted. I have received information from the applicant regarding water usage and will be discussing it with SEH prior to the meeting Monday evening. Also, a topographical map of the site has been provided which will be reviewed by SEH. Any additional information Staff feels is pertinent to the review of the request will be addressed on Monday. All signing and informational or visual communication devices shall be in compliance with the Sounds View Sign Code (Chapter 39 ) . k . The provisions of Section 40 . 25 , Subd . A( 5 ) of this Code are considered and satisfactorily met . ( 2 ) Car washes (drive through, mechanical and self-service ) provided that: a. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing -buildings or area as to - - cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot. b . Magazining or stacking space is constructed to accommodate that number of vehicles which can be washed during a maximum thirty ( 30 ) minute period and shall be subject to the approval of the City Engineer. c . At the boundaries of a residential district, a strip of not less than ten ( 10 ) feet shall be landscaped and screened in compliance with Section 40 . 04 , Subd . H of this Code . d . Each light standard island and all islands in the parking lot shall be landscaped or covered . e . Parking or car magazine storage space shall be screened from view of abutting residential districts in compliance with Section 40 . 04 , Subd . H of this Code . f . The entire area other than occupied by the building or plantings shall be surfaced with material which will control dust, drainage and erosion which is subject to the approval of the • City Engineer. • g . The entire area shall have a drainage system which is subject to the approval of the City Engineer. • h. All lighting shall be hooded and so directed that the light source not visible from the public right-of-way or from an abutting residence and shall be incompliance with Section 40 . 04 , Subd. I of this Code . 40 . 25 ( 2 ) The Planning Commission shall consider the request at its next regular meeting unless the filing date falls within fifteen ( 15 ) days of said meeting , in which case the request would be placed on the agenda and considered at the regular meeting following the next regular meeting. The City Clerk-Administrator shall refer said application along with all related information to the City Planning Commission at least ten ( 10 ) days prior to the regular meeting. ( 3 ) The applicant or a representative thereof shall appear before the Planning Commission in order to answer questions concerning the proposed amendment or conditional use. ( 4 ) The amendment or conditional use application shall be referred to the City staff for a report and recom- mendation to be presented to the Commission . A preliminary draft to the City staff ' s report and recommendations shall be given to the City Planning Commission at least ten ( 10 ) days prior to the meeting at which said report and recommendations are .to be presented. The final report and recommenda- tions of the City staff is to be entered in and made part of the permanent written record of the Planning Commission meeting . • ( 5 ) The Planning Commission shall consider possible adverse effects of the proposed amendment or condi- tional use . Its judgement shall be based upon ( but not limited to ) the following factors : a. Relationship to municipal comprehensive plan . b. The geographical area involved . c . Whether such use will tend to or actually depre- ciate the area in which it is proposed . d . The character of the surrounding area. e . The demonstrated need for such use . ( 6 ) The Planning Commission and City staff shall have the authority to request additional information from the applicant concerning operational factors or to retain expert testimony with the consent and at the expense of the applicant concerning operational factors , said information to be declared necessary to establish performance conditions in relation to all pertinent sections of this Code. ( 7 ) The Planning Commission shall make a finding of fact and recommend such actions or conditions relating to the request as they deem necessary to carry out the intent and purpose of the Code . Such recommendation shall be in writing and accompanied by the report and recommendation of the City staff . 40 . 18 i . Vehicular access points shall be limited , shall create a minimum of conflict with through traffic movement and shall be subject to the approval of the City Engineer. j . All signing and informational or visual communi- cation devices shall be in compliance with the Mounds View Sign Code (Chapter 39 ) . k . Provisions are made to control and reduce noise . 1 . The provisions of Section 40 . 25 , Subd . A ( 5 ) of this Code are considered and satisfactorily met. ( 3 ) Motor fuel station, auto repair-minor and tire batterystoresand serviceprovidedthat : a. Regardless of whether the dispensing , sales or offering for sale of motor fuels and/or oil is incidental to the conduct of the use or business , the standards and requirements imposed by this Code for motor fuel stations shall apply-. These . standards and requirements are , however, in addition to other recuirements which are imposed for other uses of the property. b . The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or area as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot. c . The entire site other than that taken up by a building , structure or plantings shall be surfaced with a material to control dust, drainage and erosion which is subject to the approval of the City Engineer. d . A minimum lot area of twenty-two thousand five hundred ( 22 , 500 ) square feet and minimum lot dimensions of one hundred fifty ( 150 ) feet by one hundred thirty ( 130 ) feet be provided . e . A drainage system subject to the approval of the City Engineer shall be installed. . f . A curb not less than six ( 6 ) inches above grade shall separate the public sidewalk from motor vehicle service areas . • 40 . 24 ( 3 ) Final Plat Stage. After approval of a general concept plan for the PUD and approval of a develop- ment stage plan for a section of the proposed PUD the applicant will submit the following material for review by City staff prior to issuance of a building or other permits : a. A detailed landscaping plan . b . Proof of recording any easements and restrictive covenants prior to the sale of any land or dwelling unit within the PUD and of the_ establish- ment andactivation -of any entity that is to be responsible for the management and maintenance of any public or common open space or service facility. c. All certificates , seals and signatures required for the dedication of land and recordation of documents. • d . Final architectural working drawings of all structures . e . Final engineering plans and specifications for streets , utilities and other public improvements , together with a Community/Developer Agreement for the installation of such improvements and finan- cial guarantees for the completion of such improvements. f . Any other plan , agreements , or specifications necessary for the City staff to review the proposed construction . 40 . 25 ADMINISTRATION - AMENDMENTS TO THIS CODE , OFFICIAL ZONING MAP AND ISSUANCE OF CONDITIONAL USE PERMITS Subd . A Procedure. ( 1 ) . Request for amendments of this Code , the official zoning map or conditional- use• permits , as provided within this Code , shall be filed with the City Clerk- Administrator on an official application form. Such application shall also be accompanied by ten ( 10 ) copies of detailed written and graphic materials • fully explaining the proposed change , development or use. The City Clerk-Administrator shall refer said application, along with all related information , to the Planning Commission for consideration and a report and recommendation to the City Council . 40 . 25 ( 8 ) The City Council shall not grant -a conditional use permit until they have received a report and recommendation from the Planning Commission and the . City staff or until sixty ( 60 ) days after the first regular Planning Commission meeting at which the request was considered . • ( 9 ) Upon receiving the report and recommendation of the Planning Commission and the City staff , the City Council shall place the report and recommendation on the agenda for the next regular meeting . Such reports and recommendations shall be entered in and made part of the permanent written record of . the City Council meeting. ( 10 ) Upon receiving the report and recommendation of the Planning Commission and the City . staff, the City Council shall hold a public hearing and shall make a recorded finding of fact and shall impose any conditions it considers necessary to protect the public health, safety and welfare. ( 11 ) Amendments of this Code , the official zoning map or a conditional use permit ehall require passage by a four-fifths ( 4/5 ) vote of the full City Council . ( 12 ) The City Clerk-Administrator shall notify the applicant of the Council ' s decision in writing . Subd . B Amendments - Initiation. The City council or Planning Commission may upon their own motion , initiate a request to amend this. Code or the official zoning map. Any person , owning real estate within the City may initiate a request to amend this Code or the official zoning map as it affects the real estate owned by said person . , -7 Subd . C Conditional Use Permit. ( 1 ) Purpose . The purpose of a conditional use permit is to provide the City of Mounds View with a reasonable degree of discretion in determining the suitability of certain designated uses upon the general welfare , - public health and safety. ( 2 ) Criteria for Granting Conditional Use Permits. In granting a conditional use permit, the City Council shall consider the advise and recommendations of the Planning Commission and the effect of the proposed use on the Comprehensive Plan and upon the health, safety and general welfare of occupants of surrounding lands. Among other things , the City Council shall make the following findings where applicable : 40 . 25 a . The use will not create an excessive burden on existing parks , schools , streets and other public facilities and utilities which serve or are proposed to serve the area. b. The use will be sufficiently compatible or separated by distance or screening from adjacent • residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrance to development of vacant land . c . The structure and site shall have an appearance that will not have an adverse effect upon adjacent res-idential properties. d . The use , in the opinion of the City Council , is reasonably related to the overall needs of the City and to the existing land use . e . The use is consistant with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use . f . The use is not in conflict with the Comprehensive Plan of the City. g . The use will not cause traffic hazards or congestion. h. Adequate utilities , access roads, drainage and necessary facilities have been or will be provided. ( 3 ) Additional Conditions . In permitting a new conditional use or the alteration of an existing conditional use , the City Council may impose , in addition to these standards and requirements expressly specified by this Code , additional conditions which the City Council considers necessary to protect the best interest of the surrounding area or the community as a whole . These conditions may include , but are not limited to the following: a. Increasing the required lot size or yard dimension. • b. Limiting the height, size , or location of buildings. c . Controlling the location and number of vehicle access points . 40 . 25 d . Increasing the street width. e . Increasing the number of required off-street parking spaces. f . Limiting the number, sized location or lighting of signs . g . Requiring diking , fencing , screening , landscaping or other facilities to protect adjacent and nearby property . h. Designating sites for open space . The Zoning Administrator shall maintain a record of all conditional use permits issued including infor- mation on the use , location , and conditions imposed by the City Council; time limits , review dates and such other information as may be appropriate . ( 4 ) Reconsideration. Whenever an application for a conditional use permit has been considered and denied by the City Council , a similar application for a conditional use permit affecting substantially the same property shall not be considered again by the Planning Commission or City Council for at least six ( 6 ) months from the date of its denial; and a subse- quent application affecting substantially the same property shall likewise not be considered again by • the Planning Commission or City Council for an additional six ( 6 ) months from the date of the second denial unless a decision to reconsider such matter is made by not less than four-fifths ( 4/5 ) vote of the City Council . ( 5 ) Lapse of Conditional Use Permit by Non-Use. Whenever within one ( 1 ) year after granting a conditional use permit the work as permitted by the permit shall not have been completed , then such permit shall become null and void unless a petition for extension of time in which to complete the work has been granted by the City Council. Such extension shall be requested in writing and filed with the City Clerk-Administrator at least thirty ( 30 ) days before the expiration of the original conditional use permit. There shall be no charge for the filing of such petition. The request for extension shall state facts showing a good faith attempt to complete the work permitted in the conditional use permit. Such petition shall be presented to the Planning Commission for a recommendation and to the City Council for a decision. 40 . 25 ( 6 ) Performance Bond . a . Upon approval of a conditional use permit the City shall be provided with a surety bond , cash escrow, certificate of deposit , securities , or cash • deposit prior to the issuing of building permits or initiation of work on the proposed improvements or development. Said security shall guarantee conformance and compliance with the conditions of the conditional use permit and the Code of the City. b. The security shall be in the amount of the City Engineer ' s or City Building Inspector ' s estimated costs of labor and materials for the proposed improvements or development. Said project can be handled in stages upon the discretion of the City Engineer and Building Inspector. c . The City shall hold the security until completion of the proposed improvements or development and a certificte of occupancy indicating compliance with the conditional use permit and Codes of the City has been issued by the City Building Inspector. d . Failure to comply with the conditions of the conditional use permit and/or the Codes of the City shall result in forfeiture of the security. 40 . 2.6 ADMINISTRATION - VARIANCES AND APPEALS Subd . A Composition. The Board of Adjustment and Appeals shall consist of all members of the Planning Commission. All members shall serve without compensation. Subd . B Oroanization , [ieetinc. The Board of Adjustment and Appeals may elect a chairman from among its appointed members for a term of one ( 1 ) year; and the Board may create and fill such other offices as it may determine . The Board shall meet by order of its Chairman, after notice , whenever an appeal has been properly presented to it. A two-thirds ( 2/3 ) vote of a properly convened Board meeting shall be required to grant the relief sought in the appeal. • • Subd . C All written reports and recommendations to the Board of Adjustment and Appeals from the City staff shall be entered in and made part of the permanent written record of the Board ' s meeting . • 40 . 26 Subd. D Criteria for Granting Variances. A variance to the provision of the Zoning Code may be issued by the Board • of Adjustment and Appeals to provide relief to the • landowner in• those cases where the Code imposes undue • hardship or practical difficulties to the property owner in the use of his land. No use variances may be issued . A variance may be granted only in the event that the following circumstances exist: ( 1 ) Exceptional or extraordinary circumstances apply to _ the properties which do not apply generally to other properties in the same zone or vicinity .and result from lot size or shape , topography or other circum— stances over which the owners of the property since enactment of this Code have had no control . ( 2 ) The literal interpretation of the provisions of this . Code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this Code . (3) That the special conditions or circumstances do not result from the actions of the applicant. ( 4 ) That granting the variance requested will not confer on the applicant any special privilege that is denied by this Code to owners of other lands, structures or buildings in the same district. ( 5 ) That the variance requested is the minimum variance which would alleviate the hardship. Economic conditions alone shall not be considered a hardship. ( 6 ) The variance would not be materially detrimental to the purpose of this Code, or to other property in the same zone . ( 7 ) The proposed variance will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion of the public streets, or increase the danger of fire or endanger the public safety, or substantially diminish or impair property values within the neighborhood . The Board of Adjustment and Appeals may impose such restrictions and conditions upon the premises benefited by a variance as may be necessary to 40. 26 comply with the standards established by this Code, or to reduce or minimize the effect of such variance upon other properties in the neighborhood , and to better carry out the intent of the variance . Subd. E Appeals. If the Board acts in favor of the appellant it thereupon shall issue an order to the administrative official involved setting forth the terms and conditions adopted . Said order shall be signed by the Chairman and the City Clerk-Administrator or Secretary of the Board. If the Board denies the applicant ' s relief the applicant - - _ within sixty (-60 ) _ days from the- decision of the Board may appeal to the City Council for the relief sought. Subd. F Procedures . ( 1 ) Requests for a variance or appeal shall be filed with the City Clerk-Administrator on an official appli- cation form. Such application shall be accompanied by a fee as outlined in Section 40 . 28. This fee shall not be refunded. Such application shall also be accompanied by ten ( 10 ) copies of detailed written and graphic materials necessary for the explanation of the request. ( 2 ) Upon receiving said application, the City Clerk- Administrator shall refer the application, along with all related information , to the Board of Adjustment and Appeals and City staff . , ( 3 ) After receiving the City staff ' s report and recommen- dations concerning a request for variance or an appeal , the Planning Commission serving as the Board of Adjustment and Appeals may set a date and hold a hearing on said request. The Board shall hear such persons as wish to be heard , either in person or by agent or attorney. Notice of any such hearing shall be mailed not less than ten ( 10 ) days before the date of hearing to the person or persons who filed the appeal or request, to all owners of property according to the City assessment records , within three hundred fifty ( 350 ) feet of the property to which the variance relates. (4) Failure of property owner to receive notice shall not invalidate any such proceedings as set forthwithin this Code. ( 5 ) The Planning Commission serving as the Board of Adjustment and Appeals shall make a finding of fact and shall decide whether to approve or deny a request for a variance or an appeal within thirty ( 30 ) days - after the public hearing on said request. RESOLUTION NO. 4387 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE REQUEST OF GATEWAY FOODS FOR A REAR YARD SETBACK VARIANCE AT 2390 HIGHWAY, PLANNING CASE NO. 362-93 WHEREAS, the Mounds View City Council has reviewed the request of Gateway Foods for a- variance to allow--a- 20- foot rear - -- yard setback where a 40 foot setback is required by Municipal Code; and WHEREAS, the applicants property is currently zoned B- 3 , Highway Business, and is subject to setback requirements set forth in Chapter 40. 05 Subdivision C of the Mounds View Municipal Code; and WHEREAS, the applicant has presented a hardship statement to the City Council, attached hereto; and WHEREAS, the City Council has reviewed the criteria in Chapter 40.26 of the Municipal Code used to evaluate all variance requests. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves the request of Gateway Foods for a rear yard setback variance at 2390 Highway 10 based upon the following findings of fact: 1) The literal interpretation of the provisions of this code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this Code. 2) The special conditions of the property do not result from the actions of the applicant. 3) Granting the variance would not confer special privileges on the applicant that are not enjoyed by other property owners in the same district. 4) The variance requested is the minimum necessary to alleviate the hardship. ATTEST: Mayor (SEAL) Clerk-Administrator RESOLUTION NO. 4387 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION DENYING THE REQUEST OF GATEWAY FOODS FOR A REAR YARD SETBACK VARIANCE AT 2390 HIGHWAY, PLANNING CASE NO. 362-93 WHEREAS, the Mounds View City Council has reviewed the request of Gateway Foods for a variance to allow a 20 foot rear yard setback where a 40 foot setback is required by Municipal Code; and WHEREAS, the applicants property is currently zoned B- 3 , Highway Business, and is subject to setback requirements set forth in Chapter 40. 05 Subdivision C of the Mounds View Municipal Code; and WHEREAS, the applicant has presented a hardship statement to the City Council, attached hereto; and WHEREAS, the City Council has reviewed the criteria in Chapter 40.26 of the Municipal Code used to evaluate all variance requests. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council denies the request of Gateway Foods for a rear yard setback variance at 2390 Highway 10 based upon the following findings of fact: 1) The literal interpretation of the provisions of this code would not deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this Code. 2) The special conditions of the property result from the actions of the applicant. 3) Granting the variance would confer special privileges on the applicant that are not enjoyed by other property owners in the same district. 4) The variance requested is not the minimum necessary to alleviate the hardship. The facility must, at all times, be in compliance with State Laws and Minnesota Pollution Control Agency Standards for air quality and noise. 2 . The hours of operation shall be 24 hours. After one year of operation the City shall hold a public hearing to solicit input on the hours of operation. If there are any negative com- ments, the hours of operation may be reduced. 3 . The car wash facility shall include a blower system designed to remove as much water as feasible from the vehicle before it is allowed to exit the facility. This equipment shall operate as a customer option from April 16 to Resolution No. 4388 Page Two October 14 and as a mandatory service from October 15 through April 15. 4 . The North Suburban Chapter of the Minnesota Deer Hunter's Association will be holding the annual banquet at the Bel-Rae Ballroom on August 27 at which four raffles for various hunting accessories and art prints will be conducted. Subpart 1. Conducting raffles. The following items apply to the conduct of raffles: A. Each ticket for entry in a raffle must constitute an equal chance to win in the raffle. B. No person shall be required to purchase more than one ticket, or to pay for anything other than the ticket, in order to enter a raffle. C. No person shall be required to be present at a raffle drawing in order to be eligible for the prize drawing. D. Each ticket seller shall return to the organization the stubs or other detachable section of all tickets sold before the drawing. E. No tickets may be sold after the first drawing. F. Before drawing, the organization shall place each stub or other detachable section of each ticket sold into a receptacle from which the winning tickets are to be drawn. G. The receptacle must be designed so that each ticket placed in it has an equal chance to be drawn. Subp. 2. Raffle prizes. An organization conducting a raffle in which real or personal property prizes are to be awarded shall have paid for in full or otherwise become the owner, without lien or interest of others, of all the real or personal property before the drawing at which the winners of the prizes are to be determined. Subp. 3. Raffle ticket requirements. The following items are raffle ticket requirements: A. Raffle tickets shall have a detachable section and be consecutively numbered. Although these funds have been available, they have not been utilized because state law and municipal code states "a salary increase cannot become effective until after the next municipal election. " With the upcoming special election scheduled for August 24, 1993, it is proposed that Ordinance No. 527 be adopted approving compensation increases for Mayor and Council. This would allow for the salary increases to become effective 30 days. after the ordinance is published (August 27) or 3 days after the special election. The current annual salary for the Mayor is $3 ;600. It is proposed that this salary be increased to $5, 100 per year. The current salary for Councilmembers is $3, 300/year.
