ADJOURNMENT: /TEM 4.A RESOLUTION NO. 4312 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA Pursuant to due call and notice thereof, a meeting of the City Council of the City of Mounds View, Minnesota was held at the City Hall, on December 9, 1992 with the following members present: and the following members absent: Member introduced the following resolution and moved its adoption: A RESOLUTION ADOPTING THE 1993 CITY OPERATING BUDGET WHEREAS, the City Council did hold a public hearing on the proposed 1993 Budget on December 9, 1992 . ATTEST: (SEAL) a • APPROVED PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA Budget Hearing December 9, 1992 Mounds View City Hall 2401 Hwy. 10, Mounds View, MN 55112 CALL TO ORDER The Mounds View City Council was called to order by Mayor Linke at 6: 00 p.m. on Wednesday, December 9, 1992 . SLEDGE OF ALLEGIANCE The Pledge of Allegiance was said. ROLL CALL MEMBERS PRESENT: Councilmembers Quick, Wuori, Blanchard and Mayor Linke. MEMBERS ABSENT: Councilmember Rickaby ALSO PRESENT: Samantha Orduno, City Administrator; Don Brager, Finance Director; Tim Cruikshank, Management Assistant Mayor Linke explained that he had spoken to Councilmember Rickaby regarding a letter that she had published in the FOCUS. The subject was property taxes and rate increases. Councilmember Rickaby stated that the information given to the Council was not correct and, therefore, the Council did not have correct information when setting the levy. Mayor Linke had asked Councilmember Rickaby to make a formal apology to staff because of inferences she had made regarding staff in the letter. A Work Session was held on December 7, 1992. Councilmember Rickaby had asked where the cuts were that had been made by staff. Mayor Linke xplained that if the Councilmembers had any cuts they were to bring them r discussion and Councilmember Rickaby had stated at several meetings that Mounds View City Council Page Budget Hearing December 9, 1 she had cuts, but had none at this meeting. Rickaby asked again where staff cuts were and Mayor Linke explained the situation again. Rickaby accused the other nine. persons in the room of having collective memory loss because they did not recall what she remembered with regards to staff cuts. Rickaby got up, put her coat on half way through the meeting and stated, "sitting here is not my top priority if I'm not going to be listened to" . Mayor Linke asked her at that time if she was going to fulfill her responsibilities with regards to the budget. Mayor Linke stated he had never seen or had something like this happen in the past. Mayor Linke read a letter that he wrote to Councilmember Rickaby asking for her resignation from her position as Councilmember. Mayor Linke made note that Councilmember Rickaby would not be in attendance at this meeting. Councilmember Rickaby called yesterday at 11:55 a.m. looking for Samantha Orduno, City Administrator. Rickaby left a message with the receptionist that said, "I won't be at the budget hearing on Wednesday night, I'm planning to be sick" . Mayor Linke stated that he did not ask for this resignation without much thought. On behalf of the residents, Mayor Linke stated that he felt the residents -deserve a Councilmember that should be doing what the person was elected to do. Councilmember Rickaby had not participated in the budget process all year long. Councilmember Wuori stated her concurrence with Mayor Linke's statements. Wuori stated that when she did not understand information she came in and • spent time with staff. That is why staff is hired and Council is elected. Councilmember Wuori requested signing the letter to Councilmember Rickaby. Councilmember Blanchard concurred with Mayor Linke and stated that, in her opinion, Councilmember Rickaby is not serving constituents. Councilmember Blanchard did not feel that four Councilmembers could ask for Councilmember Rickaby's resignation. Councilmember Blanchard would have to think about it before signing the letter. Duane McCarty, Long Lake Road, has a concern about what is happening with the Truth In Taxation notice. There is a misrepresentation of information regarding the proposed property taxes. The County is given credit for the raising of the property taxes. The County acts under state laws and must maintain property estimated values at 90 - 105% of their market value and we are currently at 95% in Ramsey County. Mr. McCarty stated that we have to get to the legislature in their next session and make it workable for everyone. Mayor Linke stated that the City Council is trying to keep the 1993 rate the same as the 1992 rate. If you keep the rate the same and the tax capacity rate for the residents the same the taxes won't increase. Mr. McCarty stated that an escalated estimated market value will increase the revenues. The proposed City tax levy is exempt on the Mounds -View Cit Newsletter. unds View City Council ol Page Three dget Hearing December 9, 1992 Linke stated that the market values for the City of Mounds View went up 3.3% on the average, however, the capacity value for the City went down. Using the same rate the City will receive less of the taxpayers money than in 1992. McCarty stated that trying to explain the Truth In Taxation handout is very difficult to do. Samantha Orduno, City Administrator, reviewed the 1993 proposed budget by presenting it through transparencies and handouts. Orduno went through the information provided to the public. Orduno reviewed where the City receives revenues and what the revenues are spent on. Don Brager, Finance Director-Treasurer, reviewed what the City received of the taxpayers property taxes. Mr. Brager showed a video regarding all the services that the City provides. Brager pointed out the revenues that finance City services. These revenues basically are received from the taxes and state aids. > Brager stated that the tax rate will not change in 1993 . The City has tried to keep the tax rate relatively stable over the years. Mayor Linke stated that 1.5% of this year's was going to come out of reserves but last week the City was notified that it would be receiving a , cal government aid payment because of the Mega Mall doing better than ticipated. Because of the 1/2% sales tax that was added, the City is looking at approximately an additional $47,700 coming to the City this year. The City Council decided Monday night to take that money and put it in this year's budget so that reserve funds did not have to be used to buy down property taxes. The City's reserves are getting low. Don Brager stated that operational costs will go up in City water rates by $. 05 and approximately 4% in City sewer rates. The City's practice has been to hold a separate hearing on those funds. Mayor Linke thanked staff for a great presentation. Il ••• ITEM 4.B RESOLUTION NO. 4313 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA Pursuant to due call and notice thereof, a meeting of the City Council of the City of Mounds View, Minnesota, was held at the City Hall on December 9, 1992 with the following members present: and the following members absent: Member introduced the following resolution and moved its adoption: A RESOLUTION CERTIFYING THE 1993 GENERAL FUND PROPERTY TAX LEVY BE IT RESOLVED by the City Council of the City of Mounds View, Minnesota, as follows: RESOLVED that the following sums be and are hereby levied upon the taxable property in the City of Mounds View, County of Ramsey, State of Minnesota, for the year 1993 for the following purpose to wit: General Fund Levy $1,553, 042 The motion for the adoption of the above resolution was duly seconded by Member and upon a vote being take, Ayes Nays, said resolution was declared duly passed and adopted this 9th day of December, 1992 . ATTEST: (SEAL) ITEM 4.0 RESOLUTION NO. 4314 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA Pursuant to due call and notice thereof, a meeting of the City Council of the City of Mounds View, Minnesota was held at the City Hall on December 9, 1992 with the following members present: and the following members absent: Member introduced the following resolution and moved its adoption: A RESOLUTION CERTIFYING THE 1993 BONDS AND INTEREST TAX LEVY BE IT RESOLVED by the City Council of the City of Mounds View, Minnesota as follows: 1. There shall be a tax levied for repayment of an Equipment Debt Certificate in the amount of $100,955 pursuant to MSA, Section 412.301, and that the County of Ramsey is hereby requested and directed to levy upon taxable property within the City of Mounds View the sum of $100,955 for the payment of principal and interest of said Equipment Debt Certificates. 2 . That the County of Ramsey is hereby requested and directed to levy upon taxable property within the City of Mounds View the sum of $100,381 for the payment of principal and interest on the General Obligation Fire Improvement Bonds, Series 1991A. 3 . That the total amount to be levied in 1993 for the bonds and interest tax levy is $201, 336. The motion for adoption of the above resolution was duly seconded by Member and upon a vote being taken, Ayes Nays, said resolution was declared duly passed and adopted this 9th day of December, 1992 . ATTEST: (SEAL) r /TEM 4-D RESOLUTION NO. 4315 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA Pursuant to due call and notice thereof, a meeting of the City Council of the City of Mounds View, Minnesota was held at the City Hall on December 9, 1992 with the following members present: and the following members absent: Member introduced the following resolution and moved its adoption: A RESOLUTION AUTHORIZING ISSUANCE OF AN EQUIPMENT DEBT CERTIFICATE, PRESCRIBING THE FORM AND DETAILS THEREOF, AND LEVYING TAXES FOR THE PAYMENT THEREOF BE IT RESOLVED by the City Council of the City of Mounds View, Minnesota as follows: 1. It is hereby found and determined that it is necessary and expedient for the City to issue an Equipment Debt Certificate for the purpose of financing the purchase of police and street maintenance equipment, in accordance with the provisions of Minnesota Statutes, Section 412 . 301; and that the sale of said Certificate to the Utility Fund, on terms hereinafter set forth, is hereby ordered. 2 . The City shall issue it's General Obligation Equipment Debt Certificate in the amount of $100,955. 00 authorized by the Council pursuant to the provisions of Minnesota Statues, Section 412.301 for the purpose of financing the purchase of police and street maintenance equipment. Said Certificate shall be dated on or about January 3, 1993 and shall be payable to the Utility Fund at the City of Mounds View. 3 . Said Certificate shall be as follows: UNITED STATES OF AMERICA STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF MOUNDS VIEW EQUIPMENT DEBT CERTIFICATE RESOLUTION NO. 4315 Page Two KNOW ALL MEN BY THESE PRESENTS that the City of Mounds View, Ramsey County, Minnesota, hereby acknowledges itself to be indebted and for values received promises to pay to the Utility Fund of the City of Mounds View on order, the sum of $100,955. 00 plus interest at 8% per annum in one installment in 1993. Principal and interest on this Certificate is payable at the office of the City of Mounds View, Minnesota and for the prompt payment of said principal, the full faith, credit and taxing power of the said City have been and are hereby irrevocably pledged. This Certificate is issued for the purpose of purchasing police and street maintenance equipment for the City and is authorized by a duly adopted resolution of the City Council of said City, dated January 3 , 1993 and is issued pursuant to and in full conformity with Minnesota Statutes, Section 412 . 301. IT IS HEREBY CERTIFIED AND RECITED, that all acts, conditions and things required by law to be done, to exist, to happen and to be performed, precedent to and in the issuance of this Certificate have been done, do exist, have happened and have been performed in regular and due form, time and manner; that a direct, annual, irrepealable ad valorem tax has been duly levied by said City in an amount sufficient to pay the principal on this Certificate when it falls due, and that this Certificate, together with all other existing indebtedness of the said City, does not exceed any constitutional or statutory limitation on indebtedness.. IN WITNESS WHEREOF, said City has caused this Certificate to be executed in its behalf by its Mayor and Administrator and the Official Seal of the City to be affixed hereto as of January 3, 1993.
