Item Title/Subject: Resolution 7370 Adopting the 2009 Property Tax Levy
Attached is Resolution 7370 adopting the 2009 property tax levy.
The Truth-in-taxation hearing was held on December 1, 2008.
The City Council may adopt the tax levy on December 8th or schedule an additional meeting if
necessary to adopt it no later than December 20, 2008.
Staff recommends that the City Council adopt resolution 7370 adopting the 2009 property tax levy
with a 1% decrease over the previous year.

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
Adopting the 2009 Property Tax Levy
WHEREAS, the City Council has conducted numerous meetings and has made available detailed
copies of the proposed 2009 Budget; and
WHEREAS, the City Council held a public hearing on December 1, 2008 to take comment on the
proposed 2009 levy; and
WHEREAS, General Obligation Improvement Bonds of 2004 were issued and require a debt service
levy of $187,928 to be collected in 2009; and
WHEREAS, when the Fire Improvement Bonds of 1991 were issued, the debt service was
scheduled to be $77,278, however, due to changes in the allocation of costs between participating
cities, Mounds View’s actual 2009 cost on said bonds will be $63,372; and
WHEREAS , when the Fire Improvement Bonds of 2005 were issued, the debt service was
scheduled to be $98,444, however due to changes in the allocation of costs between participating
cities, Mounds View’s actual 2009 cost on said bonds will be $95,523.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View that the
following property tax levy for 2009 is hereby approved:
General levy $ 3,210,748
Fire Bonds of 1991 levy 63,372
Fire Bonds of 2005 levy 95,523
PERA rate increase levy 26,822
Police Referendum net tax capacity levy 215,000
Total General Fund 2009 property tax levy $ 3,611,465
G.O. Improvement Bonds of 2004 debt service levy $ 187,928
Total Property Tax Levy 2009 $ 3,799,393
and the City Clerk-Administrator is hereby directed to notify Ramsey County and the State of
Minnesota of said 2009 property tax levy.
Said resolution was declared to have been duly passed and adopted this 8th day of December,

all cases where the work is of such a nature that the permit fees cannot be determined from the
schedule established below for such work. The minimum fee for all permits shall be $23.50 unless

D. OTHER INSPECTIONS / PLANNING FEES
Applicants are responsible for all costs incurred associated with the filing, review and processing
of development applications. Such fees are to be paid in escrow up front or upon receipt of
statement from the City of Mounds View. Fees may include but are not limited to costs for
consultants retained by the City, consultant planning services, attorney, and engineer fees. A
deposit may also be required to cover costs of public notices, materials and staff time spent in the
review, research or preparation of materials associated with this application. The applicant shall
be responsible for all reasonable incurred costs in excess of the initial deposit amount. Any
portion of the deposit not spent or encumbered shall be refunded to the applicant within 30 days
after consideration of the application is completed. Payment of park dedication fees is required
with subdivision applications. Application fees are not refundable.

Introduction
Attached is the Fee Schedule for 2009. Changes to the Fee Schedule from 2008 to 2009
are highlighted in red and blue.
There was no public comment at November 24, 2008, public hearing in regard to this Fee
Schedule. However, the Public Hearing on the Fee Schedule was continued to allow Staff
time to research business license fees.
Discussion
The City Council directed Staff to research what other communities charges for various
business licensing fees. Below are the results of Staff Research:
Amusement Device License: The City currently charges $15 per location plus $15 per
machine for all amusement devices, which includes “pinball
machines”, arcade machines, kiddie cars, etc. Staff found
that some cities either charged a flat fee (for example,
Forrest Lake charges $100.00) or they charge, like we do
here in Mounds View, a fee per location in addition to a fee
per machine. The Mermaid, Moe’s, Robert’s, and the
Wynsonng Movie Theatre currently have Amusement
Business Licenses. The Mermaid has the most amusement
machines (41 machines). Attached is the League of
Minnesota Cities Permit Survey for your reference. Staff
recommends to not increase this fee. This fee seems to be
consistent with the League’s survey.
Automobile Sales: In accordance with Section 510.01, anyone who, as a part of
their livelihood, engages in the regular sale, trade or exchange
of automobiles shall be deemed to be doing business as a
new or used automobile dealer. The City only has one car
dealer, Saturn. The City currently charges, $158.00/year.
After looking at the League of Minnesota Cities Permit
Survey, Staff feels that the City should be charging more.
For example, the City of New Brighton charges $190.00.
Staff recommends revising this fee to $200.00/year.
Bowling License: The Mermaid is the only bowling facility in Mounds View. The
City currently charges $20 per alley, per year. The Mermaid
paid $640.00 in 2008 (32 bowling alleys X $20 = $640). Staff
recommends not to increase this fee. This fee seems to be
consistent with the League’s survey.
Cigarette/Tobacco License: The City currently charges $158.00/year for a Cigarette and
Tobacco License. Researching the League of Minnesota
Cities Survey, Staff recommends increasing this fee to
$200.00/year. Most cities on the survey charge more than
$150.00/year for this type of license.
Liquor Licenses: According to the League of Minnesota Cities Survey, we are
charging more than most cities for this type of license. Staff
recommends to not increase these fees.
Massage Licenses: Staff recommends to not increase this fee. Staff is not sure if
the cities listed on the League Survey are including
investigation fees for their massage licenses. The City has
three licensed Therapeutic Massage Therapists and Staff
requests more time to research.
Peddler/Solicitor: Staff recommends to not increase this fee. The League
Survey seems to include that we are charging more that most
cities for this type of license.
Restaurant: Staff recommends to not increase this fee. This fee seems to
be consistent with the League’s survey.
Recommendation:
Make any necessary changes to the Fee Schedule and adopt Resolution 7369. Staff will
provide the City Council a clean final draft when all changes are completed.

The 2008 cable budget includes $2000 in the Capital Equipment fund (Account #210 –
4350 – 7030) for the purchase of a podium and other council chamber improvements. Staff
has been requested to investigate a replacement for the current podium, which is in poor
repair and does not meet the needs of the City.
Background
Based on direction from the Council at the December 1, 2008, Work Session, Staff revised
the podium specifications to include a second fold-up shelf and indicate load capacity for
the fold-up shelves and contacted the vendors with revised information. Staff also revisited
the options for off-the-shelf podiums as an alternative to custom-built.
Discussion
Quotes for the custom design were received from three vendors.

The lowest quote for a custom podium was from Wilkie Sanderson at a cost of $1709 for a
podium with two side shelves, or $1379 for a podium with one side shelf. This cost
includes delivery and sales tax. Wilkie Sanderson did the millwork for the Council
Chambers during the 2006 renovation, so should be able to make a podium that is an
extremely good match to the existing materials in the room. Because the solid surface
countertop is no longer available in the color used in Council Chambers, the top surface of
the podium will be finished with the pink laminate used in other parts of City Hall.

Two of the off-the-shelf podiums would cost more than the lowest cost quote for a custom
podium, so Staff does not recommend those as good options. The lowest cost for an off-

and the off-the-shelf podium from K-Log is $779.15. The custom-built podium would be
finished using the same materials as already in the Council Chambers for an integrated

The City of Mounds View and its residents have benefitted from the services provided and
managed by the Housing Resource Center since 2001.
Discussion:
The Housing Resource Center (HRC) is a division of the Greater Metropolitan Housing
Corporation (GMHC) whose stated mission is to preserve, improve and increase
affordable housing for low and moderate income families, as well as to assist
communities with housing revitalization. The HRC provides construction management
consultations, program administration, provides information on a variety of relevant
housing programs and coordinates and manages several grant and loan programs
geared toward home improvement and renovation. As the Council may recall, the HRC
agreed last year to manage the City’s Housing Replacement Program’s demolition
reimbursement component as part of the agreement, at no additional cost to the City.
The fee for this contracted service is $11,000 which is reflected in the draft 2009 EDA
budget 230-4650-3030.
Recommendation:
Approve Resolution 7377 which approves a consultant services agreement with the
Greater Metropolitan Housing Corporation for Housing Resource Center Services in
2009.

Background:
On June 12, 2006, the City Council adopted Resolution 6846 awarding a
construction contract for the Hidden Hollow South Utility and Street Improvement
Project to Nord Excavating Incorporated of Elk River, Minnesota in the amount of
$177,723.00.
On September 25, 2006, the City Council adopted Resolution 6928 approving
Change Order No. 1 for the project, which extended the specified completion
date but resulted in no change to the contract amount.
On October 8, 2007, the City Council held a Public Hearing and adopted
Resolution 7169 approving the assessment roll for the project.
Discussion:
Nord Excavating Incorporated has requested that acceptance and final payment
be made by the City for the Hidden Hollow South Utility and Street Improvement
Project. All work has been satisfactorily completed in accordance with the
contract plans and specifications.
The necessary contract documents have been provided. A copy of Request for
Payment No. 4 & Final is included with this Staff Report, along with a project
summary letter that provides a recap of the construction schedule and cost.
The original contract amount was $177,723.00. There was one change order on
the project, which modified only the specified completion date and did not alter
the contract amount. The actual final construction cost is $185,895.41, and the
final payment amount is $34,930.70.
As noted in the project summary letter, the difference in the original contract
amount and the actual final construction cost is due primarily to the 1-year delay
in the wear course paving of the street from the original schedule of August 2007.
The assessment roll for this project was adopted on October 8, 2007. The
increase in construction cost due to the wear course delay was anticipated in the
preparation of the assessment roll. The estimated construction cost used in the
determination assessments was $185,884.32, which is a difference of only
$11.09 from the actual final construction amount.
Recommendation:
Resolution 7379, accepting the project and authorizing final payment to the
contractor, has been prepared and is included with this Staff Report. Staff
recommends that the City Council adopt the resolution and make final payment
for the Hidden Hollow South Utility and Street Improvement Project to Nord
Excavating, Incorporated in the amount of $34,930.70.

Background:
At the November 24, 2008 meeting, I alerted the Council members that the amusement
machines at the Community Center were going to be removed by the vending company, as
they were not bringing in enough revenue to justify keeping them there. The owner provided
the City with the cost of each machine if we were interested in keeping any or all of the
machines. The Council discussed this issue at the December 1 work session, at which point
direction was provided to staff to acquire a pool table and the foosball table..
Discussion:
Earlier this month, Pat Prindle, Program Director at the Community Center, let us know that
the two pool tables, the foosball table and air hockey table, plus the change machine, were
in jeopardy of being removed from the Community Center as they were not generating
sufficient revenue, according to the owner of the machines. American Amusement Arcades,
the owner, provided the City with a cost breakdown of the machines in the event we desired
to purchase any or all of them. Also provided were the year–to-date revenues generated by
the machines.

While the air hockey machine brings in the most revenue, Pat Prindle suggested it would be
better to keep the foosball table and one of the pool tables. The cost of the two indicated
devices would total $1,200. As discussed, the drawback with the air hockey machine is one
of maintenance and operation costs—it is the only motorized game which could not be self-
maintained if owned by the City. It is also the least mobile of the machines.
Subsequent to the Dec 1st meeting, I contacted a different vendor to determine if they would
be interested in bringing in a replacement air hockey table and perhaps a basketball machine
at no cost to the City. As of the writing of this report, I am unable to provide any further
update on that possibility.

Also on December 1st, the YMCA Advisory Committee met to review (among other things)
the machines in question. The Committee felt it was beneficial to have some machines there
to provide entertainment and activity alternatives for the families and individuals who use the
Community Center, recommending acquisition of a pool table and foosball table.
Recommendation:
Staff and the YMCA Advisory Committee recommend acquisition of one pool table and the
foosball table from American Amusement Arcades for $1,200. Attached to the report is
Resolution 7378 to formalize the purchase utilizing funds from the Community Center
account.

intent to remove the machines along with the change dispensing machine; and,
WHEREAS, the owner indicates that the revenues collected from these machines
are not enough to justify keeping the machines at the Community Center; and,
WHEREAS, the owner provided the City with an option to buy any or all of the
machines by written correspondence in November of 2008; and,
WHEREAS, the YMCA Advisory Committee reviewed the options and assessed the
value of the machines to the overall function of the facility, finding that it would be
beneficial to retain one pool table and the foosball table; and,
WHEREAS, the City Council considered the relevant options at meetings on
November 24 and December 1, 2008, and directed staff to prepare a resolution to
formalize the acquisition consistent with the Committee’s recommendation.

Amendment to Add “Retail” as an Allowed Use at the Mermaid, 2200 36

Planner Heller provided an overview of the requested major subdivision and PUD amendment to 39
allow retail as an allowed use at the Mermaid. 40

Planner Heller indicated that Staff recommends a park dedication fee be applied to the 1.4 acre 42
with the difference between the 2000 and 2008 value being charged, because a park dedication 43
fee was paid on the entire site in 2000. 44

Barbara Haake of County Road I indicated that she would like to know how the parking will be 1
affected with the reduction in parking. She then said that she objects to the lowering of the 2
parking. 3

Ken Glidden of 5240 Edgewood Drive said that it is hard to tell what the benefits would be. He 5
then said that he would hope that there is fairness in treatment of these applicants as well as 6
conformance to the Code. 7

Sherry Gunn attended on behalf of the Planning Commission and noted that they reviewed this 9
proposal and parking was carefully considered by the Planning Commission, and determined that 10
the plan, as proposed, is adequate for parking. 11

Hearing no further comments, Mayor Marty closed the public hearing at 8:05 p.m. 13

Council Member Mueller asked where a drive through type of business would be located on the 15
plan. 16

Clerk Administrator Ericson indicated that this request is to create the parcel and, once created, 18
the developer would need to create a site plan for consideration of approval. 19

Council Member Flaherty commented that he does not believe parking is a big issue as he has not 21
seen the parking lot too full. The park and ride lot may need to be removed to accommodate 22
necessary parking. 23

Dan Hall pointed out that the hotel was designed for four floors and only was built as three. 25

Mayor Marty said that he goes past the Mermaid all the time and he has seen the parking lot 27
relatively empty and, at other times, there are quite a few cars parked there. However, there are 28
always parking stalls available. 29

Mayor Marty said that he has never seen the parking lot full and the types of development being 31
proposed to be brought in does not seem to be the type to create large amounts of traffic as there 32
is not the space for it. 33

Mayor Marty indicated that he is concerned about the Park and Ride lease and the ability to move 35
the cars around back, or the fact that the lease is year to year and can be eliminated if necessary, 36
and would like that listed in the resolution. 37

Mike Read said that at the candidates’ forum he understood that funding for the roads is still not 24
set and it may be necessary to go back to assessments. 25

place, so the City would need to hold off on levying until three years from now and the 10 year 28
period will run from now until 13 years from now. 29

Mayor Marty indicated that her son had notice and should have informed her and should be 8
responsible for paying the bill. 9

Clerk Administrator Ericson suggested that if she comes in by the end of the week to pay for the 11
fees, Council could waive the $35.00 fees as she may not have received notice from her son of 12

Mayor Marty agreed to waive the fees and offer a chance to pay the fees by 4:30 p.m. Friday, 15
October 17, 2008, and the rest of the council concurred. 16

H. Resolution 7333 Approving Lease Agreement Amendment #3 with 14
Verizon Wireless for the Installation of a Generator at the Water Tower 15
Site. 16

Clerk Administrator Ericson explained the requested lease amendment to install a generator to 18
serve their facility adjacent to the water tower. The generator has been installed but the gas line 19
has not. Clerk Administrator Ericson indicated that there is a letter from the attorney for Verizon 20
regarding the City’s request for compensation for use of City property. The letter indicates that 21
there are regulations for requiring a generator backup to allow communications to continue in an 22
emergency situation. Verizon is not willing to provide any compensation for use of City property 23
as they view this as a simple gas line running to a facility much like with a gas line to a 24
residential property. 25

Clerk Administrator Ericson clarified a previous statement made, in that the City Attorney agrees 27
that it would not be typical for a city to ask for compensation in this circumstance, however, it is 28
entirely reasonable to do so. 29

Council Member Stigney indicated that the FCC requires generator power and he feels that 35
Verizon should pay something for the use of City property to run a gas line and for restoration of 36
the easement area. 37

Tammy Bernard, representing Verizon, indicated that they can meet FCC requirements by using 39
battery backup, but the FCC prefers a gas line to the generator for longer term backup. 40

Council Member Stigney said that he feels that the City should be paid for the use of the right of 42
way. 43

Mayor Marty indicated that he agreed that there is nothing in that ground right now and Xcel 1
would be disturbing the site to install the gas line, and the City should be compensated for that. 2

Council Member Mueller said that she sees the Verizon service as a benefit to residents as the 7
City has seen that the phone lines are changing from landlines to cell phone use, and Verizon is a 8
large supplier of that service. She then said that she would not want to do anything to harm 9
resident’s service over some unknown expense to run a gas line through City property to allow 10
backup coverage in the event of a catastrophe. 11

Council Member Hull asked if Attorney Riggs gave any recommendation of what fee would be 13
reasonable. 14

Clerk Administrator Ericson indicated that he discussed with the City Attorney the need to 16
differentiate this situation because this is a lease situation where Verizon is leasing space from 17
the City as a for profit entity. The Attorney’s opinion is that since Verizon needs to increase the 18
amount of property they are leasing it is reasonable to require a fee. 19

Council Member Stigney indicated that there is an amendment to use a diesel generator for 21
backup and, this has nothing to do with public safety and everything to do with what is fair and 22
equitable for the use of the City’s property by a for profit entity. 23

Clerk Administrator Ericson indicated that the Streets Committee was asked to meet to discuss 11
Hillview Park with the Parks Commission and that meeting is set for October 20, 2008 at 6:00 12
p.m. He then asked whether the joint meeting could be held in the conference room to work 13
through issues with Hillview Park so that this joint meeting is on neutral ground rather than 14
having the Parks Commission sit out in the audience and the Streets Commission at the dais. 15

Council Member Stigney indicated that there is a Resolution that states that committee meetings 17
in this City will be broadcast. He then said that he is not concerned with how the chairs are set 18
up but would like to ensure that the meeting is broadcast. 19

Staff will set it up to be taped for replay. 21

Clerk Administrator Ericson indicated that the family fun day was well received by the 23
community. 24

Clerk Administrator Ericson indicated that Staff met with Rice Creek and they seem agreeable to 26
the plan to handle storm water to include excess capacity in other street projects to eliminate the 27
need to construct the spring creek pond. Boonestroo is working on the technical data for this 28
matter and the Board seemed pleased with the City for being proactive to address storm water 29
management issues. 30

Community Development Director Roberts reviewed his quarterly report with Council. 34

Mayor Marty thanked Director Roberts for his efforts to learn the City and to work with the staff 36
and Council as he has. He then thanked Ken and his department for all of their efforts on behalf 37
of residents, especially in the Code enforcement area. 38

Community Development Director Roberts indicated that Jeremiah Anderson will need 40
additional help. Council asked that this matter be added to a work session for discussion. 41

Mayor Marty indicated that there was a Council and Staff mini-retreat on September 29, 2008 43
and it went well, and was also attended by a number of residents. 44

Mayor Marty said that in the development agreement it states that the developer is responsible 17
for permits and 3.02 notes the developer agrees to pay City costs for this development. On Page 18
13 under Occupancy Permits states that the City will not issue occupancy permits until the 19
developer has installed all required landscaping. 20

Mayor Marty noted that the developer had agreed to certain plantings to screen the neighbors and 22
that is not in the Resolution or developer’s agreement. 23

programs and that is in direct competition with the Mounds View programs with the YMCA and 34
there is not enough attendance so some of the Mounds View youth sports activities have been 35

Mayor Marty indicated he received an invitation from Pinewood Elementary to attend the Annual 38
Fall Parade on October 31, 2008 at 11:15 a.m. Mayor Marty asked anyone that could to try and 39
attend the parade as it is fun. 40

Council Member Hull provided information to Council on a request from a resident for a sign 44
noting “autistic child area.” There is also a program that New Brighton has started that is a wrist 45

an autistic child or vulnerable adult. 2

Clerk Administrator Ericson noted that there was a joint meeting of the Parks Commission and 9
the Streets and Utilities Committee to discuss a way to ensure that future street projects do not 10
cause issues with the parks. The Parks Commission does not feel that any additional parking is 11
necessary and they are recommending that the City does not include it in the street project. 12

Council Member Mueller said that there was concern with barrier curbs that they would cause 14
traffic congestion. She then said that she would like to have the residents on Greenwood, 15
Hillview and Long Lake Road come to the work session to discuss this parking issue. 16

The Park Commission representative commented that residents that live on Hillview felt that 18
existing parking is adequate. The traffic issues are when the first teams are leaving and the next 19
teams are coming and that is about 30 nights per summer. 20

Clerk Administrator Ericson noted he attended the North Metro Mayor’s Association meeting 22
and received updates from other metro counties. 23

Clerk Administrator Ericson noted that the Chamber is interested in leasing out the office they 25
had previously leased, and they are exploring the option of picking up the second office space as 26
well. 27

Clerk Administrator Ericson said that he met with Springsted for three hours to discuss the HAY 29
points for the positions that the City has to arrive at an appropriate wage. He did note that the 30
salary being advertised for the public works salary is commensurate with other communities in 31
the study area. Staff plans to ask reauthorization to advertise for this position. 32

Clerk Administrator Ericson asked Council whether they would like to review the budget before 34
the truth-in-taxation hearing. Council concurred. 35

A. Public Meeting to Discuss Parking Issues at Hillview Park. 3

Clerk Administrator Ericson noted that this meeting was set to take public comment on parking 5
issues at Hillview Park. The Park and Recreation Commission has expressed concern with the 6
encroachment of parking into the park area. Staff notified 55 properties, the Streets and Utilities 7
Task Force, and the Park and Recreation Commission about the meeting. 8
9
Josie Warren of 8044 Greenwood Drive said that she has lived here since 1977 and she is in 10
favor of the proposal to provide additional parking for Hillview Park. She then said that the City 11
began upgrading park buildings including Hillview and, she questioned the cost of that building 12
and was told that it was needed to provide a neighborhood gathering space and promote park use. 13
Hillview Park does not have adequate parking for the new building. 14
15
Russ Warren of 8044 Greenwood Drive said that with the parking on Hillview. He is not that 16
concerned about the number but, if the park building is to be an attraction to residents, then the 17
parking is needed. He then said that he is more concerned about Greenwood because he drives 18
the street between 5:00 and 8:00 p.m. and he would like to consider indenting the parking that 19
would leave more space between the driver and the people walking. Mr. Warren indicated that 20
he does not feel that if this is done here, that it has to be done in other locations, however, it 21
would have to be looked at for other locations. 22

Valerie Amundsen, 3048 Bronson Drive said that she is on the Streets Committee and she did 24
read over the document that the Parks Commission submitted and wanted to comment. The 25
recommendation of the Streets Committee came because there was information submitted that 26
there was a parking need that was not being met. 27

Ms. Amundsen said that if the City decided to spend park funds on this facility then the parking 29
should be provided to support it. The Committee is trying to make sure that the nine years of 30
streets get done. She was the person who suggested using some of the park dedication funds 31
because there were funds that were to be used for the other trail and that was her thinking. 32

Gerald Arel of 7750 Greenwood Drive said that he is a Park Commission member and a member 34
of the baseball league who uses the park. The Park Commission had a number of reasons for its 35
recommendation against the proposed parking on Greenwood and Hillview. He then said that 36
safety is a number one concern. Mr. Arel said that he feels that this parking would have a cost to 37
the park in terms of safety and that is why they have recommended against it. 38

Mayor Marty said that he has coached since T-ball and Gerry does come out and tours the games 40
as they go on to see how things are going. He then said that the most active use of that park in 41
his opinion, is the baseball. 42

Sherry Gunn, 5459 Landmark Circle suggested moving the parking stalls away from the 1
playground if there is going to be angled parking. She then said that she is concerned about 2
angled parking and vehicle u-turns. 3

Jim Kavanaugh said that additional parking is needed so that people do not have to park in the 5
neighborhoods. There are no sidewalks and that forces people to walk in the street to get to the 6
park. His recommendation would be to approve the plan as recommended by the Streets and 7
Utilities Committee. 8

Cindy Palm of 2266 Terrace Drive said that there are a few homes near the park but she feels that 10
this could be solved by opening this up for parking on both sides of the street. She then said that 11
she does not think that this is cost effective or necessary when parking is available on the street 12
already if it is opened up to allow parking. 13

Jerry Kunz, Chair of Park Commission, said that the thing that got his attention is the price tag 15
for this. Changing from parallel to angled costs $71,000 and only gains the City 10 spots. He 16
then said that he feels this is not the best use of the City’s resources. 17
18
Council Member Mueller said she has never coached but she uses the parks. She then said that 19
there are usually 15 kids for one team so that is 30 kids, and 3 coaches so that is about 30 cars at 20
the park for that time and there are about 15 parallel parking spots along Hillview. Random Park 21
has its own parking lot, which is a good thing. She then said that she does not like the price but 22
she does know that the streets being put in will make it more difficult for parking to carry on as it 23
is because they will not be able to pull onto the boulevard with the barrier curb. 24

Council Member Mueller said that she feels that the parking as proposed is needed for the 26
future. 27

Council Member Flaherty further stated he feels that the funding comes out of streets and utilities 29
and not park dedication fees. He then said that he is concerned about the parking in that area but 30
how to accomplish it is the question. 31

Council Member Flaherty said that the bump out on Greenwood does not make sense to him as 33
you lose two spots. 34

Council Member Flaherty said that it concerns him that people would be turning around in 36
residence driveways to park on Hillview. He then suggested a parking lot next to the hockey rink 37
or removal of the hockey rink to add a parking lot. 38
39
Council Member Hull indicated that he is leaning toward Option 1 with keeping Greenwood as it 40
is as he feels that is the most cost efficient way to accommodate parking with the lowest cost. 41

Mayor Marty thanked everyone for their input. He then said that cutting 15 feet off of the area 43
behind the backstop would further congest the area where the spectators sit and the pitchers 44

warm up. He further said that he does not think that angled parking should be used there nor 1
does he feel that a bump out is necessary. 2

Mayor Marty said that he feels that Option 1 with angled parking on the east side of Hillview 4
with angled parking up near the park building seems to make the most sense. 5

Mayor Marty suggested allowing parking on both sides of the street from May through August 7
from 1:00 to 9:00 p.m. 8

Clerk Administrator Ericson said that he would research the reason the no parking was specified 10
and bring that information back to Council. He then suggested considering straight in stalls 11
rather than angled parking as that would allow for three more stalls. 12
13
Joe Rhein, city Engineer from Bonestroo, indicated that straight in parking requires six additional 14
feet of length. He then said that the Parks Supervisor has recommended Option 1. 15
16
Dale Aukee, of 2458 Sherwood Road, said that there would need to be some access on the west 17
side of Hillview building for flooding of the ice rink because with the barrier curb the vehicles 18
would not be able to drive over the curb. 19
20
Council Member Flaherty said that, if no one wants to discuss a parking lot, then his preferred 21
option would be Option 1. He then said that he wants to make sure that City Staff has access to 22
the park for whatever purpose so a curb cut of some sort will be needed. 23
24
Mayor Marty indicated that the cost of asphalt has more than tripled. He then said that less 25
asphalt is being created so there are asphalt shortage which means the price continues to go up. 26
That means that the street project costs may have doubled or more. 27
28
Council Member Stigney said that he would like to go with Option 1 for $28,700 whether there is 29
a bituminous or concrete sidewalk should be dependent upon pricing. On Greenwood he said 30
there should be no dollars spent for additional parking. 31

John Kroeger, 8280 Pleasant View Drive, said that in looking at the information, the costs for 33
parking spots is the same for both options and then asked what costs went into the $71,000 34
estimate. Joe Rhein indicated that the additional costs were for widening and bumping out the 35
street. 36

Mayor Marty asked whether there would be enough room for a parking lane. 38
39
A resident commented that the road would be narrow without the bump out on Greenwood. 40

Staff asked for direction on how to proceed with a Resolution for Council to consider. 42

Council Member Hull recommended Option 1 and asked Staff to prepare the information for 44
consideration. 45

Council Member Flaherty said that he does not want to give up two parking spaces so he does 2
not agree with the bump out. He then said that he would agree with Option 1. 3

Council Member Mueller said that she feels that Option 1 is a nice compromise and could agree 5
to it. She then said that she is pleased that the street project will not have to purchase property 6
for a pond. 7

Mayor Marty agreed to the no bump out on Greenwood and to consider Option 1. He then said 9
that he would like to consider parking on both sides of Hillview and asked Staff to provide 10
historical information as to why the no parking was instituted. 11
12
Jim Battin, Streets and Utility Committee Member, asked Council to consider that if parking is 13
allowed on Hillview, it is a major part of the pedestrian bike trail and taking out the biking trail 14
eliminates options for bike lanes on Hillview. 15
16
Council directed staff bring back a resolution amending Resolution 7307 to approve option 1 (15 17
stalls) on Hillview and no bump out on Greenwood Drive. 18
19
B. Resolution 7352, Considering Appeals for the Stormwater Infiltration 20
Program on the 2009-2010 Street and Utility Improvement Program. 21
22
Clerk Administrator Ericson provided an overview of the appeals for Council and noted that 23
Staff does not feel that the requests for appeal are justified and would recommend not allowing 24
the exemption. 25

Tom Winiecki of 2748 Sherwood Road said that the Council has decided against him again. He 27
then said that he does not want a ditch in front of his house that is 75 feet long. He further asked 28
why he is not allowed a vote in this matter. 29

Mayor Marty indicated that the Council was elected by the residents to vote on their behalf. 31
32
Council Member Flaherty explained that Mr. Winiecki had asked Council, by bringing in a 33
bucket of asphalt, to fix his street. He then said that a task force was created and there has been a 34
plan created and this is one of the details of the plan. 35

Evelyn Pomper’s daughter of 2600 Sherwood Road said that there was an offer to look at the 37
sideyard on Greenwood and they would like the city to explore that option. Evelyn said that she 38
is concerned about water in her basement if water is routed to her property for infiltration. 39

Joe Rhein explained that the City is required to treat water with infiltration ponds in order to 41
move forward with the street program. He then said that the forester did indicate that an 42
infiltration feature could be constructed with no detriment to the tree but there is room in the 43
sideyard to construct one as well. 44

Jim Kavanaugh, 7956 Red Oak, said that he has lived at his residence for 36 years and they are 1
scheduled for a water garden but they look forward to it. He then said that Rice Creek does 2
require that overall water needs to be handled, however, there is nothing that says it has to be in a 3
certain location. There are people in the area that would be willing to have a garden rather than 4
force it on those that do not want them. He then said that he feels it is poor public policy and bad 5
community relations to force a rain garden on them when there are people willing to have them 6
instead. 7

Bob Glazer, member of the Streets and Utilities Committee provided photographs to the Council 9
for review. He then said that he does not see how the rain gardens are going to work with barrier 10
curbs. 11

Joe Rhein indicated that moving one rain garden may require replacing it with two in another 13
location. The rain gardens, as proposed, are designed to handle the required stormwater for this 14
project. 15

Valerie Amundsen said that this is the first of nine street projects so this establishes the city 17
policy and practice going forward. She then said that if there is an appeals process available to 18
people she would want to make sure that each individual case is heard and considered. She then 19
said that this is a big deal to some people and she would hope that the City would take that into 20
account. 21

Mayor Marty said that he would like to try working with the property owners in this case to come 23
to agreement as best is possible. 24

Council Member Mueller asked how many swale areas were identified. Joe Rhein indicated that 26
there were 104 noticed. 27

Council Member Flaherty commented that he was pleased that Ms. Pomper said that she did not 29
like the rain garden in front and then asked if the City would consider using the sideyard because 30
that shows that she is willing to work with the City. 31

Council Member Hull asked whether the City would be liable for any water that fills a basement 33
after the swale is constructed. Joe Rhein explained that the swale is designed to hold 12 inches 34
of water and, if there is more than that, it backflows out to the street and flows down the street. 35

Clerk Administrator Ericson reviewed the improvement project for Lake Court Drive and Lake 4
Court Circle noting that the Association will agree to bring the streets up to City standards and 5
the City will accept the streets. 6

Council Member Flaherty said that he is concerned about the bid amounts and whether there 8
would be any issue with the City incurring additional costs. He then said that he would approve 9
of moving this forward but would like to wait on the street transfer agreement. 10
11
Council Member Stigney said that in the Petition it says that the Association would have to pay 12
$415,000 but the bids are not known at this time and that concerns him. 13
14
Council Member Stigney indicated that he is concerned and would like the Attorney to look into 15
this before anything is signed. 16

Council Member Mueller said that she is concerned about Rice Creek requiring swales with this 18
project because there is no public hearing on this project, because they have waived their right to 19
one. She would want to know about the process if she had a swale coming to her yard. 20

Staff amended the Resolution to note that the Council is receiving the petition and waiver 22
agreement and not an acceptance until the language is clarified. 23

Council Member Flaherty, asked about Brian Rock Products. Clerk Administrator Ericson 31
explained that this is an expenditure for gravel used on the trail in Greenfield Park. 32

Council Member Flaherty asked about Commercial Asphalt Company and asked whether there 34
was an increase. Clerk Administrator Ericson indicated that the cost has increased by 35
approximately 100%. The issue is that they are using more of the petroleum product and there is 36
less asphalt available leading to the price increase. 37

Council Member Flaherty asked about the fiber optic cable to North St. Paul. Clerk 39
Administrator Ericson confirmed that the work has been done. 40

Council Member Mueller asked whether the rough sawn cedar was for sign posts. Clerk 42
Administrator Ericson indicated he has asked and will report to Council when he receives an 43

Council Member Mueller indicated that there are two residents that have had serious injuries, and 21
there is a spaghetti fundraiser at Abiding Savior for Pastor Geddi There is also a student that was 22
injured in an accident, and there is a Caring Bridge website to view on progress. Any donations 23
to her medical expenses would be greatly appreciated and accepted at Irondale High School. 24

Clerk Administrator Ericson noted that 283 surveys have been received as part of the branding 28
process that is underway. 29

Clerk Administrator Ericson noted that there was not a lot of participation in the fall clean up day 31
and staff is looking at whether it is cost effective to have both spring and fall clean up days. 32

Clerk Administrator Ericson noted that there are openings on the City’s Commissions and 34
Committees and applications are being accepted until December 1, 2008. 35

Council Member Mueller asked whether there is an update on the Xcel Energy situation. 37

Clerk Administrator Ericson noted that there is no update as of yet. 39

Joe Rhein indicated that Ramsey County is okay with the traffic signal request of the City, but 41
requires a study and the cost estimate for the study is approximately $3,000. 42
