RESOLUTION 8735 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA ACCEPTING BIDS AND AWARDING CONTRACT TO NAC MECHANICAL AND ELECTRICAL FOR ROOF DRAIN REPAIR AT CITY HALL WHEREAS, Albertson Engineering prepared a scope of work to repair the existing roof drain lines and the Institute for Environmental Assessment has prepared a scope of work for mold remediation; and WHEREAS, the City Council approved staff to prepare bid documents and request quotes for repair of the roof drain and mold remediation on February 13, 2017 via Resolution 8711; and WHEREAS, Public Works staff prepared bid documents and solicited eight quotes from qualified mechanical contractors and NAC Mechanical and Electrical from Vadnais Heights, Minnesota submitted the lowest bid of $14,625.00; and WHEREAS, Public Works staff prepared bid documents and solicited five quotes from qualified mold remediation contractors and Trinity Environmental Specialists from Roseville, Minnesota submitted the lowest bid of $1,971.00; and WHEREAS, City staff recommends approving construction contracts with NAC Mechanical and Electrical to perform the roof drain piping and insulation replacement, and Trinity Environmental Services to perform mold remediation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View, Ramsey County, Minnesota as follows: 1. The bid proposal for $14,625.00 submitted by NAC Mechanical and Electrical from Vadnais Heights, Minnesota for roof drain insulation and piping repair (City Project No. 2016-M03) is hereby approved. 2. The bid proposal for $1,971.00 submitted by Trinity Environmental Specialists from Roseville, Minnesota for mold remediation (City Project No. 2016-M03) is hereby approved. 3. City Staff is authorized to prepare a construction contract agreement between the City of Mounds View and NAC Mechanical and Electrical for $14,625.00. 4. City Staff is authorized to prepare a contract between the City of Mounds View and Trinity Environmental Specialists for $1,971.00. 5. The Director of Public Works is authorized to make approvals related to additional work resulting from unknown conditions discovered during construction of the project up to a combined total of $1,660 (10% contingency) on behalf of the City Council. 6. The total project cost is not to exceed $18,256.00, which includes a contingency of $1,660.00. 7. The Mayor and City Administrator are hereby authorized and directed, for and on behalf of the City, to execute and enter into a construction contract agreement with NAC Mechanical and Electrical. 8. (Planning Case MU2017- 001) Introduction: MWF Properties is proposing to construct a 60-unit apartment building at the NW corner of Mounds View Blvd. & Groveland Rd. The project will require several planning approvals, including; (1) zoning map amendment, (2) conditional use permit for a multiple-family dwelling, (3) major subdivision to combine four lots into one lot, and (4) development review. The current applications are for a zoning map amendment (rezoning), and a conditional use permit (CUP). Public Hearings for both are scheduled for the May 8th City Council meeting. If approved, and if the developer obtains financial assistance, MWF’s intent is to apply at a later date for a major subdivision and development review. Analysis: The proposed project is located on four properties. Multiple-Family Dwellings are not permitted in the R-1 or B-3 districts, necessitating a rezoning to R-4, where they are conditionally permitted (CUP). ADDRESS EXISTING USE EXISTING COMP. The Ramsey County Auditor/Treasure has consented to the planning applications. Item 07A April 24, 2017 Page 2 The Comprehensive Plan Future Land Use Map1 guides the Mounds View Blvd corridor west of Fairchild Ave. for Mixed Use-Planned Unit Development (MU-PUD), including the four subject properties. The intent is for development to occur as a PUD for residential and commercial/office use, although, a “PUD” is not required. No amendment to the Comprehensive Plan is required nor proposed as part of this project. The minimum project size for a Mixed Use PUD is 4-acres, and 3-acres for Residential PUD’s 2. PUD’s allow for flexibility not otherwise permitted within the underlying zoning district (e.g. R-4 High Density Residential). The proposed project is consistent with the R-4 District, thus, the flexibility of a PUD is not necessary. The most recent PUD was for the Bel Rae assisted living facility (2010). Additionally, the properties are located within the County Road 10 Corridor Overlay District, which includes all properties within 200’ of Mounds View Blvd. (Co Rd 10). The Overlay District requires higher standards for building location, appearance, and landscaping. These regulations will be applicable during the Development Review process. The procedure for considering Zoning Map amendments are described in City Code, Section 1125.01, and include the consideration by the Planning Commission of “Adverse Effects”. Staff’s analysis is as follows (Findings): 1. Relationship to Municipal Comprehensive Plan. Findings: The Mounds View Comprehensive Plan, Figure 6 (Future Land Use Map) guides these properties for Mixed Use (MU- PUD). MU-PUD is defined as “Land containing a building or buildings with significant amounts of residential uses in combination with commercial and/or office uses. Sites with this designation should be developed as planned unit developments to provide flexibility to ensure that integrated efficient and well-planned development occurs. Examples include projects that could provide for a mix of residential and commercial uses within single or multiple structures.” The proposed Zoning Map amendment is consistent with the residential component of the Mixed Use designation. 2. The geographical area involved. Findings: The proposed Zoning Map amendment is in harmony with the adjacent southeasterly zoning district; R-4 High Density Residential. 3. Whether such use will tend to or actually depreciate the area in which it is proposed. 1 City of Mounds View Comprehensive Plan (2008), Figure 6: Future Land Use Map 2 City Code, Section 1120.03 (Special Requirements and Standards) Item 07A April 24, 2017 Page 3 Findings: Any depreciation or increase in area property values is speculative. It is expected that approval of this Zoning Map amendment will be followed by a development of a multiple- family dwelling, which will improve the properties from its current vacant status, thereby improving the vibrancy of the neighborhood. 4. The character of the surrounding area. Findings: The character of the surrounding area along Mounds View Blvd (County Road 10) includes a mixture of commercial, single-family detached homes, and single-family attached townhomes. The character of the surrounding area along Groveland Road includes single-family detached homes. 5. The demonstrated need for such use. Findings: The two parcels are currently zoned B-3; and R-1. The B-3 parcel was formerly occupied by a gas station (1972 - 2001). The R-1 parcel is landlocked and undevelopable as-is. Once re-zoned, the applicant’s intent is to develop a multiple-family dwelling on the subject properties and the adjacent southeasterly two properties. The need is demonstrated by the market demand for multiple family housing, and the lack of demand for allowable commercial uses on the B-3 zoned parcel. Planning Commission Recommendation: The Planning Commission considered the zoning map amendment on April 5, 2017, approving Resolution 1067-17, recommending approval of the amendment. Summary: MWF Properties is requesting to rezone two properties to R-4, High Density Residential. The CUP will be considered at the May 8th City Council meeting. The proposed apartment building will include 60-units of affordable workforce housing. MWF Properties will be requesting financial assistance from the Minnesota Housing Finance Agency (competitive grant) and from the City EDA (Housing TIF District). If financial assistance is obtained, MWF will then apply for a Major Subdivision to combine the four lots into one lot, and will apply for a Development Review for the project. The Development Review will include specific plans for the location and appearance of the facility. Item 07A April 24, 2017 Page 3 A Public Hearing is scheduled for May 8, 2017 to consider the second reading and adoption of Ordinance 934 (rezoning). Appendix A of the Mounds View Municipal Code entitled “Specific Rezonings” is hereby amended to include reference to the following Ordinance 934. Subdivision 1.The City of Mounds View Municipal Code, Section 1105.02 establishes a Zoning Map of Mounds View. Subdivision 2. The City of Mounds View Municipal Code, Section 1125.01, describes the procedure for considering an amendment to the Zoning Map, including the Planning Commission’s consideration of adverse effects. The Planning Commission’s findings are found in its Resolution 1067-17, and its recommendation of approval for the Zoning Map amendment. The City of Mounds View City Council agrees, finding that there would be no adverse effects to adjoining properties resulting from the Zoning Map amendment and that this amendment would not be detrimental to the community at large. Subdivision 3. At the April 5, 2017, Planning Commission meeting, the Commission amended its Bylaws, removing “Agenda Sessions”. Staff is requesting that the City Council amend the correlating language in the City Code so that the two documents are consistent. Discussion: There are four types of Planning Commission meetings; (1) Regular Meetings, (2) Special Meetings, (3) Emergency Meetings, and (4) Agenda Sessions. The intent of Agenda Sessions is to discuss non-actionable items. Historically, a regular meeting would be adjourned, and an agenda session convened to review meeting minutes and staff updates. The minutes would then be approved at the next regular meeting. Agenda Sessions were last held in 2013. The Planning Commission’s current practice is to discuss non-actionable items as part of its Regular Meeting. Recommendation: Staff recommends a first reading and introduction of Ordinance 933, amending City Code, Section 401.06, Subd 3, deleting “Agenda Sessions”. The City Council of the City of Mounds View hereby amends Chapter 401, Section 401.06, of the Mounds View Municipal Code by adding the underlined material and deleting the stricken material as follows: 401.06: ORGANIZATION; MEETINGS: Subd 3. Agenda Sessions: An Agenda Session is an informal session of the Planning Commission, typically held immediately following adjournment of a Regular or Special meeting, at which time the Planning Commission may review minutes, informally review proposed or pending planning cases or ordinance amendments, and to perform other matters not requiring a vote of the Commission. Subd. 4. 3. Special Meetings: Special meetings can be proposed during any regular meeting by any Commission member or at the request of the Director of Community Development, yet must be approved by a majority vote of the Commission. Emergency special meetings may be called via written notice to the Director of Community Development by the Chairperson or two (2) Commission members, or by the Director of Community Development. The Director of Community Development shall post and mail a notice of any special meeting in accordance with state statutes. Subd. 5. 4. Quorum: A majority of the appointed voting Commission members shall constitute a quorum. Subd. 6. 5. Voting Privileges: Each of the appointed members shall have equal voting privileges. The bylaws shall be reviewed on an annual basis at the first regular meeting in February. Subd. 8. 7. Records: A recording secretary, who may be recommended by the Planning and Zoning Commission for appointment, shall keep a record of attendance at Commission meetings and a record of resolutions, votes and abstentions on each question requiring a vote. The record of the Commission shall be a public record. SECTION 2. In accordance with Section 3.07 of the City Charter, City Staff shall have the following summary printed in the official City newspaper in lieu of the complete ordinance: On May 8, 2017, the Mounds View City Council adopted Ordinance 933 which amends Chapter 401 of the Mounds View City Code, deleting Planning Commission “Agenda Sessions” as a type of meeting. There are several requirements in the City Charter and State Statutes that need to be met. The calendar listed many staff work start and due dates. Items in bold type are City Council meetings or actions. Resolution 8748 only lists City Council meeting dates or other dates of significance to the City Council. Staff will publish a copy of the calendar in the Mounds View Matters and on our web site. Item No: 07D Meeting Date: April 24, 2017 Type of Business: Council Business City of Mounds View Staff Report To: Honorable Mayor and City Council From: James Ericson, City Administrator Item Title/Subject: Second Reading and Adoption of Ordinance 932, an Ordinance Amending Chapter 502 of the Mounds View City Code Relating to Hours of Operation for Off-Sale Licensed Establishments—ROLL CALL VOTE Introduction: The Governor has signed into law legislation allowing off-sale liquor sales on Sundays, beginning effectively July 2, 2017. The Council has discussed changing the Code to allow for Sunday sales and expanded sales Mondays through Thursdays. The Council asked staff to invite the three off-sale licensees to provide input or attend the April work session. Discussion: Staff reached out to the three off-sale licensees and invited all three to attend the April 3, 2017, work session. Only Merwin Liquors, represented by Stuart Tapper, attended the meeting. Greg Waste from Vino & Stogies indicated that they’d probably be unable to attend but were not opposed to the proposed changes. Mr. Tapper indicated that the proposed changes would be beneficial to MN liquor stores as many Minnesota residents drive over the border into other states on Sundays. Concerning the expansion of hours to 10:00 pm Mondays through Thursdays, Mr. Tapper indicated this would be a benefit to Mounds View stores as well as a convenience to Mounds View residents, who are forced to drive to Fridley, Spring Lake Park or Blaine to purchase alcohol after 8 pm on those days. It was noted that the expanded hours and ability to sell on Sundays were permissive, not mandatory. A liquor store may open later or close earlier than what is allowed in Code. Recommendation: Staff recommends the City Council approve the second reading and adoption of Ordinance 932, an ordinance amending Section 502.12 of the Mounds View City Code to allow off- sale licensees to stay open until 10 pm Mondays through Thursdays and to be open from 11 am to 6 pm on Sundays. General Restrictions: No sale of intoxicating liquor for consumption on the licensed premises shall be made between the hours of two o’clock (2:00) A.M. and eight o’clock (8:00) A.M. on the days of Monday through Saturday. Additionally, as part of this project, mold remediation quotes were solicited and received. Discussion: On February 13, 2017, the City Council approved resolution 8711 to prepare bid packages, and solicit quotes for repair work. Public works staff prepared bid packages utilizing the scopes of work prepared by Albertson Engineering for the roof drain repairs and Environmental Assessment, Inc. for the mold remediation. The for the roof drain repairs eight (8) quotes from qualified mechanical contractors were solicited, and five (5) quotes were solicited from qualified mold remediation contractors. Quotes were received from three (3) mechanical contractors and four (4) mold remediation contractors. If awarded, NAC Mechanical and Electrical will begin scheduling the roof drain and insulation replacement in conjunction with mold remediation services performed by Trinity Environmental Specialists in order to limit disruption to work in the Engineering office, which will likely be late April/early May. The contract documents require that the work be substantially complete by May 26, 2017, with final completion on or before June 16, 2017. Because of the cost of the repairs and the fact that there is sufficient funding in the Special Project Fund, the funding for this project will come from the Special Project Fund 480-4180-7050. This has been discussed with the Finance Director and has his concurrence. The parking lots at City Hall and the Community Center were fog sealed in October 2014. Due to the current condition of the pavement in these parking lots (potholes, cracking, general deterioration, etc.) it is recommended that both parking lots be milled and overlaid with a new bituminous wear course. Parking lot restriping is also included in the bidding documents. In addition to this work, several sidewalk panels at the Community Center and sections of concrete curb and gutter will also be removed and replaced due to excessive cracking. Discussion: The Engineering Division of Public Works has prepared plans and specifications (bid documents) in- house for use in obtaining public bids for parking lot mill and overlay. A public bid is required since the estimated construction cost exceeds $100,000. The 2017 budget includes funding of $150,000 to perform the proposed work in the Street Improvement Fund (485-4470-7050). Staff recommended the Council hold a public hearing and approve the 5 bee keeping license. 6 7 Mayor Mueller opened the public hearing at 7:04 p.m. 8 9 Brentley Zaier, 2090 Oakwood Drive, expressed concern with his neighbors having honeybees. 10 He feared he would be negatively impacted in his backyard by the bees while grilling. 11 12 Susie Jacobs, 2091 Pinewood Drive, did not oppose her neighbor having honeybees. She 13 requested that Mr. Retterath be properly trained to manage the bees to ensure they do not swarm. 14 15 Assistant City Administrator Crane reported the applicant had successfully completed a bee 16 keeping course through the University of Minnesota. Mayor Mueller explained proper training 17 and certification was a requirement for all bee keepers in the City of Mounds View. 18 19 Adam Retterath, 2071 Terrace Drive, introduced himself to the Council and described the 20 training he attended at the University of Minnesota. He stated he would be attending several 21 additional courses to improve his knowledge of beekeeping. He explained his grandfather would 22 be assisting him with the bees. He commented the smoke from neighboring grills would assist in 23 keeping the bees more docile. Resolution 8744, Dissolving the Fridley Training JPA. 9 10 Council Member Meehlhause requested information from the Fire Chief regarding this item. 11 City Administrator Ericson reported in 1991 the cities of Brooklyn Center, Fridley, Blaine, 12 Spring Lake Park and Mounds View entered into a JPA for training services and a training 13 facility was constructed in the City of Fridley. He explained that with the new Fridley City Hall 14 this area was no longer available for collaborative use. For this reason, staff recommended the 15 Council dissolve the Fridley Training JPA. 16 17 Fire Chief Smith noted Spring Lake Park and Fridley had already approved the dissolution of the 18 JPA. 19 20 Council Member Meehlhause questioned if the fire department used this space frequently. Fire 21 Chief Smith reported this space was used monthly or bi-monthly by the SBM Fire Department. 22 He stated he was working to locate new space for training. 23 24 Mayor Mueller understood the SBM Fire Department offered high quality training for its fire 25 fighters. She asked if this training program would continue. Fire Chief Smith indicated the same 26 high level of training would continue for all SBM firefighters. Reports of Mayor and Council. 39 40 Council Member Gunn stated she attended the Cable Commission meeting and noted the group 41 was still working on an agreement with Comcast. 42 43 Council Member Gunn reported the Irondale Robotics Team would be heading to St. Louis for 44 Nationals. 45 Mounds View City Council April 10, 2017 Regular Meeting Page 8 1 Council Member Gunn stated last Saturday the Irondale drumline won their second consecutive 2 state championship receiving the highest overall score at this event. She indicated the drumline 3 was now preparing for the world championship with a free send-off performance this Saturday, 4 April 15th at 7:00 p.m. at Irondale High School. She explained this group would enter the world 5 competition rated second in the country in their class. 6 7 Council Member Meehlhause thanked Public Works Director Erickson for inviting the City 8 Council to participate in the ground breaking ceremony for the new Public Works Facility last 9 Friday. 10 11 Council Member Meehlhause noted he would be attending two NYFS meetings this week. 12 13 Mayor Mueller invited the public to attend the next Festival in the Park Committee meeting on 14 Tuesday, April 18th at 7:00 p.m. at City Hall. She explained this group was still seeking 15 volunteers to assist with planning this year’s event. 16 17 Mayor Mueller encouraged residents to consider participating in the Mounds View 60th 18 Anniversary Celebration. More information regarding this committee could be gained by 19 contacting City Hall. 20 21 Mayor Mueller noted she would be attending the Minnesota Mayors Conference at the end of 22 April in Brainerd, Minnesota. 23 24 Mayor Mueller indicated four out of the five Council Members would be attending the League of 25 Minnesota Cities Annual Conference June 14th through June 16th in Rochester, Minnesota. 26 27 B. Reports of Staff. 28 29 Public Works Director Erickson indicated the spring road restrictions would be lifted at midnight 30 on Thursday, April 13th. 31 32 Public Works Director Erickson stated work on Area I would begin shortly after the road 33 restrictions were lifted. He reported that notices were sent to residents and explained that 34 mailboxes would be relocated. 35 36 Public Works Director Erickson provided the Council with an update on the County Road H and 37 I-35W project. 38 39 Public Works Director Erickson thanked the Councilmembers for attending the groundbreaking 40 ceremony last Friday for the new Public Works Facility. 41 42 City Administrator Ericson discussed the recent alarm event that occurred in Dallas, Texas.
