STATE OF MINNESOTA
ACCEPTING BIDS AND AWARDING CONTRACT FOR CITY HALL AND COMMUNITY
CENTER PARKING LOTS MILL AND OVERLAY PROJECT
WHEREAS, Public Works has prepared bidding documents in-house for public bidding to
mill and overlay the City Hall and Community Center parking lots; and,
WHEREAS, City Council approved the plans, and specification and authorized the
advertisement for bids on April 24, 2017 (Resolution 8750); and,
WHEREAS, seven bids were received and publicly opened on June 6, 2017; and,
WHEREAS, the actual bid tabulation is:

WHEREAS, Bituminous Roadways, Inc. of Mendota Heights, Minnesota submitted the
lowest bid of $106,880.25; and
WHEREAS, Public Works staff recommends approving a construction contract with
Bituminous Roadways, Inc. to perform the parking lots mill and overlay project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View,
Ramsey County, Minnesota as follows:
1. The bid proposal for $106,880.25 submitted by Bituminous Roadways, Inc. of Mendota
Heights, Minnesota for the City Hall and Community Center Parking Lots Mill and Overlay
Project (City Project No. 2017-C09) is hereby accepted.
2. City staff is hereby directed to prepare a construction contract agreement between the City of
Mounds View and Bituminous Roadways, Inc. for $106,880.25
3. The Director of Public Works is authorized to make approvals related to quantity over-runs
or additional work resulting from unknown conditions discovered during construction sewer
rehabilitation up to a combined total of $10,700 (10% contingency) on behalf of the City
Council.
4. The Mayor and City Administrator are hereby authorized and directed, for and on behalf of
the City, to execute and enter into a construction contract agreement with Bituminous
Roadways, Inc. for said project for said price.
5. Funding for the project shall be from the street improvement fund (485-4700-7050) in an
amount not to exceed $117,580.25, which includes the 10% contingency noted above.

Police Chief Harder introduced newly hired Police Officer Sarah David to the City Council. He 1
then administered the Oath of Office to Officer David. A round of applause was offered by all in 2
attendance. 3

Mayor Mueller welcomed Officer David to the City of Mounds View. Officer David thanked her 5
training officers and the City Council for the warm welcome. 6

9. COUNCIL BUSINESS 8
A. Resolution 8758, Approving the Hire of Sidney Dison as Police Officer in the 9
Mounds View Police Department. 10

Assistant City Administrator Crane requested the Council approve the hire of Sidney Dison as 12
Police Officer for the Mounds View Police Department. She explained the Police Civil Service 13
Commission had created an eligibility list for this position and staff recommended the hire of the 14
top candidate, Sidney Dison. 15

Sidney Dison reported she was originally from Rochester, Minnesota. She indicated she 17
participated in the Explorers Program which led her to a career in law enforcement. She 18
explained she has a four-year degree from Minnesota State where she graduated with honors. 19
She stated she looked forward to working in the Mounds View community. 20

B. 6:00 p.m. Public Hearing: Resolution 8756, Adopting a Five Year Financial 28
Plan for 2018 through 2022. 29

Finance Director Beer stated City Charter requires the Council to adopt a five-year financial plan 31
on an annual basis. He explained the five-year plan was used by the Council as a blueprint for 32
the future and was not set in stone. He reviewed the five-year financial plan for years 2018 33
through 2022 in detail, along with the City’s respective fund balances and requested the Council 34
adopt the plan. It was noted Xcel Energy would be changing over the City’s lights to LED’s in 35
the coming years. 36

Council Member Meehlhause commented on the City’s fund balance policy and the General 38
Fund budget. He discussed how the Council was being impacted by the current levy cap and 39
believed this item needed to be addressed. 40

Mayor Mueller asked if the Ford Interceptors would be changed out for SUV’s. Finance Director 42
Beer explained this determination would be made by the Chief of Police. 43

Mayor Mueller requested further information on the City’s pond dredging schedule for Silver 45

View Pond. Finance Director Beer reviewed the City’s proposed plan and noted this pond would 1
be dredged when 50% full of sediment. He estimated this would occur sometime after 2020. 2

Council Member Meehlhause asked if the proposed bonds would be paid back through increased 4
utility rates. Finance Director Beer reported this was the case and noted the City would be 5
bonding for 10 years. 6

C. Resolution 8755, Accepting Bids and Awarding Contract for 2017 Sewer 13
Rehabilitation Project. 14

Public Works Director Erickson requested the Council accept bids and award a contract for the 16
2017 Sewer Rehabilitation Project, with a 10% contingency. He explained this project was 17
completed in house and was advertised per State Statute. It was noted this project was included 18
in the 2017 budget. Staff reported bids were submitted for this project and the low bid was 19
received by Insituform out of White Bear Lake. 20

Council Member Meehlhause asked where the sewer rehabilitation project would take place this 22
year. Public Works Director Erickson provided a brief description on the areas of the City that 23
would be worked on. 24

D. Resolution 8759, MWF Properties Purchase Option Agreement of Tax 35
Forfeited Parcels. 36

City Administrator Ericson requested the Council approve a Purchase Option Agreement for tax 38
forfeited parcels with MWF Properties. He explained MWF Properties was proposing to 39
construct a 60-unit workforce apartment complex with housing tax credits located on Mounds 40
View Boulevard and Groveland Road. It was noted two of the parcels within the project area 41
were tax forfeited. He described how the City, County and developer were working together on 42
this project. Staff provided the Council with the most recent document for their consideration 43
and explained the EDA had adopted a Resolution approving the Purchase Option Agreement. 44

Council Member Meehlhause asked if MWF does not commit to purchasing these properties by 1
July 30th, then the County would be sticking hard to the six-month timeline. City Administrator 2
Ericson reported this was the case and noted the July 30th date was critical. 3

Chris Stokka, MWF Properties, understood he would run the risk of the land going back to a 5
public auction after July 30th. However, he understood the next public auction was not scheduled 6
until November. City Attorney Riggs commented on the timing risks within the development 7
and stated the City would continue to work to keep this project moving forward. 8

Council Member Meehlhause questioned if the only real risk to the City would be the project 10
would not happen. City Attorney Riggs advised this was the case, along with the loss of staff 11
time. 12

MWF Properties Purchase Option Agreement of Tax Forfeited Parcels as revised. 15

Mayor Mueller reiterated that this was one of the many steps that would have to be taken in order 17
to construct workforce housing along Mounds View Boulevard and Groveland Road. 18

E. Resolution 8757, Approving an Adjusted Salary Scale and the Advertisement 22
for the Housing/Code Enforcement Inspector Position. 23

City Administrator Ericson requested the Council approve an adjusted salary scale and the 25
advertisement for the Housing/Code Enforcement Inspection position. He explained staff would 26
like to fill this position which has been vacant since last August. He reported a salary study was 27
conducted by Springsted for this position in order for the City to determine a proper wage. Staff 28
reviewed the Resolution with the Council noting the wage rate had been adjusted and 29
recommended approval of the advertisement of the position. 30

Mayor Mueller thanked City Administrator Ericson for stepping in and finding assistance for this 32
position. He questioned when this position would be posted. City Administrator Ericson 33
reported the position would be posted on the League of Minnesota Cities and the City website 34
tomorrow, and would be in the newspaper on Sunday. 35

Council Member Bergeron commented on the Council’s goal to retain staff. It was his hope the 41
City would be able to hire and retain a good person for this position. 42

1. Resolution to Consider an On-Sale Intoxicating Liquor License Renewal 2
for Moe’s located at 2400 Mounds View Boulevard (this item will be 3
continued to the next City Council Meeting) 4

Assistant City Administrator Crane stated all liquor license renewals require approval by Public 6
Hearing. She explained Moe’s has an on-sale liquor license with the City that will expire on 7
June 30, 2017. She reported all liquor license materials were due to the City on Monday, May 8
15th. Staff did not receive any information from Moe’s. She noted for the record that the 9
property owner had outstanding property taxes. For these reasons, staff recommended the Public 10
Hearing be opened and continued to the Monday, June 12, 2017, City Council meeting. 11

Finance Director Beer explained the property owner had paid his outstanding delinquent utility 13
bill and noted he would have one other bill to pay prior to the June 12th meeting. 14

Council Member Meehlhause clarified that the liquor license holder would have to work with the 16
property owner in order to get the property taxes paid prior to the June 12th meeting. Assistant 17
City Administrator Crane reported this was the case. 18

Council Member Bergeron questioned the City’s next step in this process if the information were 25
not provided to the City in a timely manner before June 12th. Assistant City Administrator Crane 26
reported the matter would have to be continued to June 26th, which may mean Moe’s liquor 27
license will lapse. 28

Code for their On-Sale Intoxicating Liquor license. Staff recommended the Council hold a 37
Public Hearing and approve an On-Sale liquor license for The Mermaid. 38

Assistant City Administrator Crane stated all liquor license renewals require approval by Public 13
Hearing. She explained ABC Liquor has an off-sale liquor license with the City that will expire 14
on June 30, 2017. She reported all liquor license materials were due to the City on Monday, May 15
15th. Staff did not receive any information from ABC Liquor and advised the Council this 16
establishment was under new ownership. She was confident ABC Liquor would have their 17
paperwork into the City by June 12th. For these reasons, staff recommended the Public Hearing 18
be opened and continued to the Monday, June 12, 2017 City Council meeting. 19

Assistant City Administrator Crane reported Merwin Liquors has met all requirements under City 32
Code for their Off-Sale Intoxicating Liquor license, except their compliance check. She stated 33
unfortunately, Merwin Liquors had an employee that sold to a minor. This employee was 34
terminated immediately and all other employees had received additional training. Staff 35
recommended the Council hold a Public Hearing and approve an Off-Sale liquor license for 36
Merwin Liquors. 37

Council Member Meehlhause questioned when the violation occurred. Assistant City 39
Administrator Crane reported the violation occurred during a Mounds View Police Department 40
sponsored compliance check. She commented further on the City’s liquor license revocation or 41
suspension process. 42

Assistant City Administrator Crane reported SuperAmerica has met all requirements under City 31
Code for their Off-Sale 3.2 Malt Liquor license. Staff recommended the Council hold a Public 32
Hearing and approve an Off-Sale 3.2 Malt liquor license for SuperAmerica. 33

Mayor Mueller requested staff amend the first paragraph of the staff report noting the reference 35
to 3.5 malt liquor should be changed to 3.2. 36

Council Member Gunn reported on Thursday, May 18th she and Council Member Meehlhause 6
attended the Law Enforcement Memorial Service in New Brighton. She stated this was a very 7
moving service and was pleased to report the City of Mounds View would be hosting this event 8
in 2019. 9

Council Member Meehlhause agreed this was a great event. He stated he attended a Twin Cities 11
Gateway Board meeting last week where the group discussed hotel taxes being down in the first 12
quarter of 2017 when compared to 2016. It was noted Mounds View hotel taxes were down 8% 13
this year. He commented on how this decrease could impact Twin Cities Gateway’s donation to 14
the City for Festival in the Park. 15

Council Member Meehlhause stated he would be attending the NSCC. meeting on Thursday, 17
June 1st. He indicated he would be attending a YMCA Advisory Committee meeting on 18
Monday, June 5th. He then reviewed the NYFS meetings he would be attending in early June on 19
behalf of the City. 20

Mayor Mueller reported the Festival in the Park Committee would be meeting next on Tuesday, 22
June 20th at 7:00 p.m. at City Hall. She stated this group was still seeking volunteers to assist 23
with this year’s event. She explained volunteers were also needed for the 60th Anniversary 24
Celebration be planned for the City of Mounds View. Those interested in volunteering their time 25
were encouraged to contact City Hall for further information. 26

Mayor Mueller stated on Friday, June 2nd the Minnesota Women in Government would be 28
meeting to review the nominations for Outstanding Women in Elected City Government. She 29
reported these awards would be presented at the League of Minnesota Cities Conference in 30
Rochester, Minnesota. She was pleased that Mounds View would be sending five 31
representatives from the City to this event. 32

Mayor Mueller indicated the Ramsey County League of Local Government would be meeting 34
next on Thursday, May 25th at 7:00 p.m. in Maplewood. 35

Mayor Mueller explained the Five Cities mayor’s group met last Monday in Roseville where the 37
group discussed issues facing each community. 38

Mayor Mueller encouraged the public to get on the mailing list for the Sun Focus, in order to 40
keep receiving City’s official newspaper. 41

Mayor Mueller stated Thursday, May 25th was Red Nose Day, which was a great way for the 43
community to give back to children in need. 44

Finance Director Beer reviewed the Finance Department’s quarterly report and interim financial 7
statements with the Council. He commented on the financials and it was noted the first quarter 8

Public Works Director Erickson updated the Council on the projects occurring in the City. He 11
explained he recently met with officials from the Rice Creek Watershed District to discuss the 12
Anoka/Ramsey County judicial ditch. He indicated he had received several calls regarding 13
infiltration basins and reported staff would be following up on these water table concerns. 14

Council Member Gunn asked if sump pump hoses could drain directly into the street. Public 16
Works Director Erickson stated he has not gone around and stopped residents from doing this 17
because of the high level of the ground water. He encouraged residents to discharge their sump 18
pump into their yards. 19

City Administrator Ericson stated he attended the North Metro Mayor’s meeting with Mayor 21
Mueller last week and where crisis management was the topic. The importance of public 22
notification was discussed. He noted former Mayor of Blaine and MnDOT Commissioner Elwyn 23

City Administrator Ericson reported he attended a Charter Commission meeting last week where 26
seat vacancies and special elections were addressed. 27

City Administrator Ericson commented on the scheduled July 3rd City Council worksession 29
meeting and suggested this meeting be rescheduled due to the 4th of July holiday. He 30
recommended the July worksession meeting be held on Monday, July 17th. He explained the 31
Charter Commission would be invited to attend this meeting. The Council supported this 32

Introduction
Since 2009, the City of Mounds View has been a member of the Twin Cities Gateway. One of
the Twin Cities Gateway’s programs is the “Member City Marketing Grant.” Beginning in 2011,
the program was structured so that each member city receives an annual grant based on the
percentage of lodging taxes collected from the prior year. Below is the breakdown of annual grant
fund allocations for the City of Mounds View from Twin Cities Gateway:

Discussion
As part of accepting the 2017 grant funds, the City Council is required to enter into the attached
agreement. Upon accepting the grant, the City must disperse the funds to community festival(s),
and/or event(s) the City Council wants to support. Last year, the Mound View City Council chose
to provide grant funds towards the Festival in the Park ($7,172) and towards website restructuring
to market and promote program and events at the Mounds View Community Center ($1,500).
During the June Work Session, the City Council consensus was to split the funds between the
Mounds View Community Center Banquet Center in the amount of $1,000, and have the rest of
the funds allocated to the Festival in the Park Committee in the amount $6,964. Staff contacted
the president and the treasurer of the Festival in the Park committee. The committee revised their
budgets to reflect $6,964. The Banquet Center will use the funds towards marketing and
promotion of their facility.

community festival(s) and/or events that the City wants to support; and

extend beyond the City’s borders in order to draw tourists to the community,

As part of the City of Mounds View’s Municipal Separate Storm Sewer System (MS4)
permit, there is a requirement for an annual public information meeting discussion
stormwater.
Discussion:
The City of Mounds View holds a MS4 permit issued by the Minnesota Pollution Control
Agency (MPCA) and is charged with meeting a number of requirements. One of those
requirements is an annual Stormwater Public Information Meeting. As part of this meeting
Public Works will present an update of the actions completed for 2016 as well as initiatives
for the future. In addition, staff has invited members of the Rice Creek Watershed District
to be part of this meeting as well. As of the date of this writing their attendance has not
been confirmed.

the Notice of Public Hearing was published in the City’s official newspaper. Property taxes
are current on this property.
ABC Liquor has submitted their city liquor license application materials and the applicable
fees. The following investigations and inspections have been conducted to determine
whether there is cause for the City to deny the above referenced intoxicating liquor license

2016. This license will expire on June 30, 2017.
The notice of this public hearing was sent out to residences within a 350 feet radius, and the Notice of Public
Hearing was published in the City’s official newspaper. This public hearing was originally scheduled on May
23, 2017. The public hearing was continued to this meeting because Moe’s had not submitted their city
liquor license application materials and the applicable fees by the deadline.
Discussion:
The following investigations and inspections have been conducted to determine whether there is cause for
the City to deny the application:
Police Inquiry and Investigations (Mounds View Police Department)
Staff has submitted a criminal background check to the Minnesota Bureau of Criminal Apprehension, and
has not received the criminal background check. This liquor license renewal will be contingent on a
satisfactory background check. Moe’s passed their liquor compliance check.
Utility Billing Inquiry (City of Mounds View)
Finance Department has issued an unsatisfactory report due to the non-payment of the delinquent utility bill
of $1,723.72. Moe’s is up to date on payment of their property taxes. It has come to Staff’s attention on
Friday, June 9, 2017, that Moe’s was delinquent in payment of their liquor sales taxes to the Minnesota
Department of Revenue. At 2:30 p.m., on Monday, June 12, 2017, Mr. Jeff Moritko (manager of Moe’s) paid
the outstanding utility bill (by check), and also paid the delinquent liquor sales taxes to the Minnesota
Department of Revenue (by wire transfer).

Staff recommends closing the public hearing. If the delinquent utility bill is not paid in full before the start of

subd 2a, if the City’s Utility Bill and State liquor sales taxes are not paid. However, if the City Council wishes

building located at 4821 Mustang Cir., (2) a Conditional Use Permit for the Storage of
Flammable Liquids Over 800 Gallons Above Ground, and (3) a Conditional Use Permit
for Automobile Assembly and/or Major Repair, within the I-1 Industrial District.
The applicant’s construction schedule is to complete the 4821 Mustang Cir building
addition by August. Prior to a building permit being issued, approval of a Development
Review is required. In order to accommodate this schedule, the Development Review
is being brought to the City Council prior to the Conditional Use Permit public hearing(s)

The existing building at 4825 Mustang Cir. will continue its use as a motor freight
terminal (warehouse) and offices, including use by Parts Midwest, also a subsidiary of
SCIPI. Additional building space will be leased to related businesses.
Analysis
A Development Review is required for construction activity that increases the size of a
principal building by 10% or more, or by more than 10,000 sq ft.2 The applicant
proposes to expand the building at 4821 Mustang Cir. by 148% (6,380 sq ft), from
4,325 sq ft to 10,705 sq ft.
A Development Review is a review of compliance with the following requirements:
Utility Service:
Separate utility services (sewer & water) are existing for 4821 and 4825 Mustang Cir.
Surface Water Drainage:
The grading plan has been reviewed by Public Works. The total area to be disturbed is
less than 10,000 sq ft, and will not require a permit from RCWD.
Much of the current surface water drains into three existing catch basins located near
the rear fence line of 4821 and 4825 Mustang Cir, draining into a storm water basin,
and into the adjacent wetland.
Erosion and Sediment Control:

fluctuate.
Shared parking between more than one use is permitted if within 300’ of the applicable
building. Twenty-two parking spaces located on the 4825 Mustang Cir properties will be
shared with 4821 Mustang Cir. Of these 22 spaces, 9 will be dedicated for bus
parking. A legal document, acceptable to the City Attorney is required for shared
parking.
Landscaping:
Required landscaping is calculated using the lot perimeter5 (approximately 2,050 linear
feet). Because the majority of the lot for 4821 Mustang Cir is wetland, Staff
recommends that only the developable area of the lot be used (approximately 936

Staff visited the site again after the Planning Commission meeting (refer to Site Photo).
The existing trees and chain-link fence along the north property line of 4825 Mustang
Cir does not adequately screen the shared parking areas from the adjacent mobile
home park. 6
Regarding screening, the Resolution includes a requirement for additional screening
consisting of 8’ tall pine trees or a 6’ tall solid fence, to be determined by the applicant.
Regarding landscaping, Staff’s recommendation is to require the landscaping as shown
on the Site Plan.
The Planning Commission discussed whether the landscaping is necessary, being that
the area is industrial.
It is Staff’s interpretation of the City Code that the intent of these requirements is to
beautify the property no matter its use. The City Code allows for a 15% reduction of
landscaping because the property is zoned I-1. Additionally, Staff is supportive of a
further reduction (46%) due to the extensive wetland on the property. The remainder
are the trees and shrubs as shown in the table on page 3 (5 pine trees, 4 ornamental
trees, and 27 shrubs).
A landscape escrow or letter of credit equal to 150% of the cost of materials and labor
(or $10,000, whichever is less) is recommended as a condition of the Development
Review. The escrow/letter of credit may be released one-year after the certificate of
occupancy is issued, and upon inspection of the landscaping.
A 4’ tall wrought-iron fence will be installed within the front yard. During the June 7th
Planning Commission meeting, the applicant expressed an interest in applying for a
Variance to the front yard fence height. If applied for, this will be addressed by the
Planning Commission at a later date.
Screening & Buffering:
Non-residential parking lots consisting of 5 or more spaces are required to be screened
from view from residential uses 7. Towns Edge Mobile Home Park is adjacent to 4825
Mustang Cir. and is partially screened by existing trees along the common property line.
The City Code requires that such screening consist of pine trees not less than 8’ in
height, berming, or a solid fence at least 6’ in height.

landscaping near the proposed building expansion at 4821 Mustang Cir.
Recommendation
Staff recommends approval of Resolution 8765, approving a Development Review for
property located at 4821 Mustang Cir.
Resolution 8765 also requires the removal of barbed wire from the existing chain-link
fence (not discussed during June 7th Planning Commission meeting). Barbed wire is
not permitted in Mounds View unless for facilities providing essential services or
governmental services. Barbed wire fencing is common on properties in this area, and
may predate this section of the City Code.

The City Council is requested to consider the following options:
1. Resolution 8765, approval of a Development Review.
2. The City Council may choose to deny the Resolution. If the Council chooses this option,
Staff would need to be directed to draft a resolution of denial with findings of fact
appropriate to support the denial.
3. Table the request. If additional information is needed before a decision can be rendered
or if more discussion is needed, the Council can simply move to table the request until
such information has been provided. Because of the 60-day requirements (Deadline:
July, 25, 2017) the Council would need to act upon the request as soon as reasonably
possible to avoid an inadvertent approval.

WHEREAS, the City of Mounds Municipal Code, Section 1006.06 (Development
Controls) requires a Development Review of non-residential construction activity that increases
the gross square footage of the principal building by more than ten percent (10%), or more than
10,000 sq ft.; and,
WHEREAS, St. Cloud Industrial Products, Inc., owner of North Central Bus and

NOW, THEREFORE, BE IT RESOLVED, based upon the above findings, the
information and documents regarding the proposed Development Review, the Planning
Commission recommendation, the Staff Report, and testimony of the applicant, and in
consideration of public testimony, the City Council does hereby approve the Development
Review request by St. Cloud Industrial Products, Inc., with the following conditions:
1. Development of the site shall be consistent with the Site Plan date stamped May 30,
2017, with the addition of screening the shared parking area on 4825 Mustang Cir. from
the adjacent Towns Edge Mobile Home Park. This screening shall be located between
the northeast property corner of 4825 Mustang Cir, and the building on the same lot,

option 2: a solid fence, not less than 6’ in height. The applicant may choose either option.
2. The applicant shall submit a legal document acceptable to the City Attorney, allowing
shared parking of a minimum of 14 stalls on 4825 Mustang Cir., for the benefit of 4821
Mustang Cir., and within 300’ of this building. This shall be completed prior to a
Certificate of Occupancy being issued for 4821 Mustang Cir.
3. The applicant shall submit an escrow or letter of credit for landscaping in the amount of
150% of the cost of materials and labor, or $10,000 (whichever is less) to the City of
Mounds View. The escrow or letter of credit may be returned one-year after the date of
Certificate of Occupancy of 4821 Mustang Cir., and upon site inspection by staff. Upon
staff’s inspection, if landscaping is in need of replacement, a proportionate amount of the
escrow or letter of credit may be retained by the City until one-year after landscape
replacement and survival.

Resolution 8765 also requires the removal of barbed wire from the existing chain-link

not permitted in Mounds View unless for facilities providing essential services or

may predate this section of the City Code.

The City Council is requested to consider the following options:
1. Resolution 8765, approval of a Development Review.
2. The City Council may choose to deny the Resolution. If the Council chooses this option,
Staff would need to be directed to draft a resolution of denial with findings of fact
appropriate to support the denial.
3. Table the request. If additional information is needed before a decision can be rendered
or if more discussion is needed, the Council can simply move to table the request until
such information has been provided. Because of the 60-day requirements (Deadline:
July, 25, 2017) the Council would need to act upon the request as soon as reasonably
possible to avoid an inadvertent approval.

INDUSTRIAL PRODUCTS, INC., FOR PROPERTY LOCATED AT 4821 MUSTANG

WHEREAS, the City of Mounds Municipal Code, Section 1006.06 (Development
Controls) requires a Development Review of non-residential construction activity that increases
the gross square footage of the principal building by more than ten percent (10%), or more than
10,000 sq ft.; and,
WHEREAS, St. Cloud Industrial Products, Inc., owner of North Central Bus and
Equipment, Inc., and represented by Dean Wick (Outsource Architecture, LLC) has requested
approval of a Development Review for property located at 4821 Mustang Cir. This property is

NOW, THEREFORE, BE IT RESOLVED, based upon the above findings, the
information and documents regarding the proposed Development Review, the Planning
Commission recommendation, the Staff Report, and testimony of the applicant, and in
consideration of public testimony, the City Council does hereby approve the Development
Review request by St. Cloud Industrial Products, Inc., with the following conditions:
1. Development of the site shall be consistent with the Site Plan date stamped May 30,
2017, with the addition of screening the shared parking area on 4825 Mustang Cir. from
the adjacent Towns Edge Mobile Home Park. This screening shall be located between
the northeast property corner of 4825 Mustang Cir, and the building on the same lot,
approximately, 140’ in length. Screening shall consist of option 1: coniferous trees, not
less than 8’ in height, and not less than 10’ apart unless impeded by existing trees, or
option 2: a solid fence, not less than 6’ in height. The applicant may choose either option.
2. The applicant shall submit a legal document acceptable to the City Attorney, allowing
shared parking of a minimum of 14 stalls on 4825 Mustang Cir., for the benefit of 4821
Mustang Cir., and within 300’ of this building. This shall be completed prior to a
Certificate of Occupancy being issued for 4821 Mustang Cir.
3. The applicant shall submit an escrow or letter of credit for landscaping in the amount of
150% of the cost of materials and labor, or $10,000 (whichever is less) to the City of
Mounds View. The escrow or letter of credit may be returned one-year after the date of
Certificate of Occupancy of 4821 Mustang Cir., and upon site inspection by staff. Upon
staff’s inspection, if landscaping is in need of replacement, a proportionate amount of the
escrow or letter of credit may be retained by the City until one-year after landscape
replacement and survival.
4. The applicant shall obtain all necessary building and fire permits from the City of
Mounds View, SBM Fire Dept., and the Rice Creek Watershed District.
5. The applicant shall remove all barbed wire from the existing chain-link fence, prior to the
City fully releasing the landscape escrow/letter of credit.

Background:
The Engineering Division of Public Works has prepared plans and specifications (bid documents)
in-house for use in obtaining public bids for the City Hall and Community Center parking lots mill
and overlay project. A public bid is required since the costs of estimated construction will exceed
cost exceeds $100,000. The 2017 budget includes $150,000 in the street improvement fund
(485-4700-7050) to perform this work.
Discussion:
Approval to advertise for public bids was given at the April 24, 2017 Council Meeting (Resolution
8750). The Advertisement for Bid was published in the Sun-Focus newspaper and the online bid
management system Quest Construction Data Network.
Bids were received from seven (7) qualified contractors. The following table provides the bidders
names, and associated bids.

The low bid was submitted by Bituminous Roadways, Inc. of Mendota Heights, Minnesota. If
awarded, Bituminous Roadways, Inc. will begin scheduling the mill and overlay work as soon as
possible. The contract documents require that the work be substantially complete by October 1,
2017, with final completion on or before October 31, 2017. Staff recommends that a contingency
amount of 10% ($10,700) be included to account for possible unknown conditions, additional
required work, or quantity overruns.
The specifications include provisions to ensure access to the Community Center, particularly over
weekends so as not to impact weekend events. In addition, the contractor is required to
coordinate their work timeline with the Community Center’s schedule to minimize impacts to the
operations there.
Recommendation:
Public Works staff recommend that the City Council adopt the attached resolution approving a
construction contract with Bituminous Roadways, Inc. for the City Hall and Community Center
Parking Lots Mill & Overlay Project. Staff further recommends a 10% contingency of $10,700 for
quantity over-runs or additional work resulting from unknown conditions discovered during
construction. The total budget for the parking lots mill and overlay is not to exceed $117,580.25.
Any contingency work would require pre-approval by the Public Works Director.

Introduction:
The City Council is asked approve the attached resolution approving an amendment to the agreement with Oertel
Architects for additional design related services on the Public Works Facility (City Project No. 2017-C02).
Discussion:
Design services for the Public Works Facility were awarded to Oertel Architects on April 25, 2016 via Resolution
8561 in the amount of $247,860.00. Additionally, a contingency of $12,000 was included as part of Resolution
8561. Thus the total amount for design services under Resolution 8561 is $259,860.00.
Since the start of the design work there were some additional structural and mechanical engineering design
services required. These services included:
• Building layout change. As part of a discussion at a work session, the building layout was adjusted to
move the office area from the northeast corner to the southwest corner. This resulted in additional
structural design costs.
• Cost reductions/value engineering. In an effort to reduce the construction cost of the building a
maintenance bay was removed and the office area was reduced. This resulted in additional structural
design costs.
• Cold storage area adjustments. As the design developed the cold storage area was adjusted to allow for
the inclusion of workshop spaces and this caused a change in the HVAC and fire suppression system.
This resulted in additional mechanical design costs.
These additional services have resulted in a total additional subconsultant cost of $25,700.00. No additional
costs from Oertel have been incurred. In order to account for potential additional services, staff would
recommend a small contingency $1,300 remain available for design services. Taking all this into account ththe
final result is an additional cost of $16,000.00. This information summarized in the following table.

WHEREAS, there was $12,000 contingency as part of the design services contract; and
WHEREAS there is sufficient funding in the Special Projects budget (480-4180-7050).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View, Ramsey County,
Minnesota as follows:
1. Oertel Architects is authorized to perform the additional design related services due to the building layout

Background:
Staff received a notice of retirement from Public Works Maintenance Worker Jeff Wienke
today. Mr. Wienke has served the City for 28 years. Mr. Wienke’s last day is June 30,
2017.
Discussion:
Staff is requesting to start the process of advertising and hiring for the position. The current
Public Works Collective Bargaining Agreement requires that all permanent job vacancies
are posted internally for five (5) working days so current members of the bargaining unit can
be considered for the vacancy before it gets advertised to the general public. Only after the
vacancy is posted for five (5) working days and no responses or qualified candidates are
received will the vacancy be posted.
The job description for this position has been reviewed by the Public Works Supervisor and
Public Works Director, and no updates or revisions are required.
Recommendation:
Staff recommends that the City Council adopt the attached resolution, which will approve
the hiring of a maintenance worker position. The starting wage for the new maintenance
worker will start at the lowest step in accordance with the labor agreement. A
recommendation for hire is anticipated sometime in late July or early August.
