Introduction: St. Cloud Industrial Products, Inc. (SCIPI) is expanding an existing building located at 4821 Mustang Cir. The property will be used by North Central Bus, Parts and Truck Equipment, a subsidiary of SCIPI, for the customization and repair of buses and commercial vehicles. The business operates facilities in Minneapolis (maintenance) and St. Cloud (sales, maintenance & body shop). The Minneapolis location will be relocated to Mounds View, and will employ 4 – 9 persons. As part of the business, SCIPI is requesting to install three above ground fuel tanks, and to conduct major auto repair. The applications may be discussed together. However, separate Public Hearings are required for each Conditional Use Permit request. Discussion: St. Cloud Industrial Products has submitted multiple applications. These CUP requests are specific to 4821 Mustang Cir. Tyson received a CUP for a Motor Freight Terminal in 1981 (Resolution 1324), and a CUP for Open or Outdoor Storage as an Accessory Use in 2011 (Resolution 7857). Analysis The property at 4821 Mustang Cir. is zoned I-1 Industrial, and is guided for Light Industrial in the Comprehensive Plan. STORAGE OF FLAMMABLE LIQUIDS OVER 800 GALLONS ABOVE GROUND The storage of flammable liquids over 800 gallons above ground is a conditional use within the I-1 Industrial district, requiring a Conditional Use Permit (CUP).1 The applicant proposes to relocate three above ground fuel tanks from their Minneapolis location, onto the 4821 Mustang Cir property. 1,000 gal propane 3’-9” dia, 16’-4” long located along the rear fence line 2,000 gal gasoline 6’-5” dia 13’-2” long located outside north wall of building 2,500 gal diesel 6’-10” dia 15’-9” long located outside north wall of building Dispensing devices for the fuel tanks are required to be a minimum of 10’ from property lines, and 10’ from buildings or structures consisting of combustible surfaces.2 A Fire Permit is required. AUTOMOBILE ASSEMBLY AND/OR MAJOR REPAIR “Motorized vehicle or recreational equipment sales and service and rental” is a permitted use within the I-1 district.3 “Automobile Assembly and/or Major Repair” is a conditional use within the I-1 Industrial district.4 The following definitions are applicable: Minor Automobile Repair: Minor repairs, including body and fender work, minor painting and upholstering service, replacement of parts and engine service to passenger vehicles and trucks not exceeding a one (1) ton chassis design.5 Major Automobile Repair: General repair, rebuilding or reconditioning engines, motor vehicles or trailers, collision service, including body, frame or fender straightening or repair, overall painting or paint job and vehicle steam cleaning.6 1 Mounds View Municipal Code, Section 1116.04, Subd 9 (Storage of flammable liquids) 2 International Fire Code, Section 2303.1 (Location of dispensing devices) 3 Mounds View Municipal Code, Section 1116.02 (Permitted Uses) 4 Mounds View Municipal Code, Section 1116.04, Subd 7 (Automobile Assembly and/or Major Repair) 5 Mounds View Municipal Code, Section 1102.02, Subd 6 (Definitions; Automobile Repair, Minor) 6 Mounds View Municipal Code, Section 1102.02, Subd 5 (Definitions, Automobile Repair, Major) Item 9A & 9B June 26, 2017 Page 3 The applicant has stated that planned work to take place on-site will be consistent with minor automobile repair (e.g. installing bolt-on accessories onto buses, light-duty and medium-duty commercial trucks), but does not want to be prohibited from conducting major repair. CRITERIA FOR GRANTING A CONDITIONAL USE PERMIT The Mounds View Municipal Code, Section 1125.01, Subd 1(e) requires the Planning Commission to consider possible adverse effects of the proposed conditional use permit(s), and is described in detail within Resolution 8766 and Resolution 8768. In summary, the proposed conditional use(s) are consistent with the Comprehensive Plan, should have no effect on area property values, is compatible with the surrounding industrial area, and has a demonstrated need by the applicant as part of the business operation. The Mounds View Municipal Code, Section 1125.01, Subd 3(b) states that in granting a conditional use permit, the City Council shall consider the advice and recommendation of the Planning Commission and the effect of the proposed use on the Comprehensive Plan and upon the health, safety and general welfare of occupants of surrounding lands, including Findings, where applicable. These Findings are described in detail within Resolution 8766 and Resolution 8768. In summary, the proposed conditional use(s) will not create a burden onto public facilities, is separated or screened from residential areas (Towns Edge Mobile Home Park) by the adjacent building at 4825 Mustang Cir. and will not have an adverse effect onto these residential properties, is a reasonable use, is consistent with the Zoning Code and Comprehensive Plan, will not cause traffic hazards, and is serviced by adequate roads, public utilities, and drainage. Summary St. Cloud Industrial Products (SCIPI) is requesting (1) a Conditional Use Permit to install three above ground fuel tanks, and (2) a Conditional Use Permit to allow major automobile repair, at property located at 4821 Mustang Cir. The business customizes, maintains and repairs buses and commercial vehicles. The fuel tanks will be used by the business, and will not be for retail use. A Public Hearing notice was mailed to property owners within 350’ of the SCIPI properties (4821 & 4825 Mustang Cir.), consisting of eight owners, and published in the Mounds View – New Brighton Sun Focus on June 16, 2017. Planning Commission Recommendation: On June 7, 2017, the Planning Commission approved Resolution 1072-17, recommending approval of a Conditional Use Permit for the Storage of Flammable Liquids Over 800 Gallons Above Ground. Item 9A & 9B June 26, 2017 Page 4 On June 21, 2017, the Planning Commission approved Resolution 1073-17, recommending approval of a Conditional Use Permit for Automobile Assembly and/or Major Repair. Staff Recommendation: Staff recommends approval of Resolution 8766, approving a Conditional Use Permit for the Storage of Flammable Liquids Over 800 Gallons Above Ground, and Resolution 8768, approving a Conditional Use Permit for Automobile Assembly and/or Major Repair. The City Council is requested to conduct separate Public Hearings, and consider the following options: 1. Resolution 8766, approving a Conditional Use Permit for the Storage of Flammable Liquids Over 800 Gallons Above Ground. Resolution 8768, approving a Conditional Use Permit for Automobile Assembly and/or Major Repair. 2. Denying the Conditional Use Permit request(s). If the City Council chooses this option, Staff would need to be directed to draft a resolution(s) of denial with findings of fact appropriate to support the denial(s). 3. Table the request(s). If additional information is needed before a decision can be rendered or if more discussion is needed, the City Council can simply move to table the request(s) until such information has been provided. Because of the 60-day requirements (Deadline: July, 25, 2017 (Res 8766), and August 12, 2017 (Res 8768) the City Council would need to act upon the request(s) as soon as reasonably possible to avoid an inadvertent approval. RESOLUTION 8766 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR ST. CLOUD INDUSTRIAL PRODUCTS, INC., FOR THE STORAGE OF FLAMMABLE LIQUIDS OVER 800 GALLONS ABOVE GROUND FOR PROPERTY LOCATED AT 4821 MUSTANG CIRCLE (PLANNING CASE MU2017-002) WHEREAS, the City of Mounds View Municipal Code, Section 1116.04, Subd 9 allows the Storage of flammable liquids over 800 gallons above ground, upon approval of a Conditional Use Permit (CUP); and, WHEREAS, St. Cloud Industrial Products, Inc., owner of North Central Bus and Equipment, Inc., has requested approval of a Conditional Use Permit for one (1) 1,000 gallon propane tank, one (1) 2,000 gallon gasoline tank, and one (1) 2,500 gallon diesel tank above ground, for property located at 4821 Mustang Cir. This property is legally described as: PID: 17-30-23-13-0008 Lot 6, Block 1, Mounds View Industrial Park No. 3 WHEREAS, the City of Mounds View Municipal Code, Section 1125.01, Subd. 1(e), states that the Planning and Zoning Commission shall consider possible adverse effects of the proposed conditional use. Its judgement shall be based upon (but not limited to) the following factors (Findings in italics): 1. Relationship to [the] Municipal Comprehensive Plan. Findings: Above ground fuel tanks are not specifically addressed within the Comprehensive Plan. Industrial uses are addressed in numerous sections, including (where applicable): Resolution 8766 Page 2 Industrial (p. 3-11) Goal 1: Consider new industrial development in order to provide a broad tax base and an expanded employment base in the city. Policies (b) Cooperate with industrial developers and property owners to ensure that industrial land uses are an asset to the City and that such uses meet city standards. (e) Ensure industrial development and redevelopment occurs in designated industrial areas. Goal 2: The City will ensure that industrial development is compatible with adjacent land uses and that any such projects preserve desirable environmental features and natural amenities. Policies (a) Industrial development must adequately provide for storm water drainage and surface water management. (b) The City will require buffering to protect adjacent and nearby residential neighborhoods from industrial land uses. (d) Mounds View will carefully consider all potential physical implications, public services and facility demands (e.g. traffic generation, sewer / water demands, etc.) when reviewing proposals for industrial development or redevelopment. (f) The City shall restrict and carefully regulate industrial development on or near wetlands, flood plains, shore land, and other natural features that, in their natural state, perform public protection functions. 2. The geographical area involved. Findings: The above ground fuel tanks will be located on the property at 4821 Mustang Cir., and within an industrial area. The approximate distance to the nearest non-industrial uses include: Resolution 8766 Page 3 260’ wetlands, within the 4821 Mustang Cir. property 440’ Town’s Edge Mobile Home Park 490’ Rice Creek Regional Park 1,300’ Rice Creek 1,400’ Skyline Motel 1,460’ Single-family homes within the City of New Brighton 1,630’ Irondale Senior High School property These non-industrial uses will be screened from the proposed above ground fuel tanks by existing buildings and wooded areas. 3. Whether such use will tend to or actually depreciate the area in which it is proposed. Findings: Any appreciation or depreciation of property values is speculative. The installation of the above ground fuel tanks is expected to have no effect on area property values. 4. The character of the surrounding area. Findings: The property is zoned I-1 Industrial, as is the adjacent properties to the north, east, and south. These adjacent properties are industrial in use. The adjacent property to the west is located within the City of New Brighton, and zoned R-1 Single Family Residential. This property is within the Rice Creek Regional Park, operated by Ramsey County Parks and Recreation. 5. The demonstrated need for such use. Findings: The property is owned by St. Cloud Industrial Products, Inc., and will be operated by its subsidiary, North Central Bus and Equipment Sales, Inc. The property will be used for the maintenance, repair, and outside storage of buses and commercial vehicles. On-site fueling is needed as part of the business operation. A Conditional Use Permit (CUP) was approved in 1981 for a Motor Freight Terminal (Res. 1324) for this property and the adjacent properties at 4825 Mustang Cir. A CUP was approved in 2011 for Open or Outdoor Storage as an Accessory Use (Res. 7857) for the same properties. Resolution 8766 Page 4 WHEREAS, the City of Mounds View Municipal Code, Section 1125.01, Subd 3(b) states that in granting a conditional use permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and the effect of the proposed use on the Comprehensive Plan and upon the health, safety and general welfare of occupants of surrounding lands. Among other things, the City Council shall make the following findings where applicable (Findings in italics): 1. The use will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. Findings: The proposed use (above ground fuel tanks) will have no burden onto parks, schools, streets and public facilities. 2. The use will be sufficiently compatible or separated by distance or screening from adjacent residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrence to development of vacant land. Findings: The above ground fuel tanks will be screened from adjacent residential uses (Towns Edge Mobile Home Park and residential neighborhood in New Brighton) by existing buildings and wooded areas. 3. The structure and site shall have an appearance that will not have an adverse effect upon adjacent residential properties. Findings: The appearance of the above ground fuel tanks will not have an adverse effect upon adjacent residential properties. 4. The use, in the opinion of the City Council, is reasonably related to the overall needs of the City and to the existing land use. Findings: The above ground fuel tanks are a reasonable use. 5. The use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use. Findings: The above ground fuel tanks are consistent with the Zoning Code, and the I-1 Industrial district. 6. The use is not in conflict with the Comprehensive Plan of the City. Findings: The above ground fuel tanks are consistent with the Comprehensive Plan. 7. The use will not cause traffic hazards or congestion. Findings: The above ground fuel tanks will have no effect on traffic or congestion. Resolution 8766 Page 5 8. Adequate utilities, access roads, drainage and necessary facilities have been or will be provided. Findings: There are adequate existing utilities, access roads, and drainage. WHEREAS, the Planning Commission considered this request on June 7, 2017, recommending approval of the Conditional Use Permit (Resolution 1072-17); and, WHEREAS, the City Council conducted a Public Hearing on June 26, 2017, noticing property owners within 350’ of the subject property, and publishing notice in the Mounds View – New Brighton Sun Focus on June 16, 2017; and, NOW, THEREFORE, BE IT RESOLVED, that the City Council approves this Conditional Use Permit request by St. Cloud Industrial Products, Inc., subject to the following conditions: 1. A fire permit shall be obtained prior to installation of the fuel tanks. 2. The applicant shall register the gasoline and diesel tanks with the MPCA, and abide by applicable regulations. 3. Light industrial uses would typically have all processing within buildings, require limited exterior storage, generate limited amounts of truck traffic, and be free of hazardous or objectionable elements such as noise, odor, dust, smoke, glare or other pollutants. Examples include greenhouses, food and drink processing plants and storage, light manufacturing and assembly, small machine and tool and die shops, flex industrial centers, miniwarehouses, and research and development facilities. Findings: The proposed use (major auto repair) is consistent with the property’s Light Industrial designation. General Land Use (p. 3-3) Goal 1: Maintain a cohesive land use pattern that ensures compatibility and functional relationships between activities and uses. Findings: The proposed use (major auto repair) will be screened from adjacent residential areas by existing trees and by additional screening along the north property line of 4825 Mustang Cir., approved as part of the Development Review, June 12, 2017 (Res. 8765). The requested use is compatible with adjacent uses. Industrial (p. 3-11) Goal 1: Consider new industrial development in order to provide a broad tax base and an expanded employment base in the city. Goal 2: The City will ensure that industrial development is compatible with adjacent land uses and that any such projects preserve desirable environmental features and natural amenities. Findings: The proposed use (major auto repair) will be served by existing storm water and surface water drainage infrastructure, and will have no negative impact to public infrastructure. WHEREAS, the City of Mounds View Municipal Code, Section 1125.01, Subd 3(b) states that in granting a conditional use permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and the effect of the proposed use on Resolution 8768 Page 4 the Comprehensive Plan and upon the health, safety and general welfare of occupants of surrounding lands. Among other things, the City Council shall make the following findings where applicable (Findings in italics): 1. The use will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. Findings: The proposed use (major auto repair) will have no burden onto parks, schools, streets and public facilities. 2. The use will be sufficiently compatible or separated by distance or screening from adjacent residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrence to development of vacant land. Findings: The proposed use (major auto repair) will be located in an industrial area, and screened from residential uses to the north (Towns Edge Mobile Home Park) and west (Rice Creek Regional Park) as approved through the Development Review process (Res. 8765). 3. The structure and site shall have an appearance that will not have an adverse effect upon adjacent residential properties. Findings: The appearance of the use will not have an adverse effect upon adjacent residential properties. 4. The use, in the opinion of the City Council, is reasonably related to the overall needs of the City and to the existing land use. Findings: The proposed use (major auto repair) is consistent with previous use on this site (truck maintenance). 5. The use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use. Findings: The proposed use (major auto repair) is consistent with the Zoning Code, and the I-1 Industrial district. 6. The use is not in conflict with the Comprehensive Plan of the City. Findings: The proposed use (major auto repair) is consistent with the Comprehensive Plan. 7. The use will not cause traffic hazards or congestion. Findings: The proposed use (major auto repair) will have no effect on traffic or congestion. Resolution 8768 Page 5 8. Adequate utilities, access roads, drainage and necessary facilities have been or will be provided. Findings: There are adequate existing utilities, access roads, and drainage. WHEREAS, the Planning Commission considered this request on June 21, 2017, recommending approval of the Conditional Use Permit (Resolution 1073-17); and, WHEREAS, the City Council conducted a Public Hearing on June 26, 2017, noticing property owners within 350’ of the subject property, and publishing notice in the Mounds View – New Brighton Sun Focus on June 16, 2017; and, NOW, THEREFORE, BE IT RESOLVED, that the City Council approves this Conditional Use Permit request by St. Cloud Industrial Products, Inc., subject to the following conditions: 1. Use and development of the property for major auto repair shall be consistent with the approved Development Review (Resolution 8765), and compliant with applicable building and fire codes. RECITALS 1. The Project is identified in Ramsey County’s 2016 – 2020 Transportation Improvement Program. 2. County Road H (CR H), in the area affected by reconstruction, is designated County State Aid Highway (CSAH) 9 and is located within the City. 3. The Project has been designated by the Minnesota Department of Transportation (MnDOT) as eligible for County State Aid Highway funds. 4. The Project has been designated as State Project (S.P.) 6284-162 and 062-609-006, State Aid Project (S.A.P.) 146-020-011. AGREEMENTS 1. Responsibility for Design Engineering 1.1. Plans, specifications, and proposals will be prepared in accordance with MnDOT State Aid requirements. 1.2. The County will prepare plans, specifications, and proposals for the Project, which will include, among other things, the proposed reconstruction, alignment, profiles, grades, cross sections, paving, concrete curb and gutter, medians, bridges, storm 2 sewer, storm water treatment and infiltration basins, pedestrian curb ramps, turf establishment, traffic signals, street lighting, accessible pedestrian signals, and utility replacement and adjustments. 1.3. Plans for the Project showing proposed construction will be presented to the City and will be on file at Ramsey County Public Works Department. 1.4. Any costs associated with Project revisions after the completion of plans and specifications will be paid for by the party requesting the revisions. Revisions are subject to approval by the County. 2. Procurement and Award of Contract 2.1. The County will take bids in accordance with state law and County procedures. 2.2. The County will prepare an abstract of bids and a cost participation summary based on the lowest responsible bidder’s proposal, and will provide the same to the City. 2.3. The County will request the City’s concurrence to award a contract to the lowest responsible bidder. 2.4. The County will award a contract, and pay the contractor from the Federal, State, 2014 Legislative, and County State Aid Highway funds identified for the Project. 3. Responsibility for Construction Engineering 3.1. The County shall perform or contract the performance of the construction engineering for all elements of the Project. 4. Project Costs 4.1. Except as provided herein, the County and City will participate in the costs of construction in accordance with the Ramsey County Cost Participation Policy and approved in the 2016 – 2020 Ramsey County Transportation Improvement Plan. If there is a conflict between the Cost Participation Policy and this Agreement, this Agreement will prevail. 4.2. A list of the construction pay items and City funding responsibility as well as the total estimated City Project cost is attached as Exhibit A (Cost Participation Based on Low Bid). Quantities in Exhibit A are estimates. Actual costs shall be based on the contract unit prices and the quantities constructed. 4.3. The City will pay 50% of the cost of the sidewalk/trail located on County Road H west of I-35W within the limits of the City not located on the bridge as shown in Exhibit A. 3 The County will pay for 50% of the cost of the sidewalk/trail on the bridge that is not paid for by the State. The City pays for 25% of the cost of the sidewalk/trail on the bridge not paid for by the State. Pursuant to Agreement PUBW2016- 13(R) the City of Arden Hills is also responsible for 25% of the cost of the sidewalk/trail on the bridge not paid for by the State. 4.4. The City will pay 50% of the cost of the irrigation system. Pursuant to Agreement PUBW2016-13(R) the City of Arden Hills is responsible for the remaining 50% of the cost. 4.5. The City will pay for a portion of the proposed Program Wet Pond located between Program Avenue and the I-35W southbound off ramp based on the portion of runoff attributed to areas outside of County and MnDOT Right-of-Way. The City will pay f or a portion of the proposed Mermaid Wet Pond located at the southwest corner of County Road H and County State Aid Highway 10/Mounds View Boulevard based on the portion of runoff attributed to areas outside of the County Right-of-Way. 4.6. Mobilization, Field Office, Erosion Control Supervisor, and Traffic Control are defined collectively as the “Prorated Items”. The City percentage of the Prorated Items is calculated as follows: (City Cost excluding the Prorated Items Cost) City % Prorated Items = (Total Project Cost excluding the Prorated Items Cost) The costs in the Prorated Items calculation will be based on contract unit prices and quantities at the time of contract award. No adjustments in the percentages will be made if unit prices or quantities vary during construction. 4.7. Design Engineering Costs 4.7.1. The City shall pay the County a design engineering fee equal to 8% of the City’s share of the project items identified in Exhibit A and those revisions requested by City. 4.7.2. Design engineering fees shall be calculated based on the quantities and unit prices at the time of contract award. 4.8. Construction Engineering and Administration Costs 4.8.1. The City shall pay the County a construction engineering fee equal to 8% of the City’s share of the project items identified in Exhibit A and any revisions requested by City. 4 4.8.2. Construction engineering and administration fees shall be calculated based on the final contract quantities and unit prices. 5. Payment Schedule 5.1. Design engineering will be invoiced upon execution of this agreement. 5.2. The County will invoice the City for construction costs incurred on a monthly basis or as determined by the payment schedule for the contractor. 5.3. Construction engineering will be invoiced at the time of substantial project completion, as determined by the County. 5.4. Payment will be made within 30 days of receipt of an invoice. 6. Ownership and Maintenance Responsibility for Project Elements 6.1. The County shall own and maintain the roadway and associated roadway elements located within the County Right of Way, except as detailed below 6.2. The City shall own and maintain Program Avenue and Program Connector roadways and associated roadway elements. 6.3. The County shall own, operate, and maintain all of the components of the storm sewer system including catch basins and catch basin leads except for the structures and pipes labeled ‘Maintained by City of Mounds View’ as shown in Exhibit B. 6.4. The County shall own, operate, and maintain the Program Wet Pond located between Program Avenue and the I-35W southbound off ramp. 6.5. The City shall own, operate, and maintain the Mermaid Wet Pond located at the southwest corner of County Road H and County State Aid Highway 10/Mounds View Boulevard. Pond maintenance includes but is not limited to inspection, cleaning, maintenance of the turf and erosion control measures around the pond perimeter, and pond sediment removal as needed to perpetuate pond capacity and function as designed. The County may perform maintenance and bill the City if it determines that the pond basin is not being adequately maintained. 6.6. The County shall own, operate, and maintain the traffic signal located at the intersection of Trunk Highway 10/County State Aid Highway 10/County Road H, except that the City shall be responsible for maintenance of painted signal poles and mast arms. The County will perform maintenance on the EVP system and will bill the cost to the City. 6.7. The City will own and maintain the street lights. 5 6.8. The City shall own, operate, and maintain all of the components of the irrigation system within the limits of the City. 6.9. The County shall own and maintain the trail, including snow removal. 7. The City and County shall indemnify, defend, and hold each other harmless against any and all liability, losses, costs, damages, expenses, claims, or actions, including attorney’s fees, which the indemnified party, its officials, agents, or employees may hereafter sustain, incur, or be required to pay, arising out of or by reason of any act or omission of the indemnifying party, its officials, agents, or employees, in the execution, performance, or failure to adequately perform the indemnifying party’s obligation pursuant to this Agreement. Nothing in this Agreement shall constitute a waiver by the County or the City of any statutory or common law immunities, limits, or exceptions on liability. 8. This Agreement shall remain in full force and effect until terminated by mutual agreement of the parties. RECITALS 1. The Project is identified in Ramsey County’s 2016 – 2020 Transportation Improvement Program. 2. The Project is located within the City. AGREEMENTS 1. Responsibility for Design Engineering 1.1. The City will prepare plans, specifications, and proposals for the Project, which will include, among other things, the proposed reconstruction, alignment, profiles, grades, cross sections, trail paving, concrete curb and gutter, pedestrian curb ramps, and turf establishment. 1.2. Plans for the Project showing proposed construction will be presented to the County and will be on file at the City Public Works Department. 1.3. Any costs associated with Project revisions after the completion of plans and specifications will be paid for by the party requesting the revisions. Revisions are subject to approval by the County. 2. Procurement and Award of Contract 2.1. The City will take bids in accordance with state law and County procedures. 2.2. The City will prepare an abstract of bids and a cost participation summary based on the lowest responsible bidder’s proposal, and will provide the same to the County. 2 2.3. The City will request the County’s concurrence to award a contract to the lowest responsible bidder. 2.4. The City will award a contract, and pay the contractor from City funds identified for the Project. 3. Responsibility for Construction Engineering 3.1. The City shall perform or contract the performance of the construction engineering for all elements of the Project. 4. Project Costs 4.1. Except as provided herein, the County and City will participate in the costs of construction in accordance with the Ramsey County Cost Participation Policy and approved in the 2016 – 2020 Ramsey County Transportation Improvement Plan. If there is a conflict between the Cost Participation Policy and this Agreement, this Agreement will prevail. 4.2. A list of the construction pay items and percentages of City and County funding responsibility as well as the total estimated City Project cost is attached as Exhibit A (Cost Participation Based on Low Bid). Quantities in Exhibit A are estimates. Actual costs shall be based on the contract unit prices and the quantities constructed. 4.3. The County will pay 50% of the cost of the sidewalk/trail located within the limits of the City as shown in Exhibit B. 4.4. Mobilization, Field Office, Erosion Control Supervisor, and Traffic Control are defined collectively as the “Prorated Items”. The City percentage of the Prorated Items is calculated as follows: (City Cost excluding the Prorated Items Cost) City % Prorated Items = (Total Project Cost excluding the Prorated Items Cost) The costs in the Prorated Items calculation will be based on contract unit prices and quantities at the time of contract award. No adjustments in the percentages will be made if unit prices or quantities vary during construction. 4.5. Design Engineering Costs 4.6.1. The County shall pay the City a design engineering fee equal to 8% of the County’s share of the project items identified in Exhibit A and those revisions requested by County. 3 4.6.2. Design engineering fees shall be calculated based on the quantities and unit prices at the time of contract award. 4.7. Construction Engineering and Administration Costs 4.7.1. The County shall pay the City a construction engineering fee equal to 8% of the County’s share of the project items identified in Exhibit A and any revisions requested by County. 4.7.2. Construction engineering and administration fees shall be calculated based on the final contract quantities and unit prices. 5. Payment Schedule 5.1. Design engineering will be invoiced at the time of contract award. 5.2. The County will invoice the City for construction costs incurred on a monthly basis or as determined by the payment schedule for the contractor. 5.3. Construction engineering will be invoiced at the time of substantial project completion, as determined by the County. 5.4. Payment will be made within 30 days of receipt of an invoice. 6. Ownership and Maintenance Responsibility for Project Elements 6.1. The City will own and maintain the trail and pedestrian ramps, including snow removal. 7. The City and County shall indemnify, defend, and hold each other harmless against any and all liability, losses, costs, damages, expenses, claims, or actions, including attorney’s fees, which the indemnified party, its officials, agents, or employees may hereafter sustain, incur, or be required to pay, arising out of or by reason of any act or omission of the indemnifying party, its officials, agents, or employees, in the execution, performance, or failure to adequately perform the indemnifying party’s obligation pursuant to this Agreement. Nothing in this Agreement shall constitute a waiver by the County or the City of any statutory or common law immunities, limits, or exceptions on liability. 8. This Agreement shall remain in full force and effect until terminated by mutual agreement of the parties. Erickson, Public Works Director/City Engineer Item Title/Subject: Resolution 8779, Approving Reconstruction of County Road H (County State Aid Highway 9) and County State Aid Highway 10 Trail Segments 6 & 11 Cost Share Agreements with Ramsey County Introduction: As part of their Transportation Improvement Plan, Ramsey County programmed the Reconstruction of County Road H (County State Aid Highway 9) project (CR H/I-35W) for 2016. This project includes two new bridges, roundabouts, a new intersection at CR H and Mounds View Blvd (CSAH 10) and trail/sidewalk connections. The construction of this project is in preparation for anticipated development at Rice Creek Commons in the near future. In 2016, the City of Mounds View awarded County State Aid Highway 10 Trail Segments 6 & 11 (Trails) along Mounds View Blvd. The two segments run from Red Oak Drive to Groveland Road on the north side (Segment 6) and Woodale Drive to Edgewood Drive on the south side (Segment 11). As each of these projects includes portions to be funded by both Ramsey County and the City of Mounds View the attached draft agreements have been prepared to allocate these costs. Discussion: The CR H/I-35W cost share agreement covers three separate cost categories. They are Project Cost, Design Engineering Costs and Construction Engineering and Administration Costs. The Project Cost is based on costs associated with construction of sidewalk/trail, irrigation, storm water ponds and project overhead items. The Design Engineering Cost is based on 8% of Mounds View’s share of the ‘as bid’ cost for this project, that is, before any construction has begun. The Construction Engineering and Administration Costs are based on 8% of Mounds View’s share of the final contract cost, that is, after final quantities are established. It should be noted that the full costs of the above items are allocated to the cities of Mounds View and Arden Hills as well as Ramsey County. Based on ‘as bid’ cost of $16,722,222.22, Mounds View’s cost is estimated to be $150,157.67. Ramsey County is currently reviewing cost allocations and will confirm the final estimated costs prior to the Council meeting. The Trail cost share agreement also covers the three categories above. In this case, the Project Cost is based on the cost of the trail as allocated by Ramsey County’s cost share policy. At this point, the Trail project is nearly completed and thus the final costs will be calculated and presented to Council in the near term. Based on these two agreements the total cost to Mounds View is estimated to be $85,429.62 which is Mounds View’s cost for the CR H/I-35W less Ramsey County’s cost for the Trail. The funding for this is in the 2017 budget under the Street Improvement Fund (485-4470-7050) in the amount of $285,000. As a result, should the estimated cost increase there is sufficient funding to cover any increases. The City Attorney reviewed an earlier version of this agreement that combined both of the projects, and staff has requested that they review these updated agreements. Approval of the agreements should be contingent upon approval of the City Attorney. Recommendation: Staff recommends that the attached agreements between Ramsey County and the City of Mounds View be approved. At the May 8, 2017, City Council Meeting, the City Council approved the Facilities Maintenance/Building Custodian job description in order for Staff to start the process of a HAY point and salary compensation analysis for the position. Discussion: As in past compensation studies, the City used Springsted Group for this job analysis. Springsted Group reviewed the job description and submitted their findings. According to the study, Springsted Group is recommending to not revise the HAY points (98 points). However, the market analysis states that Step 5 should be at $44,158/year ($21.23/hour). The City’s current rate for Step 5 is $50,648 /year ($24.35/hour). In other words, the current position is overcompensated by $6,490/year. Below is the current range for the position.
