On June 2, 2013, the City Council approved implementation items and dates for each action step. The current status of each action step is shown on the chart below. Respectfully submitted, Heidi Steinmetz, Economic Development Specialist I � 1 City of Mounds View Staff Report Item No: 2 Meeting Date: Sept. 3, 2013 Type of Business: Work Session Administrator Review: To: Honorable Mayor and City Council From: Heidi Steinmetz, Economic Development Specialist Item Title/Subject: Discuss Potential Request for Qualifications (RFQ) for Land Development Planning Services for Southeast Corner of County Roads 10 and H2 Background In 2006, the Mounds View EDA hired DSU/Bonestroo to complete the "Premium Stop Redevelopment Area Study". The study included a series of parcels located along the south side of County Road 10 between County Road H2 and Woodale Drive. The three parcels located at the southeast corner of County Road 10 and County Road H2 were part of the study. At their August 16th meeting, the EDC discussed the study; specifically the study's redevelopment concepts for the three parcels. The EDC recommended that the EDA consider requesting quotes from land development firms to assist the EDA in updating its redevelopment vision for the three parcels. Discussion The EDA's goal in authorizing the 2006 study was to create a redevelopment vision for the area, rather than reacting to developer proposals. Updating the EDA's vision for the three parcels would be consistent with this goal. One way to update the EDA's redevelopment vision for the three parcels would be to generate a Request for Qualifications (RFQ). The purpose of a RFQ would be to identify a qualified land development planning consultant, who may utilize a market research firm, to provide the following services to the EDA: Market analysis of the three -parcel redevelopment site Redevelopment visioning workshop (for the site) with the EDA Two to three redevelopment concept drawings/scenarios for the site Staff Recommendation Staff recommends that the City Council discuss and provide direction to City staff regarding the EDA's interest in distributing an RFQ for land development planning services for the southeast corner of County Roads 10 and H2. Respectfully submitted, Heidi Steinmetz, Economic Development Specialist of Mounds View Staff Item No: 3 Meeting Date: Sept 3, 2013 Type of Business: Work Session To: Honorable Mayor and City Council From: James Ericson, City Administrator Item Title/Subject: Review License Fee for Donation Collection Bins Introduction: On August 26, 2013, the City Council approved Ordinance 880 which authorized, with limitations, the siting of donation collection bins on religious, educational, Institutional and non-profit properties within the City. The Council will now need to establish an appropriate license fee for the donation collection bins. Discussion: Fees are adopted by resolution on an annual basis. From time to time, however, a correction or addition may be needed which would warrant revisiting the fee schedule. The 2013 Fee Schedule was approved by the City Council on November 13, 2012. Given the anticipated work involved with the review of the license application and the potential for inspections and reinspections, staff had suggested $100 per year as a starting point. Staff will check with other communities to find out the range of fees being charged. Recommendation: Discuss possible license fee amounts for donation collection bins. Respectfully submitted, J6.4um James Ericson City Administrator of Mounds View Staff Item No: 4 Meeting Date: September 3, 2013 Type of Business: Work Session To: Honorable Mayor and City Council From: James Ericson, City Administrator Item Title/Subject: Review Noise Control Regulations Introduction: At the August 26, 2013, City Council meeting, resident Karey Love expressed concern regarding the apparent lack of noise regulations or policies that would apply to outdoor concerts or events in residential districts. The cause for concern stemmed from an event held by the church adjacent to the Love property. According to the event flyer, many bands played from 1 pm until after 9 pm. Mr. Love complained to the police about the noise and was told that nothing really could be done about it. Mr. Love encouraged the Council to look at the ordinances and consider changes that would better control outdoor events such as what was held by the church, in a residential district. Discussion: The City's noise control regulations can be found in Section 607.08: 607.08: NOISE CONTROL REGULATIONS: Subd. 1. Loud Or Unnecessary Noises Prohibited: It shall be unlawful for any person to make or cause to be made any loud, unnecessary or unusual noise which either annoys, disturbs or affects the comfort, repose, health or peace of others. Subd. 2. Loud Or Disturbing Noises Enumerated; Restrictions: The following acts set forth in the following paragraphs are declared to be loud, disturbing and unnecessary noises in violation of this Section, but said enumeration shall not be deemed to be exclusive: a. Construction or Repairing of Buildings: The erection, including excavating, demolition, alteration or repair of any building between the hours of ten o'clock (10:00) P.M. and seven o'clock (7:00) A.M., Monday through Sunday. The City Administrator may grant authority for work to occur at anytime in the event of an emergency or when it is found that such activity would not affect the health, safety, comfort and repose of persons in the vicinity. b. Nighttime Noise In Residential Areas; Parties: (1) No person shall, between the hours of ten o'clock (10:00) P.M. and seven o'clock (7:00) A.M., participate in any loud party or gathering of people from which noise emanates of a sufficient volume as to disturb the peace, quiet or repose of persons residing in any residential area. Noise Control Regulations Report September 3, 2013 Page 2 (2) Loud noises between the hours of ten o'clock (10:00) P.M. and seven o'clock (7:00) A.M. of such volume as to be plainly audible at a distance of one hundred feet (100') from the residential premises wherein such loud party or gathering is located shall be prima facie evidence of a violation of this Section. (3) No persons shall visit or remain within any residential dwelling unitwherein such loud party gathering is taking place, except the owner, persons residing in that unit or persons who are there for the sole purpose of abating the disturbance. c. Stereos, Radios, Tape Players, Disc Players, Etc.: Operation of a stereo, radio, tape player, disc player, or any such device at anytime in a motor vehicle in such a manner as to be plainly audible at a distance of fifty feet (50') from the vehicle shall be prima facie evidence of a violation of this Section. As evidenced by the first subdivision in Section 706.08, the Code takes a broad, comprehensive approach to defining a code violation, providing for discretion on the part of the enforcement official: "It shall be unlawful for anyperson to make or cause to be made any loud, unnecessary or unusual noise which either annoys, disturbs or affects the comfort, repose, health or peace of others." The regulation makes no distinction between a residential or non-residential district. The question, it would seem, is whether amplified music could be considered a "loud, unnecessary or unusual" noise. While certain musical genres could be considered noise by some, unless the music is occurring after 10 pm, it is generally not cited as such. In his appearance before the City Council, Mr. Love referenced an ordinance that had been adopted in 2008 that addressed outdoor special events but was repealed the following year after being found overly onerous and restrictive. (See attached Ordinance 808.) Mr. Love suggested that a rock concert is not appropriate in a residential district regardless of the time of day. While his position is understandable, crafting a regulation that promotes peaceful and quiet neighborhoods would be a challenging proposition. Some of the questions to consider may include: • Would all amplified music prohibited? • What about a wedding reception or a grad party? • What about "unplugged" music? • What about the Festival or Music in the Park? • Should a car show or motorcycle rally be prohibited? • Should neighbors to a proposed event be noticed? • Should outdoor events require a permit? CUP? • How would an outdoor event be defined? Noise Control Regulations Report September 3, 2013 Page 3 Recommendation: Review and discuss the City's noise control regulations in response to the concerns addressed by Mr. Love regarding concerts and outdoor events in residential districts.
