Item Title/Subject: Zoning Review Process and a Proposed Accessory Use at Sam’s
Market, 2408 County Road I
Introduction:
In 2010, when the B-1 zoning code was amended to add thrift stores as a permitted use, the
following statement was also added:
The City will allow uses similar to those listed above in this Section if the proposed use
would not create a nuisance and if the use would not be noxious or hazardous. The
City Council shall review uses that are not clearly similar to those listed in this Section
for a determination of compatibility.
City staff has been working with Ahmad Muqbil, the business owner of Sam’s Market, on
different businesses that he could do in order to fill the vacant space in their building. Mr.
Muqbil has a proposal to add a cooking area to the existing market, and City staff felt that the
Planning Commission and City Council should review this idea to determine whether it would
be an acceptable accessory use to Sam’s Market.
Discussion:
According to the Zoning Code, the purpose of the B-1 district is as follows:
The purpose of the B-1, Neighborhood Business District, is to provide for the
establishment of local centers for convenient, limited office, retail or service outlets
which deal directly with the customer for whom the goods or services are furnished.
These centers are to provide services and goods for the surrounding neighborhoods
and are not intended to draw customers from the entire community.
Mr. Muqbil has proposed expanding the market into the entire building and adding a small
cooking area (approximately 8’x8’) into the back corner of the building with a grill and fryer in
order to sell hot, prepared food, such as burgers and fries for take-out.
The property at 2408 County Road I includes a building that is about 4,800 square feet and a
large parking lot with 21 marked spaces. The surrounding neighborhood includes single
family homes, several apartment buildings and an office building that is zoned B-3, Highway
Business. Besides a convenience grocery store, the only other food uses that are allowed in
a B-1 district are candy and ice cream type stores. The applicant’s proposal for a cooking
area is only a small area of the store and would not be the primary use of the property.

The City Council should consider if this proposed use is too dissimilar from other B-1
permitted uses and would be too intense for this property, or would it be compatible as an
accessory use to the grocery store and not disrupt the primarily residential neighborhood?
The Planning Commission discussed this proposal at their August 1, 2012 meeting and
unanimously agreed that they want the business to remain successful and grow, and support
the addition of a cooking area in Sam’s Market.
Recommendation:
The City Council should review and discuss if the proposed additional take-out food cooking
area would be an appropriate use for this property and neighborhood. Staff will bring a
resolution for the Council to take action on at the August 13, 2012 City Council meeting.

Item Title/Subject: Discuss Estimated MnDOT Signage Costs Associated with
County Road 10 Name Implementation Project
Introduction:
In 2011, the city councils from Blaine, Spring Lake Park and Mounds View met jointly to
discuss issues of common interest and mutual concern. One of the issues discussed was
the persisting confusion from having two similarly named highways bisecting the
communities. The City Councils asked that a task force be created to examine the issue
and to identify a name for County Road 10
Discussion:
As a result of the Councils’ direction, a task force was established to consider possible
names for the County Road 10 corridor. The task force met in February, March and April
of 2012 and through these meetings a single name emerged to be recommended to the
City Councils—Northtown Boulevard. The three city councils met separately to informally
consider the name, and all the three bodies consented to the Task force’s
recommendation.
The next step was to (1) work with MnDOT to ascertain the estimated costs associated with
changing the signage on 35W, Highway 65 and Highway 47, and to (2) prepare a joint
powers agreement between the three cities to identify tasks and assign costs accordingly.
MnDOT staff had originally indicated to staff that the cost to swap out all the affected signs
could easily exceed $50,000. Staff notified MnDOT of the name to be implemented, and
they responded with an estimate that was significantly higher than anyone expected--
$400,000. Little explanation was given to account for the huge discrepancy between their
original estimate and the more refined figure.
Direction:
Staff is requesting direction from the City Council as to how it should proceed, given the
new cost estimate from MnDOT. Staff has already heard from one of the other two cities,
which preliminarily indicated they would be unable to accommodate the additional cost.
