Item Title/Subject: Review Section 1 of the City’s Personnel Manual
Introduction:
On December 13, 2010, the City Council adopted Resolution 7716 which approved
revisions to the City’s Personnel Manual. Generally, the major revisions added
“disclaiming” language to the introductory passages of the manual, eliminated
inconsistencies between Sections 1.05 and 1.37 regarding probationary employees, and
clarified that the City Council, not the City Administrator, approves employee terminations.
Also on December 13, Staff indicated that numerous inconsequential revisions were made
to correct references, statutory and otherwise, position titles, footnotes and other notations.
References to policies which no longer exist were deleted and a few poorly written and
unclear passages, typographical errors, redundant paragraphs and other issues were
updated. Finally, Staff indicated that the offensive behavior / sexual harassment policy
would need to be revamped and that Kennedy & Graven has provided the necessary
revision.
Discussion:
At the December 13, 2010, a suggestion was made to provide the Council with copies of
personnel manual for discussion purposes, to ensure the policies continue to represent the
goals of the City Council. Because the Personnel Manual is too large to effectively review
and discuss in one fell swoop, Staff will present the manual in logical sections, the first
referencing “Workplace Issues”, labeled Exhibit 1.
Section 1.27 of the Personnel Manual is the policy outlining Offensive Behavior and Sexual
Harassment. The policy in the manual is the existing version; the policy as suggested by
Kennedy & Graven is attached at the end of this report, labeled Exhibit 2
Recommendation:
Review attached Section One of the Personnel Manual and the suggested revision to
Policy 1.27. Minor revisions can be made at the direction of the Council by motion, major
revisions such as the revision to Section 1.27 should be done by resolution. (The Council
determines what constitutes a minor and major revision.)
