Item Title/Subject: Ultimate Fighting Moratorium – Expires August 2008
The Mounds View City Council adopted Resolution 7145, which approved a one-year
Moratorium on boxing and mix martial arts/ultimate fighting events. This moratorium will
expire at the end of August, 2008, and staff would like direction from the City Council on
whether to start the proceedings to ban boxing and mix martial arts/ultimate fighting
events or to allow the moratorium to lapse and allow such events.

Item Title/Subject: Update Regarding Salary Compensation Study
Introduction:
The Council has asked staff to obtain quotes from area HR consultants to assist the City
Council with the proposed compensation study to be completed this year.
Discussion:
The Council has asked whether a consultant is even needed given the relative availability of
salary and benefits data through the League’s website. There are two key issues which
necessitate some level of consultant interaction, the first being that there are enough
positions on our staff that either do not compare well across the board or not enough other
communities have the position at all which limits the usefulness of a comparison. The
second issue is the compensation framework as specified in the Personnel Manual. As the
Council is aware, the “Stanton Mean” is no longer a valid benchmark since the reports are no
longer being produced. Staff had provided to the Council a suggested list of comparable
cities which included ALL metro area cities with populations between 9,000 and 20,000
which had their own police force. Springsted indicates that while the resulting list could be
considered comparable, the existence of a police department in a community (or lack
thereof) does not make enough of an impact to justify omitting an otherwise comparable city,
such as Arden Hills or Vadnais Heights. Thus, an HR consultant would meet with the
Council to get a better understanding of its perception of comparability and ask additional
questions to help clarify the City’s overall compensation goals.
Recommendation:
We are still collecting information from consultants but based on some discussions we’ve
already had, staff is reasonably confident that all tasks can be accomplished to our
satisfaction keeping the cost to less than $6,000. Additional materials may be provided to
the Council at the meeting as information may arrive subsequent to the preparation of this
report.

Item Title/Subject: Resolution 7267 Adopting the Special Outdoor Event
Policy
At the February and March Work Sessions, Staff and the City Council presented a draft
policy for special outdoor events. Many businesses have requested to hold special
outdoor events, including Moe’s, The Mermaid, and most recently Robert’s Sports Bar
and Entertainment. Staff was directed by the City Council to come up with draft policy
language that would address a parking plan, security plan, clean up plan, placement of
portable toilet facilities, entertainment or stage locations, and proof of Workers
Compensation Insurance, Fire Inspection, and a requirement to notify residents of the
event. At the direction of the City Council, Staff added other provisions to the policy to
include a requirement for a public notice announcement to all residents within a 500 feet
radius of the proposed outdoor event; approval by the Police Chief, Fire Marshal and
Clerk-Administrator before the event is presented for Council consideration; and a
requirement for the establishment to have liability insurance. Each business or
organization or person(s), will only be allotted two (2) Special Outdoor Event Permits
per calendar year.
At the February Work Session, the City Council determined a fee for a Special Outdoor
Even at $100 per event for 2008, however, Staff feels that the $100 fee may not be
enough to cover administrative costs. For example, it may cost upwards to $100 to mail
public notices to residents within 500 feet of the event. Staff would like to price this
Special Outdoor Event Permit at $150.00 for 2008, and in 2009 conduct a cost analysis
to determine if $150.00 covers the City’s administrative costs. Staff would report to the
City Council prior to the adoption of the 2009 Fee Schedule on this cost analysis.
Attached is the Special Outdoor Event Permit Policy for the City Council’s consideration.
Recommendation:
Staff recommends approval of the Special Outdoor Event Policy. If the City Council
agrees with this policy, Staff will notify all businesses in Mounds View of this new policy
by First Class Mail. This information will also be provided on the City’s website.

Adopting the Special Outdoor Event Policy
WHEREAS, a Special Outdoor Event means an outdoor event where the
general public is invited to attended, held by person(s), business or organization,
including but not limited to, festivals, concerts, tournaments, and parties; and
WHEREAS, many businesses have requested to hold special outdoor
events; and
WHEREAS, at the February and March Work Sessions, Staff and the City
Council presented a draft a policy for special outdoor events; and
WHEREAS, staff was directed by the City Council to draft policy language
that would address a parking plan, security plan, clean up plan, placement of
portable toilet facilities, entertainment or stage locations, and proof of Workers
Compensation/Liability Insurance, passing Fire Inspection, and a requirement to
notify residents of the event.
NOW, THEREFORE BE IT RESOLVED, that the Mounds View City
Council does hereby adopt the attached Special Outdoor Event Permit Policy,
effective April 29, 2008.

SPECIAL OUTDOOR EVENT PERMIT POLICY
A Special Outdoor Event means an outdoor event where the general public is invited to
attend, including but not limited to, festivals, concerts, tournaments, and parties. Any
person(s), business or organization shall be required to obtain a permit for any special
outdoor event. Such permit shall be obtained on a form available by the City
Clerk/Administrator. A person seeking issuance and approved by the City Council shall
file an application with the Clerk-Administrator on forms provided by the Clerk-
Administrator. The application must be accompanied by the fee as set forth in the City’s
Fee Schedule. To ensure an orderly approval process, Permit applications must be
filed not less than sixty (60) days or more than one year before the date on which the
event is proposed to take place. Failure to file in a timely manner may be grounds for
denial of the permit. The permit application must include the following:
1. The name and phone numbers of at least two people in charge of the event,
and phone numbers where they can be reached on the day of the event.
2. Diagram set-up of the event. Diagram must include entertainment or stage
locations (if applicable), portable toilet placement, parking areas, and
placement of trash containers.
3. Date and hours of the event. The hours of the event must be in compliance
with the City’s Noise Ordinance.
4. Proposed parking plan.
5. Type of entertainment
6. Security Plan: A security team of a minimum of two persons, including an off
duty Police Officer, per 100 persons expected at the event, shall be present at
the event. The off duty Police Officer will be paid for by the permit applicant in
addition to the $100 permit fee. The security team shall be easily identifiable
by a uniform, shirt, etc.

9. First Aid facilities – please indicate who is providing this service.
10. Insurance. This permit may be granted only after the applicant has secured
and filed with the Clerk-Administrator insurance and submits a Certificate of
Liability Insurance. The policy or policies shall specifically provide for payment
by the insurance company on behalf of the insured all sums which the
insured’s shall be obligated to pay by reason of liability imposed upon them by
law for injuries or damages to persons or properties arising out of the activities
and operations of the insured.
All insurance required by this special outdoor event policy shall be issued by
insurance companies acceptable to the City and Minnesota. The Certificate of
Liability Insurance must specify:
Workers’ compensation insurance that meets the statutory
obligations with coverage B – employer’s liability limits of at least
$100,000.00 each accident, $500,000.00 each disease – policy limit and
$100,000.00 disease – each employee.
(1) Fifty thousand dollars ($50,000.00) for bodily injury to any one
(1) person in any one occurrence and subject to the limit of one (1)
person, in the amount of one hundred thousand dollars ($100,000.00) for
bodily injury to two (2) or more persons in any one (1) occurrence and in
the amount of ten thousand dollars ($10,000,00) for injury to or destruction
of property of others in any one (1) occurrence.
(2) Fifty thousand dollars ($50,000.00) for loss of means of support
of any one (1) person in any one (1) occurrence and, subject to the limit for
one (1) person, one hundred thousand dollars ($100,000.00) for loss of
means of support of two (2) or more persons in any one (1) occurrence.
11. Special Outdoor Event Permit must be approved by the Police Chief, Fire
Marshal and Clerk-Administrator prior to City Council approval. Applicant must
pass a fire inspection prior to any approval by the City Council.
12. Payment for the Special Outdoor Event Permit per the Mounds View Fee
Schedule.
13. Before issuance of a Special Outdoor Event Permit, the Clerk-Administrator or
designee must notify residents within a 500 feet radius of the event that the
City Council will consider the issuance of a Special Outdoor Event Permit.
This notice must be mailed at least 10 days prior to City Council consideration
of the permit.
Exceptions: The following are exempt from the requirements of the Special Outdoor
Event Permit:
a. City-Sponsored Events.
b. Private Parties: A Private Party is any party held on private property in
which members of the general public are not invited.
No individual or entity shall be issued more than two (2) such permits in a calendar
year, and all Special Outdoor Event Permits must be approved by the Mounds View City
Council. The Mounds View City Council meets every second and fourth Monday of
each month.

Item Title/Subject: Review and Discuss Draft Special Outdoor Event Policy
At the April 28, 2008, City Council Meeting, the City Council tabled Resolution 7267
(Resolution Adopting a Special Outdoor Event Policy). Many questions were raised at
the City Council Meeting, including:
Security Plan: Would the City want to require all special outdoor events to
have security? Should security only be required when
liquor is served at the event?
Clean-Up Plan: What type of deadline should the City enforce businesses
to clean their area after such an event?
Exceptions: Who should be exempt from this Special Outdoor Event
Policy? Churches? Businesses who want to have sidewalk
sales, like Mounds View Square? National Night Out?
Attached is the staff report presented to the City Council on April 28, 2008, regarding
the Special Outdoor Event Policy draft and the City Attorney’s opinion on the Special
Outdoor Event Policy.
Recommendation:
Please discuss and review the draft of the Special Outdoor Event Policy.

Item Title/Subject: Update on Recruitment of Community Development
Director and Public Works Director Positions
Community Development Director
The deadline for submitting applications for the Community Development Director
position was April 30, 2008. Staff received twenty-four (24) applications, and of those,
nineteen (19) satisfy the minimum requirements. Staff did receive one application from
a city employee who is currently working in the Community Development Department.
Staff is currently reviewing the nineteen (19) qualified applications, and will likely begin
interviewing the applicants on May 15th and 16th. Staff’s intentions are to have a top
candidate for approval at the last City Council Meeting in May.
Public Works Director
The deadline for submitting applications for the Public Works Director position was also
April 30, 2008. Staff received ten (10) applications, and of those, three (3) meet the
minimum requirements. Staff will be interviewing the three (3) candidates on Monday,
May 5th, prior to this Work Session. The interview panel will consist of myself, Jim
Ericson and Joe Rhein of Bonestroo. Staff will update the City Council at this Work
Session in regard to the candidates. If the candidates interviewed do not have the
skills, experience and abilities to lead the department and coordinator the City’s Streets
and Utilities Improvement Program, then Staff and the City Council can discuss
alternatives in recruitment at this meeting.

Item Title/Subject: Review Town Hall Meeting Informal Questions and
Responses
Background
At the April 19th Town Hall meeting, Planning Associate Heidi Heller facilitated an
inter-active display to encourage residents to think and talk about Mounds View’s
Comprehensive Plan. The Comprehensive Plan Task Force and Ms. Heller
developed six questions that were displayed on the wall at the Town Hall
meeting. Residents provided input by anonymously placing stickers under the
following five columns for each question: Strongly Agree, Agree, Somewhat
Agree, Disagree and Strongly Disagree. Attached are the results of the informal
and unscientific questions and responses.
Issue
One of the six questions displayed at the Town Hall meeting specifically relates
to the redevelopment roundtable discussion held by the City Council at its April
7th Work Session. The question: “Do you support City acquisition of property or
public financial assistance to promote redevelopment on the County Highway 10
corridor?” received 53 responses, 46 of which were “Strongly Agree” or “Agree”.
Feedback Request
One of the next steps suggested at the April 7th redevelopment roundtable was to
determine the City Council’s future role with redevelopment. The Council may
determine this by also answering the question from the April 19th Town Hall
meeting regarding City acquisition of property or public financial assistance to
promote redevelopment along County Road 10. Staff requests the City Council’s
feedback regarding this issue.

- We need to have a place for teens that is in biking distance. A
skate park or swimming pool would do that.
- We need more recreation options close to our homes to stay

Item Title/Subject: Discussion of Resolution 5555
Discussion:
The Mounds View City Council adopted Resolution 5555 on April 9, 2001. The intent of
the resolution was to reaffirm the relationship between the City Council and the Clerk-
Administrator. There have been many discussions in past Work Sessions and City
Council Meetings about the intent and interpretation of Resolution 5555 since its adoption.
On February 10, 2003, Staff presented to the City Council Resolution 5944, a resolution
rescinding Resolution 5555. At this meeting the City Council tabled action, and Resolution
5555 still remains in effect.
Staff received a letter from the AFSCME Council 14 Union on April 12, 2004, challenging
Resolution 5555. AFSCME felt that Resolution 5555 violated the Public Employment
Labor Relations Act (PELRA). According to the City Attorney’s memo dated June 2, 2004,
the resolution “does not prohibit direct communication between City staff and Council
members by instead merely outlines a policy whereby Department Directors are directed
to report to the City Clerk-Administrator in performing the day-to-day business of the City.”
Further, the City Attorney felt that Resolution 5555, ”does not infringe on the First
Amendment rights of AFSCME’s members or constitute an unlawful restraint of their
collective bargaining rights.”
Recommendation:
Review the previous staff reports and Council Minutes relating to Resolution 5555 and
provide direction to staff, if necessary.
