Item Title/Subject: Joint Meeting with the Festival in the Park Committee
Background:
For 2009, the City has budgeted $4,500 (Account Number: 100-4110-3900) in support
of the Festival in the Park. Last year, the City Council passed Resolution 7304
(attached), which authorized additional expenditures to the Festival in the Park, not to
exceed $5,300, to assist the Committee in payment of Insurance, Professional Bands,
Port-a-Potties, Irondale Marching Band, use of the City’s copier machine, and the Car
and Tractor Show. The Festival in the Park Committee would like to ask the City
Council if the City would assist in the expenditures for this year. The Festival in the
Park is scheduled for August 22, 2009.
Budget Discussion:
Attached is The Festival in the Park Committee budget. The Festival Committee needs
assistance on payment of insurance, Professional Bands, Port-a-Potties, Irondale
Marching Band, use of City’s copier machine, the Car and Tractor Show and Festival in
the Park Signage. Any help that the City could give to the Festival Committee would be
greatly appreciated. The Committee feels that contributions from area businesses may
be minimal due to the present economy.
Members of the Festival in the Park Committee will be present at this Work Session to
answer any questions.

1. What chairs will be used and who will provide them, set them up and
take them down?
- The chairs that will be used will be from the event center.
Volunteers or YMCA staff will set up and take down chairs.
2. What will the PA system be used for and can the band get by without
it?
- The PA system will be used solely for announcing our program, not for
amplifying any instruments. If we can provide the power drop, they will
use it for one mic.
3. Will there be any labor costs to the city?
- It was originally mentioned that city staff may be needed to clean
up, but that is no longer anticipated. Volunteers and/or YMCA staff
expect to set up and take down the chairs without any city staff
involvement.
4. What will the back-up plan be in case of inclement weather?
After further discussion with the band, a back-up date is not an
option. Pending council approval, the concert date has been set for
June 9th. The band director and Pat Prindle will be looking at the site
on Thursday, May 7th to see if there would be facilities that could be
used in case of a light rain or in case of cloudy weather. If the event
can not be held due to inclement weather and the event is cancelled
prior to 2 hours before the start time, we will receive a full refund
of the money.
5. What time do we want the event to start?
A 6:30 or 7:00 p.m. start time has been discussed. The final start time
will be finalized shortly.
6. Where will the event be held?
- City Hall park, exact location will be determined during the May 7th
walk through with the band director.
Key points
7. The Parks, Recreation and Forestry Commission is looking for a
verbal commitment from the council during the work session on May 4th to
continue to plan the event and to ensure ample time for advertising.
8. The desire to have an exemption from the current special event
permit as the event timing requires that we have the event prior to
final approval of that item.
9. The below listed businesses have committed to sponsoring the event
and they will be included in the advertising as be provided with space
to promote their business at the event. (This will be limited to a
specific space anticipated to be a table with printed flyers or
brochures. No other media will be accepted and we will work with City
Staff to ensure that the city code regarding this is adhered to.)

Item Title/Subject: Music in the Park
At the April 27, 2009, City Council Meeting, Darren Peterson (Park, Recreation and
Forestry Commissioner), updated the City Council on a program that the Commission is
planning called Music in the Park. This event will be located at City Hall Park, and is
presently scheduled for early June.
Members of the Park, Recreation and Forestry Commission will be attending this Work
Session to answer any questions or address any concerns that the City Council may
have in regard to this event. Many of the questions raised at April 27th City Council
Meeting are answered in the attachment submitted by the Commission. The
Commission would like to have approval of this event by the City Council at the next
City Council Meeting.

Item Title/Subject: Resolution 7464, Revising the Policy for the Mounds View
Citizenship Award
The City of Mounds View Citizenship Award recognizes ordinary citizens who have
demonstrated to improving the community. Past recipients of this award include:
2004: David Jahnke
2005: Frank Silvis
2006: Ed Lanz
2007: Don Hodges
2008: Barbara Haake
Nominations are open to the public and the award is subject to the following guidelines
below:
Eligibility:
Nominees must be:
• A Mounds View resident, business owner or land owners.
• Recent elected officials, City employees, City contractors, or political candidates
are not eligible.
Selection Criteria:
1. Courage: Exemplifies courage and determination to follow one’s own values.
2. Initiative: Demonstrates drive and initiative in his/her approach and
overcoming challenges on the way.
3. Time Commitment: Volunteers a significant amount of time and energy to the
betterment of the City of Mounds View and its residents;
more than just financial contributions.
4. Effectiveness: Generates positive results for the community.
5. Unselfishness: Does not expect anything in return for his/her actions, i.e.,
financial compensation, fame or political notoriety.
At the February 23, 2009, City Council Meeting, the City Council requested that the
second bullet, under eligibility, be changed from “recent” elected officials to “current”
elected officials. Staff was in the process in making the change, and it was discovered
that Resolution 6361, was passed on October 11, 2004, approving the Mounds View
Citizenship Award Policy. In order for the City Council to make any changes to this
policy, Staff will need to draft another Resolution to authorize this change. It was the
consensus of the City Council at the March Session to revisit the policy after the 2008
Citizenship Award was presented to the recipient, Barbara Haake.

Item Title/Subject: Outdoor Event Policy
Background:
On September 22, 2008, the Mounds View City Council adopted an ordinance creating
an Outdoor Special Event provision into the City Code. The purpose of adding the
provision was to promote the health, safety, and welfare of all residents and visitors of
the City by ensuring that special events do not create disturbances, become nuisances,
threaten life, health and property, and disrupt traffic or damage private or public
property.
Discussion:
Since the adoption of the policy, Staff has received 2 requests for Special Outdoor
Events: Sunrise Methodist Church and The Mermaid. Both organizations have
expressed opposition to this policy.
Sunrise Methodist: Sunrise Methodist Church would like to have an outdoor event on
August 22, 2009. This event would start at 2pm and end at 6pm.
They intend to grill hot dogs, have non-alcoholic drinks, and have
live Christian music. The Christian band would only play from
3pm to 5pm. All activities would be in their parking lot. Sunrise
Methodist Church intends to have church volunteers to clean the
parking lot after the event, and have First Responders for First
Aid. All residents are invited to this event.
Some of the issues raised by Sunrise Methodist are the cost, and
the requirement to have liability insurance. According to the code
requirements, the applicant must possess or obtain liability
insurance or protect damage arising from the event. Insurance
must be maintained during the duration of the event and the
coverage must be a commercial general liability policy. The
minimum limits must be at least $1,000,000. However, this
insurance requirement can be waived by the City Council if
Sunrise Methodist can verify that the insurance coverage is
impossible to obtain. Sunrise Methodist feels that the City may
be setting too many requirements for an event such as theirs.
The Mermaid: The Mermaid is in the process of planning a car show in their
parking lot. It is Staff’s understanding that there will be no food
or music being played outside during the event. The owner of
the Mermaid, Dan Hall, spoke to the Clerk-Administrator about
his concerns for requiring such a permit. Mr. Hall felt that he
would be essentially paying the City to just park vehicles in his
parking lot for the car show event. In addition, Mr. Hall further
stated that this permit is unnecessary, and The Mermaid always
ensures that the parking lot is well maintained and cleaned.
According to the City’s present policy on Outdoor Special Events,
The Mermaid’s car show event would require a permit regardless
of whether music is being played or if food being served outside.
Under the present policy, this event would require a permit
because this event is open to the public.
Staff would like some discussion with the City Council on whether this ordinance should
be rescinded. Many of the provisions of the Special Outdoor Event Code are already in
our City Code to include Nuisance provisions. It is Staff’s opinion that this policy may
be too broad, and is already requiring considerable Staff time to manage.
Attached is Ordinance 808, which established the Outdoor Special Event policy for your
reference.
