PLEDGE OF ALLEGIANCE ilkPledge of Allegiance was said. ROLL CALL MEMBERS PRESENT: Councilmembers Quick, Blanchard, Wuori and Mayor Linke. MEMBERS ABSENT: Councilmember Rickaby joined the Council Meeting at 7:06 p.m. ALSO PRESENT: Samantha Orduno, City Adminirator, Ric Minetor, • - ks Director/City Engineer APPROVAL OF MINUTES: MOTION/SECOND: Quick/Blanchard to approve February 24, 1992 minutes as amended. - Councilmember Wuori amended page thirteen, under "Council Business , paragraph_ 6, sentence 2 by deleting the last four words of the sentence and adding since 610 was put in. • 4 ayes 0 nays Motion Carried Mounds View City Council Page Two Regular Meeting March 9, 19410 SPECIAL ORDER OF BUSINESS: There was no Special Order of Business scheduled for this meeting. RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR Bill Frits, 8072 Long Lake Road, commented_that he had noticed the road restriction signs had been put up within the last week. Mr. Frits stated that he understood that all trucks with a limit of five tons are permitted on the roads posted, but that trucks over 5 tons need a special permit to travel on City roads. Mr. Frits asked the Council if all garbage trucks were getting permits? Mayor Linke indicated that the garbage trucks are getting permits and the road restrictions are being enforced. Mayor Linke further explained that each time a truck over 5 tons enters and drives on a posted 5 ton road, the garbage truck must obtain a permit. Randy Jackson, 5299 O'Connell Drive, stated that he was very disturbed by an article he read in the New Brighton Bulletin regarding things he stated about the parking problem at Robert's Off 10. Mr. Jackson further stated that the article made him look as though he was lying about talking to an officer regarding Roberts. The Police Chief's comment was that the statements referred to were never made by an officer. Mr. Jackson stated 0 that he had a witness to what was said by the officer in question. Roxanne Jackson, 5299 O'Connell Drive, stated that she contacted Lieutenant Brick. Ms. Jackson stated that there may have been a lack of communication between him and the Chief of Police. The Police Chief indicated that perhaps what he did say was misunderstood or maybe he didn't mean to say what he did, if in fact he did. Lieutenant Brick indicated to Ms. Jackson that Robert's was in violation of some codes and that the issues were being looked into and a citation may be issued in a couple of weeks. Ms. Jackson stated that she and her husband, Randy Jackson, did not appreciate the fact that it looked as though they were making these things up. Brad Jahnke, 8408 Eastwood Road, asked if he could obtain a copy of the questions that would be asked on the City Survey. Mayor Linke explained to Mr. Jahne that the meeting to discuss the City survey was posted on sign board and that the Council had not decided on the questions yet. Mayor Linke further stated that the format and questions would be discussed on the evening of the meeting, Wednesday, March 11. Mr. Jahnke then asked if the City had bought the printer that was brought up at the last Council meeting, what type was purchased and the cost. Samantha Orduno, City Administrator,indicated that a printer had been purchased. Orduno also indicated that it was the printer that the Council had approved which was a Hewlett-Packard IIID at a cost of approximately • $2500. 1 .unds View City Council Page Three gular Meeting March 9, 1992 PUBLIC HEARINGS Mayor Linke opened the public hearing to consider Wetland Alteration Permits for Long Lake Road at 7:05 p.m. Ric Minetor, Director of Public Works/City_Engineer, stated that because of the remodeling and mass confusion at City Hall, notices were inadvertently not published. Minetor stated that according to the City's code, the Council has the authority to issue wetland permits without a public hearing if they so desire. Minetor further stated that the Council had two options with regard to this public hearing: 1) reschedule it for a date two weeks from tonight, or 2) proceed with the hearing. Staff recommends rescheduling the hearing for two weeks from tonight. MOTION/SECOND: Quick/Blanchard to reschedule the public hearing to consider Wetland Alteration Permits for Long Lake Road for two weeks from tonight which would be March 23 , 1992 . VOTE: 5 ayes 0 nays Motion Carried •NSENT AGENDA Samantha Orduno, City Administrator, read the items on the proposed Consent Agenda. Councilmember Quick asked that Item 7, replacement of unmarked police vehicle, be removed from the Consent Agenda for clarification by the Clerk- Administrator. MOTION/SECOND: Rickaby/Wuori to adopt the Consent Agenda minus Item 7 regarding replacement of unmarked_polic-e—vim - VOTE: 5 ayes 0 nays Motion Carrie. Samantha Orduno, City Administrator, was asked by Councilmember Quick to clarify Item No. 7 taken from the Consent Agenda regarding replacement of the unmarked police vehicle. Orduno explained that the reason this item was removed was because a fund number had not been assigned to this expenditure. The replacement vehicle should be coded to the Forefeiture Fund. Councilmember QuickaskedOrduno to explain where-the funds in thisaccount come from. Orduno explained that these are funds raised from the sale of items confiscated in raids or drug busts. Orduno further stated that this fund is used mostly for police items such as bullet proof vests, squad •.rminals and radios. Samantha Orduno reviewed Staff Report No. 92-195C regarding the appointment of Henry E. Ruggles to the Planning Commission. Orduno stated that Mr. Ruggles is a resident of the City of Mounds View. Mr. Ruggles is a former banker and bank examiner and currently drives the senior van for the Park and Recreation Department. MOTION/SECOND: Quick/Rickaby to appoint Henry E. Ruggles to the Planning Commission for a three year term ending December 31, 1994 VOTE: 5 ayes 0 nays Motion Carried 2. Ric Minetor, Director of Public Works/City Engineer left the meeting at 7: 17 p.m. and returned at 7:20 p.m. 411 While Mr. Minetor had stepped out, Samantha Orduno, City Administrator, shared some information regarding another City and a survey they undertook. Orduno stated that the City of Fridley conducted a survey very similar to ours regarding what the residents liked about the City, best services, unnecessary services, and other general questions of this type. Fridley did the survey through the use of in-house personnel. Over 3, 000 questionnaires were sent out and the City received less than one-third of the questionnaires back. Fridley had hired a consultant te- process theresponses-.- The_respanses to_th 7estionnaire were returned to the consultant. The cost to the City of Fridley was $5,000 not including staff time. Orduno stated that the City Manager told her the cost of staff time was approximately 160 staff hours. Their cost was $5, 000 for the survey and in excess of $3, 000 in staff costs. The City of Mounds View's survey will cost less than $6,000 total. Ric Minetor, Director of Public Works, rejoined the meeting at this time and Staff Report No. 92-196C regarding the approval of the final plans for reconstruction of County mad-J from the City. Minetor -stated that the plans for Long Lake Road have been completed and are consistent with the details shown in the study report previously approved by the Council. Minetor further stated that the County would like to have the Council formally approve the plans. A copy of the plans are in the City Offices. Minetor asked that the Council approv • Mounds View City Council Page Five Regular Meeting March 9, 1992 the final plans for reconstruction of County Road J and authorize the City Engineer/ Director of Public Works to sign said plans for the City. MOTION/SECOND: Wuori/Blanchard to adopt Resolution No. _4204 Approving Plans for the Reconstruction of Long Lake Road Between County Road H and County Road J Mayor Linke asked with regard to a time line for the start of the project. Minetor stated May or early June as it takes approximately 6 weeks depending upon how quickly the state aid office processes the paperwork. Councilmember Quick asked if there would be a. sidewalk on the left side and if Long Lake Road would be 4 lanes wide like County Road I and County Road H2, and if this road would be typical of what is in New Brighton. Minetor responded that there would be a sidewalk on the left side and the road would be 4 lanes wide like County Roads I and H and • would it be constructed typical of what the roads are in New Brighton. Councilmember Rickaby commented regarding adding a sidewalk and Ramsey County wanting to turn the road back to us. Minetor stated that Ramsey County was not going forward with the changes that were suggested in the consolidation report. Mayor Linke stated that before any changes can be made with regards to roads being turned over to the City from the County, this Council must approve them. Councilmember Ri ckahy ked—whatt_he di stance would be between the sidewalk and the boulevard. Minetor responded that there would be 6 foot boulevards between the curb and sidewalk. Councilmember Rickaby asked if there was a City ordinance which prohibited bicycles from using sidewalks and who pays for the clearing of the sidewalks. Minetor replied that there is-no ordinance which prohibitsbicycles from using sidewalks in the City and the City would be responsible for keeping the sidewalks clear. • Councilmember Wuori asked if this was a two stage project beginning at the south and working north. Mounds View City Council Page S Regular Meeting March 9, 19 Councilmember Quick asked what would happen to Williams Pipeline. Minetor responded that the entire length of the pipeline for the project would be replaced. The pipeline would be set back from where it is now. The County is setting up a meeting with._Williams Pipeline for next week to talk about final details. Minetor responded that Dave Rollins, Desing Engineer, will be meeting with him to put a traffic plan in place. The project will only take up certain sections of the road at a time. Minetor further stated that at that time they will also decide where the detours will be placed with emphasis on local access to housing facing Long Lake Road. Mayor Linke suggested that Minetor notify the school system of the work being done. Councilmember Wuori stated that by late May or early June school will just about be over. VOTE: 4 ayes 1 nay Motion Carried Councilmember Rickaby stated the reason she voted against adoption • of this resolution was that sidewalks would increase the costs to the City and at this time she stated they were not necessary. Councilmember Quick stated that this item had been discussed previously by the Council and the safety aspects of pedestrian traffic going to and from Irondale High School more than justified the expense. Sidewalks are safe walkways that are utilized as a means of exercise. Long Lake Road between Mississippi Street and Silver Lake Road forms a loop which is used constantly by adults for walking. Councilmember Wuori also stated there are four parks along Long Lake Road-that-are-frequented very-often-by-children and adults_. 3 . Ric Minetor, Director of Public Works, reviewed Staff-Report No. 92-197C regarding the bid award for the construction of a new water tower. Minetor stated that three bids were received. The lowest of. the three bidders was Pitt - Des Moines, Inc. in the amount of $718,300. Four deduct items regarding the lighting plans for the tower could be eliminated. They are as follows: $5,300 for lighting of the column; $4,300 for west logo lighting; $7,400 for southeast logo lighting;--an - - - $4,300 for northeast logo lighting. Lighting costs would be approximately $21,300. Electricity and repairs would be approximately $6,000 per year if they were to be installed. Council wanted these prices to determine if they wanted to go ahead with the lighting. 4Itunds View City Council Page Seven Regular Meeting March 9, 1992 Councilmember Rickaby stated that the lighting was discussed at the last meeting of the Environmental Quality Task Force. The group consensus was that the Task Force opposed this amount of electricity being spent on lighting. This lighting goes against the priority of conserving electricity. _ ^ Mayor Linke polled the Council and it was felt that this was too expensive and felt the lights should just be placed at the top of the tower and the access point. Minetor stated that the cost without the lighting would be $697,000 with ten percent contingency for a total of $766,700 to Pit - Des Moines, Inc. Councilmember Rickaby stated that the Environmental Quality Task Force suggested that we use solar lighting. MOTION/SECOND: Quick/Blanchard to award bid to Pit Des Moines, Inc. for the construction of a new water in an amount not to exceed $766,700 which includes ten percent contingency to be charged to account number • 680-4121-705. These monies would come from the water bond fund and tear down of the old towers. Councilmember Quick commented that it was cheaper to tear down and put up one new tower than to refurbish the existing two. Ric Minetor, Director of Public Works/City Engineer, indicated that the main problem with refurbishment of the two existing towers is the lead paint and structure repairs need to be made at each tower. Councilmember Quick verified that Minetor had stated at a previous meeting that the towers would have to be completely shrouded in order to da the repairs as paint from_the towerswou-ld-ha-v-e to_be-contained when the towers were sandblasted and the dust collected and hauled away as hazardous waste. - Orduno stated this would be a potential liability. Bill Frits, 8072 Long Lake Road, asked if someone else would purchase and put up these towers or would they be scrapped out. Minetor stated that sometimes smaller towns will purchase these towers. What they do is-take t towers into the shop and structurally repair the towers before they put them back up. Minetor stated he had two - interested contractors contact the City. • VOTE: 5 ayes 0 nays Motion Carried 7 Mounds View City Council Page Eigh io Regular Meeting March 9, 19 4. Ric Minetor, Director of Public Works, City Engineer, reviewed Staff Report No. 92-198C, a request to use MSA Funds for the reconstruction of Long Lake Road. Minetor stated that the Council is required to formally request the Commissioner of Transportation to authorize the use of Municipal State-Aid Street Funds for use on a County-State Highway project. The total amount requested_ from State- Aid funds is $696,421.90. This is used to pay for the City's share of parking lanes, storm sewer, concrete walk, and other miscellaneous items for which Ramsey County requires city participation. MOTION/SECOND: Blanchard/Rickaby to request the Commissioner of Transportation to Approve Municipal State Aid Funds for Reconstruction of Long Lake Road. Councilmember Quick asked Minetor to explain what MSA funds are. Minetor explained that the gas tax that the taxpayers pay is placed in three funds; 'highway trust fund, county and city. The amount the City received is decided by population and number of miles the City has in Minnesota state aid network. VOTE: 5 ayes 0 nays Motion Carried • 5. Ric Minetor, Director of Public Works/City Engineer, reviewed Staff Report No. 92-197C regarding parking restrictions for Long Lake Road reconstruction. Minetor stated that Long Lake Road between County I and County Road H2 has been designed to be four lanes. Minetor further stated that parking would have to be posted no parking along this section. Minetor also stated that it is a requirement of Ramsey County to have the City Council adopt a resolution stating they are in concurrence with the parking restrictions. Ric Minetor, Director of Public Works/City Engineer, reviewed Staff Report No. 92-200C regarding parking restrictions ori streets adjacent to Robert's Off 10. These streets are Edgewood, Greenfield,__O'Connell and Clearview. Minetor stated that the residents came in with a petition at the February 24, 1992 asking the City to prohibit parking from 10:00 p.m. to 6:00 a.m. on these streets. Staff felt that this was an adequate amount of time to prohibit parking. If a problem arose on O'Connell and Jeffrey Drives, • these streets could be phased in at a later time. unds View City Council Page Nine lingular Meeting March 9, 1992 • Mayor Linke stated that this would allow parking on the east side of Edgewood Drive around the Robert's property. Mayor Linke and the Police Chief discussed County Road H2 and noted there is not enough adequate room to park. County will post Long Lake Road to 10 as no parking. Mayor Linke stated that there will be no parking on Greenfield by Mister Donut. Sue Janssen, 2440 Clearview, stated that when the petition went around she misunderstood what its purpose was. Ms. Janssen further stated that at this address they have five cars in the driveway. Ms. Janssen also stated that because of the different times these persons have to leave the house, two cars are parked in the street. Ms. Janssen asked if no parking or restricted parking is enforced from 10:00 p.m. to 6:00 a.m. then where can these cars be parked - on the lawn? Ms. Janssen suggested that perhaps the City hand out to the persons in the household stickers to display on vehicles when parked in the street. This would indicate to the law enforcement personnel that these cars belong to the residence. 411 Mayor Linke stated that this could cause an enforcement problem and would require much more time spent checking the vehicles for stickers, however, this item could be visited by the Council. Sue Janssen, 2440 Clearview, stated that there are not that many cars parked on Clearview at the present time and she has had no problems with violence or loud persons. Ms. Janssen also stated that Robert's brings in the right clientele. Ms. Janssen doesn't feel there is a problem on Clearview, but there will be if they post Edgewood no parking. Ms. Janssen stated she is opposed to the parking restrictions on Clearview. Ms. Janssen further stated that there was no time stated on the letter that she received regarding the meeting for Robert's. Michael Janssen, 2440 Clearview, stated that he usually does not attend Council meetings. Mr. Janssen further stated that he is in agreement that there is a parking problem with regards to Robert's. Robert's, he stated, does not have adequate parking as the cars are often three deep on the road. Mr. Janssen also stated that the residents of the city pay taxes to use the streets. Mr. Janssen also stated that if he parks on the front lawn or yard he will begivena ticket by the City because this is against City ordinance. Mr. Janssen stated that knew nothing about the parking restrictions until he received the letter in the mail Friday and that it was very short notice for Monday evening, and he 111 commented that the letter had no time indicated on it for the meeting. Mounds View City Council Page Tii, Regular Meeting March 9, 19 Mayor Linke. stated that these parking problems were brought up on Monday, February 24th at the Council -Meeting. Residents living close to Robert's did come into the Work Session to discuss this item. Mayor Linke stated that he brought up the parking restrictions for Clearview and Jeffrey Drive as he believes if the parking restrictions are placed on Edgewood and Greenfield the parking problem will move down to Clearview and Jeffrey Drive. Teresa Lexcen, 5229 Jeffrey Drive, was not alerted to the parking restrictions being suggested for Jeffrey Drive until 3 :30 p.m. , Friday, she stated she was informed by a letter in the mail that there would be a meeting on Monday evening to discuss these restrictions. Mayor Linke explained that Jeffrey Drive was not on the list at this time to receive restricted parking signs. Ms. Lexcen stated that she spoke to someone in the City Offices on Monday and that Jeffrey Drive was on the list and had been discussed at the meeting on Monday night. Ms.Lexcen further stated that it would be better if the City did not post Jeffrey Drive as she talked to the people on her street and they have a wait and see attitude to see if the parking restrictions on Edgewood and Greenfield cause the problem to move to Jeffrey Drive. Ms. Lexcen further suggested that resident could be given large cards to put in the vehicles window and to give friends and relatives that stated, "Residential Parking Only Permit". Ms. Lexcen also stated that the problem is that Robert's needs an overflow lot for parking. Ms. Lexcen further stated that the establishment has become popular because it has good bands and draws persons from as far away as the southern suburbs. Personally, Ms. Lexcen stated that the signs are a bandaid to the real problem. Ms. Lexcen believes that patrons of Roberts will park 3-4 blocks away to listen to the bands. Mayor Linke stated that the owner of Robert's is looking into an auxi-1-carry parking lot. Teresa Lexcen, 5229 Jeffrey Drive, asked if anyone from the City had gone into the establishment and checked the occupancy for violation of code. Samantha Orduno, City Administrator, stated that the owner of Robert's has been cited $100 per day for violation of code and that seating must be removed in the establishment to be consistent with seating stated by the City Code. Ric Minetor, Director of Public Works/City Engineer, stated that Mr. Waste had brought in a new site plan on Friday. Orduno stated that the $100 per day fines had begun on Tuesday. • aunds View City Council Page Eleven gular Meeting March 9, 1992 Cindy Camarillo, 5299 Greenfield stated that this establishment does not bring in nice people. A resident that lives on Edgewood Drive found a half full bottle of Vodka and a butcher knife. Ms. Camarillo stated these types of things are found in the neighborhood often. Ms. Camarillo stated that people from Robert's don't care where they park and have blocked her driveway in the past. Ms. Camarillo stated that 8 :00 p.m. to 1: 00 a.m. would be a good span of time for a parking restriction on these streets as in the summer the kids are still out at 8: 00 p.m. Ric Minetor, Director of Public Works/City Engineer, stated that the signs are premade and the time can be placed on by decal. At the meeting on March 2 the general consensus of the group was 10:00 p.m. to 6:00 a.m. Ms. Janssen stated that with the parking restrictions, and the five cars at their residence, when they have company there is no where for the company to park. Mayor Linke stated that anyone having a party or company where it will involve street parking on restricted streets, should notify the police • department and specify the times and the address of the party. This should be done a couple of days ahead of time. Ms. Camarillo stated again 8:00 p.m. to 1:00 a.m. would be good times as in the summer she would like to enjoy the neighborhood. On Friday night Greenfield was packed with cars and her driveway was blocked. Mike Janssen stated that he would call every couple of days and let the police department know that they will be parking on the street if parking is restricted. Bruce Ritter, 5240 Greenfield, stated that it appears that the bar has more pull over residents than the residents have over the bar when it comes to street parking. Mr. Ritter states the problem is that the patrons of Robert's are parking on theta payer's streets. These- streets hesesstreets should be made residential parking only. Mayor Linke stated that these are public streets and the City cannot stop anyone from parking on these streets unless they are designated no parking. The residents who brought the petition to the City were advised that it would impact them with the no parking signs and they were willing to accept this inconvenience. Bruce Ritter, 5240 Greenfield, stated that cars that are left 2-3 days in Robert's parking lot are towed away. Mayor Linke responded that it was Robert's parking lot and there is nothing the City can do about 410 that problem. Mr. Ritter stated that Roberts is a good business for the community and that it is a nice establishment, but they don't have Mounds View City Council Page Twel l, Regular Meeting March 9, 19 enough parking. Also, Mr.. Ritter commented that the patrons of Roberts throw beer cans in people's yards and urinate on their property, as well as constantly turn around in their driveways. Teresa Lexcen asked if the decision on the signs would be made tonight and, if so, will the signs be the same signs that Jeffrey Drive will receive in the future if signs are needed. Mayor Linke stated that the decision would be made tonight on the parking restriction signs and that the residents on Jeffrey Drive, if the parking problems arose, would have to come in and request parking restrictions. Ms. Lexcen again brought up the solution of using stickers or cards and issuing them for parking. Mayor Linke stated that the problem arises when no parking signs are posted. Jeffrey Drive is not a part of this problem at this time. Mayor Linke was not sure if what the apartment complex had decided to do regarding the parking problem. Samantha Orduno, City Administrator, noted that the apartment complex • is going to put up signage that reads, "Residential parking only, violators will be towed. " Daryl Madison, 5200 Jeffrey Drive asked if there could be more parking behind Donatelle's available. Mayor Linke indicated that Mr. Waste was looking at that option. Paul Johnson, 5259 Greenfield, wants to put in a new driveway so he would have to park two cars on the street. The idea of being able to call the police and let them know there will be cars—parked—onthe—street oncethe—res-t-r-ic ions—a-r-einorce W-i-l1 really help. Bruce Ritter stated that permanent parking signs stating no parking should be place on certain streets. Orduno stated that the Council was trying to do something that would help the residents and that it was a very fair thing to do. Orduno stated that she had compared petitions and there are persons on Clearview who are in favor of the parking restrictions. There are 8 persons on Clearview who have signed either one or both petitions, the -_ one presented tonight and the one presented last week. Mike Janssen stated that when the petition was brought around it was stated to him as either sign the petition or have the bar crowd on his street. Mayor Linke stated that the City of Mounds View does not have the officers that the City of St. Paul or University of Minnesota has to enforce permit parking. Until a motion is made as to what to do, this problem is still up in the air as to which way to go. Minetor explained why the enforcement of stickers is difficult. The officer would have to check every car on the street for a sticker. Minetor stated it is easier to have a ban or have no ban at all. • Mayor Linke stated that another concern would be who pays for the stickers. Teresa Lexcen stated that there would not be that great a need for stickers because there is not that much on street parking going on at the residences on a weekly or daily basis. She stated that it is of her opinion that a permit parking situation would work. Minetor, Director of Public Works/City Engineer stated that he understands it to be unconstitutional to give preferential treatment to residents on certain streets. Annette Steiner, 5220 O'Connell Drive, stated they have no traffic from the bar, but people do park on the street every night. She stated that people who live on the street should have more rights than the people going to the bar. Teresa Lexcen, 5229 Jeffrey Drive, stated a permit that is big and bright that could be placed on the dashboard of the vehicle would be easy for the police to see for enforcement purposes. Ron Michna, 5287 Edgewood Drive, brought up the seating oroccupancy problem at Robert's Off 10. Orduno explained to Mr. Michna that Mr. Waste had been cited for not being in compliance with the site plan for seating. Mayor Linke stated that these two codes do not agree with each other. Mr. Michna stated that his belief was_that there was an_ error in issuance of the permit for Robert's Off 10 many years ago when the establishment was changed from a restaurant to a bar. Mr. Michna stated that because of this error Mr. Waste is getting a bad deal and having to pay for the City's error in issuance of a permit. Mr. Michna also stated that he understood that the City's Code does not allow a business to have parking across a public way. Samantha Orduno, City Administrator, explained to Mr. Michna that that the site plan for Robert's Off 10 met the conditions of the Code to which this establishment is grandfathered. Mr. Michna asked if Mr. Waste had submitted a plan for parking when he expanded the seating in the establishment. Mr. Minetor explained to Mr. Michna that because Mr. Waste had adequate parking, in fact more than enough parking, to satisfy • the requirements of the Code to which he is grandfathered into and there was no parking plan needed. Mr. Waste was in compliance. Mr. Minetor further explained that Mr. Waste was being cited for signing a statement on his permit that stated that the site plan was true and accurate and it was not. This is the reason that Mr. Waste has to remove seating to come into compliance with the Code established for his building. Mr. Michna stated that the remodeling that added seating is occupancy. Mr—Minetor s-tatedthat occupancy is the use of the building, i.e. , changing from a bar to a used car building would be an occupancy change. Samantha Orduno, City Administrator, stated that it is difficult for cities and states to deal with property rights. The U.S. Supreme Court at this time is guarding property rights. Orduno stated whether we agree or disagree, Robert's has rights on the property. All the City can do is try to balance the rights of businesses to do business and the rights of City residents. Mayor Linke stated that he read what Mr. Harrington had said and that Ric Minetor reiterated was that when Mr. Waste removed the • volleyball court and put in seating Mr. Waste had enough parking for seating added. Mayor Linke stated that the City can't go in and arbitrarily tell Mr. Waste that he does not have enough parking. The City can only enforce the Code for Mr. Waste's establishment. Mayor Linke stated that according to the site plan and the floor plan if Mr. Waste is in compliance, the City can't do anything. Mr. Waste has been asked to remove seating in order to come into compliance. Mr. Michna stated that he and a neighbor have had problems with their mailboxes being knocked off or destroyed and Mr. Michna understands that this type of vandalism is against federal law. Mr. Michna asked who will continue to fix their mailboxes or replace them. Mayor Linke stated that individuals have the right to park on public streets and that he sympathized with Mr. Michna when it comes to those types of problems. Mr. Michna asked why County Road H2 had no parking posted when it • is two lanes wide and has a curb. Councilmember Wuori stated that parking restrictions on County Road H2 were requested by the residents of the apartment building so there could be a loading an unloading zone there. Mike Janssen, 2440 Clearview, suggested that the City have the Fire Marshall look at the occupancy load in Roberts at 10:00 p.m. and at 1:00 a.m. as these are peak times. Michna questioned the time frame of 10: 00 p.m. to 6:00 a.m. Samantha Orduno, City Administrator, responded that this was the time on the petitions that were submitted by the residents. Mr. Michna stated that this time frame would create a problem for him at times. Mayor Linke concurred with Mr. Michna and stated that perhaps 9:00 p.m. to 2 :00 a.m. would make more sense and would then cover the second shift workers. --Mr—Michna—asked the Council to take a handcount -to-see--what time-- — frame they would want. • Orduno took hand count and it appeared to be 9:00 p.m. to 2:00 a.m. that was favored. Mayor Linke stated that the Council was looking into that situation now and may not be any of those events happening. _ Ms. Janssen, 2440 Clearview, asked if there were signs to be considered for Clearview she would like to be notified by letter in her mailbox. Mayor Linker indicated that is why the City Administrator put the letters out prior to this meeting to make sure all persons were notified of the proposed parking restrictions. Ms. Janssen thanked the Council for listening to the complaints. Roxanne Jackson thanked the Council and staff for all their efforts. Mr. Michna confirmed that there would be no parking along the east side of Greenfield at any time. Wally Steiner, 5220 O'Connell, asked that after the signs go up could the Police Department patrol those streets that had been posted to • see if people are still parking there. Mayor Linke asked the residents to call if there were still parking problems on the posted streets. Report of Mayor Linke: Mayor Linke stated he had spoke earlier to Samantha Orduno, City Administrator, regarding the Governor's comments on how he was going to solve the State budget problems. Mayor Linke stated that there will be a 3 .5 percent cut in Local Government Aid and he had questioned if this was in the remainder to be paid to us or in the total Local Government Aid. Samantha Orduno advised him that it was all Local Government Aid. Mayor Linke stated that last year $83 , 000 had to be cut from the budget and this year it looks like double that. Report of Administrator: Orduno reported that with the cut in Local Government Aid the City will • have to look at reducing the budget from now until the end of the year by $163,000. Orduno explained that when private citizens are cut in pay they cut something from their budget. When the City receives a cut there are so many restrictions put on the City by state and federal government and mandates placed on top of that. Orduno stated the Primary Presidential Election as one mandate and the Hepatitus B shots as another. These mandates cost the City a great deal of money. Orduno encouraged everyone to attend the meeting on Wednesday, March 11, 1992 at 6: 00 p.m. with Decision Resources to discuss the City survey in the City Hall Council Chambers. Staff had no report. There will be work in wetland areas as well as in the buffer zone. Under the City Code, this will re- quire a public hearing and Council determination to authorize issuing permits. Rice Creek Watershed and possibly Corps of Engineers permits are also necessary. Council set a public hearing for March 9, 1992 to determine the appropriateness of City Wetland Alteration permits. Unfortunate- ly, staff did not send notices or publish this hearing due to mis-communication. The Council is not required to hold a Public Hearing for issuing wetland alteration permits. Therefore, the Council has 2 options at this time. The first is to reschedule the public hearing and the second is to take action without a public hearing. Explanation/Summary (attach supplement sheets as necessary.) SUMMARY; Staff has reviewed the concerns of residents regarding overflow parking from Robert's Off 10 utilizing residential streets. The residents have presented a petition requesting prohibition of parking between 10 p.m. and 6 a.m. Staff has determined that the cost of signing the streets involved would cost approximately $1,000 for signs and posts and about $1,500 for labor and equip- ment. This is based on approximately 35 signs at a materials cost of $30 per sign and our standard charges for labor and equipment. The streets that would be signed are: Edgewood Drive from Woodale Drive to County Road H-2 Greenfield Avenue from Woodale Drive to O'Connell Drive Clearview Avenue from Irondale Road to Edgewood Drive O'Connell Drive from Greenfield Avenue to Jeffrey Drive Ri in or City Engineer/Director of Public Works RECOMMENDATION; Staff recommends that Cduncil move to restrict parking between 10:00 p.m. and 6:00 a.m. on the roads listed above. Explanation/Summary (attach supplement sheets as necessary.) SUMMARY: Staff has reviewed the concerns regarding parking along County Road H-2 between Long Lake Road and State Highway 10. This road has no improved shoulders and affords no safe parking area adja- cent to the paved surface. In addition, overflow parking from businesses in the area tends to cause patrons to park illegally along the boulevard and on the edge of the road surface. This creates an unsafe situation when pedestrians cross the road from between parked vehicles at night. Discussion with the Police Department regarding enforcement problems has caused staff to recommend that this section of County Road H-2 be signed "NO PARKING".
