Resolution Approving An Intoxicating Liquor Business
License (Off-Sale) for ABC Liquor located at 2840
Highway 10
In accordance with Section 502.08 of the Mounds View City Code, a public hearing is required for all
liquor license renewals.
502.08: LICENSE HEARING:
No issuance of a new license, transfer of an existing license, renewal of an existing license, issuance
of temporary special event or banquet licenses, or special outdoor consumption endorsements for
the sale of intoxicating liquor on-sale or off-sale, club, Sunday sales or on-sale wine shall be
hereafter granted by the Council until a public hearing has been conducted by the Council after
published notice in the official newspaper at least ten (10) days in advance of the hearing.
The City of Mounds View issued an intoxicating liquor license for ABC Liquor in June of 2006, and their
renewal is before the Council for consideration. ABC Liquor’s Intoxicating Liquor License will expire June
30, 2007. The notice of this public hearing was sent out to residences within a 350 feet radius, and the
Notice of Public Hearing was published in the Mounds View/New Brighton Bulletin.
ABC Liquor has submitted their city liquor license application materials and the applicable fees. The
following investigations and inspections have been conducted to determine whether there is cause for the
City to deny any of the above referenced intoxicating liquor license application:
Police Inquiry and Investigations (Mounds View Police Department)
No Issues. The establishment did pass a compliance check. The compliance check was done by the
Mounds View Police Department.
Utility Billing Inquiry (City of Mounds View)
The Finance Department has issued a satisfactory report for ABC Liquor.
Fire Inspection (City of Mounds View Fire Marshal)
The City’s Fire Marshal has not done a yearly inspection yet on ABC Liquor. This license will be pending
a satisfactory inspection.
Recommendation
Staff recommends that the City Council open the Public Hearing for public input. Staff recommends
approval of this business license. If this renewal is approved, the time period of this license will be July 1,
2007 to June 30, 2008.

Resolution Approving an Off-Sale Intoxicating Liquor License for
ABC Liquor
WHEREAS, ABC Liquor’s Intoxicating Liquor License expires June 30, 2007; and
WHEREAS, all City of Mounds View business licenses must be approved by the
City Council; and
WHEREAS, staff recommends approval of ABC Liquor’s Intoxicating Liquor
License, pending a satisfactory fire inspection from the Mounds View Fire Marshal.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does
hereby approve an Off-Sale Intoxicating Liquor License for ABC Liquor for the period of
July 1, 2007 to June 30, 2008, pending a satisfactory fire inspection from the Mounds

There was incident at Vino & Stogies. Please refer to the Police Chief’s memo for more information.
Utility Billing Inquiry (City of Mounds View)
The Finance Department states that the establishment owes money on their utility bill. This liquor license
will not be issued until payment is made on the utility bill. The utility bill payment was due on May 31st.
Fire Inspection (City of Mounds View Fire Marshal)
The City’s Fire Marshal has not inspected Vino & Stogies and this liquor license will not issued until a
satisfactory report from the Mounds View Fire Marshal is issued.
Recommendation
Staff recommends opening the Public Hearing for Public Comment. If the City Council does decide to
approve this liquor license, then this license will not be issued until utility bill payment has been made and
a satisfactory fire inspection has been done. The time period for this license will be July 1, 2007 to June
30, 2008.

WHEREAS, Big Top Liquor’s Intoxicating Liquor License expires June 30, 2007;
and
WHEREAS, all City of Mounds View business licenses must be approved by the
City Council; and
WHEREAS, all necessary investigations for the establishment have been
conducted, with the exception of the Fire Marshal’s inspection; and
WHEREAS, staff recommends approval of Big Top Liquor’s Intoxicating Off-Sale
Liquor License pending a satisfactory fire inspection.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does
hereby approve an Off-Sale Intoxicating Liquor License for Big Top Liquor for the period
of July 1, 2007 to June 30, 2008, pending a satisfactory fire inspection from the Mounds

SuperAmerica decided to renew their 3.2 Off Sale Malt Liquor License (they were contemplating
on not renewing their 3.2 Malt Liquor License) and Staff did not receive their application
materials until Tuesday, June 5, 2007, and therefore was not able to present it to the City
Council on June 11, 2007 along with the other liquor licenses.
SuperAmerica has submitted the city liquor license application materials and the applicable
fees, and Certificate of Liability Insurance. The notice of this public hearing was sent out to
residences within a 350 feet radius, and the Notice of Public Hearing was published in the
Mounds View/New Brighton Bulletin. The following investigations have been conducted to
determine whether there is a cause for the City to deny SuperAmerica’s Off-Sale 3.2 Malt Liquor
License:
Police Inquiry and Investigations (Mounds View Police Department)
This establishment did pass a compliance check this year and the Mounds View Police
Department issued a satisfactory report.
Utility Billing Inquiry (City of Mounds View)
The Finance Department has issued a satisfactory report.
Fire Inspection (City of Mounds View Fire Marshal)
The Fire Marshal has issued a satisfactory report on the property.
Recommendation

Robert’s Sports Bar and Entertainment has not had a fire inspection for this year. This liquor license will
not be issued unless the Mounds Fire Marshal issues a satisfactory fire inspection.
Recommendation
Staff recommends that the City Council to open the Public Hearing for public comment. Staff
recommends approving Robert’s Sports Bar and Entertainment’s application for an On Sale Intoxicating
Liquor License pending a satisfactory inspection from the Mounds View Fire Marshal and full payment of
their utility bill. The time period for this license will be July 1, 2007 to June 30, 2008.

The City of Mounds View issued an intoxicating liquor license for The Mermaid in June
of 2007, and their renewal is before the Council for consideration. The Mermaid
Intoxicating Liquor License will expire June 30, 2008.
The Mermaid has submitted their city liquor license application materials and the
applicable fees. The notice of this public hearing was sent out to residences within a
350 feet radius, and the Notice of Public Hearing was published in the Mounds
View/New Brighton Bulletin.
The following investigations and inspections have been conducted to determine whether
there is cause for the City to deny any of the above referenced intoxicating liquor
license application:
Police Inquiry and Investigations (Mounds View Police Department)
The Mounds View Police Department has issued a satisfactory report for The Mermaid.
Staff has submitted a background check application on the owner of The Mermaid to the
Minnesota Department of Criminal Apprehension. The liquor license will be contingent
on a satisfactory background check.
Utility Billing Inquiry (City of Mounds View)
The Finance Department states that the establishment owes money on their utility bill.
In addition, Ramsey County Property Records show that The Mermaid continues to be
delinquent in their property taxes for 2007. This liquor license will not be issued until
payment is made on the utility bill and delinquent property taxes. According to Section
502.04(b) of the City Code, No license shall be granted for operation on any premises on
which taxes, assessments, utility bills or other financial claims of the Municipality are
delinquent or unpaid. The City Council may approve this liquor license contingent on
payment of their utility bill and property taxes, or the City Council may deny renewal in
accordance with Section 502.04(b).
Fire Inspection (City of Mounds View Fire Marshall)
The City’s Fire Marshall is in the process of conducting final inspections on all liquor
establishments. This license will be contingent on a satisfactory fire inspection.
Recommendation
Staff recommends opening the Public Hearing for public comment. Staff has a
resolution prepared in case the City Council wishes to approve the liquor license
contingent on a satisfactory background check, utility bill and property tax full payment,
and a satisfactory fire inspection. If approved, the time period for this license will be
July 1, 2008 to June 30, 2009.

Introduction:
The applicant, Craig Gilb with Merryville Farms, is requesting approval of a conditional use
permit to operate a summer seasonal produce stand in the parking lot of the Mermaid at
2200 County Road 10 from approximately June 21 – September 3 each year. Merryville
Farms has been operating their summer produce stand at Mounds View Square since 1996
and would have continued in that location except that the mall property owners did not renew
the lease agreement with Merryville Farms this year. Merryville Farms wanted to stay in
Mounds View and was welcomed by the Mermaid to move to their parking lot.
Requirements:
Section 1115.04, Subd. 2: which allows for open or outdoor service, sales and rental as an
accessory use for a period of greater than 10 days with a Conditional Use Permit (CUP).
Section 1125.01, Subd. 1e: The Planning Commission is required to review the possible
adverse effects of the requested conditional use.
Section 1125.01, Subd. 1g: which states that the Planning Commission shall make findings
of fact and recommend such actions or conditions relating to the request as it deems
necessary to carry out the intent and purpose of the Zoning Code and forward such findings
to the City Council.
Discussion:
The produce stand would be open seven days a week from approximately 10:30am to
6:30pm, and would be selling produce home-grown from Waverly, Minnesota. The stand is a
gazebo-like structure with a roof and is 14 feet wide and 9 feet high at the peak. The stand
requires no utility hook-ups and would take up about two parking spaces. Merryville Farms
was granted a Conditional Use Permit for their Mounds View Square location, but since
conditional use permits go with the land, not the user, they need to apply for a new CUP for
their location at the Mermaid. Staff is not aware of any problems associated with this
operation since they have been in Mounds View.
Signage for the produce stand will be banners affixed to the gazebo base and lettering on the
roof. As was done previously, the conditional use permit is drafted in such a way so they will
not need to appear before the Planning Commission and City Council each year, as long

as Merryville Farms submits a letter of permission from the property owner and a current site
plan to the City prior to setting up the stand each year. The CUP will remain in effect
indefinitely so long as there are no changes to the operation and there have been no
problems or reasons, which would warrant the City Council to re-examine the CUP.
CUP Considerations:
Chapter 1125 of the Zoning Code requires that the City Council review and address any
potential adverse effects which include, but are not limited to, relationship with the
Comprehensive Plan, geographical area involved, potential depreciation, the character of the
surrounding area and the demonstrated need for such a use. Each of these potential
adverse effects is addressed below.
Relationship with the Comprehensive Plan. The Comprehensive Plan encourages existing
businesses to remain in the city along with the introduction of new businesses within Mounds
View when compatible with surrounding uses. The Mermaid is zoned Planned Unit
Development (PUD) and is surrounded by commercial and industrial zoning designations and
land uses. If the requested conditional use permit were approved, this CUP would be in line
with the Comp Plan “Community Commercial” and “Regional Commercial” land use
designations for the Mermaid site.
The Location and Character of the Surrounding Area. The Mermaid is located on the corner of
County Road 10 and County Road H. The produce stand would be located in the corner of the
parking lot, closest to the intersection for the best visibility. There are no residential properties
within sight of this location and the proposed produce stand would not be out of place in this
commercial neighborhood, nor should it affect any neighboring properties.
Depreciation. The proposed produce stand will only be operating for a few months during the
summer and will result in little, if any, adverse effect upon the surrounding area.
The Demonstrated Need for Such a Use. The applicant is proposing a small produce stand to
operate during the summer and only during daylight house. This business has been very
successful in Mounds View for the past 11 years, and offers a variety of fresh fruits and
vegetables to the residents.
Summary:
All zoning and code issues are satisfied with this request. The Planning Commission
unanimously (6-0, Meehlhause absent) recommended approval of this request on Wednesday,
June 6, 2007.

Recommendations:
After taking testimony from staff and the property owner, the City Council can take one of the
following actions related to the request:
1. Recommend approval of the conditional use permit. Resolution 8005 is attached if the
Council so chooses.
2. Recommend denial of the conditional use permit. If the City Council selects this option,
Staff would need to be directed to draft a resolution of denial with findings of fact
appropriate to support the denial.
3. Table the request. If additional information is needed before a decision can be rendered
or if more discussion is needed, the Council can simply move to table the request until
such information has been provided. Because of 60-day requirements, the Council would
need to act upon the request by July 17, 2007 in order to avoid an inadvertent approval.

Introduction:
On May 7 and again on June 4, 2007, the City Council reviewed code enforcement staffing
levels in the Community Development Department. The Council asked staff to explore
alternatives to increase our code enforcement presence.
Discussion:
Last year, the City Council authorized the PSO position to work ten hours a week to help the
department stay on top of the code enforcement workload. This summer it has become
apparent that additional staff hours would be necessary to respond to the growing volume of
complaints and violations in our neighborhoods. The PSO position presently works 30
hours a week (20 hours in the Police Department and 10 hours with Community
Development) and would be able to work up to an additional ten hours a week through the
end of August. While this will not fully resolve the code enforcement backlog and staffing
deficiency, it will certainly help. Such an arrangement was concluded to be the most cost
effective short term solution to our code enforcement needs.
As we start the planning process for the 2008 budget, the issue of code enforcement will
again need to be reconsidered, as the additional hours assigned to the PSO is a temporary
response to a long term issue.
Recommendation:
Staff recommends approval of Resolution 8002 which allows the PSO to work up to an
additional ten hours per week through the end of August. The additional cost (up to
$142.50 per week) will be absorbed by the existing personnel budget for the Community
Development Department.

WHEREAS, to address a growing volume of reported and witnessed nuisance
code violations, there is an immediate need in the Community Development Department to
increase its code enforcement presence to better respond to complaints and violations;
and,
WHEREAS, the Public Service Officer, who presently works ten hours per week in
the department on code enforcement duties, is able to work an additional ten hours per
week on code enforcement activity through September 1, 2007; and,
WHEREAS, the cost for the additional ten hours per week through September 1,
2007, will be assigned to the existing community development personnel budget with no
further adjustment or modifications necessary.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Mounds

A Resolution Approving Business Licenses for 2007-2008
WHEREAS, all City of Mounds View Business Licenses expire June 30,
2007; and
WHEREAS, all City of Mounds View business licenses must be approved
by the City Council; and
WHEREAS, staff recommends approval of the business licenses for the

NOW, THEREFORE, BE IT RESOLVED that the Mounds View City

Item Title/Subject: Resolution 7090 Approving a Service Contract for
the City Hall Elevator
Background:
The one year warranty on the renovated City Hall elevator expired at the end of
April. According to various state and federal regulations, monthly service and
systems checks must be performed on this elevator. In the past this service has
been provided by All City Elevator Company.
Discussion:
Three quotes were received to provide the required monthly service. The quotes
received were from:
• All City Elevator, Inc. for $94.00 per month which includes the annual no-
load test in accordance with A.N.S.I. A-17.1 Code requirements.
• Eagle Elevator for $110.00 per month which does not include the annual
no-load test in accordance with the A.N.S.I. A-17.1 Code requirements.
• Metro Elevator, Inc. for $95.00 per month which includes the annual no-
load test in accordance with the A.N.S.I. A-17.1 Code requirements.
This service as quoted by all three venders is normally referred to as an Oil and
Grease Agreement. Any repairs determined to be needed during these service
calls will be billed separately.
It should be noted that All City Elevator did the upgrading of the elevator during
the City Hall Rehabilitation project. Also, the emergency telephone in the
elevator is currently programmed to call All City Elevator when used. Due to their
familiarity with the elevator, in addition to submitting the low quote, staff
recommends that All City Elevator continue to provide these services. This would
be a two year contract and would automatically be renewed for successive one
(1) year periods thereafter unless either party serves written notice to cancel.
Recommendation:
Staff recommends that the City Council approve awarding a service contract to
All City Elevator for the maintenance of the City Hall elevator.
