Ric Minetor, Director of Public Works/City Engineer, reviewed Staff Report No. 92-277C regarding the second reading of a major subdivision for Mounds View Business Park West Addition. Minetor stated at the May 11, 1992 City Council meeting, Resolution No. 4229 was adopted approving the preliminary plat of Mounds View Business Park West Addition. The Mounds View Municipal Code, Chapter 42, requires that all major subdivisions be approved at both the preliminary and final plat stage. Ric Minetor, Director of Public Works/City Engineer, reviewed • Staff Report No. 92-278C regarding the minor subdivision for 8298 Knollwood Drive, Arnold Scholljegerdes. v dAPPROVED glans View City Council Page Three Regular Meeting May 26, 1992 Mr. Scholljegerdes is dividing one lot into two lots. Minetor stated that the request is in full compliance with all require- ments of Chapter 42 of the Mounds View Municipal Code. MOTION/SECOND: Quick/Wuori to adopt Resolution No. 4233 Approving the Minor Subdivision for the Property Located at 8298 Knollwood Drive VOTE: 5 ayes 0 nays Motion Carried 3 . Samantha Orduno, City Administrator, reviewed Staff Report No. 92-279C Rescheduling the July 6, 1992 Work Session to July 7, 1992. Orduno stated that on the first of the year the Council adopts a resolution rescheduling all Council Meetings and Work Sessions that fall on legal holidays. Even though the 4th of July falls on Saturday this year, a number of employees have asked for a four day holiday over the 4th of July. In order to grant the four days, staff would encourage the City Council to move the scheduled Monday, July 6th Work Session to Tuesday, July 7. . MOTION/SECOND: Wuori/Rickaby to adopt Resolution No. 4231 Amending Resolution No. 4159 Rescheduling City Council Meetings Falling on Legal Holidays VOTE: 5 ayes 0 nays Motion Carried 4. Ric Minetor, Director of Public Works/City Engineer, reviewed Staff Report No. 92-280C Regarding City Wide Parking Restrictions. Minetor stated that the Council discussed the concept of a City Wide parking ban between the hours of 2 :00 a.m. and 6:00 a.m. with staff at the May 4 Work Session. Staff has prepared an ordinance that would implement this parking restriction. If the Council is in favor of proceeding on this Ordinance, the first reading can be held tonight. The second reading could then be set for June 22, 1992 . Minetor stated that if the ordinance were approved, signing would occur near the end of July. At this time, staff is suggesting placing signs at every road entering the City, and possibly at major intersections within the City. MOTION/SECOND: Quick/Wuori to approve and waive the first reading of Ordinance No. 511 Regarding City Wide Parking Restrictions 'Councilmember Rickaby stated that she is opposed to this ordinance because of the way in which it reads. The ordinance states that signs will only be placed at entrances to the City and major intersections. . This would be very difficult to enforce. Rickaby stated buying enough signs to be able to enforce this parking restriction would cost the City more money than it was saving. APPROVED Mounds View City Council Page Fou Regular Meeting May 26, 199 Rickaby further stated that the section of the ordinance that states " . . .no person shall stop, stand, or park a motor vehicle, . . . " seems to be very broad and very difficult to enforce. Rickaby also stated that when the Robert's Off 10 issue was discussed that people had problems with parking restrictions. These persons had stated that everyone in the household worked and that in some cases there were five cars. Rickaby stated that nowadays with taxes and other payments the way they are, everyone in the household has to work. The city has not made any provisions for these cases where there are five in the family and five working. Rickaby stated that the problems with this parking restriction addressed by the people haven't been resolved. Rickaby stated that she isn't comfortable with passing an ordinance to prevent these people from parking on the street without speaking to them further. Rickaby stated she is opposed to this action. Sue Janssen, who gave her address as living on Clearview, stated that she is opposed to this parking ban. She stated that she has lived in Mounds View since 1967 and there has been no problem with plowing or any kind of parking in this town. Ms. Janssen stated that she is upset because the City is trying to take the parking away without notifying the village people. Ms. Janssen also stated that she found nothing regarding these parking restrictions in the New Brighton Bulletin, which is to be the City's official newspaper and Ms. Janssen stated that this is against the law that the City is to publish notice of this type of change. Ms. Janssen wanted to know whose idea it was. This issue has been discussed in the past and the reason it goes nowhere is that no one wants it. Ms. Janssen stated that no one she has spoken with wants parking restrictions. Ms. Janssen further stated that her son, Michael, was at the Council meeting a couple of weeks ago to ask about parking restrictions and was told at this time the Council was not working on it and that was a lie. Mayor Linke warned Ms. Janssen to not make accusations or charges that she could not substantiate. At this point, Ms. Janssen calmed down and apologized admitting that she was just very upset about the parking restrictions. Ms. Janssen asked if there were private meetings held on this issue. Mayor Linke stated that the Council does not hold private meetings and that this issue had been talked about previously. Mayor Linke explained the process of ordinance changes such as this. Ms. Janssen went on to say that she had heard that the City was laying off an officer so how could the City afford to buy all the sign it would take to post the parking restrictions. APPROVED Slnds View City Council Page Five Regular Meeting May 26, 1992 Mayor Linke stated that this issue had been brought to the City Council by the Police Department and Public Works. Mayor Linke clarified the fact that there was no officer being laid off. There was no one being laid off. Mayor Linke then clarified the budget process and explained that the first part of the budget process is just beginning and that right now its a "pie in the sky" budget. Ms. Janssen asked where the money is coming from to buy the signs and hire the people to put up the signs. Ms. Janssen asked that the City poll the community to see if they want restrictions on parking or not. Ric Minetor, Director of Public Works/City Engineer stated that this issue came to the Council Work Session. At the Work Session Council asked if staff could draft an ordinance pertaining to the issue. The ordinance is then brought to the Council Meeting and has its first reading which is its introduction. Per City Charter an ordinance must have two readings before adoption. Minetor stated that staff had prepared a first reading. A public hearing for resident input and a second reading could be held in 14 days on this item. Samantha Orduno, City Administrator, displayed a copy of an article written in the New Brighton Bulletin dated 1992 regarding thecity wide parking restrictions. This news was not included in the headline but was a part of the article written on the meeting. Orduno asked the residents to read through the articles in the Bulletin even if the subject is not in the headline because many times the reporter branches off from the headline in to some of the other items that were discussed during the meeting. Ms. Janssenstated that shehas-never- fought the City. She stated that it wasn't her personality. Ms. Janssen wanted to know how much it would cost the City to buy the signs and install them. Mike Ulrich, Public Works Foreman, stated that it would cost approximately $1500 if every entrance street to the City on the outer perimeter were posted. Ulrich stated that if the City were to do Long Lake Road, Sherwood, Ardan, and Hillview which would be doubled for a -----cost-of $3,-000 for-materials and labor. = Ulrich stated that the labor cost could be recouped in the fact that the City would not spend the extra time with snowbirds and going back • three and four times to plow the streets because the snowbirds wouldn't be there. APPROVED Mounds View City Council Page Si ll, Regular Meeting May 26, 19 Ms. Janssen asked why the City couldn't plow odd/even. Janssen stated that she has been here since 1967 and never had any problem with snowplowing. Janssen further stated that if the car was in the street it would just get plowed around. If the owner of the car doesn't move it, plow around it and have it towed. The City could make money that way. Mayor Linke stated that cities don't make money towing cars. The odd/even approach would not be cost effective for the City because of the city's size. The streets that are being plowed are not that wide and the City doesn't have many new streets. Mayor Linke stated that these parking restrictions would help the Police Department. There have been a lot more burglaries and thefts from cars as well as damage to cars. It would help to have cars off the streets and if there were a car parked between 2:00 a.m. and 6:00 a.m. it could be a burglary in progress because the residents wouldn't be parking there. Mayor Linke listed a number of cities surrounding Mounds View that have parking restrictions in effect. Ms. Janssen asked if these signs would be up only during the winter Al) snowplowing or would they be up all year. Ms. Janssen also asked if there has been trouble all of a sudden. Mayor Linke explained that the problems are getting worse as the City grows. Ms. Janssen asked if the City was going to issue preferential parking for residential parking because there are five persons in her household with cars and someone always ends up parking in the street. Mayor r,i nke_stated that he also has four drivers in hiq family—and four cars. When he leaves the house, he has to move at least one car and further stated that he sets aside a-little extratimeto do this. Mayor Linke suggested that the City change the driveway ordinance to allow parking within one foot of the property line with written permission of property owner next door. Ms. Janssen stated that she is really opposed to City wide parking restrictions. Janssen indicated that her taxes went from $356 to $952. The—residents in this City don't need any more taxes or—burdens Janssen stated that the City should help the young kids, pay for field trips, give money to the schools instead of putting up parking signs. Mayor Linke explained that the City is not part of the school and that there is a state law that prohibits one government agency to give mone to another for those purposes. APPROVED ounds Vty Council Page Seven gular Meeiew tCiing May 26, 1992 Councilmember Quick stated that only 16% of your tax dollar goes to the City while 55% of your tax dollar goes to the school district. Mayor Linke stated that with the restrictions the City could do a better job of plowing and this is the taxpayer's money at work. Also, arresting burglars is another way of the taxpayer's money at work. Mayor Linke stated that he rode with a squad a couple of weeks previous and that in seven hour's time they had five "smash and grab" calls regarding thefts from cars. Councilmember Quick stated that this type of crime is escalating all of the time. Mayor Linke stated that there is much more graffiti in the City on the park buildings and other places that indicates the gangs are moving out to the suburbs. Ric Minetor, Director of Public Works/City Engineer, stated that it would cost $1500 to $2500 and that not having to replow because of snowbirds would recoup this money in two to three years. Samantha Orduno, City Administrator, made a statement that this is no 0 longer the small Village of Mounds View. This City is a first ring metropolitan suburb in terms of crime and residents moving into the City of Mounds View. The City is not the same as it was in 1967 and it won't be the same community as it is today in 1997. Orduno encouraged residents to call City Hall to verify things that they have heard in order to receive the right information. Too many times people are getting upset over items and don't have the right information due to the rumor mill. Again, Orduno encouraged anyone who had questions regarding the City to call City Hall and be directed to the person who would have the most knowledge in the area they have questions. Mayor Linke stated that the Police Department and Public Works Department have the health, safety and welfare of its residents as their first concern-. The City doesn't-go around just putting upno -- parking signs for the heck of it. These issues were brought to the City Council by the Police and Public Works Departments. Alice Frits, 8072 Long Lake Road, stated that with the reconstruction of Long Lake Road she would loose part of her driveway. Ms. Frits stated she has a large family and during holidays there are many cars. Mayor Linke__reminded Ms. -Fr-its that this is from 2: 00 -a:-m. until 6:00----- a.m. and not during the day. Mayor Linke further stated that persons having overnight company from out of town or a party, should call the Police Chief and he can give authority for you to have cars on the Aft street at those special times. Mayor Linke stated that he has the same lip problem when he has everyone over during the holidays. APPROVED Mounds View City Council Page Eigh Regular Meeting May 26, 199 Sue Janssen stated she has sisters from Texas and New York and since her father passed away she entertains her mother and family gatherings are always held at her house. Janssen stated she understands now that she can call the Police Chief and get approval from him. Councilmember Rickaby suggested that the City have this ordinance read by an attorney. • ine or s a e. a e a. •iscusse• is or•inance wi 'ar ' arney, although Mark Karney has never seen the actual written document, regarding the legality of the enforcement of the ordinance. A number of cities post the entrance streets to their City with no parking. Minetor also stated that the Council can approve areas that can be prohibited from these parking restrictions due to the way in which the ordinance is written. Councilmember Rickaby stated that this ordinance, in her opinion, could not pass constitutional muster. Alice Frits stated that the no parking on lawns ordinance is not enforced. People are still parking on their lawns. Ms. Frits wants t ll know if these parking restrictions will be enforced or are they just another law on the books. People park on their boulevards. Mayor Linke stated that parking on boulevards is not legal. Ms. Frits stated that she understood that cars had to be parked on paved driveway. Mayor Linke stated that he has seen a few parked on lawns, but when he does he calls on them. The cars need to have two wheels on a paved drivewayarea_to—be_legal_ Councilmember Rickaby stated that parkingalongthe boulevard is not legal. People are parking on their boulevards and this is not generally enforced according to the Chief. If this ordinance passes, I don't think it should. Bill Frits, 8072 Long Lake Road, stated that the parking lane on Long Lake Road does not make a lot of moxy. Mr. Frits asked why the City is putting a parking lane on Long Lake Road and then telling them they can't pare-ori it. Discussion followed regarding the parking lane on Long Lake Road. Mayor Linke explained the parking lane and its use. Minetor explained that parking in a travel lane on Long Lake Road is illegal. This road has to meet County state aid standards and is to 410 have a full shoulder if it has no parking lane. APPROVED *nds View City Council Page Nine Regular Meeting May 26, 1992 Bill Frits stated that these roads used to have ditches along them and now they are boulevards. Mayor Linke would like to see the code changed regarding the width of the driveway. Councilmember Quick stated that a party can widen their driveway by using crushed stone. This can be looked into when the code is rewritten. Mayor Linke stated that crushed rock disappears very quickly. Councilmember Quick stated that people are getting a lot of wrong information that comes out of some meetings they attend. Some of the persons who attend the meetings do not fully understand the process or what the process is and this leads to a misunderstanding. MOTION/SECOND: Quick/Wuori to Approve and Waive the First Reading of Ordinance No. 511 Regarding City Wide Parking Restrictions and Set Second Reading and Informational Meeting for June 22, 1992. • Councilmember Quick stated that he has four vehicles but he deals with it in that you just have to learn to stack cars in an orderly fashion. There is a savings to the City in the long run. VOTE: 4 ayes 1 nay Motion Carried 5. Ric Minetor, Director of Public Works/City Engineer, stated that the agreement from Ramsey County had not been received by the City for tonight's meeting. Staff recommended tabling of this meeting to a future meeting. Samantha Orduno, City Administrator reviewed Staff Report No. 92-282C regarding Resolution No. 4230 Adopting the 1992 Long Term Financial Plan and. the 1993 Budget. Orduno stated that the Mounds View City Charter requires that the City_ Council adopt, by resolution, an Annual Budget Calendar. Orduno stated that this calendar will be posted and mailed 40 to those persons who wanted any budget information mailed to them. These persons attended the budget hearing in March. APPROVED Mounds View City Council Page Tell Regular Meeting May 26, 19 Councilmember Quick commented that the calendar appeared to be a very ambitious schedule. Samantha Orduno, City Administrator, reviewed Staff Report No. 92-283C regarding Resolution No. 4235 Amending Resolution No. 4099 Establishing a Uniform Schedule of Fees and Charges. Orduno explained that two months ago, portions of the City's schedule of permit and license fees were increased to reflect increased costs incurred by the City and competitive market rates. At the time the Council adopted the amended fee schedule, staff noted that other fees were being examined and would be brought to Council for approval within the next two months. Orduno stated that the adjustments that are proposed are consistent with increased City processing costs and are also consistent with market rates in the Metro area. Don Brager, Finance Director, reviewed Staff Report No. 92-284C regarding the Water Connection Surcharge. Brager stated that recently passed legislation authorizes the Department of Health to assess an annual fee of $5.21 for every service connection to a public water supply that is owned or operated by a city, town or water district. This water connection surcharge is to pay for state water supply testing. Brager further stated that the operator is required to collect the fees and to pay the State on a quarterly basis. The first payment would be due September of 1992 . Brager recommended that this money be collected on a quarterly basis and that Council consider adding a 10% administrative fee to defray the expense of adding this charge to the computer system and the ongoing costs of billing for it. On a quarterly basis the additional amount which would be billed would be $1.43. Rickaby stated that when the street light utility was discussed we have minimized the cast of_utti.ng it on the billin_g_because we already bill people. Because this was mandated by state this would then cost a lot more than something the City processes do. Mayor Linke stated that it would cost $1500 more or less. This would 410 be the cost to the City for bookkeeping and keeping track of these dollars and then sending a check to the state. Mr. Brager stated that he could address this issue in more detail. Mr. Brager stated that he spoke with the City Utility Account regarding the process of entering this information on the computer. Mr. Brager explained the process to be followed and then indicated that the street light utility administrative charge was $1750. Ric Minetor, Director of Public Works/City Engineer stated that the City has to test for copper and lead beginning July 1. MOTION/SECOND: Wuori/Rickaby to adopt Resolution No. 4236 Authorizing the Billing of City Utility Customers for the State Mandated Water Connection Surcharge VOTE: 5 ayes 0 nays Motion Carried REPORTS: Councilmember Wuori - Councilmember Wuori stated she was honored to • have been present at the AMM Banquet where Mayor Linke was sworn in as a member of the AMM Board. Wuori stated she learned a lot more about the association at this banquet. Wuori stated that she hopes that . legislative issues that they are working on to bring forth metropolitan municipal problems are taken seriously. Councilmember Wuori stated that she also attended the Ramsey County Family Violence Meeting. The six month reported was presented and gives a good start to what is going to continue as a five year program. Linke stated that he will attend his first meeting on June 25, 1992. 2) Mayor Linke will miss the meeting on June 8th. Linke stated that it will be his pleasure to be at Irondale's graduation ceremony handing . _ , graduate from Inrondale that evening and then Mayor Linke will spend that evening as a chaperon to the Irondale all night party at the Mermaid. - Report of Administrator: No report. Report of Staff: 1. Ric Minetor stated that he had received a letter from Mark Karney stating that Harstad litigation is being dropped. Harstad could bring this up in the future again. 2 . a) Mike Ulrich, Public Works Foreman, reviewed a memorandum which he had submitted regarding lighting of the City Hall Building. Ulrich explained that he had NSP complete a survey of City Hall buildings to check out lighting for energy conservation. Ulrich stated that the results of the survey were that many of the existing fixtures are original and extremely inefficient. Ulrich explained the savings to be approximately $2700. This change in lighting could be financed by NSP or pay for the upgrade upfront with City funds. Councilmember Rickaby stated this was a good idea and one that theEnvironmentalQuality- Task-Force had discussed i-n the past. Mayor Linke stated that the City would save $500 right now but have $10, 000 non-budgeted outlay without all information. Council could discuss this item at its June 1 Work Session. The interest from NSP could be $500. There has been few too many high items brought to the Council from this department without having adequate information. Councilmember Blanchard stated she doesn't like things brought to the Council at the last minute. Blanchard stated that there were no figures for the Council to review. Councilmember Quick asked Mayor Linke what information was missing. Mayor Linke felt that he needed to see what the interest was from NSP and what are the funds in the contingency account. SUMMARY: The Council discussed the concept of a City Wide parking ban between the hours of 2:00 a.m. and 6:00 a.m. with staff at the May 4 work session. Attached is an ordinance that would implement this parking restriction. If the Council is in favor of proceeding on this ordinance, the first reading can be on May 26 . The second reading would then be set for June 22 , 1992. Should this parking restriction be approved, signing would occur near the end of July. At this time, staff is suggesting placing signs at every road entering the City, and possibly at major intersections within the City (such as Highway 10 and County Road I) . SUMMARY: Two months ago, portions of the City's schedule of permit and license fees were increased to reflect increased costs incurred by the City and competitive market rates. At the time that Council adopted the amended fee schedule, staff noted that other fees were being examined and would be brought to Council for approval within the next two months. The attached resolution reflects staff's recommendation for additional changes, primarily in reference to installation permit fees which have not been adjusted in several years. The recommended increases are consistent with increased City processing costs and are also consistent with market rates in the Metro area. Explanation/Summary (attach supplement eets as necessary.) SUMMARY: Recently passed legislation authorizes the Department of Health to assess an annual fee of $5.21 for every service connection to a public water supply that is owned or operated by a city, town, or water district. This fee is estimated to generate $4.8 million for State water supply testing. The operator is required to collect the fees and to pay the State on a quarterly basis. The first payment is due September 30, 1992. In order to collect the fees and send them to the State by September 30, 1992 we need to bill them to utility customers with the second quarter bills(April,May,June) which are to be paid no later than August 31, 1992 . To ease the burden of this fee on customers I recommend that it be billed on a quarterly basis. I further recommend Council consider adding a 10% administrative fee to defray the expense of adding this charge to the computer system and the ongoing costs of billing for it. The annual fee with a 10% administrative charge would be $5.72 ($5.21 x 1 1. 10%) . Based upon approximately 3, 020 water connections that administrative fee would generate $1,540. on a quarterly basis the o-un- -o u1d be $1.43 .
