SUMMARY;
The annual photo contest judging will take place on Monday,
December 2 , 1991. The City Council and Department Heads are
asked to vote for six pictures to be used in the 1992 issues of
the Mounds View City Newsletter. Staff will number and display
each photo and group them according to season. Ballots for
voting will be distributed at the meeting.

SUMMARY;
Representatives of Everest Development met briefly with City staff last week
and again today to discuss a proposed development for the Loose Ends site.
Everest is working in conjunction with the Saturn Corporation to construct
a "satellite dealership" on the site.
Saturn's concept is to provide one or two large dealerships in centralized
areas in the Metro area and construct smaller, area specific, operations in
suburban communities . The satellite operations include a showroom floor
which accommodates one new Saturn automobile, offices, general
lobby/reception area and two "maintenance bays" . Saturn provides general
service maintenance in the form of oil changes, tune-ups and other short
term maintenance activities .
Saturn's policy of providing general service maintenance on site poses
concerns in that the building will include 2 large garage door bays for oil
and other fluid changes. The drawings which were shown to staff indicated
that the bay doors would be on the front side of the building facing Highway
10 . The general maintenance activity and its emphasis, both from a visual
and actual activity perspective, may pose image concerns and be
inconsistent with the Year 2000 plans for Highway 10 .
The plan would utilize the existing building (with modifications) and
provide for approximately 123 parking- spaces,_ approximately 100 of the
spaces are for their new and used car inventory. As a new car dealership,
Saturn will carry an inventory of used cars which have been traded in for
new cars and will be sold on the site.
Everest has also proposed construction of a road behind the proposed Saturn
dealership which would connect at Jackson and cut through the Business Park.
The road, if constructed, could have a significant negative impact on the
surrouncring-neighborhood.
Representatives from Everest and the Saturn Corporation will be present
Monday night for the presentation.

SUMMARY:

In 1976, Bauer Welding, 2159 Mustang Drive, was given City approval for the
construction of their present facility. At that time, Bauer and the City
entered into a Development Agreement for the project. One condition of that
Development Agreement was that Bauer construct and maintain a road across
their property to serve as a second access to Townsedge Terrace Mobile Home
Park. This road was never constructed.
In 1982, Bauer expanded their facilities and entered into an amendment to
the original Development Agreement. Reference to the road was not made in
the amendment.
Bauer Welding contends that because no reference to the road was made in the
1982 amendment, they are not responsible for construction of the road. Our
attorney says that the action entered into in 1982 was an amendment to the
original Development Agreement and that all conditions of that document are
still enforceable.
At present, construction of the road has not occurred. As per Council
request, staff has referred this item to both the Fire and Police
Departments for their review and comment on the potential need for a second
access to Townsedge TPrr_ac_e_Mobil_e_H 'a the BauPr sJ tP. A copy of
the Fire Departments' comments are attached for your review. Police Chief
Ramacher has indicated that he will be available for comment at the December- --
2, 1991 Council Work Session.

Townsedge Terrace Mobile Home Park
Dear Paul:
Because the original construction of the Bauer Welding building
occurred in 1976, we no longer have any records as to what was
discussed. During this fifteen year period, we have never had an
occasion to utilize a second entrance if one were available.
The fire department's policy is that a minimum of two entranceways be
provided at all mobile home parks. Having recently inspected the
original roadway as proposed on the Bauer site, it is my opinion that
this roadway would be unworkable for our present apparatus and we
would be unable to use it. The minimum full and clear road width we
require for fire apparatus is 24 feet. If this cannot be provided on
the Bauer property, then I suggest that a search be made to locate a
second entrance to Townsedge Terrace.

REGULATION OF OUTDOOR CONCERTS

SUMMARY
The following outline provides for more specific possibilities with regard
to regulating outdoor concerts:
1. Outdoor Alcohol Consumption
Chapter 100 of the City Code currently prohibits the possession and
consumption of alcohol in parking lots and other outdoor areas of on- and
off-sale liquor establishments. This part of the code has not been
enforced at outdoor concerts . If the Council decides to continue to allow
alcohol at outdoor concerts, the Code should be amended to reflect this.
A temporary permit could be issued which would allow outdoor alcohol
consumption under certain conditions . Some conditions that might be
required include the complete fencing of the area in which the alcohol is
to be served and a ban on glass containers in the outdoor area.
2 . Hours of Operation
In order to remain consistent with the Nuisance section of the Code, any
outdoor concert should be required to end by 10:00 p.m.
3. Noise
Noise is an extremelydifficultaspect of outdoor Concerts to regulate. A
maximum decibel level could be set, but enforcement of that maximum
becomes problematic, as the City would need to purchase measuring devices
and to train staff in its use. Determining a maximum level would be
difficult as well, since intolerable vol = subjective determination.
