NOW, THEREFORE, BE IT RESOLVED that Rob Marty is being certified as being elected
to a two-year term as Mayor of the City of Mounds View; and that Al Hull and Carol A. Mueller are
being certified as being elected to four-year terms as City Council Members of the City of Mounds
View.
NOW, BE IT FURTHER RESOLVED, that the Charter Amendment Question is certified as
being passed, which adds new language to Chapter 7, Section 7.03 of the City Charter to limit
annual property taxes, levies and specified fees for City services to a maximum increase of 5%, or
the CPI (Consumer Price Index) plus 2%, whichever is less, and to restrict the ability of the City to
increase specified fund balances beyond set limits, with any increase in excess of these limits
being subject to voter approval.

Item Title/Subject: Second Reading and Adoption of Ordinance 780, an
Ordinance Approving Modifications to the Official
Wetland Zoning Maps for the City of Mounds View
Introduction:
As discussed at City Council meetings on September 25, 2006, October 9, 2006 and again
on October 23, 2006, the City's official wetland zoning maps date back to the early 1980s
and no longer reflect present conditions. On July 10, 2006, the City Council approved a
resolution authorizing Short Elliott Hendrickson Inc. (SEH) to create a new set of official
wetland maps based upon their recently completed wetland inventory, recent wetland
delineations and approved alterations. SEH has completed the contracted work and has
delivered to City staff updated maps. To modify the official maps, the City Council is
required to adopt an ordinance after holding a public hearing.
Discussion:
Generally speaking, the identified wetland areas on the new maps cover less area than the
previous map series, which is more a result of overly broad designations on the original map
series than actual wetland subsidence. In some cases the changes reflect wetland
alterations that have been approved in the last twenty years however due to the relative
inability to modify the original maps these changes have not been incorporated until now.
As directed by the Council at the October 23, 2006 meeting, a few revisions were made to
the maps. The revisions are as follows:
• The buffer was removed from Spring Lake,
• The buffer was removed from the storm water pond at the corner of County Road 10
and Spring Lake Road,
• The buffers were removed from numerous ditches, most on County Road 10,
• The buffer was removed from Judicial Ditch #1 under Lois Drive,
• The wetland in Spring Lake Park (and its buffer) was removed, and
• The “new” wetland identified on the west side of Long Lake Road was eliminated
based on the review and feedback of the RCWD inspector.
The one new item of significance that needs to be addressed is the “definition” of a wetland
according to Chapter 1010 of the Mounds View City Code. Wetlands are defined as:
Those areas greater than one acre in size that are inundated or saturated by
surface or ground water at a frequency and duration sufficient to support and
that under normal circumstances do support hydrophytic vegetation, hydric soils
and wetland hydrology, as delineated on the Wetland Zoning District Map.

The significance of this definition is such that any wetland area less than or equal to an acre
would not need to be noted on the official maps of the City or if noted, would not be buffered.
This likely explains why some of the smaller wetland areas were omitted from the original
maps series. One can only assume that the Council at that time felt it would be excessive to
require 100 feet of buffer on smaller wetlands. If the maps are prepared according to the
Code, at least three notable wetlands would not require a buffer, including the Hidden Hollow
wetland, the Bronson-Erickson-Quincy wetland and the Groveland Road wetland that was
discussed at the October 23 public hearing. It should be noted that Rice Creek Watershed
District would retain jurisdiction over the wetlands whether or not they are buffered.
Public Notice
Public hearings were held on October 9 and October 23, 2006. Notices were sent to virtually
every affected residential property owner in the City regarding the new maps, regardless of
whether or not the wetlands or buffer areas on the property changed. The intent of the
notice was to provide residents with a reminder about the City’s wetland regulations and
buffer requirements, valuable information especially for newer residents of the community
who may otherwise have been unaware of the requirements.
Not a Delineation
It should again be emphasized that the City’s Wetland Zoning maps do not take the place of
a wetland delineation. If a property owner is proposing work that may alter or impact a
wetland, a delineation will be required before the work may proceed. In the case of higher
density residential, new subdivisions, commercial and industrial development, a delineation
will be required if wetlands are present on the property, regardless of whether alteration is
anticipated.
Recommendations:
Ordinance 780 has been prepared for Council action. Staff is recommending the City
Council approve the second reading and adopt Ordinance 780 which approves the updated
and revised wetland zoning maps prepared by Short Elliot Hendrickson and dated November
8, 2006. Consistent with City Charter, staff further recommends the Council authorize the
publication of the ordinance summary in the official City newspaper rather than the full
ordinance, with a full text copy of the ordinance saved to the website.

On November 13, 2006, the Mounds View City Council adopted an ordinance which
approves updated and revised wetland maps. The original maps, created in 1981, were
inaccurate and no longer representative of current conditions. The new maps, along with the
full and complete text of this ordinance, are on file at the office of the Clerk Administrator and
are posted in their entirety on the City’s website, located at www.ci.mounds-
view.mn.us/ords/775.htm.

AN ORDINANCE AUTHORIZING THE ADOPTION OF NEW AND UPDATED
“OFFICIAL WETLAND ZONING DISTRICT” MAPS
WHEREAS, the City of Mounds View adopted Ordinance 318 in 1982 which
established the creation of wetland zoning districts in the City of Mounds View; and,
WHEREAS, Ordinance 318 also established the regulations pertaining to wetlands
and wetland buffers originally codified as Chapter 48 and later recodified as Chapter 1010;
and,
WHEREAS, pursuant to Chapter 1010 of the Mounds View City Code, amendments
to the official wetland zoning district maps shall be effectuated by ordinance.
NOW THEREFORE,
THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City of Mounds View Municipal Code Appendix D is hereby amended to
include reference to the following Special Ordinance No. 780.
Subd. 1. The City of Mounds View determined that a comprehensive update of the
wetland zoning district maps was necessary and so authorized their preparation.
Subd. 2. The resulting Wetland Zoning District maps dated November 8, 2006 and
attached as Exhibit A to this ordinance shall hereby replace any and all previous versions
of adopted wetland zoning maps and shall hereafter be identified as the Official Wetland
Zoning District Maps for the City of Mounds View.
SECTION 2. This ordinance is effective thirty days after its publication.
First read and introduced by the City Council of the City of Mounds View this
23rd day of October, 2006.
Second reading and adoption by the City Council of the City of Mounds View on
this 13th day of November, 2006.

Item Title/Subject: Introduction and First Reading of Ordinance 783, an
Ordinance Amending Exhibit E of the Municipal Code
Relating to Planning and Development Fees
Introduction:
The City last updated its planning fees for the 2005 fee schedule. Certain changes at
Ramsey County as well internally have increased the cost to process some planning
applications. The changes proposed are reflected ion the proposed 2007 Mounds View Fee
Schedule however Minnesota Statutes require such fees be adopted by ordinance.
Discussion:
The attached ordinance amends Exhibit E of the Municipal Code, the section where the
planning and development fees are identified. The fees should be considered the minimum
fee, as it may be the case that the fee collected is not sufficient to cover the costs associated
with the processing of the application. Applicants are made aware that they are responsible
for costs above and beyond the application fee and they sign a statement acknowledging
this.
A public hearing is required for this ordinance and it will be held in conjunction with the
second reading scheduled for 7:05 pm November 27, 2006.
Recommendation:
Staff recommends Council approval of the introduction and first reading of the attached
Ordinance 783 which amends Exhibit E of the Municipal Code pertaining to planning and
development fees.

Item Title/Subject: Consideration of Resolution 6958, a Resolution
approving a Wetland Buffer Permit to allow for New
Home Construction at 7057 Pleasant View Drive
Background:
Larry Beach Construction has purchased the property at 7057 Pleasant View Drive, the
former residence of Don Jenkins, and demolished the existing home in order to construct a
new single family home. There is a wetland on a large portion of the rear of this property and
the new construction would occur partially within the 100 foot wetland buffer area.
The previous home was located several feet lower than the new home next door, which
caused drainage concerns for the former owner. The new home will be built at a higher
elevation that is similar to the new neighboring homes, and will be brought forward to have
the same front setbacks. The attached survey indicates the old and new home footprints.
The old house and detached garage footprint was approximately 1200 square feet. The new
house with attached garage footprint will be approximately 2120 square feet.
Discussion:
The City reviews all development that occurs within wetlands and their buffers because of
the important role that wetlands play in maintaining the ecosystem and the area hydrology, in
that they are critical to the present and future health, safety and general welfare of the land,
animals and people within the City. Chapter 1010 of the City Code outlines the permitting
process for work occurring within a wetland buffer. The intent of the buffer permit
requirement is not to prohibit development within 100 feet of a wetland, but rather to allow
the City an opportunity to review the work in relation to the potential impacts to adjacent
wetlands. Buffer permits do not allow for any alteration of a wetland—only those areas
surrounding a wetland.
The boundaries of the wetland on the subject property covers approximately the rear two-
thirds of the lot. The attached wetland map shows the location of the wetland and footprint
of the previous home. The proposed home footprint would also not be entirely inside the
buffer area. The previous home had been built several feet lower than the street level, which
caused the homeowner to have water runoff concerns from the new neighboring home that
was at a slightly higher elevation than the street. The new home will be built at a similar
elevation to the neighboring homes.
The wetland area will not be impacted during grading or construction. The City’s Surface
Water staff will be monitoring the site during the entire project construction.
Recommendation:
Staff recommends the Council approve Resolution 6958, a resolution approving a wetland
buffer permit for a new home at 7057 Pleasant View Drive.

RESOLUTION APPROVING A WETLAND BUFFER PERMIT FOR
7057 PLEASANT VIEW DRIVE;
PERMIT 2006-00864
WHEREAS, Larry Beach has requested approval of a Wetland Buffer Permit for
a property of which he is the owner of record, property legally known as:
Lot 66, KNOLLWOOD PARK, Ramsey County, Minnesota
WHEREAS, the above-described property is zoned R-1, Single Family
Residential; and,
WHEREAS, said property is located within an identified wetland; and,
WHEREAS, the City Council has found that wetlands within the City, as part of
the ecosystem, are critical to the present and future health, safety and general welfare
of the land, animals and people within the City, as well as within the Rice Creek
Watershed District; and,
WHEREAS, the City Council has in mind its statutory obligation to comply with
Chapters 104, 105 and 112 of Minnesota State Law, the regulations of Rice Creek
Watershed District, Regulations of the Department of Natural Resources, including
provisions for protected waters, Public Law 92.500 (Federal Water Pollution Control
Act), open space policies of the Metropolitan Council and its guidelines encouraging
protection and enhancement of marshes, wetlands in the flood plain area and the public
interest in preventing irreparable destruction or deterioration of valuable natural
resources; and,
WHEREAS, Section 1010.08 of the Municipal Code states that a Wetland Buffer
Permit is required when any construction activities are planned within one-hundred feet of
a wetland; and,
WHEREAS, the City of Mounds View has reviewed the survey and construction
plan and has found them to be acceptable; and,
WHEREAS, no development activities or disturbances of any kind will occur
within the wetland itself; and,
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council
approves the Wetland Buffer Permits requested by Larry Beach, contingent upon the
following:
1. Only clean fill, substantially free of chemical pollutants and contaminants, shall be
brought onto the site.
2. No waste--solid, hazardous or otherwise--shall be allowed to enter directly or
indirectly into the wetland.
3. To the extent possible, a minimum five-foot natural buffer area shall be maintained
between the wetland and lawn area.
4. “Flags” shall be installed on the property to mark the boundary of the wetland (as
determined by Rice Creek Watershed District)
5. Grading of the site shall not extend into the designated wetland area.
6. Construction erosion control measures designed to limit soil loss from the
development site shall be installed prior to construction activity as approved by the
Director of Public Works and maintained during the duration of the construction, not
to be removed until graded areas have been sodded or revegetated.
7. The applicant must submit plans to Rice Creek Watershed District for review due to
the property being over one acre in size.

equipment for parts or re-sale to police agencies. It should be noted that this equipment
cannot be sold to the general public as it is programmed for police frequencies.
CommTech Enterprises LLC has offered to pay $3041.00 for the surplus equipment, and
Action Radio and Communications, Inc. has offered $1550 .00 for the equipment.
Recommendation:
Staff recommends sale of the equipment to Comm Tech Enterprises for the amount of
$3041.00.

Background:
On May 22, 2006 the City Council approved Resolution 6823 authorizing the
preparation of a preliminary feasibility report and the selection of a consultant for
the 2007-2008 Street and Utility Improvement Project.
On November 6, 2006, a draft Preliminary Feasibility Report for the 2007-2008
Street and Utility Improvement Project was submitted for the City Council’s
review.
Discussion:
Set Public Improvement Hearing – As per State Statute 429.031: “Before the
municipality awards a contract for an improvement or orders it made by day
labor, or before the municipality may assess any portion of the cost of an
improvement to be made under a cooperative agreement with the state or
another political subdivision for sharing the cost of making the improvement, the
council shall hold a public hearing on the proposed improvement following two
publications in the newspaper of a notice stating the time and place of the
hearing, the general nature of the improvement, the estimated cost, and the area
proposed to be assessed.”
Staff is recommending that a public hearing be conducted to be in compliance
with this state statute and to allow the public to learn about the proposed project
and to provide comments.
A hearing date of December 11, 2006 will afford the necessary time to publish
legal notices. It is also anticipated that the final Feasibility Report will be
presented to the City Council on December 11, 2006 for consideration of
approval.
Prior to the Public Hearing, the City will conduct a Public Informational Meeting to
present and discuss the results of the Draft Feasibility Report and to solicit input,
comments, and suggestions from the public pertaining to this proposed project.
This will occur on November 21, 2006, at 6:30 PM at City Hall.
After conducting the Public Hearing on December 11, 2006, no immediate action
will be taken on this project; The Mounds View City Charter – Chapter 8 Section
8.04 states, “A period of sixty days shall elapse after the public hearing before any
further action shall be taken by the Council on the proposed improvement.”
Should this project proceed, the following is the tentative schedule:

Finance Director Beer explained that there is a discretionary fund to cover non-budgeted items. 7

Mr. Glidden said that he understands that there is funding for 2007 advertising for the Banquet 9
Center and he wonders if there are funds available for advertising yet this year to bring revenue 10
into the City. 11

Finance Director Beer indicated that some of the funds would need to be reprogrammed but most 13
of the operating funds are spoken for. 14

City Administrator Ulrich indicated that Staff would research the matter and bring further 16
information back to Council for consideration. 17

Mr. Glidden indicated that there is a wedding planning website where the City could advertise 19
the Banquet Center and the annual cost for that advertising is $1,200. 20

Carol Mueller of 8343 Groveland Road addressed Council and said that she was at the 22
Community Center yesterday and while there she picked up a brochure about Twin Cities North 23
with different opportunities and a map of how conveniently located the Banquet Center is but 24
there is no advertising in it for the City. She then said that there was nothing in the Mounds 25
View Matters this month either. She then said that there is a list of fees and rooms available and 26
asked any interested residents to contact Staff to schedule an event. 27

Ms. Mueller said that when the decision was made to allow the Community Center to be a 29
Community Center she thought there was a decision to put something into Mounds View Matters 30
about it. 31

Council Member Gunn explained that the November/December 2006 newsletter was already in 33
production. 34

Ms. Mueller said that she noticed the $60,000 payment in the budget for 2007 to the Minneapolis 36
North Convention and Visitor’s Bureau and she is hoping that the City lists the Community 37
Center and the Festival in the Park. 38

A. Ordinance 780, an Ordinance Approving Modifications to the Official City 12
Wetland Zoning District Maps 13

Community Development Director Ericson indicated that this is the second opportunity for 15
Council to discuss the new maps. He then said that the old map series did not reflect the 16
wetlands the City has since there have been a number of alterations including subdivisions and 17
new streets that have changed the wetlands. 18
19
Director Ericson indicated that SEH has reviewed all available information and has provided a 20
new set of maps that should more accurately reflect the wetlands that are in the City. He then 21
said that the buffer for the wetland in Spring Lake Park would be removed from the map at the 22
direction of Council. He further said the next new wetland identified was in the north half of 23
Section 6 across from Ardan Park and it is a wetland area that surprised Staff as it was not on the 24
original map series or the FEMA maps but it does show up on the National Wetland Inventory 25
and this is something that the engineer reviewed and the engineer feels that Rice Creek 26
Watershed District confirmation should be obtained to determine whether it should be included 27
or not. 28

Director Ericson indicated that the resident at 8200 Long Lake Road is impacted by this wetland 30
and he has called to express concern about the wetland as it was new information. Staff has 31
worked with the property owner as there could be a major subdivision of that property. He then 32
said that the City or SEH may need to take a look at it and that is the recommendation from Staff 33
to have Rice Creek review it. 34

Director Ericson indicated the other new wetland shown on the maps is Spring Lake and it did 36
not show up on previous maps and Council considered whether it should be taken off because 37
this is a lake. He then said that the direction from Council was to remove it. Another resident 38
asked about whether ditches along Highway 10 and other ditches like Judicial Ditch No. 1 should 39
be included because, over time, they have begun to display wetland characteristics. Staff asked 40
Rice Creek Watershed District and they feel it should be included on the maps but the buffering 41
area is where the City has the jurisdiction. 42

Director Ericson indicated there was a storm water management pond created with the Sherwood 44
Place major subdivision and Council has determined that, since it is a storm water pond, it does 45

not need to be buffered. 1

Director Ericson indicated that these maps are GIS friendly and will be of assistance to Staff 3
while reviewing permit requests. 4

Director Ericson indicated that when notice was sent to property owners Staff noted that nothing 6
has changed other than the maps and the buffering requirements are remaining the same. 7

Director Ericson asked for direction on Judicial Ditch No. 1 and the drainage ditches and finally, 9
what to do with residents that wish to challenge the location or designation of these wetlands on 10
the maps. 11

Mayor Marty reopened the public hearing. 13

Mark Schnor of 2949 County Road 10 asked when Highway 10 was changed to County 10. 15
Council indicated it was about five years ago. 16
17
Mr. Schnor asked if the pond next to his property would be removed as a wetland. 18
19
Director Ericson explained that in the lower left hand corner of the map it shows the storm water 20
pond but noted it would be left on the map designating a pond or water body and will be 21
considered as a wetland by Rice Creek Watershed District but the City will not consider it a 22
wetland for buffering purposes. 23

Mr. Schnor indicated that he called Rice Creek and there was a wetland to the north but they built 25
a house right on top of it and the first three years the guy had water on the second level of his 26
floor but he would not come to the meeting. He then said that they found out that the house was 27
built two feet too deep. 28

Mayor Marty clarified that it would be a pond but there will not be a wetland buffer zone around 30
it. 31

Carol Mueller of 8343 Groveland Road said that her neighbor who resides at 8334 Groveland 33
was not able to be at the meeting but is concerned about the wetland on Groveland and Ardan 34
because the buffer zone encompasses ¾ of his home and garage and he is worried about whether 35
he could get a permit to replace his garage at some point in the future. She then asked if there 36
would be concerns with selling the home to someone else that may want to rebuild and may not 37
be able to because the buffer zone has changed. 38

Ms. Mueller asked whether the development in the City is causing a need for more wetland 40
property because other wetland property is being lost. 41

Director Ericson explained that the buffer area changes when the edges of the wetland change. 43
He also explained that the buffer zone is more clearly defined than it may have been in the past 44
but this should not harm any resident with getting a permit for a garage. He then said that the 45

purpose is to allow the City to ensure that there will be no further impacts to the wetlands but 1
should not prevent residents from improving their property. 2

Director Ericson indicated that impacts usually come into play when there is a grading situation 4
or impervious surface added. 5

Council Member Thomas indicated that buffers are not being redefined and they are not being 7
changed because things are being taken away this is simply an improvement to the maps. 8
9
Mayor Marty explained that any developer developing a site with wetlands is required to create 10
additional wetlands in another location. 11

Mike Read of 2208 Lois Drive said that he lives next to a drainage ditch and Rice Creek 13
Watershed District has a 50 foot buffer zone and he would suggest that the City reduce its buffer 14
zone to 50 feet to match the Rice Creek Watershed requirements. 15

Director Ericson indicated that Staff has not proposed any text change to the Ordinance so Staff 17
does not have the ability to do that but, Council could choose not to buffer the drainage ditch at 18
all. 19

Mayor Marty said that he went out there for other issues and he does not see how this would 21
impact the homes in the area unless there is a need to regrade or rebuild. 22
23
Mr. Read said that with wetlands FEMA gets involved and it brings into play flood zones and he 24
does not want to find himself in a flood zone. 25

Director Ericson indicated that the City maps do not show flood zones as that is handled by 27
FEMA and buffering this and labeling it as a wetland should not change how FEMA categorizes 28
flood zones. 29

Mayor Marty said that he would be interested in seeing the flood zone map as an overlay on the 31
wetland maps. He then said that he understands the concerns. 32

Mayor Marty asked Staff to look into flood zone information prior to the second reading of this 34
Ordinance. 35

Council Member Thomas said that she has spent a lot of time on this and she does not see the 37
benefit of putting the buffers around the judicial ditches. She then said that she would like to 38
have the natural areas but not “shoot ourselves in the foot” by creating more regulations all the 39
while making sure there is good drainage. She further said that buffering does not seem 40
necessary for a man made ditch. 41

Council Member Stigney said that he feels a ditch is a ditch and needs no buffer. 43

Chris Johnson of 8200 Long Lake Road said that he has questions regarding this because a 2
wetland was added to the maps recently on his property but it is a drainage ditch. He then asked 3
which map is official because the two maps do not match. 4

Director Ericson explained that the maps are official to the agency that created them. He then 6
said that the purpose of the City maps is to designate buffers to the wetland area. 7
8
Director Ericson indicated that the wetland on Mr. Johnson’s property was not on the original 9
map and he is not sure why. He went on to explain that some of this area is a ditch with a culvert 10
but when SEH went out to the property they did indicate that there was wetland area behind. He 11
then explained that the City’s Storm Water Management Technician was sent out to the property 12
to ensure that the culvert was not blocked creating a wetland area, who determined that the ditch 13
is overgrown but it is flowing well. 14

Mr. Johnson said he questions whether it is a wetland. He then said that he would like to know 16
what happened with Hidden Hollow and what happened with wetlands for that property. 17

Director Ericson indicated that there were three pockets of wetlands found but the original maps 19
did not show any. He then explained where the wetlands were located. 20
21
Mayor Marty indicated that ponding was created in that development as well to account for the 22
two for one wetland requirements. 23

Mr. Johnson reinterated that the area in question is a man made ditch and he does not feel that it 25
needs to be buffered. Mr. Johnson indicated he did not own the vacant land. 26

Mayor Marty asked whether Mr. Johnson owns the large vacant lot because this may impact him 28
if he intends to subdivide. 29

Council Member Thomas said that whenever the City knows there is an issue with a judicial 31
ditch she feels that the buffer for the ditch can be removed but what has developed over time in a 32
low spot should be buffered and Staff would need to further delineate the situation on this 33
property. 34

Director Ericson explained that the City can remove the City’s buffer but Rice Creek Watershed 36
District requirements would still remain. 37

Mr. Johnson said that he feels that the maps should match. 39

Director Ericson said he is not sure whether the NWI maps are the official maps for Rice Creek 41
Watershed District but admits it does not match the City’s map. He then said that the intent is to 42
protect the wetlands that the City knows about but there is no intent to prohibit or restrict 43
development. 44

Director Ericson indicated that he is attempting to have Rice Creek Staff go out to the Johnson 1
property and review it for concurrence. 2

He then said that he questions whether Rice Creek maps are available through the GIS system of 5
the City. 6

Director Ericson indicated that Staff has been told that the Rice Creek maps are available to the 8
City but Staff does not have any of the files that they have and Staff is working on that. 9

Mayor Marty closed the public hearing. 11

Council Member Thomas said that there is no information on Hidden Hollow and that is a 13
question she has as to whether something needs to be reflected for what was put in for wetland 14
mitigation. 15

Director Ericson said that he agrees with Council Member Thomas and said that if the City is 17
aware of a wetland that is out there then it needs to be added to the wetland maps. 18

and First Reading of Ordinance 780, an Ordinance Approving Modifications to the Official City 21

Mayor Marty thanked Staff for putting this together and bringing it forward for clarification. He 24
then said that he would like to obtain the information back from Rice Creek to resolve the 25
questions along Long Lake Road. 26

Mayor Marty noted that this hearing will be postponed to the December 11, 2006 City Council 33

City Attorney Riggs indicated that if it will be re-noticed, then there is no need to open and table 36
to the December 11, 2006 meeting. 37

C. Non-Renewal of Multiple Dwelling Rental License at 5701 Quincy Street, 39
Resolution 6954 40

Housing Inspector Jeremiah Anderson explained that there are regulations for operating and 42
licensing multiple dwellings in the City and Chapter 1012 requires that properties with two or 43
more units obtain a license and that requires regular inspection. He then said that Staff spoke to 44
the tenants of the building for an inspection and noted there were some violation of the City’s 45

property maintenance code and notice was issued to the property owner and there were two 1
instances of not maintaining the building and notices were issued for that as well. A follow up 2
inspection was completed in September and Staff met with the owner of record and the owner 3
informed Staff that none of the noted items were repaired and three of the four units were vacant. 4

Inspector Jeremiah Anderson indicated that the property owner has indicated he does not have 6
the rental income to satisfy the mortgage obligation and is not sure how he is going to handle the 7
disposition of the building as he is in foreclosure. Staff explained to the property owner that 8
authorization would be sought from the Council for non-renewal of the multiple dwelling license 9
for failure to correct deficiencies of the maintenance code and submission of the license 10
requirements for renewal. The owner of record was notified to come to the meeting. 11
12
Inspector Jeremiah Anderson indicated that he spoke to the resident occupying the one unit and 13
Staff informed them of the situation going on. 14
15
Council Member Thomas said that she is concerned about the occupying resident and she has no 16
desire to see them evicted and she would like to work within the Code and allow the rental some 17
how. She then said that she would hate to evict someone who could potentially work out a rental 18
agreement with the new owner once the building is sold. 19
20
Council Member Stigney said that he would be concerned if the building does not meet Code to 21
allow someone to continue to live there. He then asked if Staff knows what the rental 22
arrangements are. 23

Inspector Jeremiah Anderson indicated that he is not sure what the rental arrangements are and 25
Staff usually does not get involved with that but Staff can facilitate a meeting with the owner of 26
record and the property owner. 27

Inspector Jeremiah Anderson indicated that Council can decide how to proceed with this and 29
Staff has recommended non-renewal for the entire property but would not want to see someone 30
evicted. 31

Council Member Gunn indicated it would be a hardship for the renter to have to find another 33
place to live simply because the landlord is not in compliance. 34

Mayor Marty said that the proposed 30 days is a short window of time for the tenant to locate 36
another place to live but, he would like to set a date certain to have the situation corrected. He 37
then suggested 60 to 90 days for the situation to be corrected unless there is a health and safety 38
issue at the property. 39

Director Ericson suggested a way to amend the Resolution to not renew the license for the three 41
units and, once the other unit becomes vacant then it is not valid for further rental along with 42
tying in a timeframe to bring the property into compliance. Staff would recommend an 43

Inspector Jeremiah Anderson explained that Staff is open to the idea of amending the Resolution. 5
He then said that this is a four unit rental building with shared heating paid for by the owner and 6
so is the garbage and there could be a situation where there is a nonpayment for heating based on 7
the financial situation of the property owner. 8

City Attorney Riggs indicated that the City will lose some of its ability to control some of these 13
things because it becomes a single unit rental rather than multiple. He then said that the only 14
thing the City wants to allow is for the resident that is there to remain there for a period of time 15
stated. 16

Council agreed to have this restricted to the current occupant for the next 90 days. 18

City Attorney Riggs indicated that they are in violation and the units cannot be rented. He then 20
said that he is not sure where they are in the foreclosure process and there may be an issue with 21
heating as it is a commercial unit and the cold weather rule is different. He further suggested that 22
Council handle only the matter before them regarding non-renewal of the license and require that 23
none of the other units be rented. 24

Council Member Gunn suggested leaving the Resolution as it is but change the 30 days to 90 26
days and require that all unoccupied dwelling units cannot be rented. 27

monitor the situation and work with the property owner over the 90 day period, and will keep the 30

Mayor Marty said that he wanted to ask about this because, even though he agrees with it, he was 36
wondering if there is a possibility that these lines could be buried. And, if so, would there be a 37
great cost to do so. He then said that he knows of another area in the western part of down 38
during the storm last September that went without power for an additional week and he feels that 39
under grounding the power in that neighborhood along with this line would be a good idea 40
because the trees always interfere whenever there is a storm. 41

Council Member Thomas said that the property owners usually bear the cost of under grounding 43
the power and the City should look into the costs before recommending it. 44

to have the neighbors unanimously support it. 6

Council Member Gunn provided information for the Pinewood Elementary 50th Anniversary 18
Celebration which began today. She then said that tomorrow there will be a 50’s lunch and 19
parents are invited, Wednesday is spirit day/dress like 50’s and Thursday they will assemble a 20
time capsule and on Friday there will be a staff luncheon and all past staff is invited. She then 21
asked any former employees of Pinewood to contact the school with information so that they can 22
be invited. 23

Council Member Gunn indicated that the annual Fall Parade begins at 2:45 p.m. on Friday 25
followed by a 50th Anniversary Open House at 7:00 p.m. with dancing, displays of past 26
yearbooks, memorabilia and refreshments. 27

City Administrator Ulrich indicated that the Ramsey County League of Local Governments is 1
hosting an Active Living Ramsey County on Thursday, October 26, 2006 from 4:00 to 6:00 p.m. 2

Council Member Gunn asked whether college kids can vote absentee. 5

City Administrator Ulrich indicated that, if Mounds View is their primary address, they can vote 7
by absentee ballot. 8

Public Works Director Lee proposed adding ceiling fans to the Random Park building due to the 10
high ceilings. Staff would like to seek approval for the wiring to be run for these fans and Staff 11
will purchase and install the fans. The purpose of the fans would be to move air around allowing 12
for more even heating and saving money on heating the facility. 13

Public Works Director Lee explained that the cost to do this would be $1,070 and, if authorized 15
tonight, this would come back to Council as a Change Order to the Random Park building at the 16
November 13, 2006 meeting. 17

Director Ericson handed out information concerning the Midwest Asphalt proposal in New 36
Brighton. He then said that he would be attending the meeting and the Resolution going to the 37
Council is for denial and Staff hopes that Council will uphold the Planning Commission’s 38
recommendation of denial. 39

Director Ericson provided information from the Planning Commission concerning the Accessory 41
Structure Building Codes and explained that they have concluded that, while the allowances may 42
be generous and liberal, there are larger lots in Mounds View and there have not been very many 43
complaints and it seems to be working well. He then said that they made a recommendation that 44
if changes are made to the Code that the City should consider applying design guidelines to any 45

accessory structure in excess of 400 square feet which would require garages or sheds of 800 1
square feet be constructed to match the principal structure. 2

Director Ericson indicated that the Planning Commission is recommending against a Citizens 4
Task Force to review the Codes because they feel that the Codes are working well. 5

Mayor Marty asked what happens when someone comes in and wants to build an accessory 7
building and whether plans and drawings are required. 8

Director Ericson indicated that plans are required and Staff reviews the zoning aspect of them 10
and the Building Official does a plan review to ensure that the structure complies with the 11
Building Code but there are no design criteria or design guidelines. 12

Mayor Marty said that there are structures in the City that, if painted another color would look 14
more like a barn and he would suggest reviewing plans more closely. 15

Director Ericson indicated that there is no way to control it at this time and that is why the 17
Council may wish to consider adding design criteria. 18

Council Member Stigney indicated that Maplewood has an architectural design committee and he 22
thinks that perhaps architectural design could be added to the duties of the Planning Commission 23
as part of the review. 24

School Resource Officer
There’s a new SRO at Edgewood Middle School. Officer Keith Demarest took over duties as the
School Resource Officer at Edgewood Middle School after Officer Leitch was assigned to Investigator.
This has been a busy first quarter at the school. In addition to the regular duties for the SRO, the
following juvenile arrests were made in the school:
• Case # 06004954: Disorderly Conduct: 2 juvenile females arrested and petitioned for fighting
in the hallway.
• Case # 06004999: Narcotics and Dangerous Weapon: 1 juvenile female arrested for possessing
small amount of marijuana in school. Other juvenile female arrested for possessing a razor
blade in school.
• Case # 06005196: Theft: 2 juvenile males arrested for stealing bike parts from another boy’s
bike.
In accordance with school board and state rules; a handful of fire and lock-down drills were conducted.
These drills have shown positive results. The SRO gave a number of lectures (at teachers request) on
bullying and harassment; one of the most common problems at the school. The SRO has also just
recently concluded a drug awareness/consequence lecture for three 6th grade healthy living classes.
Officer Demerast reports: “It’s been a pleasure to serve as the new School Resource Officer. This is
one of the best positions in the police department to practice community policing.”
DARE / Crime Prevention
Summer was a very busy quarter for the Crime Prevention Unit. Festival in the park was successful.
Although it was raining heavily, 22 National Night Out parties were held in the City of Mounds View.
Officer Keckeisen had a lot of fun as a councilor at this years annual “Safety Camp”.
Conduct on licensed property letters were sent to three “problem addresses” this quarter with positive
results. Police calls have dropped to zero incidents at those addresses.
With the start of school, the crime prevention officer has been regularly monitoring the cross walks
and intersections near Pinewood, Edgewood, and Sunnyside schools. Officer Keckeisen met with 5th
grade teachers and students and coordinated a lock down drill at Pinewood Elementary School.
Officer Keckeisen also met with the Pinewood PTA.

Quarterly Predatory Offender checks continued this quarter. Officer Keckeisen visited 4 offenders to
confirm that their registration information is current and correct, and to provide recent photos to the
B.C.A. All predatory offenders in Mounds View are currently in compliance with their registration.
Officer Keckeisen attended the monthly property manager’s coalition meetings this quarter, along with
meeting property managers on a weekly basis to discuss reports of crimes that happened on their
property and to develop proactive strategies to deter future criminal activity.
To address concerns of the public the following community relation projects were under taken;
• Laport- Assist citizens with a parking on lawn and criminal damage to property complaint.
• Senior Community – Make certain all officers have access to all apartments in senior housing.
Tobacco compliance checks were conducted at local venders. Two businesses were charged with
selling tobacco to a minor
To help reduce criminal activity, and address specific concerns of citizens, extra patrol and visual
police presence was focused on the following areas;
• Edgewood School-Irondale students intimidating middle school children.
• Towns Edge Manufactured Home Community- Curfew violations.
• 5000 Block Eastwood – Harassment by ex-husband.
• 2300 Block Laport – Neighborhood dispute, parking issues.
Finally, Officer Keckeisen continues to publish and distribute the weekly crime summary and crime
prevention tips.

Safe and Sober
The Safe and Sober Grant runs from October to October so the summer months brought on the last two
enforcement waves for 2006. The Speed wave took place on 7 Mondays through July and August this
summer. The results were good.

In August and September we participated in an Impaired Driver wave which took place over 5 two-day
enforcement periods. The results were disappointing. We were able to get 2 DWI arrests over the
period.
This concluded our 2006 Grant with New Brighton PD. Now we are on to 2007 grant in which the
Ramsey County Sheriffs Office is the lead agency.
Ramsey County 800 MHz Public Communication System-Update
In August the Mounds View Police Department was the first police agency in Ramsey County to make
the transition to using the 800 MHz system. All of our portable and squad radios we are now using are
the new 800 MHz radios. This change was a quantum leap for our radio communications. The quality
and clarity of our radio communication has improved greatly, and we can now communicate with
virtually any public safety entity we need to, and can have designated “talk paths” or channels set up at
a moments notice or in advance for situations or special events where any group of officers from
different departments need to be communicating with each other on the same channel. Police
dispatching will be done on both the 800MHz system and the old VHS system until all of the law
enforcement agencies in the county have made the transition. This will occur within 8-10 months.
Mounds View Police along with all of the other law enforcement agencies in Ramsey County (with the
exception of White Bear Lake) will be joining a consolidated dispatch center which will be run from a
new building to be constructed in St. Paul. This building is under construction and is expected to be
completed within the next year. When this is done all police calls will be routed to the dispatch center
and dispatched to the designated cities. This is essentially how our dispatching is done now, and the
service we are receiving now will continue with the new dispatch center.
Video Monitoring Grant
The Mounds View Police Department recently received a $25,000 grant from the US Department of
Justice to install video monitoring equipment to remotely monitor and record locations within the city.
The Police Department was very fortunate to receive this grant which will allow us to record activity
24 hours per day at selected areas which are accessible for monitoring, and are deemed appropriate for
this type of public safety observation.
We hope to implement this project this winter.
