Next Council Work Session: Monday, December 4, 2006 @ 7pm Next Council Meeting: Monday, December 6, 2006 @6pm (Special – Truth in Taxation) Item No: 7A Meeting Date: November 27, 2006 Type of Business: CB Administrator Review : ____ City of Mounds View Staff Report To: Honorable Mayor and City Council From: James Ericson, Community Development Director Item Title/Subject: Public Hearing, Second Reading and Adoption of Ordinance 783, an Ordinance Amending Appendix E of the Municipal Code Relating to Planning and Development Fees Introduction: The City last updated its planning fees for the 2005 fee schedule. Certain changes at Ramsey County as well internally have increased the cost to process some planning applications. The changes proposed are reflected in the proposed 2007 Mounds View Fee Schedule however Minnesota Statutes require such fees be adopted by ordinance. Discussion: The attached ordinance amends Appendix E of the Municipal Code, the section where the planning and development fees are identified. The fees should be considered the minimum fees, as it may be the case that the fee collected is not sufficient to cover all the costs associated with the processing of the application. Applicants are made aware that they are responsible for costs above and beyond the application fee and they sign a statement acknowledging this. To help make this more apparent, the title of Appendix E was amended to include the word “Minimum” as directed by the City Council at the first reading of the ordinance on November 13, 2006. Recommendation: Open the public hearing and consider all testimony from residents and other interested parties. Barring any reason to act otherwise, staff recommends Council approval of the second reading and adoption of Ordinance 783, which amends “Appendix E” of the Municipal Code pertaining to planning and development fees. Staff also recommends the Council approve publication of the ordinance summary in the official city newspaper as allowed by the City Charter. (Adoption occurs by roll call vote.) Respectfully submitted, ________________________ James Ericson Community Development Director ORDINANCE SUMMARY ORDINANCE NO. 783 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING “APPENDIX E” OF THE MOUNDS VIEW MUNICIPAL CODE PERTAINING TO PLANNING AND DEVELOPMENT FEES On November 27, 2006, the Mounds View City Council adopted an ordinance which increased selected planning and development fees. The requests for which fees have increased or changed include Comprehensive Plan Amendments, Conditional Use Permits, Development Reviews, Interim Use Permits, Minor Subdivisions, Planned Unit Development (PUD) Amendments, Variances and Zoning Code Text Amendments. The ordinance, along with the complete list of minimum planning and development fees, are on file at the office of the Clerk Administrator and are posted in their entirety on the City’s website, located at www.ci.mounds-view.mn.us/ords/783.pdf. Kurt Ulrich, City Clerk-Administrator ORDINANCE 783 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING “APPENDIX E” OF THE MOUNDS VIEW MUNICIPAL CODE PERTAINING TO PLANNING AND DEVELOPMENT FEES The City of Mounds View ordains: SECTION 1. “Appendix E” of the Mounds View Municipal Code entitled “Planning and Development Fees” is hereby amended by showing the old fees struck out and the new fees underlined: Refer to the attached “Appendix E” SECTION 2. This ordinance shall take effect thirty (30) days after the date of its publication in the official City newspaper. Item No: 07C Meeting Date: November 27, 2006 Type of Business: CB City of Mounds View Staff Report To: Honorable Mayor and City Council From: Kurt Ulrich, City Administrator Item Title/Subject: Resolution 6966 Approving a Step Increases for Communications Coordinator Kimberly Blackford Background: This item was not acted upon by the City Council on October 23, 2006, due to the desire of some of the Council Members to have a closed session for a performance evaluation. The scheduled executive session was cancelled due to the resignation of Kimberly Blackford on November 1st. Discussion: Communications Coordinator Kimberly Blackford had been rated satisfactory in her duties by her supervisor and would be due back pay for her six-month step increase for the last month of her employment, consistent with the Personnel Manual and Labor Agreements. Based upon the original performance concerns of the Council, the question was asked of the City Attorney as to whether the Council has the option to deny the step increase. His response included the following: “Assuming Council approval is required, theoretically such approval can be denied by the Council as long as it is not arbitrary, capricious or contrary to law. As a result, any denial would have to be based on a reasonable record before the council, which at this point consists of satisfactory reviews and your recommendation to grant the step increase. Based on the current record, it seems inconceivable that the Council could deny the step increase and avoid a successful challenge to the action.” Consequently, in order to deny the increase, the City Council would need to proceed with closed session(s) that would document justification for delaying the 6-month increase, even though there is no specific provision within the contract or Personnel Policy to do so. In other words, the Policy does require Council approval prior to advancement through the steps, but gives no guidelines on how and when a delay is appropriately administered. The Attorney also questioned the timing in that Ms. Blackford had achieved 6-month status as of October 17, 2006. As has been customary, her performance review was conducted by her supervisor at the time of the 6-month anniversary, and it was put on the next Council agenda for consideration. While the AFSCME contract allows significant latitude for the employer to dismiss prior to the 6-month anniversary, afterward there is a greater burden of evidence that needs to be developed. The Personnel Policy implies that approval by the City Administrator and City Council is required, but the apparent conflict with the contract would likely lead to a dispute with the union. In fact, the union has filed a grievance on this issue and is waiting for the Council to address the matter. Clearly, in the future, it would be preferable for the Council and supervisors to address significant performance issues for probationary employees prior to the 6-month date elapsing. Recommendation: It is recommended that the City Council approve the attached resolution granting the 6- month step increase to Communications Coordinator Blackford. RESOLUTION 6966 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA APPROVING STEP/LONGEVITY ADJUSTMENTS WHEREAS, the following below is a regular full-time employees who was employed by the City of Mounds View; and WHEREAS, their supervisor reviewed their performance as it relates to the responsibilities outlined in the job description; and WHEREAS, their supervisor determined that the following employee below has satisfactorily performed in the capacity of their position documented in their performance review on file, and WHEREAS, a step increase wage adjustment is consistent with the Mounds View Personnel Manual and Labor Agreements. NOW, THEREFORE BE IT RESOLVED that the Mounds View City Council does hereby approve a wage adjustment to the following indicated in the chart below. Based upon this direction, the YMCA has been instructed to rent available space on a first-come, first-served in accordance with the newly revised fee schedule. In addition, it was anticipated that certain expenses would need to be made to keep and attract users to the facility. While the Council has decided not to pursue the full plan for the Community Center as recommended by the Mounds View Community Center Task Force, the plan itself can function as a roadmap for incremental improvements that the City may make over the years. The Council previously discussed and considered the following items at work session: - Management Expenses: The YMCA has provided a proposal for the coordination and oversight of the banquet facility. The new position would be in charge of facility rental and provide on-site supervision as necessary. This item has been budgeted in the 2007 budget and will be considered by the Council at the December work session. - Marketing Expenses: The Task Force recommended that $2,500 be allocated for marketing of the community center in its first year of operation after remodeling. The Council has adopted this recommendation and this item has been included in the 2007 budget. In addition, additional marketing dollars were approved by the Council for advertising and printing in 2006. - Memberships: The task force recommended a membership system that would allow for quarterly and annual memberships. Currently, only a daily pass and punch card options are available. The YMCA Advisory Committee reviewed this issue and recommends that the Community Center stay with the existing daily and punch card system due to the current limited fitness facilities. - Capital Investment and Replacement: Components of the plan have been considered in the 5-year capital program for the building. - Fitness Equipment: The proposed down-sized fitness area will utilize existing space. All of the previously purchased or donated equipment is beyond economical repair. The following items are recommended to outfit a fitness area: 1. (2) Treadmills – Commercial Grade 2. (2) Elliptical Trainers – Commercial Grade 3. (1) Recumbent Bike – Commercial Grade No additional weight training equipment would be purchased at this time. Currently there is one multi-station weight machine, a dumbbell set, and a stair-climber machine. Discussion: The following quotes were considered: Equipment/vendor 2nd Wind Push-Pedal-Pull Heavy Duty Treadmill $4,700 (Life Fitness) $5,195 (PRECOR) Heavy Duty Elliptical Trainer $3,500 (Life Fitness) $4075 (PRECOR) Recumbent Bike $1,750 (Life Fitness) $2,275 (STAR TRAC) In all cases, 2nd Wind had the lowest prices. Based upon these unit prices the total expenditure would be as follows: Treadmill: 2@ $4,700 = $9,400 Elliptical Trainer: 2@$3,500 = $7,000 Bike: 1@ $1,750 = $1,750 SUB TOTAL: Equipment $18,150 ADD: Shipping/install: $350 Tax: $1,202.50 TOTAL: $19,702.50 The YMCA has used the recommended brand (Life Fitness) in its facilities and believes that the product would work well for the Community Center. Currently identified funding consists of: 2006 Community Center Budget $3,500 2007 Community Center Budget $5,000 Unidentified funding: $11,202.50 It is recommended that the Council consider an allocation from the Special Projects Fund in this amount to cover this Community Center capital expenditure. Recommendation: It is recommended that the City Council approve the attached Resolution 6971 Approving Purchase of Exercise Equipment for the Community Center. RESOLUTION NO. 6971 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA APPROVING PURCHASE OF EXERCISE EQUIPMENT FOR COMMUNITY CENTER WHEREAS, the Council has decided to pursue a modified plan for the Community Center and to generally make the building available for public use and rental; and, WHEREAS, the proposed down-sized fitness area will utilize existing space without any major modifications to the current building; and, WHEREAS, existing equipment at the facility has been found to be beyond cost- effective repair and is in need of replacement and, WHEREAS, the following quotes were received and considered: Equipment/vendor 2nd Wind Push-Pedal-Pull Heavy Duty Treadmill $4,700 (Life Fitness) $5,195 (PRECOR) Heavy Duty Elliptical Trainer $3,500 (Life Fitness) $4075 (PRECOR) Recumbent Bike $1,750 (Life Fitness) $2,275 (STAR TRAC) WHEREAS, based upon these unit prices the total expenditure would be as follows: Treadmill: 2@ $4,700 = $9,400 Elliptical Trainer: 2@$3,500 = $7,000 Bike: 1@ $1,750 = $1,750 SUB TOTAL: Equipment $18,150 ADD: Shipping/install: $350 Tax: $1,202.50 TOTAL: $19,702.50 WHEREAS, this purchase of equipment has been reviewed and recommended by the YMCA Advisory Committee.
