Call to Mayor Hankner at 7:02 PM on Wednesday, December 26, Order 1990. The Pledge of Allegiance was said. 2. Pledge of Allegiance MEMBERS PRESENT: Councilmembers Paone, Wuori, 3. Roll Call Blanchard and Mayor Hankner. It was noted Councilmember Quick was absent. ALSO PRESENT: City Attorney Meyers, Acting Clerk/ •Administrator Minetor and Planning Technician Harrington. Motion/Second: Paone/Wuori to approve the December 4. Approval of 3, 1990 special meeting minutes as presented. Minutes: December 3, 3 ayes 0 nays 1 abstention 1990 Councilmember Blanchard abstained from the vote as Motion Carried she had not been present at the December 3cd meeting. Motion/Second: Wuori/Blanchard to approve the consent agenda, minus items B, C and H, and waive the reading of the resolutions. 4 ayes 0 nays Motion Carried Mounds View City Council December 26, 1990 Regular Meeting Page Two 411 Councilmember Blanchard explained she requested Items B and C be removed, as she is concerned with salaries and benefits and would like to see them applied in the same manner for all City employees. Mr. Minetor explained how salary and benefit raises were calculated. The public works contract is slightly different than the police department, as well as non-union staff. A 5% increase overall is proposed. He added the subject would be discussed further under Item 8A of the agenda. Mr. Minetor requested two items be added under Item H, and off-sale license for Fedor ' s Market, and an entertainment and amusement license for American Amusement Arcade. Motion/Second: Paone/Blanchard to approve Item H, with the addition of the two licenses . 4 ayes 0 nays Motion Carried Mayor Hankner closed the regular meeting and opened 6. Public Hearin : the public hearing at 7:10 PM. Considerati� of Wetland Planning Technician Harrington explained the wetland Alteration alteration permit request had been discussed at the Permit for 2341 December 3rd agenda session. He reviewed the request Oakwood Drive, of Dailey Homes, Inc. for a wetland alteration permit Dailey Homes for the construction of a detached garage at 2341 Oakwood Drive. Mayor Hankner closed the public hearing and re- opened the regular meeting at 7:14 PM. Motion/Second: Paone/Blanchard to approve Resolution No. 4024, approving a wetland alte-Ldtion permit for Dailey Homes, Inc. to construct a detached garage in a wetland buffer zone, at 2341 Oakwood Drive, Planning Case No. 318-90, and waive the reading. 4 ayes 0 nays Motion Carried Mr. Minetor reviewed his memo of December 20th, 7. Consideration concerning negotiations with Teamsters Local #320 of Union regarding the union contract for police for 1991 . Contract for Police for Councilmember Blanchard pointed out they had the 1991 same situation last year, and the police union was • told them the Council needed the information ahead of time. She suggested the City go back to the Teamsters with direction to stay within a 5% increase. r _ Mounds View City Council December 26, 1990 Regular Meeting Page Three • Mr. Minetor further reviewed the negotiation process and how the police benefits compared to other - employee groups in the City. Report of received from Attorney Karney for October. The Staff Members billing has been reviewed by the Finance Director, who recommends approval of it. Motion/Second: Paone/Blanchard to approve the revised October billing from Mark Karney. 4 ayes 0 nays Motion Carried Jerry Linke stated it appeared the billing concerned the attorney used in the Don Pauley termination issue, and he does not feel it is a legal payment and he feels the bill should not be paid. Mr. Minetor reported the Council had received a conflict of interest statement, relative to 1990, which needs to be signed and returned. Mr. Minetor reported there had been a water main break, which was repaird earlier in the day. Attorney Meyers commended Peter Sabee, Ric Minetor, 12. Report of the Council members involved and members of the Attorney • community for their input and work on the wetlands zoning ordinance. He stated he feels all concerns have been answered, and the City has a good, workable ordinance. Councilmember Paone had no report. 13. Report of Councilmembers: Councilmember Paone Councilmember Wuori had no report. Councilmember Wuori Councilmember Blanchard had no report . Councilmember Blanchard Mayor Hankner thanked staff for the working relation- Mayor Hankner ship she has had with them for the past eight years. Respectfully submitted, • /� /14,A,y ciotK4binwri-A/A jb-94(Y) MEMORANDUM Memo To :Mayor and Council Members From :Ric Minetor, Acting Clerk-Administrator Date :December 19 , 1990 t*1 ; Subject :Extension of Employment Agreement The attached Employment Agreement between the City and myself contains the modifications discussed by Council on December 17th. This agreement will become effective on January 1, 1991 and extend until a new Clerk-Administrator takes over. The salary set in this agreement is a 4 percent increase above the salary set in the current contract. No other sections have been modified. I recommend that the Council authorize the Mayor to execute this agreement on behalf of the City. • 411 • EMPLOYMENT AGREEMENT This agreement, made and entered into this 26th day of December, 1990 , by and between the City of Mounds View, a municipal corporation, hereinafter called the "City" , as party of the first part, and Ricky A. Minetor, hereinafter called the "Employee" , as party of the second part, both of whom understand and agree as follows: WHEREAS, the City desires to employ the services of said Employee as the Acting Clerk-Administrator of the City of Mounds View during the term specified below; and WHEREAS, it is the desire of the City Council to provide certain benefits, establish certain conditions of employment, and to set working conditions of said Employee; and WHEREAS, it is the desire of the City Council to (1) retain the services of Employee and to provide inducement for him to remain in such employment, (2) to make full work productivity by assuring the Employee's morale and peace of mind with respect to future security, (3) to act as a deterrent against malfeasance or dishonesty for personal gain on the part of the Employee, and (4) • to provide a just means for terminating the Employee's services at such time as he may be unable fully to discharge his duties or when the City may otherwise desire to terminate his employment in the capacity as Acting Clerk-Administrator; and WHEREAS , Employee desires to accept the appointment as Acting Clerk-Administrator; NOW, . THEREFORE, in consideration of the mutual covenants herein contained, the parties heretoagree as follows: SECTION 1. DUTIES Sithereby agrees—to—employ said Employee as—Acting Clerk- Administrator of the City of Mounds View to perform, or supervise the performance of, the functions and duties specifiedin the City Charter, State Statutes, and the Municipal Code, and to perform such other legally permissible and proper duties and functions as the City Council shall assign. SECTION 2. TERMS A. The term of this agreement shall be for the period beginning January 1st, 1991 and until the City Council appoints a permanent Clerk-Administrator. B. Nothing in this Agreement shall prevent, limit, or S otherwise interfere with the right of the City to terminate the w v • services of Employee at any time subject only to the provisions set forth in Section 3 , paragraphs A, B , and C , of this agreement. C. Nothing in this Agreement shall prevent, limit, or otherwise interfere with the right of the Employee to resign at any time from his position with the City, subject only to the provisions set forth in Section 3 , paragraph D, of this agreement. SECTION 3 . TERMINATION AND. SEVERANCE PAY A. In the event the City Council desires to terminate the services of Employee as Acting Clerk-Administrator, then in that . event Employee will reinstated in his former position as City Engineer/Director of Public Works. Upon reinstatement in his former position, Employee will receive salary and benefits comparable to those he was receiving at the time of his appointment as Acting Clerk-Administrator plus any increases awarded to other City employees as across the board salary or fringe benefit adjustments. B. Employee will retain all seniority and benefits accrued during the period he serves as Acting Clerk-Administrator. • C. In the event In the event the City reduces the salary or benefits of Employee in a greater percentage than an applicable across the board reduction for all City employees, or in the event Employee resigns following a suggestion, whether formal or informal, by the City Council that he resign, then in that event Employee may at his option, be deemed terminated as Acting Clerk- Administrator at shall be entitled to the benefits set forth herein. D. In the event Employee voluntarily resigns his assignment as Acing Clerk-Administrator, Employee will give 1 month notice of such action. • SECTION 4 . SALARY City agrees to pay Employee for his services rendered pursuant hereto an annual base salary of $58,656, payable in installments at the same time as other employees of the City are paid. In addition, City may pay Employee a merit bonus based on Employee's performance if the City Council deems appropriate. SECTION 5. AUTOMOBILE • The City agrees to pay Employee $150 per month for travel and expenses in performing his duties in the immediate area of the City and Employee agrees to utilize his personal vehicle for r w this travel. For travel outside the immediate area, (such as but not limited to travel to out-of-state or out-state seminars, 411 professional meetings , or training classes ) City agrees to reimburse Employee at the rate of $0.24 per mile of actual travel. SECTION 6. OTHER TERMS AND CONDITIONS OF EMPLOYMENT All provisions of the City Charter and Municipal Code, and regulations and rules of City relating to vacation and sick leave, retirement and pension system contributions, holidays, and other fringe benefits, and working conditions as they now exist or hereafter may be amended, in addition to said benefits enumerated specifically for the benefit of Employee, except as herein provided. SECTION 7. GENERAL PROVISIONS A. The text herein shall constitute the entire Agreement between the parties, unless formally amended and agreed to by both parties. B. This agreement shall be binding upon and inure to the benefit of the heirs at law and executors of Employee. C. If any provision, or any portion thereof, contained in this Agreement is held to be unconstitutional , invalid, or • unenforceable , the remainder of this Agreement , or portion thereof, shall be deemed severable, shall not be affected, and shall remain in full force and effect. This agreement shall become effective and valid when signed and authorized by both listed parties. Ricky A. Minetor Susan Hankner Acting Clerk-Administrator Mayor City of Mounds View Date: Date: Witnessed by: • • . r 4 � � 7. f- MEMORANDUM Memo To :Mayor and Council Members From :Ric Minetor, Acting Clerk-Administrator i Date :December 19, 1990 Subject :Merit Bonuses and Salary Adjustments We are processing our annual performance evaluations and there are certain staff members that I feel are deserving of special recognition. Two of the individuals have been essential to me in keeping the City operating smoothly since I became acting clerk- administrator. Michele Severson and Don Brager have been indispensable during these past few months. Michele is the primary reason the elections ran smoothly. She took charge of the election process with far too little previous training. She took responsibility to learn as much as possible in the short time available and worked very diligently to insure a successful election. I heard from many election judges that this • was one of the smoothest elections in recent years. Michele has also been invaluable in the daily administration details of the City. While a number of issues have been delayed due to a shortage of personnel, the critical issues have been kept on schedule. I am recommending a one time merit bonus of $1000. Additionally, from reviewing her job description, observing her duties, and considering the Council's decision to have Michele take Council meeting minutes next year, I am suggesting that Michele be reclassified as an exempt employee. This is based on her supervisory duties as well as the fact that a large amount of her work is self directed and therefore independent of direct supervision by others . A reclassification to exempt would eliminate her eligibility for overtime or compensatory time; and since she is required to work beyond the normal daily schedule at ti,t&es, I would suzgyest Lhat her salary be ddjusLed similarly. I have estimated that this would be approximately a 3% increase in her annual salary (from $26,394 to $27,196) . Don Brager has been my major source of support and reference these past months. His historical perspective as well as his • knowledge of election and administrative procedures has proved very valuable in my efforts to keep City business running In preparing Don's performance evaluation, I have learned that Don has not had a salary adjustment (other than cost of living adjustments) in recent years. I am recommending a 3% salary • adjustment in Don's annual salary (from $45,387 to $46,748) , this will put Don at the 65th percentile of his pay range. I recommend that the merit bonuses and salary adjustments listed . above be authorized by City Council, that the merit bonus for Michele Severson be paid at the end of the next pay period and that the salary adjustments become effective on January 1, 1991. • • 4r-1,)n 7. MEMORANDUM Memo To :Mayor and Council Members From :Ric Minetor, Acting Clerk-Administrator Date :December 17, 1990 Subject :Labor Agreement with Public Works Maintenance Employees I met with the Public Works maintenance employees on Thursday, December 13 , 1990 to discuss a labor agreement for 1991. As you are aware, the maintenance employees de-certified in 1990 and bargained a labor agreement as their own bargaining agent. The group had met on their own and then relayed their proposal to me. Their proposal included an increase in the health insurance contribution from the City to 80% of the family coverage rate; a wage adjustment based on the cost-of-living; an increase in the hours for standby duty; additional vacation accrual ; and insurance coverage for early retirements. • Don Brager, Mike Ulrich, and I met with the maintenance employees to discuss the requests. We were able to achieve concurrence on an overall package that includes 1 additional hour for standby duty; an increase in health insurance contribution by the City of $25/month; a wage adjustment of 4% ; no change in vacation accrual; and an agreement that we would review the insurance for early retirement prior to next year's bargaining sessions. I believe we achieved a fair and reasonable agreement. I recommend the Council authorize the mayor and myself to execute an agreement with the Public Works Maintenance Employees which includes the changes listed above. 0 411 j,t,(2,1,,,-1 MEMORANDUM Memo To :Mayor and Council Members From :Ric Minetor, Acting Clerk-Administrator. Date :December 17, 1990 49, Subject :1991 Wage and Benefit Adjustments for Non-Union City Employees The City staff that are not represented by a union or bargaining. group have their wages and benefits set by the Council . The public works maintenance employees have agreed to a wage and benefit package. I would recommend that the non-represented employees be given adjustments consistent with the overall package agreed to by the maintenance group. I have calculated an adjustment for the non-represented employees comparable to the overall adjustment agreed to by the maintenance employees . This would be an increase in health insurance • _ contributions by the City to a maximum of $250/month for family coverage and a wage adjustment. of 4 . 375%. I recommend that the Council adopt the attached Resolution adjusting the wages and benefits for non-union employees for the 1991 calendar year. • • RESOLUTION NO. 4025 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION ESTABLISHING SALARIES AND BENEFITS EFFECTIVE JANUARY 1, 1991 WHEREAS the City Council of the City of Mounds View desires to establish salaries of non-union employees for calendar year 1991. The union had requested a 5% wage increase, insurance increase of $75 per month, uniform allowance increase of $25 per year, additional vacation accrual to a total of 25 days at 20 years of service, an additional holiday and premium pay for all holidays. We agreed to the increase in the uniform allowance, holiday and premium holiday pay. We agreed to no increase in the vacation accrual, and an increase of $27.50 in the insurance contribution • (this is consistent with maintenance and general staff) . The union has revised theirwage request to 4.5% and a $9 per month increase for differential for investigators. This would be an overall increase of 5 . 18%. The maintenance employees and general staff received an overall increase of 5%. An overall increase of 5% for the police could be achieved with a 4. 375% wage increase, .but the union indicated that they felt strongly that 4 .5% was necessary to settle. The City Attorney, Mark Karney, Has reviewed the agreement and concurred in the wording. Spring LAke Park has executed this agreement and Fire Chief Fagerstrom is taking the agreement to each City in turn. Chief Fagerstrom will be at the Council meeting on December 26th to answer any questions or concerns you might have. I recommend that the Council approve this agreement and authorize • the Mayor and Acting Clerk-Administrator to execute this agreement on behalf of the City. • • • JOINT POWERS AGREEMENT FIRE TRAINING ASSOCIATION THIS AGREEMENT made by and between the City of Fridley ( "Fridley" ) , the City of Columbia Heights ( "Columbia Heights" ) , the City of Brooklyn Center ( "Brooklyn Center" ) , the City of Spring Lake Park ( "Spring Lake Park" ) , the City of Blaine ( "Blaine" ) , and the City of Mounds View ( "Mounds View" ) , each being a Minnesota municipal corporation, which together shall form the Fire Training Association (the "Association" ) . WHEREAS, each party to this Agreement desires a facility to train members of its fire department; and • WHEREAS, it is more economical for the parties of this Agreement to jointly and collectively construct, use, and maintain a fire training facility rather than each party constructing and maintaining its own facility; and WHEREAS, Fridley, Columbia Heights, Brooklyn Center, Spring Lake Park, Blaine, and Mounds View are authorized to enter into an Agreement for the joint and cooperative exercise of powers { common to them pursuant to Minnesota Statutes 471 . 59 et seq. ; and WHEREAS, the cities of Spring Lake Park, Blaine and Mounds View are provided fire protection services by the Spring Lake Park Fire Department, Inc. , a Minnesota non-profit corporation; NOW, THEREFORE, the undersigned governmental units and the Association in the joint and mutual exercise of their powers • I agree to jointly construct and maintain a fire training facility in accordance with the following terms: 1. The Fire Training Association shall consist of four member departments. For purposes of this Agreement, Spring Lake Park, Blaine and Mounds View shall be collectively considered one Member and have one representative on . the Chiefs ' Board. Spring Lake Park, Blaine and Mounds View appoint the Spring Lake Park Fire Department, Inc. as their agent, which together with the cities of Fridley, Columbia Heights, and Brooklyn Center shall be known as the ( "Member Departments" ) . 2 . Term: The term of this Agreement shall be perpetual until only one Member Department remains . 3 . Fire Training Facility. The training facility shall consist of a training tower and burn room and other • elements of training as determined and recommended by an Operations Committee (Paragraph 14 hereof ) and approved by the Chiefs ' Board. 4 . Facility Site. The facility shall be constructed on property owned by the City of Fridley and located at 348 - 71st Avenue N.E. , Fridley, Minnesota. The Member Departments and the City of Fridley hereby agree to execute a twenty-five ( 25 ) year lease of the property from Fridley to the Fire Training Association in consideration of the payment of $25 for the lease term. 5 . Ownership. Ownership of the facility, excluding land, shall be jointly held by the Association. • -2- 411 6. Initial Construction. Initial construction costs are 'projected to be $200,000, which shall be shared equally by the members. The initial construction costs shall not exceed $200,000.00 without prior approval of each Member Department' s City .Council. Each Member Department shall pay its cost allocation for the facility construction pursuant to the payment schedule unanimously approved by the Chiefs ' Board. 7 . Operating Agent. The operating agent shall have authority, on behalf of the Association, to pay costs authorized under the Operating Budget for the training site, and any additional expenses unanimously approved by the Chiefs ' Board. An annual Operating Budget shall be forecast in the second quarter of each year for the following year' s operation of the site. The 1991 Operating Budget is projected to be $6,000 . The City of Fridley is appointed as the initial operating agent. The Chiefs ' Board shall have the authority to name an alternate department to take on this responsibility as it deems necessary. The Chiefs ' Board is specifically empowered to set a limit on the yearly operating costs . Failure of a Member Department to pay its proportional share of the yearly operating costs, or additional expenses unanimously approved by the Chiefs ' Board, shall be grounds for removal of that Department upon the sole discretion of a majority vote of the Chiefs ' Board. • -3- 8 . Agent for Construction. The Member Departments specifically authorize the City of Fridley to act as the Agent for Construction of the facility on their behalf . The Agent for Construction is empowered to commission designs for the facility according to the specifications approved by the Chiefs ' Board. Following approval by the Chiefs ' Board, the Agent for Construction shall cause bids to be taken for the construction and shall present the final bids to the Chiefs ' Board for ratification. Once the bids and specifications nave been approved by the Chiefs ' Board, the Agent for Construction shall have the power to award the contracts and bind the Member Departments to the contracts so awarded. • 9 . Repairs and Improvements. If recommended by the Operations Committee and approved by the Chiefs ' Board in advance and ratified by each of the Member Department ' s City Councils , all major repairs, replacements, additions/improvements shall be equally assessed against each Member Department. 10 . Insurance. The Association shall purchase policy( ies ) of insurance in forms and amounts to protect its insurable interests in the value of the site 's improvements against perils of fire, theft, vandalism and Acts of God, and to protect the; financial interests of the Association , parties , their agents and employees , against all claims or lawsuits, including expenses and attorney fees, -4- • arising from the ownership, design, operation, and maintenance of the facility. The policy( ies ' ) limits, terms and conditions shall be acceptable to each party. Costs of insurance shall be apportioned equally to each Member Department.' , 11. Facility Use. Each Member Department shall be entitled • to equal use of the facility, subject to advance scheduling through the Operations Committee under the rules and guidelines established by the Chiefs ' Board. 12 . Use By Others. The Chiefs ' Board shall establish guidelines for use of the facility by others for a fee. The Operations Committee shall carry out the guidelines and shall be in charge of scheduling and collection of • rents/fees. No rental shall be scheduled so as to conflict with any scheduled activity by a Member Department. Any rents/fees collected in excess of current year operating expenses may, at the Chiefs ' Board 's discretion, be retained for repair, improvements to the facility, future operating expenses , or returned to the Member Departments. 13. Chiefs ' Board. The Chiefs ' Board shall consist of the Fire Chief or the Fire Chief 's designee of each Member Department unless another representative is designated 4 by the City Council of a Member. The Board shall act by majority vote of a quorum present at a board meeting (unless unanimous approval is required by this Agreement ) duly called by a member of the Board upon notice given to -5- IIIall members by mail 20 days in advance of the meeting. The Board may act without a meeting by a unanimous writing in lieu of a meeting. 14 . Operations Committee. The Operations Committee shall consist of a firefighter/officer appointed by the Fire Chief of each Member Department. 15 . Indemnification. Each non-Member Department or organization using the facility shall fully indemnify the Member Departments against all loss, damage liability claims, suits, judgments, costs and expenses by reason of loss of or damage to property and injury to or death of persons caused by acts or omissions of the non-member organization, its officers , agents or employees, arising • from or growing out of, directly or indirectly, wholly or partly, its maintenance, operation or use of the facility. 16 . Termination of Agreement. Any Member Department may terminate its participation under this Agreement by giving 60 days advance written notice of intent to terminate, directed to the attention of the remaining Members of the Chiefs ' Board. The terminating Member Department has no right of refund for its share of fees or costs paid under this Agreement, and waives any and all rights and interest in the training facility. Furthermore, any city terminating its participation under this Agreement is bound to pay its proportionate share of the initial construction costs. Said city shallalso be • -6- • IIIresponsible for its proportionate share of outstanding operating costs through the fiscal year in which it gives notice of withdrawal. A withdrawing member shall have no claim to assets of the Association including excess fees or rents collected under paragraph 12. Upon the withdrawal of all Member Departments, the land and • improvements shall revert to the City of Fridley. 17. Dissolution. Upon unanimous approval by the Member Departments, the dissolution of this Association may be adopted, at which time the Building and Property shall revert to the City of Fridley, and all other assets and liabilities shall be divided among the remaining Member Departments in proportion to the contribution of the • remaining Member Departments. • 18. Amendment. Any amendments to this Agreement require a two-thirds vote of the Members of the Chiefs ' Board and must be approved by the City Councils for each party. It is my feeling that this could be clarified by adding a paragraph C to section 48.07 'EXCEPTIONS: ' which would read as follows: C. Maintenance of existing landscaping, including but not limited to, lawn care; trimming of bushes or trees; tilling, planting, and/or weeding of gardens; painting or repair of fences; or similar activities shall be permitted within a • wetland zoning district. This exception is for maintenance of an existing situation and shall not be construed as to allow establishment of a new use or expansion of an existing use in a wetland. This also shall not be construed as to allow destruction of hydrophytic vegetation. I have discussed this wording with Peter Sabee of Barr Engineering. If this amendment is considered appropriate by the Council, I do not believe any further definition or modification would be needed to allow the type of routine maintenance discussed during the hearing and first reading of the ordinance. r MEMORANDUM Memo To :Mayor and Council Members From :Ric Minetor, Acting Clerk-Administrator Date :December 12 , 1990 /qt/kt14*-- Subject :Extension of Employment Agreement The employment agreement between the City and me covering my duties as Acting Clerk-Administrator expires on December 31, 1990 . I request that the Council consider extending this agreement until a new Clerk-Administrator is hired. Two areas that Council may wish to consider in extending this agreement is the salary and the car allowance. The salary is currently set at $56,394, the same as Don Pauley was being paid. A part of the reason the agreement ran through the end of the year was that the Council could determine whether an adjustment to the salary was appropriate for 1991 . In negotiations with the Police and the Public Works employee groups, cost of living adjustments have been requested in the range of 5 percent. We are offering a 4 percent adjustment, but have not received a response from the bargaining units at this point. In addition, the Council may wish to consider a salary adjustment based on performance. The car allowance included in the contract also was based on the amount that Don Pauley was receiving. In discussion regarding the benefits to be offered the new Clerk-Administrator, it appeared the Council may wish to reconsider the concept of a car allowance. Attached is my current employment agreement for your information. The extension of the agreement and the modifications (if any) should be adopted by motion. EMPLOYMENT AGREEMENT This agreement, made and entered into this 13th day of August, 1990, by and between the City of Mounds View, a municipal corporation, hereinafter called the "City" , as party of the first part, and Ricky A. Minetor, hereinafter called the "Employee" , as party of the second part, both of whom understand and agree as follows: WHEREAS, the City desires to employ the services of said Employee as the Acting Clerk-Administrator of the City of Mounds View during the term specified below; and WHEREAS, itis the desire of the City Council to provide certain benefits, establish certain conditions of employment, and to set working conditions of said Employee; and WHEREAS, it is the desire of the City Council to (1) retain the services of Employee and to provide inducement for him to remain in such employment, (2) to make full work productivity by assuring the Employee's morale and peace of mind with respect to future security, (3 ) to act as a deterrent against malfeasance or dishonesty for personal gain on the part of the Employee, and (4) to provide a just means for terminating the Employee's services at such time as he may be unable fully to discharge his duties or when the City may otherwise desire to terminate his employment in the capacity as Acting Clerk-Administrator; and WHEREAS , Employee desires to accept the appointment as Acting Clerk-Administrator; NOW, THEREFORE, in consideration of the mutual covenants herein contained, the parties hereto agree as follows: SECTION 1. DUTIES City hereby agrees to employ said Employee as Acting Clerk- Administrator of the City of Mounds View to perform, or supervise the performance of, the functions and duties specified in the City Charter, State Statutes, and the Municipal Code, and to perform such other legally permissible and proper duties and functions as the City Council shall assign. SECTION 2. TERMS A. The term of this agreement shall be for the period beginning July 23rd, 1990 and until December 31, 1990; or until the City Council appoints a permanent Clerk-Administrator, whichever comes first. B. Nothing in this Agreement shall prevent, limit, or otherwise interfere with the right of the City to terminate the services of Employee at any time subject only to the provisions set forth in Section 3 , paragraphs A, B , and C , of this agreement. C. Nothing in this Agreement shall prevent, limit, or otherwise interfere with the right of the Employee to resign at any time from his position with the City, subject only to the provisions set forth in Section 3 , paragraph D , of this agreement. SECTION 3 . TERMINATION AND SEVERANCE PAY A. In the event the City Council desires to terminate the services of Employee as Acting Clerk-Administrator, then in that event Employee will reinstated in his former position as City Engineer/Director of Public Works. Upon reinstatement in his former position, Employee will receive salary and benefits comparable to those he was receiving at the time of his appointment as Acting Clerk-Administrator plus any increases awarded to other City employees as across the board salary or fringe benefit adjustments. B. Employee will retain all seniority and benefits accrued during the period he serves as Acting Clerk-Administrator. C. In the event In the event the City reduces the salary or benefits of Employee in a greater percentage than an applicable across the board reduction for all City employees, or in the event Employee resigns following a suggestion, whether formal or informal , by the City Council that he resign, then in that event Employee may at his option, be deemed terminated as Acting Clerk- Administrator at shall be entitled to the benefits set forth herein. D. In the event Employee voluntarily resigns his assignment as Acing Clerk-Administrator, Employee will give 1 month notice of such action. SECTION 4 . SALARY City agrees to pay Employee for his services rendered pursuant hereto an annual base salary of $56 , 394 , payable in installments at the same time as other employees of the City are paid. In addition, City may pay Employee a merit bonus based on Employee's performance if the City Council deems appropriate. SECTION 5 . AUTOMOBILE The City agrees to pay Employee $150 per month for travel and expenses in performing his duties in the immediate area of the City and Employee agrees to utilize his personal vehicle for this travel. For travel outside the immediate area, (such as but not limited to travel to out-of-state or out-state seminars, professional meetings , or training classes ) City agrees to reimburse Employee at the rate of $0. 24 per mile of actual. travel. SECTION 6 . OTHER TERMS AND CONDITIONS OF EMPLOYMENT All provisions of the City Charter and Municipal Code, and regulations and rules of City relating to vacation and sick leave, retirement and pension system contributions, holidays, and other fringe benefits, and working conditions as they now exist or hereafter may be amended, in addition to said benefits enumerated specifically for the benefit of Employee, except as herein provided. SECTION 7. GENERAL PROVISIONS A. The text herein shall constitute the entire Agreement between the parties , unless formally amended and agreed to by both parties. B. This agreement shall be binding upon and inure to the benefit of the heirs at law and executors of Employee. C. If any provision, or any portion thereof, contained in this Agreement is held to be unconstitutional , invalid, or unenforceable, the remainder of this Agreement , or portion thereof, shall be deemed severable, shall not be affected, and shall remain in full force and effect. Two of the individuals have been essential to me in keeping the City operating smoothly since I became acting clerk- administrator. Michele Severson and Don Brager have been indispensable during these past few months. Michele is the primary reason the elections ran smoothly. She took charge of the election process with far too little previous training. She took responsibility to learn as much as possible in the short time available and worked very diligently toinsure a successful election. I heard from many election judges that this was one of the smoothest elections in recent years. Michele has also been invaluable in the daily administration details of the City. While a number of issues have been delayed due to a shortage of personnel, the critical issues have been kept on schedule. I am recommending a one time merit bonus of $1000. Additionally, from reviewing her job description, observing her duties, and considering the Council's decision to have Michele take Council meeting minutes next year, I am suggesting that Michele be reclassified as an exempt employee. This is based on her supervisory duties as well as the fact that a large amount of her work is self directed and therefore independent of direct supervision by others . A reclassification to exempt would eliminate her eligibility for overtime or compensatory time; and since she is required to work beyond the normal daily schedule at times, I would suggest that her salary be adjusted similarly. I have estimated that this would be approximately a 3% increase in her annual salary (from $26,394 to $27,185) . Don Brager has been my major source of support and reference these past months. His historical perspective as well as his knowledge of election and administrative procedures has proved very valuable in my efforts to keep City business running In preparing Don's performance evaluation, I have learned that Don has not had a salary adjustment (other than cost of living adjustments) in recent years. I am recommending a 3% salary adjustment in Don's annual salary, this will put Don at the 65th percentile of his pay range. I recommend that the merit bonuses and salary adjustments listed above be authorized by City Council. j,,te/nr) '5?. MEMORANDUM Memo To :Mayor and Council Members From :Ric Minetor, Acting Clerk-Administrator Date :December 17, 1990 Subject :Labor Agreement with Public Works Maintenance Employees I met with the Public Works maintenance employees on Thursday, December 13 , 1990 to discuss a labor agreement for 1991. As you are aware, the maintenance employees de-certified in 1990 and bargained a labor agreement as their own bargaining agent. The group had met on their own and then relayed their proposal to me. Their proposal included an increase in the health insurance contribution from the City to 80% of the family coverage rate; a wage adjustment based on the cost-of-living; an increase in the hours for standby duty; additional vacation accrual ; and insurance coverage for early retirements. Don Brager, Mike Ulrich, and I met with the maintenance employees to discuss the requests. We were able to achieve concurrence on an overall package that includes 1 additional hour for standby duty; an increase in health insurance contribution by the City of $25/month; a wage adjustment of 4% ; no change in vacation accrual; and an agreement that we would review the insurance for early retirement prior to next year's bargaining sessions. I believe we achieved a fair and reasonable agreement. I recommend the Council authorize the mayor and myself to execute an agreement with the Public Works Maintenance Employees which includes the changes listed above. We agreed to the increase in the uniform allowance, holiday and premium holiday pay. We agreed to no increase in the vacation accrual, and an increase of $27.50 in the insurance contribution (this is consistent with maintenance and general staff) . The union has revised theirwage request to 4.5% and a $9 per month increase for differential for investigators. This would be an overall increase of 5 . 18%. The maintenance employees and general staff received an overall increase of 5%. An overall increase of 5% for the police could be achieved with a 4.375% wage increase, but the union indicated that they felt strongly that 4.5% was necessary to settle. If this amendment is considered appropriate by the Council, I do not believe any further definition or modification would be needed to allow the type of routine maintenance discussed during the hearing and first reading of the ordinance. The municipality may acquire, pursuant to law, fee title or easement rights, by dedication, gift, purchase, eminent domain, tax forfeiture, leasehold estates, part or all of any wetlands or land 2362161/WZO.WP/PLS 38 k 41.0 • adjacent, abutting, contiguous, or affecting wetlands, for the purpose of preserving such lands and protecting the public health, safety, and welfare. Charges authorized by Chapter 25 and Chapter 42 of the Municipal Code or by other applicable law may be used to finance the acquisitions authorized herein. The Council may abate those taxes and assessments within wetlands as authorized by law. • 48.10. RESPONSIBILITY. Neither the issuance of a permit nor compliance with the conditions thereof, nor with the provisions of this Chapter, shall relieve any person from anyresponsibility otherwise imposed by law for damages to persons or properties; nor shall the issuance of any permit hereunder serve to impose • any liability on the municipality or its officers or employees for injury or damage to persons or property. A permit issued pursuant to this Chapter shall not relieve the permittee of the responsibility of complying with any other requirements established by law, regulation or ordinance. 48.11. PENALTY. Any person who violates the provisions of this Chapter shall be guilty of a misdemeanor. Each day during which said violation exists is a separate offense. Any violation of this Chapter is a public nuisance and may be enjoined by civil action. Costs of any civil enforcement shall be assessed against the property so enjoined. Any person who, in violation of this Chapter, alters, changes or modifies any wetlands shall restore such • 2362161/WZO.WP/PLS 39 1 ,,F • wetlands to their original condition. 48.12. SEVERABILITY. If any part of this Chapter is held to be unconstitutional or otherwise illegal, the remainder of this Chapter shall be deemed and held to be valid and remain in force and effect as if such portion had not been included herein. If this Chapter or any provision herein is held to be inapplicable to any person, property or work, such holding shall not affect the applicability hereof to any other person's property or work. 48.13. SPECIAL ASSESSMENT. WETLAND ZONING DISTRICTS. Subdivision 1. Wetland Zoning District Map. . Pursuant to Chapter 48.02, the wetland zoning districts delineated in the referenced wetland zoning district map are hereby established. • Subdivision 2. Wetland Zoning Districts by Legal Description. Pursuant to Chapter 48.02, the following described properties are hereby designated as wetlands: (see Appendix A). Subdivision 3. Inclusive. The wetland zoning districts designated in Subdivisions 1 and 2 above are hereby established as wetland zoning districts for the municipality. 1 2362161/WZ0.WP/PLS 42
