Call to Order order by Chairman Mountin at 7 : 32 PM on February 5, 1986. MEMBERS PRESENT: Commissioners Zollner, Anderson, 2. Roll Call Miller, Forslund and Chairman Mountin. ALSO PRESENT: Public Works/Community Development Director Thatcher. Motion/Second: Forslund/Zollner to approve the 3 . Approval of December 18, 1985 minutes as presented. Minutes: December 18 , 1985 5 ayes 0 nays • Motion Carried There were no residents requests or comments 4. Residents from the floor. Requests and Comments from the Floor The Commissioners began discussing proposed 5. Consideration of Resolution No. 151-85 regarding satellite dishes Rslt. No. 151-85 until it was time for the informational meeting to begin. Chairman Mountin explained no formal application 6. Informational has been received by the City, but the Planning Meeting: Red Oak Commission is looking at this proposed development School Site Subd. on an informational basis only. Mr. Chuck Cook, developer of the property, explained he is in the process of purchasing the property from the school district, and the site would be used as it is presently zoned and all lots will comply with City code requirements. He explained he would subdivide the area into 16 single family lots, with street construction planned for this summer. He added that the cost for all improvements to the site would be paid for by himself, as well as the cost for changing the power lines in the area. Mr. Cook presented a Mounds View Planning Commission February 5, 1986 Regular Meeting Page Two 0 sketch of the area, showing how .he proposed to develop it. Mr. Vogt, of Red Oak Drive, stated that he under- stands that if he takes his back yard and his mother' s, they would have enough to subdivide their lots. Director Thatcher explained that if they were to subdivide, they would have to meet the frontage requirements on the road, and it did not appear they would have adequate frontage for that. Chairman Mountin clarified that Mr. Cook is not interested in developing the property of any existing homes, but rather the Planning Commission wants to determine if any of the residents are interested in setting into Mr. Cook' s development so that their property is not landlocked. She added the plan is conceptual at this time, but emphasized that if anyone would want to subdivide their property, they would have to do it at this time or else they will be landlocked permanently. Mr. Cook indicated he must know as soon as possible IIIif anyone is interested in adding their property to his development. Claude Weatherly asked what would be done with the water problem on the north side of the area. Director Thatcher replied the area in question is low land, with no positive outlet, but there is a storm sewer there. He explained that a storm water holding pond would have to be built so that storm water after development would not exceed the storm water that runs off presently. He added this area is in the City's plan to work on next year, for this type of problem. Mr. Vogt asked if the change to underground power would increase his electric rate. Mr. Cook replied it would not. Director Thatcher reviewed the proposed lot sizes, stating that they meet City requirements. He stated that it has been determined the development would generate approximately 60 trips per day. III Mounds View Planning Commission February 5, 3986 Regular Meeting Page Three IIIChairman Mountin pointed out there is quite a mix of density throughout the City, in response to a concern stated that the existing lots were much larger than what is proposed for this development. She explained the City cannot require a developer to make the lots larger than what is required by ordinance. Mr. Cook stated the price ranges of the homes would be $90, 000 to $320, 000, and stated that he is not the builder but would be selling the lots to builders. In response to questioning, he stated the prices of the lots will start at approximately $27 , 000. Chairman Mountin stated that when this development goes to the Council level for their approval, official notice will be sent to the residents of the area, and she added the Council will most likely exceed the 350 ' requirement in the mailing of notices. Mike Knapp asked what type of architectural control there would be. 410Chairman Mountin replied there is no architectural review board in Mounds View, and the square foot requirements for a single story home are 960 sf. , and 780 sf. per floor fora two story home. Mr. Knapp asked if the developer would have to post a performance bond. Director Thatcher replied that some type of security must be put forth, as determined by the Council. He also explained the City may be purchasing the third lot in on the north side of the property, as storm sewer runs through that piece of property and a storm water retention basin is required for this area, and that particular location would appear to be the most logical. He added a detailed study is being done in this area to determine cost effective solutions to dealing with the runoff. He also explained the City would maintain the area, and that the developer pays a fee to the storm water management fund, and the City uses those funds, along with funds from the State, to make needed improvements. Director Thatcher stated that if anyone is interested in subdividing their property, they must contact him illby February 10th, and he in turn will get in touch with Mr. Cook. Chairman Mountin closed the informational meeting at 8 : 25 PM and continued on with the regular meeting. ► A Mounds View Planning Commission February 5, 1986 Regular Meeting Page Four The Commissioners continued their review of0 5. Consideration proposed Ordinance No. 403 regarding satellite of Rslt. No. dishes, and had a lengthy debate concerning 151-85 (Cont. ) screening requirements and how they were to be enforced. They made several changes to Ordinance No. 403. Motion/Second: Miller/Zollner to adopt Resolution No. 151-85, amending the Municipal Code of Mounds View by amending Chapter 40 entitled "Zoning" . 5 ayes 0 nays Motion Carried Director Thatcher reported Blaine has made some 7 . Review of Blaine' s minor changes to the land use plan, but they did Proposed Revisions not make any of the changes Mounds View was to Future Land concerned with. He read the original letter the Use Plan Map City had sent to Blaine, and stated they will send another letter, stating that their concerns still stand. Director Thatcher explained this subdivision was 8. John Enberg, approved by the Council in June of 1981, but the 3030 County Rd J, owner did not file it with Ramsey County so it 4110 Case 78-81 must be reapproved at this time in order for him to file it. Chairman Mountin noted it should be changed to R-1 the next time the map is updated. Motion/Second: Anderson/Forslund to adopt Resolution No. 152-85, recommending City Council approval of Mcunds View Planning Case 185-86, minor subdivision for 3030 County Road J. 5 ayes 0 nays Motion Carried Director Thatcher reviewed proposed Resolution 9 . Staff Report No. 153-85 regarding the zoning of property bounded on the north by County Road H, on the east by Interstate 35W, and on the south and west by Highway 10. It was determined that the Planning Commission would like the Council to have the Park and Rec Conunission give their input on this. It was stated that they have considered an MTC Park and Ride as a use of that site. III Mounds View Planning Commission February 5, 1986 Regular Meeting Page Five •Motion/Second: Forslund/Miller to adopt Resolution No. 153-85. 5 ayes 0 nays Motion Carried Director Thatcher stated the Commissioners should let him know if they plan on attending any of the seminars they have been discussing, and he will send in their registration. Director Thatcher reported the Minnesota Supreme Court decided not to review the Highway 10 radiator case, so the City has won the case. The district court will still determine whether he has a legal home occupation. Director Thatcher plassed out copies of the changes proposed for Chapter 39. Commissioner Forslund reported there would be a 10. Action Items hazardous waste seminar at the Fairview Community Center in Roseville on February 19, which she is planning on attending, and another one on March 19. • 11.Director Thatcher reported the attendees_ at the Chairman' s January 15, 1986 agenda session were Commissioners Report Zollner, Miller, Forslund, Chairman Mountin and himself, with Commissioner Anderson having an excused absence.
