Call to by Chairman Mountin at 7: 35 PM on March 5, 1986 . Order MEMBERS PRESENT: Commissioners Zollner, Anderson, 2. Roll Call Forslund and Chairman Mountin. ALSO PRESENT: Public Works/Community Development Director Thatcher. It was noted that Commissioner Miller had an excused absence. Motion/Second: Anderson/Forslund to approve the 3. Approval of February 5 , 1986 minutes as presented. Minutes: February 5 , 1986 4111ayes 0 nays Motion Carried Director Thatcher explained that Ronald O 'Connell, 4. Residents 2296 Terrace Drive, would like to construct a bedroom Requests and addition to the back of his home. The existing Comments from structure is only 14 ' from the property line, with the the Floor present code requiring a 30 ' sideyard setback. He stated the hardship could be that the house pre-existed the present zoning code. Chairman Mountin noted this would continue a non- conforming condition and would not necessarily consti- tute a hardship. She stated that uniqueness must be established for this particular request. After discussion among the Commissioners , it was agreed that a hardship could be found in the uniqueness of how the neighborhood was constructed, with 14 ' setbacks. Motion/Second: Anderson/Zollner to adopt Resolution No. 158-85, granting a variance request to Ronald O'Connell at 2296 Terrace Drive. 0 ayes 0 nays Motion Carried Mounds View Planning Commission March 5, 1986 Regular Meeting Page Two nnie Lane, representing the owners of the property, 5. Marcella Rybak, esented an overhead of the area and reviewed what 8370 Groveland hey would like to do. Director Thatcher pointed out the wetland code states that no house construction shall occur within the 100 ' buffer area. He also noted that the plan that was being presented now is different than the one the Planning Commission reviewed at their agenda session. He suggested the applicant decide exactly how large they would like the various lots to be, and then come back before the Commission. It was the concensus of the Planning Commissioners that it would not be a significant problem to relocate the wetland boundary for the area in question, and they recommended the applicant work further with Staff. Motion/Second: Forslund/Anderson to table this item until the next regular meeting, and continue discussion at the next agenda session. 4111 ayes 0 nays Motion Carried Director Thatcher noted there was no one present 6. Rosewood Corp. to represent Rosewood Corporation. He stated he had Pinecrest spoken with them about a week and a half ago and they Properties Plat, were still working out some berming problems at that Case 162-84 time. Motion/Second: Forslund/Zollner to table this item until the April. 2nd meeting, since the applicant was not present and Staff has not been contacted regarding th berming situation. 4 ayes 0 nays Motion Carried Director Thatcher noted there was no one present 7. MTC Park and to represent the MTC on this request. He passed out Ride Facility sketches he had received from the MTC and stated that all requirements would be met. Avenue, Case 185-86 Chairman Mountin reviewed some of the requirements that had been placed on another car wash facility that had come before the Planning Commission, specifi- cally concerning having an attendant on duty, and she recommended the resolution be worded that the number of hours an attendant was on duty would be subject to negotiation. It was determined that an additional light would be required on the east side of the building, for security purposes. Mr. Holten agreed to that. Commissioner Zollner reviewed the situation when the Planning Commission had previously approved the other car wash facility and put some very stringent requirements on their operation, specifically with the hours of operation and having an attendant on duty at all times. She stated that in comparing the two sites, the first site was adjacent to residential property and required significant protection for the residents in how the operation was conducted, 41 hereas this property is located in a commercial area d does not require such stringent rules. Motion/Second: Forslund/Anderson to adopt Resolution No. 154-86. 4 ayes 0 nays Motion Carried Director Thatcher stated he would request the Council to set the public hearing at their next meeting, for April 14, 1986 . Commissioner ForsliInd reported she would be attending 9. Action Items: a hazardous waste meeting on March 19. Hazardous Waste Director Thatcher reported he would like to review 10 . Staff Report the Wuornos study at the next agenda session. Director Thatcher reported the attendees at the 11 . Chairman' s February 19 agenda session were Commissioners Report Zollner, Anderson, Miller, Forslund, Chairman ountin, Councilmember Blanchard and himself. 111 1 The meeting was adjourned at 9: 02 PM. 12 . Adjournment Resp Af , ub d / teven Thatcher Public Works/Community Development Director RESOLUTION NO. 154-86 • CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW PLANNING CASE NO. 185-86 , BRUCE HOLTON WHEREAS , Bruce Holton has requested City approval to construct a self-serve car wash in the City of Mounds View at 2135 Program Avenue ; and WHEREAS, construction of this facility, as requested , requires approval of the development; and WHEREAS, the Planning Commission has reviewed the staff report and reviewed information submitted by the applicant which includes the following: 1 . Development Plan 2. Site Survey 3. Evidence of Site Control ; and WHEREAS, the Planning Commission has also reviewed 4111 this proposal and it is in conformance with all chapters of the Municipal Code, specifically Chapters 40, 42, 49, and 49A and State Statutes ; and WHEREAS, this development will be reviewed and approved by the Rice Creek Watershed District (RCWD) prior to construction; WHEREAS , the storm water control will be approved by the City Engineer prior to City Council approval; and WHEREAS , the applicant' s proposal satisfies vehicle stacking requirements of the City Coder NOW, THEREFORE , BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the request by Bruce Holton; BE IT FURTHER RESOLVED that a development agreement be entered into between the City and the developer which includes the following: 1 . Exhibits : a ) Site, Grading and Utility Plan 4111 b) Development Plan c ) Site Survey d) Legal Description e ) Ordinances No. 49A 7-Year Performance bond of $1 ,000 Mounds View Planning Commission Resolution No. 154-86 Page Two of Two 4111 f) Building Plans and Specifications g) Landscaping Plan 2. Security for the development in an amount to be determined . 3. Exhibit 2A to require the following : a) Paved parking area to use B-6-18 curbing . b) Concrete cross curb and gutter shall be installed at the entrance and the exit. c ) Payment of all City expenses above and beyond amounts previously submitted . d) Other items as may be required by the City Council . e ) A light shall also be installed on the east side of the building . The light shall not shine onto the exit ramp. BE IT FURTHER RESOLVED that the Mounds View Planning Commission recommends that a conditional use permit be granted which includes the above items and the following items : 4111 1 . Trees and shrubs shall be properly maintained . 2 . Garbage cans and trash shall be located inside the trash enclosure . 3. If the business closes and is not reopened within one year, the conditional use permit is null and void. 4 . An attendant shall be on duty for a minimum of 4 hours per day. If_ there is a health, safety, welfare or nuisance problem, the number of hours an attendant is on duty shall be revised by the City. BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 5th day of March, 1986. ATTEST: Chairman 4111 (SEAL ) Director of Public Works/ Community Development RESOLUTION NO. 156-86 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW • PLANNING CASE NO. 183-86, METROPOLITAN TRANSIT COMMISSION PARK AND RIDE FACILITY WHEREAS, the Metropolitan Transit Commission (MTC) has requested City approval to construct a 52-space park and ride facility near the southeast corner of County Road H and Highway 10 in the City of Mounds View; and WHEREAS, construction of this parking lot, as requested , requires approval of the development; and WHEREAS, the Planning Commission has reviewed the staff report and reviewed information submitted by the applicant which includes the following: 1 . Development Plan • • 2. Site Survey 3 . Evidence of Site Control; and WHEREAS, the Planning Commission has also reviewed this proposal and it is in conformance with all chapters of the Municipal Code, specifically Chapters 40, 42, 49, and 49A and State Statutes; and WHEREAS, this development shall be approved by the Rice Creek Watershed District (RCWD) prior to construction; NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the request by MTC contingent upon approval from Ramsey County for curb cuts and RCWD for storm water detention; BE IT FURTHER RESOLVED that a development agreement be entered into between the City and the developer which includes the following: 1 . Exhibits : a ) Site, Grading and Utility Plan b) Development Plan c ) Site Survey 1110 d) Legal Description e ) Ordinances No. 49A 7-Year Performance Bond of $1 ,000 f) Building Plans and Specifications g ) Landscaping Plan 4110 Mounds View Planning Commission Resolution No . 156-86 Page Two of Two 2 . Security for the development in an amount to be determined . 3 . Exhibit 2A to require the following : a) Paved parking area to use B-6-18 curbing . b ) Approval from Rice Creek Watershed District prior to construction. c ) Approval from Ramsey County for access to County Road H prior to contruction. d) Payment of all City expenses above and beyond amounts previously submitted . e ) Other items as may be required by the City Council . f) A pay telephone shall be installed . g) Curb and gutter for parking spaces shall be a minimum of 16 feet from the edge of the existing bituminous on County Road H. h) Applicant shall construct skimming device that 4111 satisfies City Code requirements. BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 5th day of March, 1986. ATTEST: Chaitman (SEAL) Director of Public Works/ Community Development ill • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 158-86 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION REGARDING VARIANCE REQUEST BY RONALD O'CONNELL ( 2296 TERRACE DRIVE) , MOUNDS VIEW PLANNING CASE NO. 187-86 WHEREAS, Mr. O'Connell has applied for a variance to construct an addition to his house closer to the property line than the City Code allows; and WHEREAS , this addition is proposed to he 14 feet from the west property line; and WHEREAS , this property ( 2296 Terrace Drive ) is a corner lot; and 11111 WHEREAS , the setback requirement is 30 feet; and house has a 14 foot sideyard WHEREAS, the existing y setback ; and WHEREAS, the neighborhood is unique in that the houses were constructed with 14 foot sideyard setbacks and this setback will be a continuation of the character of the neighborhood; NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission grants a 16 foot variance from the sideyard setback requirement on the west property line at 2296 Terrace Drive .
