The Mounds View Planning Commission was called to 1. Call to
order by Chairman Mountin at 7: 35 PM on Wednesday, Order
June 4, 1986.
MEMBERS PRESENT: Commissioners Zollner, Miller, 2. Roll Call
Forslund and Chairman Mountin.
It was noted that Commissioner Anderson had sub-
mitted his resignation from the Planning Commission,
effective immediately.
ALSO PRESENT: Public Works/Community Development
Director Thatcher.
Motion/Second: Forslund/Zollner to approve the May 7, 3. Approval of

James Evans, of Buetow and Associates, reviewed the 5 . Jeff Nielson,
proposed plan of Specialized Concrete Products Mfg. 4807 Mustang
to construct a 40 ,700 square foot office and Circle,
warehouse building. He reviewed the parking Case 192-86
requirements and stated they feel they would have
sufficient parking with 57 regular and 2 handicapped
spaces, versus the 90 that is required by City code.
Director Thatcher reviewed the section of the code,
Chapter 40 , regarding parking requirements and how
the number of spaces is determined.
IllkChairman Mountin noted that in the past they have
lways required applicants to have adequate parking,
s the building may be sold in the future, and the
new business may need the additional parking spaces.
She recommended that 90 spaces be provided.

Mr. Evans responded that there is ample room for the
arking, and they will provide the required number of
spaces.
Director Thatcher noted that approval is still required
from the Rice Creek Watershed District, and the City
still needs to review and approve the drainage plan. He
reviewed proposed Resolution No. 163-86.
Mr. Evans reviewed the proposed lighting for the property.
Chairman Mountin advised that the site plan should show
the lighting.
Mr. Evans explained the operation of the business, and
stated that the trucks are stored inside the building
at night, at which time they are loaded, and they are
out making deliveries during the day. He added that
all garbage would be stored inside the building, and
noise would be very minimal, with none at night.
Director Thatcher explained a sprinkling system would be
required, under Appendix E of the State Building Code.
Motion/Second: Miller/Forslund to adopt Resolution
No. 163-86 regarding Mounds View Planning Case No.
111V92-86, for Specialized Concrete Products Manufacturing.

Director Thatcher stated this item would be placed on
the Council agenda once all the loose ends and
cleared up.
Director Thatcher reviewed proposed Resolution No. 6 . George R. Grone,
164-86. 8430 Knollwood Dr.
Case 190-86
Mr. Grone stated there is no problem with water on
his property, and he did not want to have the
expense of installing the concrete pipe to provide
drainage on the property.
Mrs. Grone stated their property is higher than any
of the surrounding property.
Director Thatcher explained that some type of
positive outlet is needed for this area, and that
once the land is fully developed, the water
situation could be entirely different than it is
today. He added they have had a similar problem
Illpfn other areas of the City.
Chairman Mountin suggested a land survey could be
done by someone hired by Mr. Grone. She explained
the City was basing their decision on an aerial

survey of the property, and the Planning Commission

be more than willing to look at the findings of
reputable firm of a land survey.
Director Thatcher explained there can be a 1-2' deviation
in the findings of an aerial survey.
Chairman Mountin stated the Planning Commission could
approve the proposed resolution at this time, deny it,
or the applicant could appeal Staff' s findings at this
time.
Director Thatcher stated Mr. Grone could hire an
engineer and provide proof to the City that there is a
positive outlet on the property.
Mr. Grone stated his objection is purely a financial one,
as he does not want to spend $2,000 - $3,000 on putting
in a positive outlet, and he does not feel one is required.
Commissioner Zollner asked Mr. Grone to remember that
conditions would change once new homes are built on the
property.
Mr. and Mrs. Grone both stated there is no standing
water on the property and there has not been any. They
Illstated they believe this is being required of them
ecause of a significant drainage problem to the east
of them.
Director Thatcher noted this same requirement has been
made to other subdivisions which have come before the
Planning Commission.
Mrs. Grone stated that they want to subdivide at this
time but do not plan on building on the lots now.
Director Thatcher replied the problem must be addressed
at the time of subdivision.
Commissioner Forslund added that all subdivisions must
meet the requirements of Chapters 40 , 48 and 49 .
Chairman Mountin stated she would be agreeable to tabling
this item until the Grone' s have had an opportunity to
explore their rights and what is required.
Mrs. Grone stated she does not feel that Staff is doing
their job.
After considerable discussion, it was the concensus of
he Planning Commission to approve the resolution, with
he stipulations as set forth.
Mrs. Grone made reference to a letter from Staff dated
May 16, and stated she did not like the. word.ing and use
of the word "pond" .

IlkChairman Mountin stated Mrs. Grone' s objections would
ecome part of the minutes. She also questioned whether
he Planning Commission could approve this without a
site plan.
Mr. Grone stated he would provide one.
Motion/Second: Forslund/Zollner to approve Resolution
No. 164-86, recommending to the Council regarding
Mounds View Planning Case No. 190-86.

Director Thatcher recommended the Grone' s secure an
expert in the field to determine what type and size
of pipe is needed before going to the City Council
with their appeal.
Motion/Second: Forslund/Miller to postpone 7. Daryl Blasberg,
discussion on this item until 9: 30 PM, at the Case 191-86
request of Mr. Ken Sjodin.

arlin Grant, of Mary Anderson Homes, stated that 8. Silver Lake
ue to changes in the market, they are requesting Woods
III to change the planned construction of
condominium units in Silver Lake Woods to one story
townhouses. He explained . they have encountered too
many problems in selling the two story units, and
they would be lowering the density, and the units
would have a greater square footage, along with a
higher price, between $86,000 and $110,000. Mr.
Grant stated they would be meeting with the home-
owners association to review the proposed change
with them.
Fred Haas, of Mary Anderson Homes, showed where
the townhouses would be located, in areas that
are now designated for condominiums. He explained
the owners of each unit would own the land under
them, versus the non-ownership of condos , and he
stated they would be dropping 30 units total.
Director Thatcher stated some minor changes may
be required in the development agreement.
Mr. Grant stated they would like to go before the
City Council on June 16, with the Planning
4Ikommission' s recommendation for conceptual approval.
e added they would also get the approval of the
homeowners association before that date.

letChairman Mountin stated she would be abstaining from the
ote, as she is planning to build in the development,
ut she would not step down from the discussion, as they
would lose their quorum.
Mr. Grant asked the Planning Commission if their
approval could be worded to allow the construction of
either condominiums or townhouses in the designated
areas, as the market may change again in the future or
they may have buyers who want condominiums rather than
townhouses.
The Planning Commission drafted the following resolu-
tion, No. 165-86:
Whereas, Mary Anderson is proposing to construct six
unit townhouses in lieu of eight unit condominium
structures on some of the remaining undeveloped lots
of Silver Lake Woods Carriage Homes, Tract D , and
Whereas the six unit townhouses will be on the lots
originally proposed as eight unit condominiums , and
Whereas the development agreement may need to be
revised, and
Illirhereas Mary Anderson shall secure approval of the
ajority of the homeowners association, and
Whereas the density will be reduced from 168 units
to as low as 138 units in the undeveloped area, and
Whereas Mary Anderson shall deedthe land beneath
the townhouses to the townhouse owners,
Now therefore be it resolved that the Planning
Commission recommends to the City Council that this
conceptual plan be approved contingent upon approval
of the majority of the homeowners association,
Be it further resolved that the Planning Commission
recommends to the City Coucil that the development
agreement be amended accordingly, and
Be it further resolved that Mary Anderson may construct
townhouses or condominiums on any particular lot in
Silver Lake Woods Carriage Homes, Tract D ,
Be it further resolved that this resolution be
forwarded to the City Council prior to the approval
of the Planning Commission minutes.

lution No. 165-86.

Chairman Mountin abstained from the vote for previously
mentioned reasons.
Director Thatcher reviewed his memo of May 27, 1986 9 . Daryl Blasberg,
to the Planning Commission, regarding the request of 8106 Groveland
Daryl Blasberg to vacate an easement at 8106 Groveland Road,
Road. Case 191-86
Ken Sjodin stated that there is a cloud on the title,
and requested the City take action. stating that the
easement is no longer needed and remove it from the
property.
Director Thatcher stated that they would need positive
information from an attorney stating that there is a
definite easement on the property and asking for it
to be vacated. He explained that it is questionable
whether an easement still exists on the property, and
if it is removed, where it should go.
11 Mr. Sjodin stated that if an easement is required
omewhere, Mr. Blasberg does not own the other land
to grant another easement.
There was considerable discussion as to whether an
easement actually exists and what action should be
taken. Director Thatcher stated he felt a legal
opinion was necessary.
Motion/Second: Mountin/Miller to table to the next
agenda session and request that this item be referred
to the City Attorney for his opinion, and further
request that the applicant or his representative
provide the Planning Commission with letters from the
attorneys who have searched the title on this. The
minutes should also be searched to the best of the
City' s ability to see what happened to the easement.

investigate the title insurance and what guarantees
are provided, to whom, and get back to them.

STATE OF MINNESOTA
RESOLUTION REGARDING MOUNDS VIEW PLANNING CASE NO. 192-86 ,
SPECIALIZED CONCRETE PRODUCTS MANUFACTURING, JEFF NIELSEN
WHEREAS, Jeff Nielson has requested City approval to
construct a 40, 700 square foot building at 4807 Mustang Circle;
and
WHEREAS , construction of this building , as requested ,
requires development and conditional use permit approval; and
WHEREAS , the Planning Commission has reviewed the staff
report and reviewed information submitted by the applicant which
includes the following :
1 . Development plan
2. Site survey
3 . Evidence of site control; and
WHEREAS , the Planning Commission has also reviewed this
11111proposal and it is in conformance with all Chapters of the
Municipal Code, specifically Chapters 40, 42, 49 and 49A and
State Statutes; and
WHEREAS, the development is being reviewed by the Rice
Creek Watershed District;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of the development and
conditional use permit contingent on the items listed in
development agreement Exhibit 2A, approval by Rice Creek
Watershed District and the Minnesota Department of Natural
Resources;
BE IT FURTHER RESOLVED that the Mounds View Planning
Commission recommends that a development agreement be entered
into between the City and the developer which includes the
following :
1 . Exhibits :
a ) Site, grading, lighting , landscaping and
utility plan
b) Development plan
c ) Site survey

e ) Ordinance No. 49A 7-year performance bond
of $1,000
f) Building plans and specifications

improvements made in the easement area and restoring
the easement area.
BE IT FINALLY RESOLVED that the Mounds View Planning
Commission direct staff to forward this resolution to the City
Council prior to approval of the minutes.

RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW
• PLANNING CASE NO. 190-86, GEORGE R. GRONE, MAJOR SUBDIVISION
( 1 LOT INTO 3 LOTS) , 8430 KNOLLWOOD DRIVE
WHEREAS, Mr. George R. Grone has requested City approval
for a major subdivision ( 1 lot into 3 lots ) at 8430 Knoliwood •
Drive ; and .
WHEREAS, the Planning Commission has reviewed the staff .
report and the certificate of survey dated April 14, 1986; and
WHEREAS, the Planning Commission has also reviewed this
proposal and it is in conformance with all chapters of the
Municipal Code, specifically Chapters 40, 48, 49, and State .
Statutes; and
WHEREAS, this development does not need to be reviewed by •
the Rice Creek Watershed District; and
WHEREAS, the subdivider shall provide plans and calcula-

tions for storm water control per City Code Chapter 49A prior to
subdivision approval; and
WHEREAS, the subdivider shall furnish the City with a
site, grading, - and drainage plan prior to approval; and
WHEREAS , the developer shall pay a park dedication fee of
$192. 00 ( $150/acre X 1 . 28 acres) prior to approval;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of the development per
the request of George R. Grone contingent upon receiving the
following :
1 . Five foot drainage easements on the rear and
side property lines.
2. A drainage easement over the storm water
detention pond. •
3. Plans and calculations for storm water control .
4 . Site , grading and drainage plan.

RESOLUTION TO THE CITY COUNCIL REGARDING THE PLANNING
STUDY, "HIGHWAY FRONTAGE, PLANNING DISTRICTS 6 AND 12, CITY
OF MOUNDS VIEW, DECEMBER 1985" , R. L. WUORNOS AND ASSOCIATES
WHEREAS, the City of Mounds View contracted R. L. Wuornos
and Associates to complete the referenced study; and
WHEREAS, the study has been completed and forwarded by the
City Council to the Planning Commission; and
WHEREAS, the Planning Commission has completed an intense
review of the study; and
WHEREAS, the Planning Commission finds that the study:
1 . contains inaccurracies and inconsistancies in data ;
2. supports its findings on selected goals and policies;
3 . does not address adjacent areas impacted by the study
• area; and
4. does not offer alternative solutions;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends to the City Council that the
Wuornos Study be neither adopted nor implemented;
BE IT FURTHER RESOLVED that the Planning Commission
forwards the Study and this resolution to the City Council prior
to approval of the minutes.
