Call to Order to order by Chairman Mountin at 7 : 40 p.m. on Wednesday, October 15, 1986 . MEMBERS PRESENT: Commissioners Zollner, Miller 2. Roll Call Forslund and Chairman Mountin. ALSO PRESENT: Public Works/Community Develop- ment Director Thatcher . Motion/Second: Miller/Forslund to table 3. Approval of approval of the minutes until the next Minutes : regular meeting. August 21, 1986 September 3, 1986 September 17, 1986 • 4 ayes 0 nays Motion Carried There were no citizens requests or comments 4. Residents from the floor . Requests and Comments from the Floor Director Thatcher reviewed the request of 5. Howard Kutcher Howard F. Kutcher for a variance . Mr. Kutcher Case 198-86 proposes to construct a 480 square foot addition to his existing 478 square foot garage bringing the total square footage to 958 . Director Thatcher noted that City Code Chapter 40 .10, Subd . C( 1 ) c, states that in an R-1 District no garage shall exceed 864 square feet in area. Motion/Second: Forslund/Miller to grant the variance for reasons of health, safety and welfare of the residents at this address due to the fact that the lot is extremely large and on a busy street that has no on-street parking available, and to recommend ammending the City Code to allow 4 car garages in an R-1, Residential District. 2 ayes 2 nays Motion Failed Mounds View Planning Commission October 15 , 1986 • Special Meeting Page Two Commissioners Mountin and Zollner voted against the motion stating they felt there was no demonstrated hardship. Motion/Second: Mountion/Forslund to recommend amending City Code to allow 4 car garages. 4 ayes 0 nayes Motion Carried Motion/Second : Mountin/Zollner to approve 6 . Consideration Resolution No. 175-86 recommending approval of Proposed of proposed Ordinance No. 415 regarding acces- Ordinance Amending sory buildings in mobile home parks. Chapter 40 , Zoning 4 ayes 0 nays Motion Carried It was noted that the applicant, Mr. Charles 7 . Charles Cook Cook, was not present. Case 184-86 Director Thatcher reviewed the request of Mr. Cook for a major subdivision ( 1 lot into • 16 ) of the Red Oak Park plat. Motion/Second: Forslund/Miller to adopt Resolution No . 174-86 . 4 ayes 0 nays Motion Carried It was noted that the applicant, Mr. Daryl 8 . Daryl Blasberg Blasberg, was not present. 8106 Groveland Rd . , Case 191-86 Director Thatcher reviewed the request of Mr. Blasberg to vacate a portion of the City sewer easement located at 8106 Groveland Road . Motion/Second: Miller/Zollner to adopt Resolution No. 172-86 . 4 ayes 0 nayes Motion Carried Directer Thatcher reviewed the request of JLN 9. JLN Development Development for P.U.D. approval to construct Pinecrest Proper- 231,000 square feet of office/service; 481,000 ties, Case 199-86 square feet of light industrial; and 4,000 square 41, feet of restaurant. ' t Mounds View Planning Commission October 15, 1986 Special Meeting Page Three • Motion/Second: Zoliner/Miller to adopt Resolution No. 173-86 . 3 ayes 1 nay Motion Carried Commissioner Forslund voted against the motion stating that she cannot support a development plan which is geared more to the north residential area than south toward Highway 10 . She felt the I-1 zoning was a togetherness with the residents and noted the Council minutes, dated May 29, 1984, established an I-1 zoning with no impact on the R-1 District, which Councilmembers Blanchard , Hankner and Linke voted for. She also noted that this brought the I-1 property in conformance with the Comprehensive Plan. Councilmember Forslund explained that the JLN Development does not comply with the Comprehensive Plan, which states I-1 Districts shall have no impact on R-1 Districts. Buildings fronting on County Road H-2 will have a County Road H-2 address, therefore, having a direct impact on the R-1 District. She also explained that drivers ( trucks or cars) will be coming to County Road H-2 addresses directly off of Highway 10 , County Road H-2 or I-35W to Quincy Street, and how traffic reaches or leaves their destination will • be determined by the driver, not the Developer or the City. Commissioner Forslund reported that the EAW Study for the JLN Developers clearly puts an impact on Quincy Street and County Road H-2. She indicated that Quincy Street will become a collector street rather than a local street. Commissioner Forslund expressed that the residents did bargain in good faith with the Planning Commission and City Council in 1984. She feels that JLN does build a nice development, but would like to see them focus their development more toward Highway 10 rather than fronting County Road H-2 . Dire or of Puorks/ 111 Community Development MOUNDS VIEW PLANNING COMMISSION 411 RESOLUTION NO. 174-86 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL REGARDING PLANNING CASE NO. 184-86 , RED OAK PARK (RED OAK DRIVE AND SHERWOOD ROAD) WHEREAS, Mr. Chuck Cook has requested City approval of a major subdivision; and WHEREAS, the request is to subdivide the property into 16 lots and to grant a drainage easement for a detention pond over a portion of lots 8 , 9 and 10 ; and WHEREAS , the preliminary plat satisfies all City Code requirements including Chapters 40 , 42, 48, 49, 49A and State statutes; and WHEREAS, the development will be reviewed and approved by the Rice Creek Watershed District (RCWD) prior to construction; and WHEREAS, there is no wetland or flood plain located on the subdivisiosn; and WHEREAS, an informational meeting was held on January 29 , 1986 ; and WHEREAS, the minimum setback on the east side of Red Oak Drive between Sherwood Road and Ardan Avenue is 54 feet; and WHEREAS , the existing house on the southeast corner of Sherwood Road and Red Oak Drive has a setback of 44 feet from the Red Oak Drive lot line; and WHEREAS , the Developer requests a 10 foot variance from the Red Oak Drive side yard setback requirements for ' Lot No . 2; and WHEREAS, the hardship is that the lot will not be buildable without the variance; and WHEREAS , there are unique circumstances which apply to this property; and WHEREAS , the special circumstances do not result from the actions of the applicant; and • WHEREAS , granting a variance request will not confer on the applicant any special privileges; and RESOLUTION NO. 174-86 PAGE TWO OF TWO WHEREAS, the variance request is the minimum variance which would alleviate the hardship; and WHEREAS, the variance is not materially detrimental to the City Code; and WHEREAS, Lot Nos. 1 , 15 and 16 shall have front yard setback of 44 feet, 58 feet and 58 feet, respectively; NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the request by Chuck Cook to subdivide the land as presented in the drawings received by the City on September 25, 1986, contingent upon approval from Rice Creek Watershed District; BE IT FURTHER RESOLVED that the Mounds View Planning Commission grants a 10 foot side yard setback variance for Lot No. 2; BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. • Adopted this 15th day of October, 1986. ' 7/- Chairm (SEAL) Dir ,or of Pub is or s/ Community Devel.prent MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 172-86 411 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING VACATING SEWER EASEMENT AT 8106 GROVELAND ROAD WHEREAS, the City of Mounds View has a sewer easement to construct, operate, repair, replace, inspect, and maintain sewer mains, pipes and lines across the south 40 feet of the north 115 feet of Lot 47, Auditor 's Subdivision No. 89, except therefrom the west 20 feet, said property located at 8106 Groveland Road , owned by Daryl D. Blasberg; and WHEREAS, the residential structure at 8106 Groveland Road has been erected over a portion of the above-described sewer easement; and WHEREAS, the City does not need for its purposes the entire 40 foot easement across the above described property. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends that the City of Mounds View vacate the south 31 feet of the east 190 feet of that sewer easement contained in that deed dated February 14, 1964, filed as Document No. 472482 in the Office of the Registrar of Titles of Ramsey County. Final plan; and WHEREAS , the Planning Commission has reviewed the staff report and information submitted by the applicant which includes the following: 1 . Mounds View City Council Resolution No. 20,91 adopted on September 22, 1986; and RESOLUTION NO. 173-86 PAGE TWO OF FOUR • WHEREAS , the applicant has submitted a project that meets the requirements of City Code Chapter 40 . 24, Subd . C(2 ) , commercial or industrial planned unit development; and WHEREAS , the applicant has provided the information required by Chapter 40 . 24 , Subd . E ( 1 ) , general concept stage; and WHEREAS, in order for the light industrial building in the northwest corner of the site to be constructed , the property must be rezoned from B-3 to I-1 ; and WHEREAS , the applicant has submitted some development stage information at this time and requests recommendations from the Planning Commission on parking requirements for this project; and WHEREAS , the letter from Dahlgren, Shardlow, and Uben, Inc . dated September 8, 1986 , addresses parking standards for office and industrial uses and does not address the restaurant; and WHEREAS , the Planning Commission has reviewed the parking report prepared by Dahlgren, Shardlow, and Uben, Inc . ; and WHEREAS , surveyed cities have parking space requirements • for office buildings that vary from 4 to 5 parking spaces per 1,000 square feet of building; and WHEREAS, surveyed cities have parking space requirements for warehouses that vary from 0 . 5 to 2 .0 parking space per 1,000 feet of building; and WHEREAS, surveyed cities have parking requirements for buildings with 50 percent office space and 50 percent warehouse space varying from 2 . 25 to 3. 0 parking spaces per 1,000 square feet of building; and WHEREAS, existing City Code requires 5.7 parking spaces per 1 ,000 square feet of building area plus 3 parking spaces for office buildings; and WHEREAS, existing City Code requires 2 parking spaces per 1 ,000 square feet of building plus 8 parking spaces for industrial buildings; and WHEREAS , existing City Code requires 1 parking space per 100 square feet of public service area plus 2 parking spaces per 1 ,000 square feet of storage area for retail sales buildings with 50 percent of the space devoted to storage; and ! I, RESOLUTION NO. 173-86 • PAGE THREE OF FOUR WHEREAS , existing City Code requires approximately 25 parking spaces per 1 ,000 square feet of building for restaurants or 1 parking space per 3 seats; NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends considering traffic control at the intersections of Quincy Street and Bronson Drive, Quincy Street and County Road H-2 , and County Road H-2 and Montclair Avenue ( entrance to the Mounds View Manufactured Home Park) ; BE IT FURTHER RESOLVED that the Mounds View Planning Commission will require that the restaurant meet City Code requirements for parking spaces; BE IT FURTHER RESOLVED that the Mounds View Planning Commission recommends the following parking requirements based on 4 .9 parking spaces/1 ,000 square feet of office and 1 .7 parking spaces/1 ,000 square feet of warehouse and the office/service buildings shall not exceed 75% office space and the light industrial buildings shall not exceed 40% office space: 1 . Office/Service Buildings ( 75% office/24% warehouse)- 4 . 11 parking spaces per 1,000 square feet. 2. Light Industrial Buildings ( 40% office/60% warehouse)- 2.88 parking spaces per 1,000 square feet. BE IT FURTHER RESOLVED that a plan be submitted such that the truck loading area can be converted to automobile parking spaces when the building use changes; BE IT FURTHER RESOLVED that if the use of buildings change and the City Council requires that the truck loading area be converted to automobile parking spaces, the property owner shall convert the truck loading area to automobile parking spaces; BE IT FURTHER RESOLVED that the Mounds View Planning Commission recommends that the City Council retain a traffic consultant to review ways to mitigate the traffic impact on Quincy Street; BE IT FURTHER RESOLVED that the Mounds View Planning Commission recommends rezoning the property proposed for the light industrial building in the northwest area of the site from B-3 to I-1 ; RESOLUTION NO. 173-86 PAGE FOUR OF FOUR • BE IT FURTHER RESOLVED that the Mounds View Planning Commission recommends including the single family house west of the McDonald 's restaurant in the P.U.D. ; BE IT FINALLY RESOLVED that the Mounds View Planning Commission direct staff to forward this resolution to the City Council prior to approval of the minutes.
