Call to order by Chairman Mountin at 7 : 33 PM on Wednesday, Order April 1 , 1987. MEMBERS PRESENT: Commissioners Saunders , Zollner, 2 . Roll Call Burgers, Miller and Chairman Mountin. It was noted Commissioner Forslund and Commissioner Peters were absent. ALSO PRESENT: Clerk/Administrator Pauley and Councilmember Wuori. Motion/Second: Zollner/Saunders to approve the 3. Requests and Comments from the Floor Clerk/Administrator Pauley reviewed the report received 5. Consideration from Short-Elliott-Hendrickson, addressing the traffic of Staff Memo situation, and one from David Braslau Associates, Inc. Regarding addressing the air quality. Amoco Oil Co. , Planning Case Jim Filippi , of North Star Engineering, representing No. 196-86 Amoco, reviewed what had been submitted the last time they met with the Planning Commission, and the changes that have been incorporated into the revised site plan, based on the input they received from the Planning Commission at that meeting. He stated that based on the Planning Commission's concern over the fence, they have replaced it on the plan with landscaping. 0 Mr. Filippi reviewed the items brought up by Short- Elliott-Hendrickson and how they plan to address them, and specifically the two directions traffic could flow b Mounds View Planning Commission April 1 , 1987 Regular Meeting Page Two 0 through the car wash, and why they would prefer to see it go through in a northerly direction, and exit back out onto Highway 10. Commissioner Miller asked if the problem had been addressed about the cars dripping water onto Highway 10 during the winter. Clerk/Administrator Pauley replied they could require the applicant to install dryers, but that would not alleviate the entire problem, aswater would still drip off the under-carriage of the cars. There was discussion among the Commissioners and Mr. Filippi as to access from Highway 10 , the type and size of delivery trucks that would be used, what landscaping would be planted, and the projected traffic flow On the site. It was the concensus of the Commissioners that they would like to see blowers installed on the car wash to help minimize the water that would drip off the vehicles as they exit onto the highway. Mr. Filippi stated they have dryers in only two other facilities, and while it would not add to the length • of the car wash, it would add noise, and an additional cost. Clerk/Administrator Pauley stated the City would have to receive the data on the blowers and submit it to the PCA for their analysis and response. Mr. Filippi asked for a clarification if the pollution issues had been addressed properly. Chairman Mountin replied that Short-Elliott-Hendrickson had addressed them and does not feel there would be a problem. Mr. Filippi reviewed the pollution control standards for the Commissioners and the procedures that are followed. It was the concensus of the Commissioners that they had no problem with the traffic flow going north through the car wash and right back onto Highway 10, and that would be a preferable route to having them exit onto Silver Lake Road. The Planning Commission asked that the applicant provide a grading plan, and show the height of the berm, and the bottom elevation of the pond, as well as the 0 lighting location and their heights and descriptions. Mounds View Planning Commission April 1, 1987 Regular Meeting Page Three • There was a brief discussion on the hours of operation, and the Planning Commission asked Staff to provide them with the information of the hours and criteria that was used for K-Gas, as well as prepare a resolution regarding the request. Mr . Filippi asked what criteria was used in determining hours of operation, and he asked for performance based standards so they could address any problems with the hours of operation. Clerk/Administrator Pauley replied there is nothing to provide , and the City has not done so in the past. He also advised the Planning Commission to look at what they have done in the past and remain consistent. Chairman Mountin stated the Planning Commission would address the development again in two weeks, at their April 15 agenda session. A representative from Amoco Oil stated he was concerned with the timeframe, and asked for an idea of when they would get the go-ahead or denial, as he has other clients to consider and work with regarding that site. Chairman Mountin stated they will not be calling to order • until the May 6 , 1987 meeting, and she expects that action will be taken at that time. Clerk/Administrator Pauley explained the Council will set a public hearing, and if the Planning Commission approves the development at their May 6 meeting, the Council will set the hearing at their May 11 meeting, and hold the hearing on May 25, and they could possibly take action at that time. He added that all the proper permits will have to be filed with the various agencies, and he suggested the developer be working on those now. He added the City cannot issue a building permit until all the other permits are issued. It was noted there was no one present from Pump and 6. Chairman' s Council meeting on March 30 were Commissioners Saunders, Report Peters, Burgers, Miller and Chairman Mountin. The attendees at the March 18 agenda session were Commissioners Saunders, Zollner, Peters , Burgers, Miller, Forslund and Chairman Mountin, Clerk/ Administrator Pauley and Councilmember Wuori. ':u Cler' Administra o. • • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 181-87 CITY OF MOUNDS VIEW 411 COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW PLANNING CASE NO. 196-86, AMOCO OIL COMPANY, 2800 TRUNK HIGHWAY 10 WHEREAS, Amoco Oil Company has requested City approval to construct a gas station/convenience store/self-service car wash in the City of Mounds View; and WHEREAS, the development, as proposed, requires a Conditional Use Permit, Minor Subdivision, and development approval; and WHEREAS, the Planning Commission has reviewed the following documents regarding this development proposal: a) Site Plan b) Landscape Plan c) Grading/Drainage Plan d) Boundary and Topography Survey e) Drainage Analysis f) Baffled Wier Plan WHEREAS, the Planning Commission has determined that the development proposal is in conformance with the requirements of the Municipal Code, especially Chapters 40', 42, 49 and 49A and State Statutues; and WHEREAS, the development proposal requires permits from the Rice Creek Watershed District, Ramsey County, the Minnesota Department of Transportation (mnDOT) , and Minnesota Department of Public Safety, Office of State Fire Marshall; and WHEREAS, the storm water controls for the project have been determined to be adequate. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of a Conditional Use Permit with the following conditions: 1. The facility must, at all times, be in compliance with State Laws and Minnesota Pollution Control Agency Standards for air quality and noise. 2. The hours of operation shall be 24 hours. -After -one year operation, the City shall hold a public hearing to solicit input on the hours of operation. If there are any negative comments, the hours of operation may be reduced. • RESOLUTION NO. 181-87 PAGE TWO • 3 . Outside loud speakers shall be utilized for clearing pumps only. 4. Outside merchandising shall be limited to the concrete entrance slabs to the building. Outside merchandise • stacking shall not exceed 4 feet. 5. The single pedestal sign shall be located as shown on the site plan dated February 6 , 1987 . All other signage shall be in conformance with Municipal Code. 6 . If for any reason the gasoline sales portion of the business closes for a one year period, the Conditional Use Permit shall be null and void and the underground tanks shall be filled with sand or removed. 7. The car wash facility shall include a blower system designed to remove as much water as feasible from the vehicle before it is allowed to exit the facility. This equipment shall operate as a customer option from April 16 to October 14 and as a mandatory item from October 15 through April 15. 8 . Entrance to the car wash facility shall be achieved • from the southeast and vehicles shall exit to the northwest. BE IT FURTHER RESOLVED that the Mounds View Planning Commission recommends approval of the Minor Subdivision. G BE IT FURTHER RESOLVED that the Mounds View Planning Commission recommends that a Development Agreement be entered into between the City and the Developer which includes the following: 1. Exhibits a) Site, Grading/Drainage, Landscaping, Lighting, Utility, Building Elevation, and Baffled Wier Plans b) Site Survey c) Legal Description d) Building Plans and Specifications e) Rice Creek Watershed District, Ramsey County, Minnesota Fire Marshall and MnDOT Permits f) Ordinance No. 49A 7-Year Performance Bond of $1,000 110 2. Payment of all City Staff and Consultant expenses related to the project above and beyond amounts previously • submitted. BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 6th day of May, 1987 . ATTEST: Chairman (SEAL) Clerk-Administrator i • MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 182-87 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING DENIAL OF A REZONING REQUEST FOR 2410 COUNTY ROAD I , TOM THUMB SUPERETTE WHEREAS, Pump and Meter Service Company has applied to rezone the property located at 2410 County Road I from B-1 , Neighborhood Business to B-3, Highway Business and install gas pumps; and WHEREAS, the Comprehensive Land Use Plan indicates the site should have a use as neighborhood commercial; and WHEREAS, a neighborhood commercial use in the Comprehensive Land Use Plan means a B-1 or B-2 zoning; and WHEREAS, this request is not in conformance with the Comprehensive Land Use Plan; and • WHEREAS, existing zoning of the site is B-1, Neighborhood Business District; and WHEREAS, rezoning of the property would constitute spot zoning; NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends denial of this request because of the following: ( 1 ) The proposed use does not conform with the Comprehensive Land Use Plan. (2) The proposed use is inconsistent with the spirit and intent of neighborhood commercial centers (Neighbor- hood Business District) . (3 ) The site cannot accommodate sufficient parking to comply with the Zoning Ordinance for the proposed use. MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 183-87 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION OF RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW PLANNING CASE NO. 204-87 , • DAILEY KNOLLS PRELIMINARY PLAT WHEREAS, Dailey Homes , Inc. has requested approval of a Preliminary Plat subdividing the east half of Lot 7 , • Lot 8 , and the last half of Lot 9 , into 3 lots for development of 3 zero lot line duplexes; and WHEREAS, the City staff has conducted a Development Review of the proposal and determined that the preliminary plat is in compliance with all applicable City codes ; and WHEREAS, the Mounds View Planning Commission reviewed the Preliminary Plat and concurred with the conclusions reached during the Development Review. NOW, THEREFORE, BE IT RESOLVED that the Mounds • View Planning Commission recommends approval of the Dailey Knolls Preliminary Plat. Adopted this 6th day of May, 1987 .
