No. 189-87 , Planning Motion/Second: Miller/Saunders to adopt Resolution Case 209-87 , No. 189-87, recommending approval to the City Council Larry Pearson, of a conditional use permit to construct an accessory 2925 Highway 10 building for Larry Pearson, 2925 Trunk Highway 10 , Planning Case No. 209-87 . 4 ayes 0 nays Motion Carried Clerk/Administrator Pauley passed out revised site 8. Continuation plans to the Commissioners for their review. of Discussion on Mounds View Councilmember Wuori arrived at 7 : 55 PM. Planning Case No. 211-87, Chairman Mountin expressed concern that there were not Silverview enough parking spaces allowed for, or enough room to Plaza add additional spaces if the need arises. Clerk/Administrator Pauley explained that in the past the City has made exceptions on the parking requirements, and the City Attorney has advised it is alright to do so. He added that this proposed development is a PUD, which does allow for it. Chairman Mountin suggested that rather than making allowances on the parking, they should review the code and change the code, if that is what is required. Tore Wistrom, of Kraus/Anderson Development Corporation, explained they had researched nine surrounding communities for their parking requirements, and found them all to be less restrictive. He added New Brighton is in the process of restructuring theirs to be there lenient that it now. He explained they do not feel the parking will present a problem on this site . The Planning Commission discussed the possibility of moving the access point to the property to meet code, but of the potential for problems with angles, or • possibly having it connect onto the Super America property and using a combined entrance/exit. Wistrom stated he did not feel that would be a desirable situation, and that he wasn't sure Super America would be willing to agree to a shared access on their property. He explained it would necessitate some relandscaping on their part. Access was discussed further and it was suggested they could leave it as was originally planned, with a stop sign going out to the west, as well as one at the Super America exit. The Planning Commission directed Staff to prepare the necessary resolution for considera- tion at the June 17 agenda session, and they will call to order at that time to take action on this development. Commissioner Peters asked if the residents had been taken into consideration with the lighting for this development. Chairman Mountin explained the berming and landscaping would serve to protect them. She also noted the lighting is required to fall onto the property and not off into the residential area. Clerk/Administrator Pauley stated that this parcel has always been a PUD, and the plans are on display in the real estate office for potential buyers in the area to •view. Clerk/Administrator Pauley explained that Paul Johnson, 9. Staff Report 8368 Red Oak Drive, had asked for and received approval in 1980 for a minor subdivision to resubdivide two lots by adjusting the common rear lines, but he did not file the documents within the 60 day timeframe, so he is back for another approval of this minor subdivision. He added Staff would recommend approval again, with the addition of an 8 ' right of way and utility easements. Mr. Johnson stated he has sold the property on a contract for deed and stated the new owner has started building a garage and he may be closer to the property than what is requested for the utility easement. Clerk/Administrator Pauley asked Mr. Johnson to have his surveyor go out again and get a reading, and he stated he would check out City records . Motion/Second: Saunders/Peters to adopt Resolution No. 190-87 , recommending approval of the minor subdivision for 8368 Red Oak Drive, Planning Case No. 212-87 . 04 ayes 0 nays Motion Carried Mounds View Planning Commission June 3, 1987 Regular Meeting Page Four •Clerk/Administrator Pauley reported three proposals had been received for the update of the Comp Plan and Land Use Plan. He explained the Council has appointed Councilmembers Wuori and Hankner to a selection committee, and would like two Planning Commissioners on the committee also, to review the proposals and select the firm to do the work. It was agreed that Commissioner Saunders and Chairman Mountin would represent the Planning Commission. Clerk/Administrator Pauley gave them copies of the proposals received and asked that the committee meet at 6 PM on June 17, before the next agenda session, and allow a half hour for each of the three firms to interview. Pa Cle /A• inist -tor • • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 187-87 111 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW PLANNING CASE 210-87, NORTH STAR INDUSTRIAL PARK, WATSON-FORSBERG COMPANY WHEREAS, Watson-Forsberg Company has requested approval of the preliminary plat for a major subdivision entitled , "North Star Industrial Park" in the northeast corner of the City, south of County Road J and east of Judicial Ditch No. 1 ; and WHEREAS, City Staff has reviewed the proposed preliminary plat`: and determined that it is in compliance with all applicable City Codes; and WHEREAS, the Planning Commission has reviewed the preliminary plat and concurred with conclusions reached by City Staff. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the preliminary plat for the major subdivision of the North Star Industrial Park submitted by Watson-Forsberg Company. BE IT FURTHER RESOLVED that the Mounds View Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 3rd day of June, 1987. ATTEST: Chairman (SEAL) Clerk-Administrator MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 188-87 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW PLANNING CASE 208-87, GREG JOHNSON, 2865 TRUNK HIGHWAY 10 REZONING FROM R1 SINGLE FAMILY RESIDENTIAL TO RO RESIDENTIAL OFFICE WHEREAS , Gregory Johnson, 2865 Trunk Highway 10 has requested approval of the rezoning of said property from R1 Single Family Residential to RO Residential Office ; and WHEREAS, the rezoning request although not consistent with the Comprehensive Plan is considered to be in the best interest of the City; and WHEREAS, the rezoning is consistent with the future intent of the City as it relates to uses of property along the corridor of Trunk Highway 10; and WHEREAS, the Planning Commission has determined that the • rezoning request is in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends amendment of the City' s Comprehensive Land Use Plan to designate this property as High Density Residential and approve the rezoning of the property from R1 Single Family Residential to RO Residential Office. CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF CONDITIONAL USE PERMIT TO • CONSTRUCT ACCESSORY BUILDING FOR LARRY PEARSON, 2925 TRUNK HIGHWAY 10 , PLANNING CASE NO. 209-87 WHEREAS , Mr . Larry Pearson , 2925 Trunk Highway 10 has requested a Conditonal Use Permit to allow construction of a 400 square foot storage building ; and WHEREAS , Mounds View Municipal Code Chapter 40. 10, Subdivi- sion C, 2, (c) , provides that the maximum size of an accessory building in an R1 District shall be 216 square feet unless a Conditional Use Permit is awarded by the City; and WHEREAS , Mounds View Municipal Code Chapter 40. 10 , Subdivision D, ( 6) , A through E provides an accessory building may be permitted up to 400 square feet when said building is a permanent structure and is designed and maintained to provide a uniform appearance with the principle dwelling unit ; and • WHEREAS , the Mounds View Planning Commission has reviewed the applicant ' s request for a Conditional Use Permit and determined that it is in conformance with the aforementioned conditions . NOW, THEREFORE , BE IT RESOLVED that the Mounds View Planning Commission recommends approval of a Conditional Use Permit to allow the construction of a 400 square foot accessory building by Larry Pearson , 2925 Trunk Highway 10. ATTEST : Chairman (SEAL) Clerk-Administrator 411 MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 190-87 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL REGARDING REAPPROVAL OF MINOR SUBDIVISION, 8368 RED OAK DRIVE , PLANNING CASE NO. 212-87 WHEREAS , on October23, 1980 Paul Johnson, 8368 Red Oak Drive , requested approval of a minor subdivision to resubdivide two lots by adjusting the common rear lot line ; and WHEREAS , the minor subdivision received the approval of the Planning Commission and City Council with a requirement that utility easements as shown on the drawing entitled , "Sheet 3" be given; and WHEREAS, Paul Johnson did not file the necessary documents for recording within the required 60 day period and has reapplied for approval of the minor subdivision ; and WHEREAS , the proposal has been reviewed by staff and recommended for approval with the requested utility easements and an additional 8 feet of right-of-way on Red Oak Drive . NOW, THEREFORE , BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the minor subdivision with the requested utility easements and 8 feet of right-of-way on Red Oak Drive . BE IT FURTHER RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes . Adopted this 3rd day of June , 1987 . Call to Order called to order by Chairman Mountin at 8: 40 p.m. on Wednesday, June 17, 1987. MEMBERS PRESENT: Commissioners Zoliner, 2. Roll Call Miller, Saunders, Burgers and Chairman Mountin. It was noted that Commissioner Forslund had an excused absence. ALSO PRESENT: Councilmembers Wuori and Hankner, Mayor Linke and Clerk-Administrator Pauley. Motion/Second: Saunders/Burgers to approve 3. Consideration . Planning Commission Resolution No. 191-87. of Resolution No. 191-87 Silverview Plaza 4 ayes 1 nay Motion Carried Commissioner Zoliner explained her nay vote by stating that the parking on the site is not in accordance with the parking ordinances and justification for this reduction in parking has not been demonstrated . Paule Clerk Ad' inistr=tor • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 191-87 • CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE SILVER VIEW PLAZA DEVELOPMENT PROPOSAL WHEREAS, Kraus-Anderson Development Corporation on behalf of M and E Realty has submitted a development proposal for a 36,000 square foot shopping center on Track C of Lot 1, Block 11 in the City of Mounds View (2655 Trunk Highway 113 ) ; and WHEREAS, the Staff and Planning Commission have undertaken extensive review of the proposal; and WHEREAS, the Planning Commission, in consideration of national standards has determined that the number of parking spaces proposed to be provided appear to be adequate to meet the needs of the site; and WHEREAS, the Planning Commission has determined that the • project is in conformance with all applicable Municipal Codes. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends approval of the site plans including lighting and landscaping with the relocation of the entry drive onto Mounds View Drive to the alternate site shown on the site plan in order to provide safe traffic patterns. BE IT FURTHER RESOLVED, that the lane accessing the drive- up window shall be designated for one way travel west to east. BE IT FURTHER RESOLVED, that the Mounds View Planning Commission directs Staff to forward this resolution to the City Council prior to the approval of the minutes.
