The Mounds View Planning Commission was called to 1 . Call to
order by Chairman Mountin at 7 : 32 PM on Wednesday, Order
September 2, 1987.
MEMBERS PRESENT: Commissioners Saunders, Zollner , 2 . Roll Call
Burgers, Miller and Chairman Mountin.
It was noted Commissioner Forslund had an excused
absence, and Commissioner Peters had an unexcused
absence.
ALSO PRESENT: Councilmember Wuori.
Motion/Second: Zollner/Saunders to approve the 3 . Approval of
August 5, 1987 minutes as corrected. Minutes:

Deborah Otto, 7405 Park View Drive, stated she had 4 . Residents
requested a building permit for an addition to her Requests and
home, which was denied by City Staff, and she is Comments from
before the Planning Commission to request a variance the Floor
and ask that they expedite it, if at all possible.
Ms. Otto explained that her property, which is located
in the Silver Lake Woods development, abutts the pond,
and the house itself, which was built in 1985 , is
within the wetland buffer, according to City code.
She explained that for economic reasons, when the house
was built, she was not able to include a planned
family room or additional bedrooms above that, or the
basement below, but now she has closed on a second
mortgage to put on the addition, and each day the
contractor is held up, it is costing her interest, and
it is delaying her from locking into refinancing for
the entire house. She added the existing home has 700
square feet per floor, and she needs the additional
room.

411Ms. Otto stated the proposed addition, which will
be 26 ' x 16 ' and will be attached behind the existing
garage, will extend -21" further back than the existing
house. She also stated that the blueprints on file
at City Hall show the headers that were put in during
the original construction, and they indicate that this
addition was planned at that time.
Chairman Mountin clarified that the variance that
would be required would be for wetland encroachment,
and she advised Ms. Otto that the Planning Commission
cannot consider economic need in granting variances,
and they must find uniqueness in the request. She
pointed out the area was platted before the wetland
ordinance took effect, and she reviewed the requirements
of Chapter 48.05, Sub 5C, for the wetland buffer area.
After considerable discussion, the Planning Commission
listed the criteria that Should be included in a
resolution to grant a variance for the wetland buffer.
Motion/Second: Miller/Burgers to adopt Resolution
No. 201-87, granting a wetland buffer variance to
Deborah Otto, 7405 Park View Drive.

"'Chairman Mountin explained that Staff will have to look
into the requirements of such a variance to determine
whether it must be addressed at the Council level. She
stated that if it did not, the Planning Commission was
the final level of approval, and Ms. Otto would be able
to get her building permit, but if it did require
Council action, the permit could not be issued until
she had gone through that process. Chairman Mountin
stated she would get a clarification and get in touch
with Ms. Otto the next day.

No. 200-87 , recommending approval of the final plat,
North Star Industrial Park, Mounds View Planning Case
No. 210-87, and forward to the Council prior to
approval of the minutes.

Wuori reported that the dissenting 6. Staff Report

group from the Greenfield Estates development would
be meeting with the Council, Staff, Harstad Company
and engineer on September 10 , at 7 : 30 PM. She
explained that the public hearing scheduled for
August 24 had to be postponed until September 14,
due to insufficient notification of affected
property owners.
Chairman Mountin reported .she had received a call 7 . Chairman' s
from Paul Fedor, regarding a garage he would like Report
to build behind his store, which isnot allowed by
Code. She suggested to him he could do a Code
appeal, but he didn't care to, and he asked that
the Planning Commission consider the garage issue again.
Chairman Mountin reported she had received a call
from John Miller, regarding a conditional use permit
for the sale of gas on his property at the North Star
Industrial Park, and she indicated to him he would
need a primary use before a conditional use permit
could be considered.
The attendees at the August 19 agenda session were
Commissioners Miller, Zoller, Saunders and Chairman
and Clerk/Administrator Pauley, with
•Mountin,
Commmissioners Burgers and Forslund having excused
absenses.

RESOLUTION NO. 200-87
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RECOMMENDING APPROVAL OF FINAL PLAT, NORTH STAR INDUSTRIAL PARK
MAJOR SUBDIVISION, MOUNDS VIEW PLANNING CASE NO. 210-87
WHEREAS, Watson Forsberg Company has requested approval of
a final plat for North Star Industrial Park; and
WHEREAS, the preliminary plat for North Star Industrial Park
was reviewed and recommended for approval by the Mounds View
Planning Commission during 1987; and
WHEREAS, the Mounds View City Council conducted a public
hearing and reviewed and approved the preliminary plat on
June 22, 1987; and
WHEREAS, a final plat has been reviewed by the Mounds View
City Staff and Planning Commission and found to be consistent
with the previously approved preliminary plat.
NOW, THEREFORE, BE IT RESOLVED the Mounds View Planning
III Commission recommends approval of the North Star Industrial
Park final plat conditioned upon the following items:
1. Deeding of Outlot A to the City of Mounds View.
2. Construction of a temporary retention or detention
ponding facility by the Developer.
3. The cities of Blaine and Mounds View enter into a
Joint Powers Agreement for theuse of public utilities
by the occupants of the industrial park.

RESOLUTION NO. 201-87
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
APPROVING VARIANCE FOR DEBORAH OTTO, 7405 PARK VIEW DRIVE
WHEREAS, Deborah Otto has requested authorization to
construct an addition to her single family residence located at
7405 Park View Drive ; and
WHEREAS, said residence is located within the 100 foot wet-
land buffer zone provided for in Chapter 48 of the Mounds View
Municipal Code entitled, "Wetland Zoning Code" ; and
WHEREAS, it has been determined that a variance is necessary
in order to allow for the construction of an addition to a home
located within a 100 foot wetland buffer area; and
411 WHEREAS, it has been determined that all homes within the
area of the Otto residence are located within the 100 foot buffer
zone; and
WHEREAS, the original blueprint for this home included a
provision for a future addition as currently proposed; and
WHEREAS, denial would render any type of an addition to the
home impossible and would further deny any future alterations to
any other homes located in the area of the wetland in question;
and
WHEREAS, the proposed addition meets all the requirements of
the City's Zoning Code including minimum rear yard setback.
NOW, THEREFORE, BE IT RESOLVED that a variance is granted
to Deborah Otto, 7405 Park View Drive to allow the construction
of an addition to her existing home.
BE IT FURTHER RESOLVED, that Staff should determine what
erosion controls may be required during construction and the
basement elevation is to be established at the existing basement
elevation per the plans submitted and received by the City of
Mounds View on August 31, 1987.
