Call to order by Chairman Mountin at 7: 30 PM on Wednesday, Order October 7, 1987. MEMBERS PRESENT: Commissioners Saunders, Burgers, 2 . Roll Call Zollner, Miller, Peters and Chairman Mountin. ALSO PRESENT: City Planner Herman and Councilmember Wuori. Motion/Second: Zollner/Burgers to approve the 3. Approval of September 2 , 1987 minutes as presented. Requests and Comments from the Floor Planner Herman reported a revised proposal has been 5. Consideration presented by Kraus-Anderson for a proposed traffic of Staff Report connector between the current Super America site Regarding and the new Silver View Plaza site, and she noted Request by they had altered the plan since the agenda session Kraus-Anderson, so that the proposal conforms to the City' s zoning Mounds View code and a variance is no longer required for Planning Case parking spaces. No. 172-85 Tore Wistrom, from Kraus-Anderson, stated they hope the Planning Commission will approve the connection between the shopping center and Super America. Bob Johnson, representing Super America, assured the Planning Commission that if there is a problem with traffic going through the access, they will come back to the City to ask that it be closed, or some 41lother appropriate action be taken. Mounds View Planning Commission October 7, 1987 Regular Meeting Page Two The Planning Commission noted that this application now meets the required number of parking spaces and they asked that Staff prepare the necessary resolution of approval. Motion/Second: Burgers/Miller to adopt Resolution No. 206-87, recommending approval of the amendment to the development agreement with Super America and Kraus- Anderson Development Corp. , and waive the reading. 6 ayes 0 nays Motion Carried Planner Herman reported nothing had changed since the 6. Consideration Planning Commission reviewed this request at the agenda of Rslt. No. session., and she noted the issue with the water main 205-87, TJB extension should be resolved by the Council. Motion/Second: Zollner/Saunders to adopt Resolution No. 205- 87, recommending approval of the TJB Companies development proposal, and waive the reading. Robert Raes, 7715 Eastwood Road, the applicant, stated he was concerned with the time element as he hopes to begin construction before the cold weather, and he also has a price lock on the material which will expire soon. Lake Road Chairman Mountin noted for the record that Mr. Hyser had been offered the opportunity at the September 16 agenda session to withdraw his request, and save the $50 fee, but he had stated he wanted to go on with it to the Council. Motion/Second: Zollner/Miller to adopt Resolution No. 203-87 , denying the variance request for Scott Hyser, 7340 Spring Lake Road, and waive the reading. 6 ayes 0 nays Motion Carried Chairman Mountin directed Planner Herman to send a letter to Mr. Hyser, informing him that the Planning Commission denied the variance request, and that if he would like to appeal the denial, he must goto the Council. •It was noted there was no one present to represent 9. Consideration the applicant. of Staff Report Regarding Exten- Planner Herman reported that Kunz Oil Company had sion of CUP been granted a conditional use permit on October 13, for Kunz Oil 1986 for a gas station and convenience store to be Company located on the present location of K-Gas at 2901 Highway 10, but after receiving the permit, they never took any action to begin construction. She explained that City code states that a conditional use permit becomes null and void if the work permitted is not completed within one year, unless a petition for an extension is filed with the City 30 days before "'the expiration date of the original permit. She noted that the request was received on September 24 , 1987 , which is less than the required 30 days. Mounds View Planning Commission October 7, 1987 Regular Meeting Page Four Chairman Mountin noted that Kunz Oil was held up originally, before the conditional use permit was granted, due to the building moratorium, but she stated she feels strongly that they need to look at the landscaping and buffering again, as they have required other similar developments in the past year to provide more. Commissioner Burgers asked if it was possible to extend the conditional use permit with the added stipulation on the landscaping, through the development review process. Commissioner Saunders stated he would like an opportunity to review the drawings, as he was not on the Planning Commission when this was first approved, and he has never seen it. Commissioner Peters noted this would be a good time to promote the new look for Mounds View, with this development fronting on Highway 10. Chairman Mountin asked Planner Herman to check with the City Attorney to see if the Planning. Commission would have an opportunity for another development review, with the extension of the conditional use permit. Planner Herman reported Mr. Kunz had just submitted plans this past week at City Hall, and she will check with the Attorney on the possibility of another development review. Motion/Second: Burgers/Saunders to table action on this item until input is received from the City Attorney. 6 ayes 0 nays Motion Carried Planner Herman presented the Commission with proposed 11 . Staff Report Ordinance No. 430 , dealing with specific changes to City code covering what is allowed or not allowed in side yards, and she asked for Planning Commission input on the proposed changes and language. There was discussion among the Commissioners and Planner Herman regarding the intent of the change and the best way to accomplish it. It was the concensus of the Planning Commission that they need a list of permitted accessory uses for side yards "'and rear yards, and a list of non-permitted uses for front yards and side yards, before they could make any suggestions. They stated they were not happy with the proposed ordinance at this time and were not ready to make any recommendation. ilr Mounds View Planning Commission October 7, 1987 Regular Meeting Page Five AliPlanner Herman handed out material on the annual gOrPlanning Institute seminar and asked if any Commissioners were interested in attending. It was determined that all members of the Commission had already attended this seminar. Planner Herman reported the consultant who is doing the Comp Plan update will be attending each agenda session for the next eight meetings or so, and she will try to get a clear understanding from him of the process to be followed. Chairman Mountin stated they would like to know in advance the areas to be covered at each meeting, to allow time to gather thoughts and jot down comments. The attendees at the September 16 agenda session were 12 . Chairman' s Commissioners Miller, Peters, Saunders, Burgers and Report Zollner, Councilmember Wuori, Clerk-Administrator Pauley and Planner Herman., with Chairman Mountin having an excused absence. Chairman Mountin clarified the action at the September 2 meeting, with the wetland variance request that had been approved for Deborah Otto. She stated that the Planning Commission is the final authority in granting Othat type of variance, and it is not necessary to go on to the Council. Chairman Mountin adjourned the meeting at 8: 38 PM. 13. Adjournment Respectfully submitted, Kimberly Herman City Planner 411 MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 202-87 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF CONDITIONAL USE PERMIT TO CONSTRUCT ACCESSORY BUILDING FOR AMBROSE DEGROSS, 8120 EDGEWOOD DRIVE, PLANNING CASE NO. 226-87 WHEREAS, Mr. Ambrose DeGross, 8120 Edgewood Drive, has requested a conditional use permit to allow construction of a 400 square foot storage building; and WHEREAS, Mounds View Municipal Code, Chapter 40 . 10, Subdivision C( 2) ( c) , provides that the maximum size of an accessory building in an R-1 District shall be 216 square feet unless a conditional use permit is awarded by the City; and WHEREAS, Mounds View Municipal Code, Chapter 40 . 10, Subdivision D( 6 ) A through E, provides an accessory building may be permitted up to 400 square feet when said building is a 411 permanent structure and is designed and maintained to provide a uniform appearance with the principal dwelling unit; and WHEREAS, the Mounds View Planning Commission has reviewed the applicant's request for a conditional use permit and determines that it is in conformance with the aforementioned conditions. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of a conditional use permit to allow construction of a 400 square foot accessory building by Ambrose DeGross, 8120 Edgewood Drive, conditioned upon the following: 1. The use of the building shall be limited to storage of domestic supply and non-commercial recreational equipment as provided for in Municipal Code Chapter 40 . 10 , Subdivision C( 2 ) . 2. No improved driving surface or apron shall be installed to the building. 3. Any vehicle stored in the building must be licensed with the Minnesota Department of Transportation as a collector or vintage vehicle. MOUNDS VIEW PLANNING COMMISSION . HYSER, 7340 SPRING LAKE ROAD, MOUNDS VIEW PLANNING CASE NO. 223-87 WHEREAS, Mr. Scott Hyser, 7340 Spring Lake Road, has requested a variance to allow construction of a 6 foot high fence; and WHEREAS, Mounds View Municipal Code, 40.04, Subdivision H( 3 ) , requires that a fence not exceed 48 inches in height when extended beyond the front line of the principle building; and WHEREAS, Mounds View Municipal Code, 40. 26 , Subdivision D, states the criteria for granting a variance; and WHEREAS, there are no extraordinary circumstances applied to the property which do not apply to other properties in the • vicinity. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission denies the variance request of Scott Hyser, 7340 Spring Lake Road, for a 6 foot high fence due to lack of exceptional circumstances meeting the requirements of the Mounds View Zoning Code. ATTEST: r- d. x4,-,,- Chai ma (SEAL) City Planner • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 205-87 111 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE TJB COMPANIES DEVELOPMENT PROPOSAL WHEREAS, TJB Companies has submitted a development proposal for a 2, 940 square foot office building at 2704 Trunk Highway 10 in the City of Mounds View; and WHEREAS, Staff and Planning Commission have undertaken review of the proposal; and WHEREAS, the issue of the extension of the water main from Silver Lake Road to the site has yet to be resolved; and WHEREAS, the Planning Commission has determined that the project is in conformance with all applicable Municipal Codes. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends approval of the • site plans including the landscaping plan contingent upon the following conditions: 1. The developer obtain a permit from Rice Creek Watershed District. 2. The water main extension from Silver Lake Road to the site will be resolved by the City Council. BE IT FURTHER RESOLVED that the Mounds View Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 7th day of October, 1987 ATTEST: C h i rma�t (SEAL) City Planner MOUNDS VIEW PLANNING COMMISSION • RESOLUTION NO. 206-87 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL TO AMEND THE SUPERAMERICA AND SILVER VIEW PLAZA DEVELOPMENT AGREEMENTS WHEREAS, Kraus-Anderson Development Corporation has submitted an amendment to the development agreements for Superamerica, 2640 County Road I , and Silver View Plaza, 2540 Highway 10, for a bypass between the two parking lots; and WHEREAS, Staff and Planning Commission have undertaken extensive review of the proposal; and WHEREAS, the Planning Commission has determined that both developments will have the required amount of parking spaces per the development agreements; and WHEREAS, the bypass will facilitate the traffic flow between the two developments; and • WHEREAS, the bypass will aide in alleviating traffic in the surrounding residential areas, and WHEREAS, the Planning Commission has determined that the bypass is in conformance with all Municipal Codes. NOW, THEREFORE, BE IT RESOLVED the Planning Commission of the City of Mounds View approves the revised site plan including the bypass between Superamerica and Silver View Plaza. BE IT FURTHER RESOLVED that the Mounds View Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 7th day of October, 1987.
