HomeMy WebLinkAbout12-02-1987 PROCEEDINGS OF THE PLANNING COMMISSION • CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA Regular Meeting December 2 , 1987 Mounds View City Hall 2401 Hwy. 10 , Mounds View, MN 55112 The Mounds View Planning Commission was called to 1 . Call to order by Chairman Mountin at 7: 30 PM on Wednesday, Order December 2 , 1987. MEMBERS PRESENT: Commissioners Saunders, Zollner, 2 . Roll Call Miller, Peters, Simons and Chairman Mountin. It was noted that Commissioner Burgers had an excused absence. ALSO PRESENT: City Planner Herman and Councilmember Wuori. Motion/Second: Zollner/Miller to approve the minutes 3 . Approval of of the November 4, 1987 regular meeting and Minutes: •ovember 18, 1987 special meeting, as presented. Mr. Newton stated it would be very costly to take it out, and that without a driveway to it, it would be only a patio. Motion/Second: Saunders/Zollner to adopt Resolution No. 210-87 , recommending approval of a conditional use permit to construct an accessory building for Odas Newton, 8319 Groveland Road, Planning Case No. 229-87. 6 ayes 0 nays Motion Carried Planner Herman advised that the Council will set the public hearing at their December 14 meeting, to be held on December 28. Mr. Newton stated he was concerned with getting started on the foundation and cement work as soon as possible, before the bad weather sets in. Planner Herman advised that since the Code states there cannot be two garages on one lot, Mr. Newton should not start until after the public hearing and approval by the Council. She added that a building permit would �e required, and one could not be issued with the exist- ing garage there. Councilmember Wuori recommended that due to the time constraints , Mr. Newton could come to the December 7 agenda session and talk to the Council and get their feelings . Planner Herman reviewed the two proposals submitted 6. Consideration by Mr. Petron far the subdivision of his property, of Rslt. No. and she stated that while neither meets the code 208-87 , Minor requirements , Staff feels that Exhibit 1 presents a Subdivision better solution to the problem. Request of Alphonse Petron, Chairman Mountin stated she was concerned with granting 2909 Woodale a variance rather than requiring removal of the garage Drive, Planning to meet Code requirements, adding that the Planning Case No. 227-87 Commission cannot consider economic hardship in granting a variance. Bonnie Hagel, representing Mr. Petron, stated she felt the lots could meet the square footage requirements if the angle . of the lot is considered as is the case in cul-de-sac lots. hairman Mountin explained this lot could not be � measured in the same manner as a cul-de-sac lot for setback; as it is a straight, corner lot and as presented at this time, does not meet, the Code require- ments. Commissioner Zollner stated that if Mr. Petron could prove the City required the garage to be built where it was, they would not have a problem now, Chairman Mountin recommended looking at the history of the lot to. see if there is a uniqueness or hardship, keeping in mind that they cannot consider personal preference or economics in granting a variance. She added they must also consider whether there were reasonable options , and if the City did require the garage to be placed on that side of the lot, they would not have required that it be detached. She also pointed out, though, that the garage is in good repair and might be damaged if moved. Ms. Hagel stated she would redraw the two lots, to meet square footage, frontage and setback requirements, which would be possible with a single lane, angled driveway. She added, however, she felt it would be much better if a variance was granted rather than going with the new layout, due to appearance. Chairman Mountin replied the decision must be made based on Code . Planner Herman recommended getting a legal description and surveyors drawing from Mr. Petron before sending the item to the Council. The Planning Commission agreed to move on to other business to allow Ms. Hagel time to draw a new rough sketch of the two lots. Motion/Second: Peters/Saunders to table this item until later in the meeting, to allow time for a new drawing. 6 ayes 0 nays Motion Carried Planner Herman reported the two proposed lots for 7 . Consideration Mr. Simon would be in conformance with the City of Resolution code , and Staff recommends approval of the request. Staff Report r proposals to five different agencies to do a community survey for Mounds View, and they hope to have them back soon and get started on the project. She also reported the consultant on the Comp Plan update is working on cleaning up the zoning code , and he will be offering suggestions on what other communities are doing, but he will not be reviewing it line by line. She asked that if the .Commissioners have any issues they would like addressed, they let her know so she can pass them on. Chairman Mountin explained the Planning Commission had been giving their comments to Steve Thatcher over the past three years, and he should have left a file that would have them listed. Planner Herman stated she had not come across such a listing, but would look for it, and if it couldn't be found, she would contact Mr. Thatcher to see where it was left. Planner Herman reported Dynamic Designers may be coming back before the Planning Commission in the near future, with basically the original plan they proposed. Commissioner Miller noted the loud speaker at Super America was being used to broadcast advertisements, and it was to be restricted to the clearance of pumps only. Planner Herman replied she had been made aware of that, and a letter was in the process of being sent to them. Chairman Mountin noted a good deal of fill had been dumped on the vacant Harstad property along County Road H2 , across from Scotland Green, and they had not been able to determine yet who was doing the dumping, as it was being done at night, and no file permit had been taken out. Councilmember Wuori suggested asking the Police to patrol that area and watch for any dumping. Planner Herman reported that._afew..1ots located at the Green- field Estates area had been staked at the request of Barr Engineering, and discrepancies between the plat map and the site in regard to the wetland boundary were found, and sub- sequently the Corps of Engineering has verbally pulled the approval they had given earlier. She stated the development would be on the Council ' s. December 7 agenda for discussion. litotion/Second: Zollner/Miller to take the minor sub- 9 . Motion/Second: Zollner/Simons to adopt Resolution No. 208-87 , recommending approval of Mounds View Planning Case No. 227-87 for Alphonse L. Petron, 2909 Woodale Drive, for a minor subdivision. 6 ayes 0 nays Motion Carried Councilmember Wuori asked that the Council be provided with the background of the lot, when it appears before them. Chairman Mountin stated the Council has the final say in the matter. In the past we have required buildings to be moved or removed for cleaner subdivisions. The newly created lots are unusual in appearance, but they do meet the requirements of the Code. The attendees at the November 18 agenda session were 10 . Chairman' s Commissioners Zollner, Miller, Simons, Saunders, Report Peters and Burgers, Chairman Mountin, Councilmember Ouori and Planner Herman.
