Call to order by Chairman Mountin at 7 : 32 PM on Wednesday, Order April 6, 1988. MEMBERS PRESENT: Commissioners Miller, Saunders , 2 . Roll Call Zollner, Peters, Simons and Chairman Mountin. It was noted that Commissioner Burgers had an excused absence. ALSO PRESENT: City Planner Herman and Councilmember Wuori. Motion/Second: Zollner/Simons to approve the minutes 3 . Approval of of the March 2 , 1988 regular meeting and March 16 , 1988 Minutes: special meeting, as presented. Planner Herman reviewed the request of James 5 . Consideration Buckley for a minor subdivision at 7770 Greenwood of Rslt. No. Drive. Code Appeal Request There was discussion among the Commissioners regard- ing the wording of some of the proposed changes, with an area of concern being-the width of permitted garages. City Planner Herman will do additional research into garage widths, and the item will be discussed further at the April 20 agenda session. It was the concensus of the Planning Commission to call to order on the 20th, to approve the zoning code change, if they are in agreement at that time. 411City Planner Herman explained the Church Upon the 7 . She also stated that beginning this fall, they will go to two Sunday services, which should diminish the parking problems. City Planner Herman explained she had checked with the State to see what their requirements are for square footage per student, and it is 30 square feet, and she reviewed the criteria used, and recommended orequiring 35 to 40 square feet per student, due to fixed space requirements for certain fixtures in each classroom area. A Mounds View Planning Commission April 6, 1988 Regular Meeting Page Three 411Councilmember Wuori pointed out problems could occur with parking if a funeral were to be going on at the same time as school classes. Chairman Mountin suggested including in the conditional use permit that the temporary building be removed or the lot be brought up to Code within a five year period. Commissioner Zollner stated she would like to see the playground area fenced, as presently it is a very dangerous situation as children can dart out into the street, and she stated she would like to see that done before the parking lot update is required. Jim Dayr, a representative from Church Upon the Rock, stated they had been ready to put a fence up at one time, but the neighbors objected. He added they would be willing to put it up now. Chairman Mountin recommended it be placed on the west side of the play yard, and should 4e -4.8:" high. She added that if it meets code, the neighbors could not object to it. She also asked that the fence be required as part of the resolution. There was discussion on how the temporary building would Woe placed in relation to the main structure, whether it would be connected, or have a canopy top, or other options available. Bob Baer, an elder of the church, stated he had been asked by the pastor to speak, as he could not attend, and he stated he would like to address the square footage requirements for each pupil. He stated it was a growing school with a waiting list, and they felt 30 square feet was adequate per pupil, and he requested the Planning Commission approve the 30 square foot requirement. City Planner Herman explained that one of the reasons Staff is recommending a higher than 30 square foot ratio is that fixed space needs go up with smaller classrooms, and their rooms are definitely smaller that the State standards. She added the Building Inspector is concerned about the emergency exits in the event of a fire , and larger classes would involve getting more students out the same exits, and there are also classes which must go through another classroom before reaching the exit. Mr. Dayr stated that 30 square feet is a normalizing measure , and a desk requires 9 square feet, which then 4111eaves 21 square feet for other needs. He added that the economics of space and operation are considerably different for them than those of State schools. Mounds View Planning Commission April 6, 1988 Regular Meeting Page Four "' City Planner Herman explained that one of the reasons the church is having this problem is because they are expand- ing, and it is recognized that the building is not capable of holding all the people they want. Chairman Mountin stated she was very concerned with moving the children through d bottleneck in an emergency, and she also notedthe expansion would exceed the parking and site capacity. Commissioner Peters asked if this expansion would require a fire inspection. City Planner Herman replied it would not, as the maximum capacity of the building itself would still be met. Commissioner Miller noted they are not up to capacity now in the number of students per square foot. Mr. Baer explained they have only 20 students per class now, but the enrollment is increasing. Councilmember Wuori stated she was concerned with the amount of time necessary to evacuate the classrooms in the event of an emergency, especially with having to °Mr. go through other classrooms to get out. Baer noted the classrooms are very small, and he feels they can be evacuated in about 30 seconds, and he also pointed out there is an outside fire escape off one of the second floor classrooms. Commissioner Miller stated that being a school teacher herself, she feels more students are always put in a classroom than should be. Commissioner Saunders stated he was concerned with the evacuation process in the event of an emergency, but he was not overly concerned with the square footage requirement, which calculated out to about 3 more children per classroom. Mr. Baer offered to have the fire drill figures available to the Council by the time this would reach them. Chairman Mountin recommended asking the Fire Department to look into it and report back. Commissioner Zoller stated she was concerned with exceeding the limits and creating hazards, and stated she would •prefer the 35 square foot requirement per student. Mounds View Planning Commission April 6, 1988 Regular Meeting Page Five 411Commissioner Peters stated he was also concerned with evacuation of the classes, especially using the fire escape , and he would like to see the data from a fire drill. City Planner Herman stated the applicant acknowledged the playground area was inadequate for 75 students, when they got their original conditional use permit, and it would now be considerably more crowded with this pro- posed expansion. Mr. Baer stated he agreed it is a problem, and they have been using City parks near the church for recreation and outdoor activities. Chairman Mountin pointed out the original development agreement was for 75 students and the applicant stated at that time that they could not handle more than that, but they are now back, having 107 students presently, asking for more. She questioned if the Planning "land Commission gives a ceiling of 144, would they come back when they had 160 or more and ask for other considerations. Mr. Baer apologized and explained the special use permit had been lost, and it had been misinterpreted by the church as to what the limits are, and they are moving now to rectify that. City Planner Herman asked that in consideration of the time limitations for the church to get the temporary building ordered, that the Planning Commission consider approving proposed Resolution No. 219-88, which would approve a conditional use permit for the temporary building, and then work further on the pupil ratios and get the fire evacuation information. She recommended discussing it at the next agenda session, and then calling to order to take action. City Planner Herman reported that the acquisition 8. Staff of 8100 Groveland Road went before the Council, and Report they have tabled it to find financing to purchase it. She added that it looks like there would be enough Council support if financing could he found. City Planner Herman reported the Harstad proposal was resubmitted yesterday, and it will go to the Council on April 18 . Staff will -recommend giving it to the Planning Commis ion for .review. Staff- will be recommend- ing that Barr Engineering look at it during the Planning Commission phase. City Planner Herman reported she had received a letter from Dynamic Designers, stating that they are appealing their denial to the Council. The. attendees at the March 16 agenda session were 9. COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A MINOR SUBDIVISION REQUEST BY JAMES BUCKLEY, 7770 GREENWOOD DRIVE, MOUNDS VIEW PLANNING CASE NO. 235-88 WHEREAS, Mr. James Buckley, 7770 Greenwood Drive, has requested approval of a minor subdivision dividing the southern 80 feet of Lot 45, Spring Lake Park Hillview Addition; and WHEREAS, the Planning Commission has reviewed the applicant's request for a minor subdivision and determines that it is in conformance with Chapters 40 and 42 of the City Code contingent upon the following: That the lot at 7770 Greenwood Drive, legally known as Lot 45, Spring Lake Park Hillview Addition, be brought up to Code either through demolition or by removing the garage from the newly created lot within 6 months of the subdivision approval by the City Council. NOW, THEREFORE, BE IT RESOLVED that the Planning 110 Commission of the City of Mounds View recommends approval of the minor subdivision request by Mr. Buckley contingent upon providing the City with appropriate title abstracts and recording of those abstracts with Ramsey County. BE IT FURTHER RESOLVED that the Planning Commission of the City of Mounds View directs Staff to forward this resolution to the City Council prior to approval of the minutes. ATTEST: hairma) (SEAL) City Planner MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 219-88 111 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT FOR A TEMPORARY ACCESSORY STRUCTURE TO BE :PLACED IN AN R-1 DISTRICT FOR THE CHURCH UPON THE ROCK, 7901 RED OAK DRIVE WHEREAS, the Church Upon the Rock, 7901 Red Oak Drive, has requested a conditional use permit to erect a temporary classroom in an R-1 District; and WHEREAS, this structure will be treated as a temporary accessory structure with a six foot setback from the principle building except for a temporary passageway connecting the two buildings; and WHEREAS, this temporary structure will be allowed on the property for a time period not to exceed five years from City Council approval provided that the use as a classroom does not change; IIINOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of a conditional use permit to allow for the erection of a temporary classroom not to exceed five years from City Council approval for Church Upon the Rock, 7901 Red Oak Drive, legally known as Spring Lake Park Hillview, Lots 113 and 114, contingent upon the following: For renewal of the conditional use permit approving the temporary structure after the five-year period, The parking lot to the church and school must be brought up to Code. _- BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes.
