Call to Order order by Chairman Mountin at 8 : 10 PM on Wednesday, April 20, 1988 . MEMBERS PRESENT: Commissioners Simons, Saunders, 2. Roll Call Burgers, Zollner, Miller and Chairman Mountin. It was .noted that Commissioner Peters had an excused absence. ALSO PRESENT: City Planner Herman and Councilmember Wuori. There were no residents requests or comments from 3. Residents 41he floor. Requests and Comments from the Floor City Planner Herman updated the Commissioners on 4 . Consideration research Staff had done on the question of the width of Code Appeal, of three car garages. Planning Case 411 No. 236-88 A Mounds View Planning Commission April 20, 1988 Special Meeting Page Two IIIity Planner Herman explained the new, temporary classroom uilding will have 720 square feet of room, and there was discussion on how the students will enter the two rooms, and whether they will be going through one to the other, or having an .outside corridor. Joanne Brown, principal of the school, explained there are currently 107 students enrolled in their program, and they will have approximately 15 additional students enrolled for kindergarten next year. Chairman Mountin stated the issue is back to whether they should require 30 sf or 35 sf per child, and that whatever standard is set, it would apply to the entire school. An unidentified representative of the school stated he did not feel it is equitable to require 35 sf for their school, when the State only requires 30 sf. Chairman Mountin explained the State also has a minimum requirement of 840 sf per room, which they do not meet in any room. The representative stated he had checked with the State 401 nd was told they are trying for 30 sf per student in e new buildings, and they do take into account the xisting situation with older, smaller rooms. He added the State now approves up to 30 students in a minimum 840 sf room. He further stated their school is not operated for profit, and their classroom size is an important feature. Mrs. Brown explained they have limited the number of children in the smaller rooms. The representative stated they would be willing to live with a 1 to 35 sf ratio in the existing facility, but would like to see a 1 to 30 ratio in the new, portable unit, which would allow 123 students in the main building and 48 in the auxiliary building. There was discussion among the Commissioners on setting two different standards. Mrs. Brown explained the school 's recess schedule, stating there is not a problem on the playground with too many children. She stated it is adequate to take care of all the children, with the use of the parking lot as a play area also. III Mounds View Planning Commission April 20, 1988 Special Meeting Page Three tion/Second: Simons/Miller to approve Resolution o. 220-88, recommending approval of Church Upon the Rock to maintian a church and elementary school within an R-1 district at 7901 Red Oak Drive. 6 ayes 0 nays Motion Carried City Planner Herman explained this would be on the Council agenda for May 23, for a public hearing. The representative of the school explained they may be hanging a chain in the parking area, to assist in the alignment of vehicles, and he also clarified the placement of the fence they plan to erect. Mrs. Brown stated they already have a 5 ' fence they would like to put up, but she understands it cannot go in front of the building. She explained there are already shrubs there, and they would like to place the fence there also, to stop balls and children from going into the street. She added they have had people driving by stop and complain about that problem, and she requested a variance for the 5 ' fence. Chairman Mountin explained the requirements for uniqueness in granting a variance. She noted, however, at Pinewood Elementary School has a fence that is 5 ' igh that goes in the front of their building. Motion/Second: Burgers/Zollner to amend Resolution No. 220-88 , granting a variance for a 5 ' fence on the west side of the playground. 6 ayes 0 nays Motion Carried It was the concensus of the Planning Commission that the hardship for granting the variance was the danger to the children in the play yard and street, and a high fence is needed to protect their safety. Motion/Second: Burgers/Miller to recommend adoption to the Council of the Zoning Code changes for Joint Facilities, Subdivision (2) , with the renumbering of Chapter 40. 07, Subd. J (2) E to (2) F, and the insertion of a new Subdivision J (2) E regarding the use of parking facilities. 6 ayes 0 nays Motion Carried City Planner Herman reviewed her memo of April 15 to 6. Consideration 4101e Planning Commission, regarding veterinary/animal of Code Appeal linics. She stated she had checked with Blaine and and Resolution New Brighton, and reviewed their conditions. No. 22288 , Kevin Barcus, 2554 Highway 10, Planning Case No. 238-88 Mounds View Planning Commission April 20, 1988 Special Meeting Page Four ere was discussion among the Commissioners of how to ie the conditional use permit to the property, as it is typically attached to the title, but the applicant in this case was not the owner of the property. It was decided to send notification to the owner of the shopping center of the conditions that would be approved. An unidentified resident expressed concern about the clean-up of any messes the animals might make in the parking lot outside the shopping center. Mr. Barcus, the applicant, explained they would have a sign at the receptionist ' s desk, requesting the customers to notify them of any accidents, which they would immediately clean up. He also pointed out the parking is directly in front of the office, with only 15 ' to go to get inside. He also explained that cement is very easy to clean up. Commissioners Simons left the meeting at 9 :26 PM. Motion/Second: Saunders/Zollner to recommend to the Council adoption of the Zoning Code change to Chapter 40. 02, Subdivision B, 110. 0, and renumbering drf all the following paragraphs, and the adoption of apter 40. 17, Subdivision D, 4 a and b. 5 ayes 0 nays Motion Carried Motion/Second: Miller/Burgers to adopt Resolution No. 222-88 , recommending approval of a conditional use permit for a veterinary animal clinic for Kevin Barcus, 2554 Highway 10, Mounds View, MN. 5 ayes 0 nays Motion Carried Due to time constraints on the part of the applicant for beginning construction of the office, to be ready by the beginning of July, City Planner Herman agreed to place the item on the consent agenda for the City Council meeting of April 25, to set a public hearing for May 16. The attendees at the April 20, 1988 agenda session 7 . Chairman Mountin adjourned the meeting at 9 : 55 PM. 8. Adjournment Respectfully submitted, 4-1-G4A- Kimberly Herman City Planner MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 220-88 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF CHURCH UPON THE ROCK TO MAINTAIN A CHURCH AND ELEMENTARY SCHOOL WITHIN AN R-1 DISTRICT AT 7901 RED OAK DRIVE WHEREAS, Church Upon the Rock has requested an update of their special use permit dated February, 1975; and WHEREAS, the Church has eliminated the adult religious school and has converted some of that space to classrooms for the elementary school; and WHEREAS, the Church has sold the triangular parcel which was used for parking; and WHEREAS, these changes from the previoius permit necessitate the revision of the Church' s special use permit. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of a conditional use • permit for an elementary school and church within an R-1 District at 7901 Red Oak Drive, legally known as Spring Lake Park Hillview, Lots 113 and 114, contingent upon the following. ( 1 ) The total number of students allowed in the facility will be determined by a ratio of pupils to square feet of classroom space. A ratio of one student per 35 square feet will be be used for the existing structure and a one to 30 ratio in the temporary classroom building. (2 ) Through joint facilities parking, the site will have the proper amount of parking spaces per the City Code for either the c urc or e e eme - •• ^ greater. In addition, the Church will obtain a written agreement with the property owner at 2791 Highway 10 to use their parking facilities on Sundays. (3 ) Placement of a fence on the west side of the play area along Red Oak Drive. BE IT FURTHER RESOLVED that the Planning Commission grants a variance to Church Upon the Rock to put up a 60" high fence along Red Oak Drive because of the exceptional and extraordinary circumstances which apply to this property, namely, the use of a school and playground on the site. RESOLUTION NO. 220-88 0 PAGE TWO BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. ATTEST: Cai rm (SEAL) , v7 City Planner MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 222-88 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT FOR A VETERINARY ANIMAL CLINIC FOR KEVIN BARCUS, 2554 HIGHWAY 10 , MOUNDS VIEW, MINNESOTA WHEREAS, Dr . Kevin Barcus has requested a conditional use permit for the property located at 2554 Highway 10 in the Silver View Plaza Shopping Center for a veterinary/animal clinic; and WHEREAS, Chapter 40 .17, Subdivision D (4 ) provides for an animal clinic as a conditional use in a B-2 zone; and WHEREAS, the Planning Commission and City Council have reviewed the proposal and found it in keeping with the intent of the Code. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of a conditional use permit for a veterinary/animal clinic contingent upon the 0 following: a. Noise and odor are effectively confined to the premises in accordance with Ordinance No. 90, Public Nuisances. b. That boarding of animals is not provided for an extended period of time . c . That the clinic meets all Ramsey County Health Codes for a use of that type . BE IT FURTHER RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 20th day of April , 1988 .
