The Mounds View Planning Commission was called to 1. Call to
order by Chairman Mountin at 7 : 32 PM on Wednesday,
May 4, 1988.
MEMBERS PRESENT: Commissioners Peters, Saunders, 2. Roll Call
Zollner, Miller, Simons and Chairman Mountin.
It was noted that Commissioner Burgers had an excused
absence.
ALSO PRESENT: City Planner Herman and Councilmember
Hankner.
Motion/Second: Zollner / Simons to adopt the April 6, 3. Approval of
1988 and April 20, 1988 minutes as presented. Minutes:

Variance
City Planner Herman reviewed her memo of April 29, Request for
stating that she had been told by the architect that A&L Management,
several revisions were being made to the original 5445 Jackson
drawings, and that she had not received them yet so Drive (Sands
could not comment on them specifically, but she did Apartments) ,
advise that the proposed changes would not significantly Planning Case

Mr. Torma presented the new drawings to the Planning
Commission and reviewed the proposed changes, for the
construction of a new apartment for the resident
manager.
City Planner Herman stated she felt the same consi-
derations would apply, and the parking requirements
would not be met, as an additional living unit was
being added, and they were short already. She
recommended denial of the request based on that
shortage, being specifically 43 garage units short
and two outdoor parking spaces short.
Chairman Mountin stated the garages were built accord-
/ling to Code at the time, and there is no room now for
them to come into compliance. She states she appre-
ciates their attempt to upgrade the building and
provide for their on-site manager, but if a variance
were to be granted now, they would have to use the
same measure for anyone else who was under the
parking code requirements.
Commissioner Saunders stated he was concerned with
setting a precedence if a variance were granted.
Commissioner Zollner stated she did not feel it
could be approved, due to the lack of a hardship
for granting a variance.
Commissioner Miller stated the Planning Commission
is charged with insuring that development fits with
Code, and she could not approve this, as they have
other options.
Commissioner Simons stated he agreed, and he did
not want to set an unfortunate precedence.
Chairman Mountin stated that she also was having
a problem with granting a variance, as the criteria
•to grant a variance was not being met.
Mr. Torma asked if it would be alright to make
improvements to the building if it did not include
any additional living space.

"'City Planner Herman reviewed the Code requirements
for determining outside parking spaces, explaining
that apartments requirements are based on the number
of dwelling units.
Chairman Mountin noted that if an office is added,
it would add square footage to the building, but it
would not be living quarters.
There was considerable discussion among the Commissioners
of the options available to improve the parking, with a
suggestion of requiring a new garage to be built for
the manager, thereby freeing up outside parking space,
to bring that into conformance.
Commissioner Zollner suggested they consider moving
another tenant into the new apartment, and making an
existing apartment by the present manager into his
new office.
City Planner Herman explained that Code requires if the
use is altered or changed, it must be brought up to
Code. She reviewed what the parking requirements are
and stated it is open to interpretation. She also
stated that if they go with the option of an office
on the third floor and no additional apartment, they
Would require only a building permit and no variance.
Chairman Mountin outlined the options available to
the applicant, to either withdraw their request for
a variance and receive a refund, or ask the Planning
Commission to vote on the request, and on the basis
that it appears it would be denied, they could then
appeal that to the Council . She added there would
be no further fees for that process. -
Mrs. Levitan stated she would like to discuss the
options presented with her husband, and she would
get back to Planner Herman within a day or two.
Chairman Mountin stated the Planning Commission
would be calling to order on May 18, and they could
take any required action at that time.
Motion/Second: Zollner/Miller to table pending
consideration by the applicant if they want to
proceed, and if they do, to place on the May 18
agenda.

City Planner Herman reported the City Attorneyhad

felt areas of the resolution regarding the variance
denial for Dynamic Designers had been ambiguous in
the wording and she reviewed the proposed changes

•and asked the Planning Commission to adopt Reso-
lution No. 224-88 . She added that she would be
sending a copy to Dynamic Designers.
Motion/Second: Simons/Miller to adopt Resolution
No. 224-88, amending Planning Commission Resolution
No. 217-88, denying a variance for Dynamic Designers,
7656/7660 Woodlawn Drive, Mounds View Planning Case
No. 138-83 , to make the language more specific.

City Planner Herman reported she had checked with
the Building Inspector regarding the fence in
question on St. Stephen Street, and it is within
the height requirements, with some height variation
because of topography. -
City Planner Herman reported a detailed report of
the community survey results is available at City
Hall, for anyone who would like to review it.
Councilmember Hankner reported a formal presentation
will be made to the Council at the May 9 Council
meeting, .and it will be cabel-cast, for anyone who
•would like to watch it.
The attendees at the April 20, 1988 agenda session 8 . Chairman's
were( Commissioners Simons, Saunders, Burgers, Report
Zollner, Miller, Chairman Mountin, City Planner
Herman and Councilmember Blanchard.
Chairman Mountin adjourned the meeting at 8 :17 PM. 9. Adjournment

RESOLUTION NO. 221-88
CITY OF MOUNDS VIEW
• COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF A MINOR SUBDIVISION
REQUEST BY ROBERT PETERSEN, 2185 LAMBERT AVENUE,
MOUNDS VIEW PLANNING CASE NO. 237-88
WHEREAS, Mr. Robert Peterson, 2185 Lambert Avenue, has
requested approval of a minor subdivision dividing the northern
149 .5 feet of his lot; and
WHEREAS, the Planning Commission has reviewed the
applicant' s request for a minor subdivision and determines that
it is in conformance with Chapters 40 and 42 of the City Code;
and
WHEREAS, the existing corner lot was grandfathered in as
it is nonconforming and the subdivision does not affect this
issue.
NOW, THEREFORE, BE IT RESOLVED that the Planning
Commission of the City of Mounds View recommends approval of the
minor subdivision request by Mr. Petersen, 2185 Lambert Avenue,
411 legally known as Lambert' s Addition, east 84 feet of Lot 20 ,
Block 1, contingent upon providing the City with appropriate
title abstracts and recording of those abstracts with Ramsey
County.
BE IT FURTHER RESOLVED that the Planning Commission of the
City of Mounds View directs Staff to forward this resolution to
the City Council prior to approval of the minutes.

RESOLUTION NO. 224-88
CITY OF MOUNDS VIEW

STATE OF MINNESOTA
RESOLUTION AMENDING PLANNING COMMISSION RESOLUTION NO. 217-88
DENYING A VARIANCE FOR DYNAMIC DESIGNERS, 7656/7660 WOODLAWN
DRIVE, MOUNDS VIEW PLANNING CASE NO. 138-83
WHEREAS, Chapter 48 of the Municipal Code sets require-
ments for building within a wetland; and
WHEREAS , Dynamic Designers have requested variances and a
conditional use permit to build two fourplexes within Wetland 1-9
and the 100 foot buffer; and
WHEREAS, there is a discrepancy between the lot size
scaled off on the site plan dated January 12, 1988, and that of
the Ramsey County records; and
WHEREAS, the existing proposal would require the following
variances :
1) Waive the minimum lot size for subdivision in a
wetland zoning district.
2 ) Waive the minimum lot width as measured at the
building setback line for subdividing within a wetland
• zoning district.
3 ) Waive the requirement that all structures shall be set
back at least 100 feet from a designated wetland.
WHEREAS, the existing proposal also needs a conditional
use permit for filling within a flood plain and a wetland altera-
tion permit to change the wetland boundaries, and
WHEREAS, Staff, City Consultants and the Planning Commis-
sion have extensively reviewed the proposed development; and

states the criteria for granting a variance; and
WHEREAS, there are no extraordinary circumstances as
presented which apply to the property which do not apply to other
properties in a wetland zoning district;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission denies Dynamic Designers' request for a
variance from lot size and lot width requirements in a wetland .
