The Mounds View Planning Commission was called to order 1. Call to
by Chairman Mountin at 7 : 30 PM on Wednesday, September
7, 1988.
MEMBERS PRESENT: Commissioners Zollner, Miller, Saunders, 2. Roll Call

It was noted Commissioner Burgers had an excused
absence.
ALSO PRESENT: City Planner Herman and Councilmember
Wuori.
Chairman Mountin welcomed Debohra Alman to the Planning
Commission and asked Staff to request Clerk/Administrator
•attend the next regular meeting to swear her in.

Mr. Leguil asked what the time limit is for the improve-
ment to the driveway.
City Planner Herman explained it is typically one year
from the time of issuance of a building permit, and it
could also be required as part of the conditional use
permit. She stated, however, since there is an existing
driveway, it would be considered to be in compliance
and nothing further would be required.
The Planning Commission discussed changing the requirements
for improved surfaces when the Code is next updated.
Mr. Leguil explained his existing driveway is a mixture of
"'many different things and he is concerned that in the
near future he would be told to improve it.
City Planner Herman explained the building inspector has
clarified gravel is acceptable, which is allowed by Code.
She stated, though, that in doing an inspection of the
garage, the building inspector might look at the mixture
of the driveway and determine that it does need improvement.
She stated she would discuss this with the inspector and
get back to Mr. Leguil .
Chairman Mountin explained the application would go on to
the City Council, who would set a public hearing. She
stated that if there are no problems, it should be approved
the second Monday in October, after the public hearing.
City Planner Herman reported the owner of the property 7 . Staff Report
at 7980 Crove.land Road had tried at one time to get that
piece of property rezoned for a barber shop, and was denied
by the Planning Commission. She stated the owner has
contacted her and is again interested in pursuing the
rezoning.
There was discussion among the Commissioners of their plans
for this area. City Planner Herman stated the Comp Plan
for
be clear, and the Planning Commission should decide
now just what they want to do there and see that the Comp
Plan reads accordingly.

There was discussion on the possible extension of
Knollwood Drive in the future, and the effect it
would have on this neighborhood. It was also
pointed out that it could be many years off .
Councilmember Wuori reported the new Comp Plan
should be coming in within the next month, and they
need to review it and see how it reads.
City Planner Herman reported Staff is trying to
rewrite the ordinance for air conditioners, before
redoing the Code. She explained the existing Code
was not being adhered to strictly, and it is
causing problems.
City Planner Herman reported Scott Hyser has
requested a 6' fence for his side yard again. She
explained it had been discussed once before. It
was agreed to discuss the issue after the regular
meeting was adjourned.
Councilmember Wouri advised the City Council has
looked at the Amoco car wash proposal and will be
etting a public hearing at their next meeting.

Councilmember Wouri reported they will most likely 8. Chairman' s

Chairman Mountin questioned a for-sale sign on
property in the 5200 block of Silver Lake Road, as
she thought it was a protected wetland.
City Planner Herman clarified the lot appears as
wetland on the City map, and it does not appear
that the lot would be buildable at all.
The attendees of the August 17 agenda session were
Commissioners Burgers, Saunders, and Zollner,
Chairman Mountin, City Planner Herman, and
Councilmember Wuori .
Chairman Mountin adjourned the meeting at 8: 30 p.m. 9. Adjournment

STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE
PERMIT REQUEST BY RICHARD HANSON TO CONSTRUCT AN OVERSIZED
GARAGE AT 8075 SUNNYSIDE ROAD, PLANNING CASE NO. 249-88
WHEREAS, Mr. Richard Hanson, 8075 Sunnyside Road, has
requested a conditional use permit to allow for the construction
of an oversized garage (up to 1,000 square feet) ; and
WHEREAS, Mounds View Municipal Code, Chapter 40. 10,
Subdivision C(D) provides that the maximum size of a garage .in an
R-1 District shall be 864 square feet unless a conditional use
permit is awarded by the City; and
WHEREAS, Mounds View Municipal Code, Chapter 40. 10,
Subdivision D(6) A through F, provides a garage may be up to
1, 264 square feet when said building isdesigned and maintained
to provide a uniform appearance with the principle dwelling unit,
and if the garage is over 1, 000 square feet no other accessory
building will be allowed on the lot; and
• WHEREAS, the Mounds View Planning Commission has reviewed
the applicant ' s request for a conditional use permit and
determines that it is in conformance with the aforementioned
conditions.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of a conditional use
permit to allow for an oversized garage of up to 1, 000 square
feet requested by Richard Hanson, 8075 Sunnyside Road, legally
known as Spring Lake Park Hillview, Lot 95, contingent upon the
following conditions :
1. The accessory building must conform with Sections
40.04, Subd. F and 40. 10, Subd. C(1) of the Zoning
Code.
2. The combined square footage of all accessory buildings
on one lot cannot exceed one thousand two hundred
sixty-four (1, 264) square feet.
3. The Codes states that if a garage square footage is
greater than one thousand (1,000) square feet, no
other accessory building is allowed. Therefore, the
site cannot hold any new storage structures as the
applicant currently has an accessory building of 96
square feet.
