The Mounds View Planning Commission was called to 1 . Call to
order by Chairman Mountin at 7 : 32 PM on Wednesday, Order
October 5 , 1988.
MEMBERS PRESENT: Commissioners Burgers , Zollner, 2 . Roll Call
Alman , Miller, Dian and Chairman Mountin.
ALSO PRESENT: City Planner Herman and Councilmember
Wuori .
It was noted Commissioner Saunders had an excused
absence.
Chairman Mountin welcomed Judith Dian to the Planning
• Commission.
Motion/Second: Zollner/Burgers to approve the 3. Approval of
September 7 , 1988 minutes as presented. Minutes :

Greg Johnson, 2865 Highway 10, stated it had come to 4. Residents
his attention the City was considering rezoning his Requests and
property from 17 units per acre to 6 , and he handed Comments from
out documentation to the Planning Commission that he the Floor
had received both from the City and the Court con-
cerning the lawsuit he had filed against the City
previously over this piece of property, and determina-
tions which had been made. He added he had been told
the City did not have to notify him concerning the
down-zoning of his property.
City Planner Herman explained the Planning Commission
is in the process of considering Zoning Code changes,
and so far they have only had informal meetings. Before
any action on the Code is taken, a public hearing would
be held and notices sent at that time.
Mr. Johnson suggested the Planning Commission talk to
City Attorney Richard Meyers before any decision is
made . He added he is working with a builder now and

Ohas blue prints and a real estate agreement just about
ready to go , and had planned to have a sign on the
property next week, but now the developer will not
enter into an agreement if the property' s zoning is going
to be changed. He stated that if it is down zoned, he
will lose everything and will go back to Court against
the City.
Mr. Johnson added he has a certificate of the real
estate value with both the present zoning and proposed
rezoning , and the proposed rezoning goes totally against
the Court order.
City Planner Herman stated she had spoken with Attorney
Meyers concerning rezoning , and it is an on-going process
which the Planning Commission will be involved in for
some time . She acknowledged that Mr. Johnson has the
only R-0 property in Mounds View.
Chairman Mountin explained the Planning Commission first
discussed this at their last agenda session , and they have
not formally written or presented anything to the Council .
Mr. Johnson suggested the Planning Commission inform
Attorney Meyers that he will be watching this very closely.
•Chairman Mountin assured Mr . Johnson there would be further
discussions before any action is taken.
Mr. Johnson asked that he be informed when the discussions
are going to take place , as both he and his lawyer would
like to attend.
It was noted there was no one present to represent the 5 . Consideration
applicant. of Resolution
No. 236-88
City Planner Herman advised she had spoken with the
applicant , who wants to go ahead with the request for
a conditional use permit. She added she had spoken
with the City Attorney, and based on his recommenda-
tions , added items 7-10 as conditions in the proposed
resolution , and she reviewed those conditions.
Chairman Mountin asked the status of the gas tanks in
the ground on the property.
Councilmember Wuori replied she believes one is still
being used , and she is not sure what has been done to
the others .
• Chairman Mountin stated she is uncomfortable with
not knowing the status of the tanks and the applicant
not coming to any of their discussions to answer
questions . She added she would like additional
information on the gas tanks .

411Chairman Mountin further stated that since the issue
is before the Planning Commission now, it was a good
time to deal with it .
City Planner Herman stated that conditions can be
added that fit along with the request , but she did
not feel the gas tanks fit into that category. She
stated that Staff will follow up on the gas tank
question.
Chairman Mountin stated she would prefer not to take
any action on this until they have a clear picture
of the tanks . She stated it may not be germain
to the request but she is concerned that it is a safety
problem. She also noted there is nothing in the Code
requiring businesses to keep their fences in good
repair , and something should be added.
City Planner Herman replied it would be added to the
nuisance ordinance.
Motion/Second: Zollner/Miller to table action on
this request until the October 18 agenda session.

Chairman Mountin clarified that the information the
Planning Commission would like to have before them
at the next meeting would include what tanks are in
use , what action has been taken for those not in use ,
any further controls over businesses maintaining
their own gas storage and dispensing facilities , if
a conditional use permit is required for personal
storage and dispensing, or just for the sale of gas ,
and how far most cities go in grandfathering in a
use that has a significant hazard.
City Planner Herman advised the Planning Commission 6. Staff Report
would be seeing the preliminary proposal for the
Miller property, at their agenda session following
the adjournment of the regular meeting. She explained
the project has been briefly discussed by City Staff,
members of the Council and the developer, who would
like to get a grading permit by the first of next month.
This would require the Planning Commission to take
action at their next session so the Council may receive
their recommendation before their October 24 meeting
which would fit into the developer ' s schedule. She
explained that the Commission would be reviewing the
•grading plan and not the full development. There will
be a wetland alteration permit which involves, generally,
the buffer area.

The attendees at the September 21 agenda session were 7 . Chairman ' s
Commissioners Burgers , Zollner , Alman, Miller, Dian Report
and Chairman Mountin, City Planner Herman and Council-
member Wuori .
Chairman Mountin adjourned the meeting at 7:55 PM. 8. Adjournment
