Call to Order order by Chairman Mountin at 7:34 PM on Wednesday, December 7, 1988. MEMBERS PRESENT: Commissioners Burgers, Alman, 2. Roll Call Miller and Chairman Mountin. Commissioners Dian, Saunders and Zollner had excused absences. ALSO PRESENT: City Planner Herman and Councilmember Wuori . Motion/Second: Burgers/Alman to approve the November 3. They expressed their concern over selective enforcement and that City residents are not used to this provision and it could pose problems in making them aware of the change and getting them to comply. There was discussion among the Commission concerning enforcement of Codes. Most enforcement is a direct result of complaints received by the City. The Police Department does not like to be involved in the enforce- ment of all ordinances, and they do not have the time, while patrolling the City, to enforce all violations . It was noted that while there are big lots in the community, people do not always place their structures in a workable manner and may have trouble meeting the 5 ' setback requirement . It was also noted that people placing their recreational vehicles and other equipment 41, right up to the property line can cause a disturbance or inconvenience for their neighbors. It was the concensus of the Commissioners that this needs to be acted on, and the public hearing stage at the Council level would be a good opportunity for residents to express their opinions. It will also need a good deal of publication and exposure to make people aware of the change once it occurs. Motion/Second: Alman/Burgers to adopt the Draft Ordinance amending the Municipal Code of Mounds View by amending Chapter 40 entitled, "Zoning, Section I , Chapter 40.04, Subdivision F(3 ) , and Section II , Chapter 40. 05, Subdivision E(4-6 ) , and forward it to the Council . 4 ayes 0 nays Motion Carried City Planner Herman reported grading work was begun 7. Staff Report on the SYSCO project . The EAW is up for approval before the Council on December 12. City Planner Herman reported Donn Wiski of Resolution, Inc. , made a presentation to the Council at their last 411 agenda session concerning the Comprehensive Plan Update. It will be redrafted and then the Planning Commission will be given the opportunity to take action on it and send it on to the Council . Councilmember Wuori added it was the concensus of the Council that this project has to be worked on and they need to follow through. The attendees at the November 16 agenda session 8. Chairman's were Commissioners Miller, Alman, Saunders, Dian Report and Chairman Mountin, City Planner Herman and Councilmember Wuori. Commissioners Burgers and Zollner had excused absences for that meeting. Chairman Mountin stated she was pleased to see the informational sheet City Planner Herman had pre- pared for residents requesting a conditional use permit or variance. She suggested the variance sheet have language added that the applicant is responsible for preparation of a hardship statement, and the criteria for that should be listed. Chairman Mountin adjourned the meeting at 8:15 PM. 9. Adjournment Respectfully submitted, • �/ Kimberly Herman City Planner MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 240-88 IIICITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A MINOR SUBDIVISION, PAUL R. NEWCOMB, 8085 WOODLAWN DRIVE, PLANNING CASE NO. 255-88 WHEREAS, Mr. Paul R. Newcomb, 8085 Woodlawn Drive, has requested approval of a minor subdivision dividing his lot into two lots; one lot 75 ' x 150 ' and the other 100 ' x 150 ' ; and WHEREAS, the Planning Commission has reviewed the applicant ' s request for a minor subdivision and determines that it is in conformance with Chapters 40 and 42 of the City Code. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends approval of the minor subdivision request by Mr. Newcomb contingent upon the following: 1 ) Providing the City with appropriate title abstracts and recording those abstracts with Ramsey County. a2 ) That a driveway be constructed on the remaining lot to afford accessibility to the lot within one year of recording of the subdivision. 3 ) The garage on the newly created lot be removed or a house built on the premises within one year of recording of the subdivision. BE IT FURTHER RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 7th day of December, 1988.
