The Mounds View Planning Commission was called to 1 . Call to
order by Chair Mountin at 7:02 PM on Wednesday, Order
May 10, 1989.
MEMBERS PRESENT: Commissioners Burgers, Miller, 2. Roll Call
Zollner and Chair Mountin.
It was noted Commissioners Alman and Dian had
unexcused absences.
ALSO PRESENT: City Planner Hren.
Motion/Second: Burgers/Zollner to approve the March 3. Approval of

40 City Planner Hren reported Clerk/Administrator Pauley 7. Consideration
had spoken to the applicant, and they have agreed to of Resolution
paint the building in earth tones, but they felt the No. 248-89
brick facade was too much. She also stated they have
made improvements to the landscaping.
Motion/Second: Burgers/Zollner to adopt Resolution
No. 248-89, regarding the conditional use permit
request by Metropolitan Waste Control Commission for
2345 County Road H, Planning Case No. 230-87, and
waive the reading.

Chair Mountin asked that in the future, site plan
drawings should be referenced as an exhibit as part
of a resolution, and it should be the one accepted
by the City with the time/date stamp on it.

City Planner Hren reported both lots meet R-1
standards. The City Engineer has looked at the
• site plan. It was noted the rear lot lines will
not line up, and the Planning Commission must
decide if they foresee a street there in the future,
since there is room for one.
Chair Mountin explained the Community has rejected
attempts to subdivide down the back. She added
there are many diverse lot lines in Mounds View.

request by Josephine Huhne, 8406 Red Oak Drive,

City Planner Hren explained the Planning Commission
has heard most of the items before, and the pro-
posed resolution has been revised since their last
review, and they have added the finding of fact
that the Planning Commission determines the
criteria for a conditional use permit is met, and

if it is met, the project would be assumed.

. Tim Nelson, of Everest Development, noted a few
changes have been made in the site plan, to
include widening of the driveway as suggested by the
City Planner. They have also deleted one parking
stall in the corner of the lot. They are now
asking approval of the final plan PUD and individual
conditional use permits. He added he does not see
any problems with the conditions attached to the
resolution.
Commissioner Miller asked if they anticipated any
traffic problems.
City Planner Hren explained the widening of the
driveway should alleviate that.
Chair Mountin asked that the latest site plan be
referenced as an exhibit in the resolution.
Motion/Second: Miller/Zollner to adopt Resolution
No. 250-89, regarding the planned unit development
and conditional use permit requests by Taco Bell
and Kentucky Fried Chicken, Planning Case Nos.
263-89 and 264-89, and waive the reading.

RESOLUTION NO. 245-89
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING DENIAL OF A REZONING REQUEST
FOR 2625 HIGHWAY 10, PTW INVESTMENT,
PLANNING CASE NO. 260-89
WHEREAS, PTW Investment has applied to rezone the property
located at 2625 Highway 10, legally known as Lots 78, 79 and 80,
Spring Lake Park Hillview Addition, from R-3, Medium Density
Residential and B-4, High Density Residential to B-3, Highway
Business District; and
WHEREAS, Chapter 40. 25, Subdivision A(5) , provides that
the Planning Commission shall consider possible adverse effects
of the proposed amendment or conditional use. Its judgement
shall be based upon, but not limited to, the following factors :
1 ) Relationship to municipal Comprehensive Plan.
2 ) The geographical area involved.
3 ) Whether such use will tend to or actually depreciate
the area in which it is proposed.
• 4) The character of the surrounding area.
5 ) The demonstrated need for such use.
WHEREAS, the rezoning request is inconsistent with the
City' s Comprehensive Land Use Plan designation for this property
which is high density residential; and
WHEREAS, a B-3 development on this property would be
directly adjacent to residential property on the north and east
and at a location where access would be required on a residential
street, Eastwood Road, as well as at an intersection already
experiencing heavy traffic loads, namely County Road I and
Highway 10; and
WHEREAS, the proposal has been submitted to the City in
order to allow the property owners to sell the property and no
development is currently before the Planning Commission or City
Council for their consideration.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends denial of this request because of
the following:
• (1 ) The proposed zoning does not conform with the
Comprehensive Land Use Plan.

(2 ) The proposed commercial zoning would be in conflict
with residential property to the north and east and
require access points onto a residential street.
( 3 ) There has been no demonstrated need for the use or
no use is currently proposed.
BE IT FURTHER RESOLVED that the Planning Commission
directs Staff to forward this resolution to the City Council
prior to approval of the minutes .

RESOLUTION NO. 246-89

STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF A ZERO LOT LINE
MINOR SUBDIVISION, WALLY BAUER, 2565/67 COUNTY ROAD I,
PLANNING CASE NO. 261-89
WHEREAS, Mr . Wally Bauer has requested approval of a minor
subdivision to allow the construction of a zero lot line duplex
at the property located at 2565/67 County Road I ; and
WHEREAS, the Planning Commission has reviewed the
applicant ' s request for a zero lot line subdivision and
determines that it is in conformance with Chapters 40 and 42 of
the City Code.
NOW, THEREFORE, BE IT RESOLVED that the Planning
Commission of the City of Mounds View recommends approval of the
minor subdivision request by Mr . Bauer contingent upon the
following:
1 ) Providing the City with appropriate title abstracts
( 410 and recording those abstracts with Ramsey County.
2 ) Inclusion of the following restrictions in the deeds
of the two parcels :
a. If one dwelling unit is burned or destroyed, it
shall be reconstructed in a uniform appearance.
b. If both dwelling units are burned or destroyed,
minimum lot widths shall then prevail as for single
family homes.
c . A double dwelling unit may be rebuilt meeting the
origina_1—Pond tt H ons of this Code.
d. A uniform exterior appearance, in terms of color,
design and maintenance, shall be maintained.
3 ) The subdivision is subject to Park Land Dedication
requirements and must be satisfactorily complied with.
BE IT FURTHER RESOLVED that the Planning Commission
directs Staff to forward this resolution to the City Council
prior to approval of the minutes .

RESOLUTION NO. 247-89
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
IIISTATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE
PERMIT REQUEST BY GERALD CLOBES TO CONSTRUCT AN OVERSIZED
GARAGE AND ACCESSORY BUILDING AT 8044 EDGEWOOD DRIVE,
PLANNING CASE NO. 262-89
WHEREAS, Mr . Gerald Clobes, 8044 Edgewood Drive, has
requested a conditional use permit to allow for the construction
of an oversized garage (884 square feet ) and to move his existing
garage to the rear yard for use as an accessory building (348
square feet) ; and
WHEREAS, Mounds View Municipal Code, Chapter 40. 10,
Subdivision C(D) provides that the maximum size of a garage in an
R-1 District shall be 864 square feet unless a conditional use
permit is granted by the City; and
WHEREAS, Mounds View Municipal Code, Chapter 40. 10,
Subdivision D(6) A through F, provides that the combined square
footages of all accessory buildings may be up to 1, 264 square
feet when said building(s ) are is designed and maintained to
provide a uniform appearance with the principle dwelling unit,
0 but if the garage is over 1, 000 square feet no other accessory
building will be allowed on the lot; and
WHEREAS, the Mounds View Planning Commission has reviewed
the applicant ' s request for a conditional use permit and
determines that it is in conformance with the aforementioned
conditions.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of a conditional use
permit to allow for an oversized garage of 884 square feet
and an accessory building of 334 square feet for a total of 1, 218
square fRet requested by Gerald Clobes, 8044 Edgewood Drive,
legally described as Woodlawn Terrace, Lot 28, contingent upon
the following conditions :
1. The accessory building must conform with Sections
40.04, Subd. F and 40. 10, Subd. C(1 ) of the Zoning
Code.
2. The combined square footage of all accessory buildings
on one lot cannot exceed one thousand two hundred
sixty-four (1, 264) square feet .
3. If the garage square footage is greater than one
thousand ( 1, 000 ) square feet , no other accessory
• building is allowed.

4. The buildings shall be designed and maintained to
provided a uniform appearance with the dwelling unit.
5. The width of the new building cannot exceed
thirty-five (35 ) feet nor allow for more than a three
(3 ) vehicle access.
6. Should the use for which the permit was granted be
changed, the permit shall be subject to reconsider-
ation, revocation or other action regulated by Chapter
40. 25 of the Zoning Code.
7. The conditional use permit shall be filed with Ramsey
County for recording on the title of subject property.
BE IT FURTHER RESOLVED that the Mounds View Planning
Commission directs staff to forward this resolution to the City
Council prior to approval of the minutes.

COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING REAPPROVAL OF A CONDITIONAL USE
PERMIT TO CONSTRUCT A PUBLIC FACILITY IN AN R-1 DISTRICT
FOR THE METROPOLITAN WASTE CONTROL COMMISSION AT
2345 COUNTY ROAD H
WHEREAS, the Metropolitan Waste Control Commission, 2345
County Road H, has requested a conditional use permit to build a
storage building in an R-1 District; and
WHEREAS, the Mounds View Municipal Code, Chapter 40. 10,
Subdivision D(2 ) , provided that governmental and public utility
buildings and structures necessary for the health safety and
general welfare of the community are a conditional use; and
WHEREAS, the Planning Commission has reviewed the proposal
and has found that the structure conforms to the setback and side
yard requirements of an R-1 District and there is no outside
storage proposed and there is adequate screening from neighboring
uses .
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of a conditional use
permit to allow for the construction of a storage building by the
Metropolitan Waste Control Commission, 2345 County Road H,
legally known as; subject to road, the east 640 feet of south 190
feet of southeast 1/4 of southwest 1/4 of Section 8, Township 30,
Range 23, contingent upon the following:
1 ) Approval by the Rice Creek Watershed District.
2 ) Trees and shrubs shall be maintained.
3 ) Outside storage will be prohibited.
4) Regular maintenance of the building facade and fencing
will be required.
5 ) The exterior of the building shall be treated in earth
tones.
BE IT FURTHER RESOLVED that the Mounds View Planning
Commission directs Staff to forward this resolution to the City
Council prior to approval of the minutes.

WHEREAS, Josephine Huhne has requested approval of a minor
subdivision for the property located at 8406 Red Oak Drive,
legally known as :
N 101 FT OF S 2531 FT OF W 528 FT OF NE 1/4
(SUBJ TO RDS) IN SEC 6 TN 30 RN 23; and
WHEREAS, the Planning Commission has reviewed the
applicant ' s request for a minor subdivision and determines that
it is in conformance with Chapters 40 and 42 of the City Code.
NOW, THEREFORE, BE IT RESOLVED that the Planning
Commission of the City of Mounds View recommends approval of the
minor subdivision request by Josephine Huhne contingent upon the
following:
411 1 ) Providing the City with appropriate title abstracts
and recording those abstracts with Ramsey County.
2 ) The existing shed on Tract B shall be relocated to
Tract A.
3 ) All requirements of the City Engineer as outlined in
the Staff Report dated April 25, 1989, are complied
with.
4) The Park Dedication requirements are satisfactorily
met.

RESOLUTION RECOMMENDING APPROVAL OF A PLANNED UNIT
DEVELOPMENT AND TWO CONDITIONAL USE PERMITS FOR EVEREST
DEVELOPMENT' S TACO BELL AND KENTUCKY FRIED CHICKEN
RESTAURANTS, PLANNING CASE NOS. 264-89 AND 265-89
WHEREAS, Everest Development has requested approval of a
Planned Unit Development and two conditional use permits to allow
Taco Bell and Kentucky Fried Chicken Restaurants at the property
located at the southeast corner. of Highway 10 and Quincy Street,
legally known as Lot 1, Block 5, Mounds View Business Park; and
WHEREAS, the Planning Commission has reviewed the
applicant ' s request for a planned unit development and
conditional use permits and determines that it is in conformance
with Chapters 40, 48, 49 and 49A of the City Code; and
WHEREAS, the Planning Commission has determined a finding
of fact that the proposed planned unit development/conditional
use permit meets the following criteria:
411 a. The use will not create an excessive burden on
existing parks, schools, streets and other public
facilities and utilities which serve or are proposed
to serve the area.
b. The use will be sufficiently compatible or separated
by distance or screening from adjacent residentially
zoned or used land so that existing homes will not be
depreciated in value and there will be no deterrance
to development of vacant land.
c. The structure and site shall have an appearance that
will not have an adverse effect upon adjacent
residential properties.
d. The use, in the opinion of the City Council , is
reasonably related to the overall needs of the City
and to the existing land use.
e. The use is consistant with the purposes of the Zoning
Code and the purposes of the zoning district in which
the applicant intends to locate the proposed use.
f. The use is not in conflict with the Comprehensive Plan
of the City.

h. Adequate utilities, access roads, drainage and
necessary facilities have been or will be provided.
NOW, THEREFORE, BE IT RESOLVED that the Planning
Commission of the City of Mounds View recommends approval of the
planned unit development and two conditional use permit requests
by Everest Development for. Taco Bell and Kentucky Fried Chicken
Restaurants contingent upon the following:
1. The planned unit development site plan, landscape
plan, grading, drainage and utility plan, lighting
plan, and the conditional use permit resolution shall
be recorded with Ramsey County.
2. The drive-through speakers shall not cause excessive
noise or be a nuisance to the surrounding property.
3. The developer must enter into and sign a development
contract with the City.
4. The commercial condominium agreement must be presented
to the City and subsequently recorded with Ramsey
County.

BE IT FURTHER RESOLVED that the Mounds View Planning
Commission directs Staff to forward this resolution to the City
Council prior to approval of the minutes.
