Call to by Chair Mountin at 7:39 PM on Wednesday, October 4, Order 1989. MEMBERS PRESENT: Commissioners Dian, Jones, Miller, 2. Roll Call Zollner and Chair Mountin. It was noted Commissioner Burgers had an excused absence, and Commissioner Alman had verbally resigned from the Planning Commission, and would be sub- mitting a written resignation. ALSO PRESENT: City Planner Hren and Councilmember Wuori . • Motion/Second: Jones/Miller to approve the September 3. Approval of 9 and September 20, 1989 minutes as presented. Minutes: September 6 and 5 ayes 0 nays September 20, 1989 Motion Carried There were no residents requests or comments from the 4. Residents floor. Requests and Comments from the Floor City Planner Hren noted the Planning Commission had 5. Consideration previously approved the rezoning of a portion of the of Resolution site from B-4 to B-3 and a conditional use permit No. 267 -89, for Hardee ' s, with a drive-through facility, and a Development/ CUP/PUD for the entire Mounds View Square site. Final Stage Plan Review for At this time the applicant is asking for development CUP/PUD for stage and final stage plan approval, and the action Mounds View by the Planning Commission at this time would be on Square Shopping the CUP/PUD for the entire site. Center, Planning Case No. 276-89 111 The applicant has submitted a revised landscaping plan, based on recommendations made by the Planning Commission, which has been reviewed by the City Forester. Mounds View Planning Commission October 4, 1989 Regular Meeting Page Two • The representative from Hardee 's presented the light- ing plan to the Planning Commission and reviewed it. There was discussion of the possibility of a gas station at some time coming in, and it was determined the entire site was under the CUP/PUD, and an amend- ment for the entire site would be required. Only the footprint of the building and the green space immediately touching it will be rezone, and the parking is not being rezoned, and there would not be adequate space for a gas station there. The holding pond on the site is controlled by the Rice Creek Watershed District, and this would be an opportunity for the City to have the drainage and other things changed. Ms. Hren noted the City Engineer has reviewed the drainage and indicates there is no problem with it. Commissioner Zollner stated the Planning Commission would not allow this drainage for a new development, and she questioned why they should settle for something that is less than what the Planning Commission wants. • Edward Paster, a partner in Paster Enterprises, gave a history of the drainage ponds and shopping center, and the planning that was done at the time the center was built. He also explained the maintenance of the holding ponds. He added they would be very receptive to having the holding ponds removed, as they do not want them. The representative from Hardee ' s stated they would also like to have the drainage pond eliminated. Mr. Paster added they are willing to cooperate in any way necessary. Commissioner Miller questioned the feasibility of added additional trees on some of the islands in the parking lot. Mr. Paster explained the problems they have ex- perienced in keeping trees alive in that area. A representative from Paster Enterprises reviewed the existing landscaping and planned additional landscaping . 0 John Streeter, construction manager for Paster Enterprises, reviewed upkeep of the shopping center, specifically drainage and landscaping, and he noted the landscaping requirements would be written into the development agreement. Mounds View Planning Commission October 4, 1989 Regular Meeting Page Three 0 Ms. Hren reported she would be meeting with the City Forester and Public Works Director tomorrow to dis- cuss landscaping on the site. She added the develop- ment agreement will contain a stipulation that the landscaping is maintained and replaced as necessary. She added they will also review the spillway. Mr. Paster noted the sign will be built into the side of the building and will not be on the roof. Commissioner Zollner stated she would like to see the final landscaping plan before taking action, and they typically do not send unfinished plans to the City Council for final approval . Mr. Paster explained the landscaping plan that was originally recommended by the Planning Commission was agreed to, and the landscaping plan that was submitted at the last Planning Commission meeting was approved, and then went on to the Council, who approved it with additional landscaping. He added the City Forester is doing the plan, and Paster Enterprises is doing everything they are asked to do, plus more. The representative from Hardee ' s explained they had followed the direction of the Planning Commission 0 and submitted the plan, as approved by the Planning Commission, to the Council . The Council has decided they would like to have additional landscaping, which the developer agrees to, but there is a timing problem with the weather, and they would like to move ahead on this as quickly as possible. There was discussion on outdoor seating . The Planning Commission would rather see as much green space as possible rather than concrete. The developer agreed to using round tile under the outdoor tables, with grass surrounding it. It was noted they have also added additional sod over the last plan. Councilmember Wuori stated she would like to still address the back side of the building and dumpsters, which would face out onto County Road I . She stated she would like to see the dumpsters enclosed, not just for Hardee ' s but the entire shopping center. Mr. Paster explained that is very expensive to do, and while they have planned to have the Hardee ' s dumpster enclosed, the cost would be excessive for the remainder of the shopping center. He reviewed the regulations they have for the tenants of the • center, which he feels are very stringent . He also explained their dumpsters are very large and require a special truck. He added they not only Mounds View Planning Commission October 4, 1989 Regular Meeting Page Four 411 would have maintenance problems but also cosmetic prob- lems as the enclosures would constantly need repair . He added nothing is allowed outside the dumpsters, and it would be difficult and an expensive hardship to require enclosures now of the entire shopping center . Planner Hren suggested an alternative to enclosed dumpsters would be to place a hedge along County Road I, which would shield them from view. She stated she would discuss it with the Forester in the meeting tomorrow. Motion/Second: Jones/Miller to adopt Resolution No. 267-89 recommending approval of Mounds View Square development stage and final stage plan review and conditional use permit/planned unit development for a Hardees convenience food restaurant, Planning Case No. 276-89, to the affirmative . 4 ayes 1 nay Motion Carried 0 Commissioner Zollner voted against the motion, stating there was not enough information available to make an informed decision. She added the plans are incomplete regarding the landscaping, and she does not feel the applicant has explored alternatives for drainage on the site. Tim Nelson, of Everest Development, reviewed plans for the future development of the property. He explained they would like to get started with the parking lot immediately, as they have only 4-5 weeks 411 of paving season left . Ms. Hren noted the building permit will address con- struction of the lot, and the City Code addresses use of gravel surfaces. Motion/Second: Zollner/Dian to approve Resolution No. 269-89 recommending approval of the minor sub- division for Tyson Trucking, 4825 Mustang Circle, Planning Case No. 259-89, and waive the reading. 5 ayes 0 nays Motion Carried Ms. Hren explained the conditional use permit granted 7. Planning Case No. 241-88 Joe Finley, attorney for Amoco Oil Company, apologized • for the missed deadline and reviewed the history of the proposal . He explained there had been some changes in management of the project, and considerable re- search had been done on hot air dryers, which are required by the City. Upon making a decision and applying for the building permit, they discovered it had just expired. They are ready to go ahead with construction and are facing a deadline with weather for construction. He stated they are asking for renewal of the permit with all conditions originally set, and they are willing to build the facility just the way the Planning Commission wants it. Ms. Hren explained a public hearing will be required at the Council level . Chair Mountin reviewed some of the major issues that were discussed at the time the original permit was granted, including traffic flow, stacking patterns, timing, and use of blowers. It was noted that a masonary enclosure for the dumpsters will be included at the time of construction. Motion/Second: Miller/Jones to approve Resolution 0 No. 268-89 recommending approval of a conditional use permit for Amoco Oil Company, 2155 Highway Avenue, Planning Case No. 241-88, and waive the reading. 5 ayes 0 nays Motion Carried Mounds View Planning Commission October 4, 1989 Regular Meeting Pane Six • Ms. Hren noted the matter would be discussed at the October 16 agenda session, with a public hearing set for October 23. Ms. Hren had no staff report. 8. Staff Report Upon the request of the Planning Commission, she agreed to look into the records of the Peoples Plus station at 2901 Highway 10 and advise the Planning Commission when the one year deadline is up for pulling the underground tanks from the gas station. Chair Mountin noted Deborah Alman has given verbal 9. Report of notice of her resignation from the Planning Commission Chair and will be following up with a written notice. She asked that the Council fill the vacancy. Councilmember Wuori reported the Council is asking the Planning Commission to undertake a review of the sign ordinance. The Planning Commission asked Staff to look into traveling lights on the Wonder Video building. • Attendees at the September 20 agenda session were Commissioners Burgers, Dian, Jones, Miller and Chair Mounting Councilmember Wuori and City Planner Hren. Commissioners Alman and Zollner had excused absences. The Planning Commission asked Staff to check into the vacancy sign at the apartments on County Road I, to see if the permit had expired yet. Respectfully submitted, /g // Michelle Hren City Planner MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 267-89 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF MOUNDS VIEW SQUARE DEVELOPMENT STAGE AND FINAL STAGE PLAN REVIEW OF A CONDITIONAL USE PERMIT/PLANNED UNIT DEVELOPMENT FOR A HARDEES CONVENIENCE FOOD RESTAURANT, PLANNING CASE NO. 276-89 WHEREAS, the Planning Commission has reviewed the requested partial rezoning from B-4 to B-3, conditional use permit/planned unit development to allow more than one principal building on the site and a conditional use permit for the convenience food restaurant to be located at the Mounds View Square Shopping Center site (PIN 07-30-23-11-0001 ) ; and WHEREAS, the Planning Commission has recommended to the City Council approval of the request as described above per Resolution No. 265-89 approved on the 20th day of September, 1989; and WHEREAS, the Planning Commission has reviewed the development and final stage plans; and • WHEREAS, the Planning Commission has determined that the proposed rezoning is in conformance with the Comprehen- sive Plan; and WHEREAS, the Planning Commission has determined that the development stage and final stage plans are in conformance with the concept plan already approved; and WHEREAS, the Planning Commission has reviewed the revised landscaping plan submitted September 27, 1989; and WHEREAS, the Planning Commission has- reviewed City Forester. Wriskey' s memo regarding the revised landscaping plan dated September. 28, 1989, and determined that additional landscaping is required; and WHEREAS, the Planning Commission has reviewed the lighting plan and has determined that it is acceptable; and WHEREAS, the Planning Commission has reviewed the sign plan and has determined that it is acceptable. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends to the City Council approval of the development stage and final stage plan review for the conditional use permit/planned unit development for the convenience food restaurant with drive-through facilities contingent upon: RESOLUTION NO. 267-89 PAGE TWO 1. All requirements per Resolution No. 265-89 are complied with. 2. The landscaping along County Road I and Long Lake Road is upgraded based on Staff recommendation in order to provide additional buffering and screening. 3. The landscaping on the north side of the property is reviewed in one year in order to determine its adequacy. 4. The City continue to pursue alternatives to the drainage ponds with all governing agencies. BE IT FURTHER RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 4th day of October, 1989. ATTEST: • � d /��- Cha rma (SEAL) aC41-1---) 4271.2.4N--/ City Planner. • RESOLUTION NO. 268-89 • CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE CONDITIONAL USE PERMIT REQUEST BY AMOCO OIL COMPANY, 2155 HIGHWAY AVENUE, PLANNING CASE NO. 241-88 WHEREAS, Amoco Oil Company has requested City approval to construct a self-service car wash at 2155 Highway Avenue in the City of Mounds View; and WHEREAS, the development, as proposed, requires a condi- tional use permit and development approval; and WHEREAS, the Planning Commission has reviewed the follow- ing documents regarding this development proposal : 1 ) Site Plan 2 ) Signage Plan WHEREAS, the Planning Commission has determined that the development proposal is in conformance with the requirements of • Chapter 40. WHEREAS, the Planning Commission once reviewed and approved the conditional use permit per Resolution No. 233-88, adopted on August 17, 1988. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View approves the conditional use permit with the following conditions : 1 ) The facility must, at all times, be in compliance with State Laws and Minnesota Pollution Control Agency Standards for air quality and noise. 2 ) The car wash facility shall include a blower system designed to remove as much water as feasible from the vehicle before it allowed to exit the facility. This equipment shall operate as a customer option from April 16 to October 14 and as a mandatory service from October. 15 through April 15. 3 ) The conditional use permit and the conditions placed upon it be recorded on the title with the County Recorder ' s Office . ATTEST: h Cha rm,/ (SEAL) /14,001 City Planner • • RESOLUTION NO. 269-89 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A MINOR SUBDIVISION (LOT COMBINATION) FOR TYSON TRUCKING, 4525 MUSTANG CIRCLE, PLANNING CASE NO. 259-89 WHEREAS, the Planning Commission reviewed the minor subdivision request which involves a lot combination of four (4) parcels located at 4825 Mustang Circle, legally known as Mounds View Industrial Park No. 3, Block 1, Lots 4, 5, 6 and 7; and WHEREAS, the lot combination would make this property one (1 ) buildable lot ; and WHEREAS, the Planning Commission has reviewed the Certificate of Survey and determines that it meets the requirements of Chapter 42 entitled, "Subdivision Regulations" . NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends to the City Council approval of the requested minor subdivision contingent upon: • 1. The minor subdivision shall be reviewed and approved by the City Engineer . 2. The minor subdivision shall be recorded with Ramsey County.
