Call to by Chair Mountin at 7:35 PM on Wednesday, November 1, Order 1989. MEMBERS PRESENT: Commissioners Dian, Jones, Miller 2. Roll Call and Chair Mountin. It was noted Commissioners Burgers and Zollner had excused absences. ALSO PRESENT: City Planner Hren and Councilmember Wuori . Motion/Second: Jones/Miller to approve the October 3 . Approval of 4, 1989 minutes as presented. Minutes: 411 October 4, 1989 4 ayes 0 nays Motion Carried There were no residents requests or comments from 4. Residents the floor. Ms. Hren reviewed the request of the applicant for 6. Consideration a minor subdivision, noting the property meets the of Rslt. No. minimum lot area and width requirements. Commissioner Dian expressed concern in approving the request without the survey available. It was agreed to take action on this item at the Planning Commission' s November 15 agenda session, after the survey has been received. Motion/Second: Jones/Dian to table this item and address again at the November 15 agenda session, when the survey is received. 4 ayes 0 nays Motion Carried Ms. Hren reported Everest Development had presented 7. South PUD Amendment, Tim Nelson, of Everest Development, pointed out the Planning Case location of the driveway in question on an overhead No. 259-89 map and he clarified how the existing driveway would be changed. The driveway would not include cross traffic with Perkins. Mr. Nelson explained MnDOT is not excited about the proposal, but it is expected they will approve it, and they may request some changes to the plan. Mr. Nelson asked that the Planning Commission approve the driveway, contingent upon MnDOT approval . Mr. Nelson reported the Perkins driveway had already been closed off, after giving them notice. He also . reviewed the changes made to the landscaping plan to accomodate the driveway. Mounds View Planning Commission November 1, 1989 Regular Meeting Page Three 411 The Planning Commission requested Everest Development discuss the previously approved plantings with the City Forester, for clarification and possible changes. Ms. Hren reviewed the options open to the Planning Commission at this time. She advised the comments are expected from MnDOT within the next few days. Chair Mountin recommended the Planning Commission be proactive and tell MnDOT what should be done, and if they are opposed, they should state so now to MnDOT. The Planning Commission can also request this go to Barton Ashmann for a traffic study on the access. The cost of the study would be borme by the developer, and there is value in having a disinterested third party do such :a study. Mr. Nelson stated he agrees that the City' s approval would be required, in addition to MnDOT' s, and he requested if the Planning Commission is uncomfortable with the request, to please ask for additional infor- mation rather than just voting it down. He pointed out they have already taken out two accesses that were there. It was the concensus of the Planning Commission that they would like further information before taking action. Motion/Second: Miller/Jones to request the Council refer the issue to Barton Ashmann or another qualified traffic consultant, to address the single issue of the driveway and its relationship to Woodale Drive, Perkins, the Mermaid and Rent-All for potential impact and/or conflict. Information to be provided would include the quantity of how many, when, peak times, as well as a quality issue, if the ingress/ egress is reasonable, and design alternatives. The Planning Commission requests the City advise MnDOT a decision has not been reached and request that they delay their decision until input can be provided. 3 ayes 1 nay Motion Carried Commissioner Dian voted against the motion, stating she felt it was against the Comp Plan, and she feels the safety impact is an issue. This driveway was not shown in the original plan and the need has not been shown. Chair Mountin clarified that the Council will direct IIIStaff to retain a consultant to do the study. He stated the structure he is proposing to put up would be close to a quarter miller dollars in value, and would be a side by side. Chair Mountin explained zero lot lines are allowed. Mr. Anderson replied he wants to own both units, to have control over who lives next to him. Motion/Second: Jomes/Miller to adopt Resolution No. 273-89, establishing Planning Commission policy regarding R-2 zoning district. 4 ayes 0 nays Motion Carried Ms. Hren reviewed the request of the applicant to 9. Mr. Anderson stated the neighbors in the area have no objection to his plan. Chair Mountin stated she does not feel the lot is on the periphery. Commissioner Jones stated he felt it was on the periphery, with the compost site, highway, commer- cial development and so forth. However, he agreed that in looking at it from the street, it would not be. Commissioner Dian stated she did not feel property south of 8275 Long Lake Road periphery, but anything 410 north would be. She added she does not feel the lot is undesirable. Anderson for property he owns at 8280 Long Lake Road, Planning Case No. 272-89. 3 ayes 1 nay Motion Carried Commissioner Jones voted against the motion due to what is across the street, the compost site, Highway 10 and the nearby commercial area, which he feels makes it periphery. Chair Mountin noted the resolution will be forwarded to the Council . Ms. Hren advised it will be on the November 20 agenda session agenda, and a public hearing set for November 27. Ms. Hren advised the Planning Commission needs to 10. Motion/Second: Mountin/Jones to declare that Deborah • Alman has vacated her seat on the Planning Commission by verbal communication and lack of attendance, and request the Council fill that position. 4 ayes 0 nays Motion Carried Councilmember Wuori reported she had received a letter from the School District, advising that Edgewood Community Center will be reverted back into a middle school, and asking the City's help in finding alterna- tive sites for the center and its programs within the community. The Council would like input from the commissions and any suggestions they may have. Commissioner Dian pointed out the 7-11 at County Road H2 and Silver Lake Road, which was recently purchased by Super America, had been boarded up and suggested that as a consideration. Attendees at the October 18 agenda session were 11 . Commissioner Miller suggested it would be helpful to have the original committee members receive a copy of the update, for their input. Commissioner Jones noted a number of neighbors of the proposed Hardees had objected to the development and stated that they had not heard of it until after the public hearing, and he questioned whether the Planning Commission tried to notify them. Chair Mountin explained the Planning Commission can have informational meetings with public notice. It is the appearance before the Council that really matters, where there is the official public hearing and two readings. While it is not official at the Planning Commission level, input could be used to help formulate directions. Chair Mountin also rioted that a proposal must meet the intent and purpose of the Comp Placa and zoning ordinance, and this did. • There being no further business before the Planning 12. Respectfully submitted, / , / / Michelle Hren City Planner • RESOLUTION NO. 271-89 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE MINOR SUBDIVISION REQUEST BY VERNON HALL, 2186 BRONSON DRIVE, PLANNING CASE NO. 281-89 WHEREAS, the Planning Commission reviewed the proposed minor subdivision request by Vernon Hall for the property located at 2186 Bronson Drive, legally known as Lambert ' s Addition, east 84 feet of Lot 1, Block 1, as shown on the proposed Certificate of Survey dated September 28, 1989, with revisions dated October. 25, 1989; and • WHEREAS, each of the proposed lots meet the minimum lot area and width requirements as outlined in the zoning and subdivision ordinances. Section 40.04, Subd. C(3 ) , indicates that a platted lot or parcel of land of record on or prior. to May 9, 1960, which • does not meet the requirements of this Code as to area, width, or other open space may, if it is properly zoned, be utilized for single family detached dwelling purposes provided the measurements of such area with their open space are within 70 percent of the requirement under the terms of this Code, but said lot or parcel shall not be more intensively developed. Such existing lots that fall within 70 percent of the requirements and have lot widths less than required by this Code shall be permitted to have side yard setbacks in the same percentage proportion as the lot width reaches the requirements of this Code. In no case shall the side yard setback be less than five feet. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends to the City Council approval of the requested minor subdivision dated September 28, 1989, contingent upon: 1. This resolution and Certificate of Survey dated September 28, 1989, be recorded with Ramsey County within sixty (60 ) days of final adoption. 2. The applicant pay the park dedication fee of $100. 00. 3. The two existing sheds will be removed within one (1 ) • year of the date of final adoption. ANDERSON FOR PROPERTY HE OWNS AT 8280 LONG LAKE ROAD, PLANNING CASE NO. 272-89 WHEREAS, Mr. Donald L. Anderson has requested a rezoning of property he owns at 8280 Long Lake Road, legally known as Greenwood Terrace, Lot 1, Block 5, from R-1, Single Family Residential to R-2, Single and Two Family Residential; and WHEREAS, the Planning Commission has taken into consideration Section 40. 25 of the Zoning Ordinance which includes the following: a. Relationship to Municipal Comprehensive Plan. b. The geographical area involved. c. Whether such use will tend to or actually depreciate the area in which it is proposed. • d. The character of the surrounding area. e. The demonstrated need for such use. WHEREAS, the Planning Commission has taken into consideration Resolution No. 273-89, R-2 Zoning Policy; and WHEREAS, the Planning Commission has determined that the property is not considered to be on the periphery of the single family neighborhood as outlined per. Planning Commission Resolution No. 273-89 (R-2 Zoning Policy) . NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends to the City Council denial of the requested rezoning. ATTEST: J� A477,- Cha" r.ma (SEAL) ` , / City Planner. 111 RESOLUTION NO. 273-89 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION ESTABLISHING PLANNING COMMISSION POLICY REGARDING R-2 ZONING DISTRICT WHEREAS, this resolution establishes Planning Commission policy regarding R-2, Single and Two Family Residential, Zoning Districts; and WHEREAS, the Planning Commission has determined that R-2 Districts are considered low density residential; and NOW, THEREFORE, BE IT RESOLVED that the Planning Commission has established the policy as herein setforth: a. The R-2 District on the periphery of single family neighborhoods. b. The R-2 District is on a collector or minor arterial street as designated in the Comprehensive Plan. c. However, the facilities which have developed to facilitate auto movement through- out the community exhibit numerous deficiencies. The first step in attempting to address and correct these deficiencies is the classification of streets within the community according to function. The map on page illustrates the proposed classifications based upon standards and criteria established by the Metropolitan Council . The shaded areas on the map refer to the two planning districts where major access to development should be provided by a ring road. The precise align- ment of both ring roads has not been determined as this task should be closely coordinated with landowners during development stage planning. PRINCIPAL ARTERIALS The City is presently served by two principal arterials - Interstate 35W, located on the eastern border of the community, and old Highway 10. These elements of the transportation system provide residents of Mounds View with regional level accessi- bility, serving long trips at high speeds. Although Interstate 35W will continue to serve the community in this regard, as noted on the map, it is anticipated that new Highway 10, which is a controlled access expressway, will replace old Highway 10 in providing regional level accessibility. Furthermore, as discussed in the Land Use Plan, the City should work cooperatively with the Highway Department to ensure that as plans are developed for new Highway 10, no interchange is planned for Red Oak Drive. With a connection point at 35W on Mounds View's eastern border and an interchange at close proximity in Blaine to the northwest, little need exists for additional access to northern Mounds View. The originally proposed Red Oak Drive interchange not only violates limited access distance policies, but as well, creates an extremely disruptive traffic focusing situation on Red Oak Drive, given its established residential development character. INTERMEDIATE ARTERIALS There are no existing or proposed intermediate arterials within Mounds View. MINOR ARTERIALS Minor Arterials are intended to provide access to principal arterials, intermediate arterials, other minor arterials and collectors. At the present, Silver Lake Road and County Road I are the only minor arterials within the community. As a conse- quence of the new Highway 10 extension, old Highway 10 will be down- lf` graded to a minor arterial .
