Call to order by Chair Mountin at 7:32 PM on Wednesday, Order January 3, 1990. MEMBERS PRESENT: Commissioners Colleen, Dian, 2. Roll Call Miller, Jones, Zollner and Chair Mountin. (Commissioner Burgers had an excused absence. ) ALSO PRESENT: City Planner Hren and Councilmember Wuori . Motion/Second: Qian/Jones to approve the December 6, 3. Approval of 1989 minutes as presented. Minutes : December 6, 6 ayes 0 nays 1989 Motion Carried There were no residents requests or comments from 4. Residents the floor. Requests and Comments from the Floor City Planner Hren reported that after discussion at 5. Consideration the last agenda session, she had drafted proposed of Resolution Resolution No. 277, taking into account the number No. 277-90 of issues addressed by the Planning Commission. The Approving main issues discussed had been the alignment of Concept Stage Jackson Drive, accessbetween the sites, truck of Mounds View traffic along County Road H2, and alternate site Business Park, plans. The Planning Commission had indicated it was Phase III, West, their intent to deal with conceptual approval for Planning Case phase 3, or the west development. No. 287-89 It was determined by the Planning Commission that the proposed resolution should deal with just the develop- ment of the west side, and proposed Resolution No. 278-89 should deal with just the east side. 41, Tim Nelson, of Everest Development, updated the Planning Commission on the status of Jackson Drive. He reported they have met with the owner of Loose Ends and he has conceptually approved a joint shared Mounds View Planning Commission January 3, 1990 Regular Meeting Page Two • access. However, because there have been several contracts for deed on that property, several people will have to be contacted for approval. Further plans will be available for review at the next Council agenda session. They are concurrently working on the other access to the property, and they would like to keep this moving along as much as possible. Ms. Hren advised this is the time to bring up any- thing the Planning Commission is concerned with. Commissioner Jones asked where the water from this develoment will go, noting Silver View Pond is not allowed to be used ' as a holding pond for any other area. Mr. Nelson replied the existing pond on the site will handle the run-off,, and there will be a con- trolled flow into the ditch on Highway 10, and then flow down to Rice Creek. The revisions to parking will be shown in the next stage of the review process. Motion/Second: Miller/Jones to adopt Resolution No. 277-89, recommending approval of the concept plan stage, Mounds View Business Park Phase III . (West) , Planning Case No. 287-89. 6 ayes 0 nays Motion carried Bill Franke, of Everest Development, reviewed the 6. Franke advised they should be ready to meet again within the next 3-4 weeks, for an informa- tional meeting, as they must first talk to the Mounds View Planning Commission January 3, 1990 Regular Meeting Page Three • people at Multi Tech and Loose Ends. They would hope to be able to have the informational meeting by mid to late February. It was noted there was no one present to represent 7. Motion/Second: Miller/Zollner to adopt Resolution No. 276-89,. recommending to the City Council denial of the request by TJB Builders for a waiver of the Highway 10 moratorium district requirements, Planning Case No. 286-89. 6 ayes 0 nays Motion Carried Ms. Hren read a statement from Commissioner Burgers, • stating he did not feel there was an undue hardship displayed by the applicant. It was the concensus of the Planning Commission in denying the request that an undue hardship had not been shown. Chair Mountin noted the bylaws call for the election 8. Other of the Vice-Chair at the first meeting in January, Business and she asked if the Chair had been appointed by the Council yet . Councilmember Wuori replied no, but she feels it would be safe to assume Chair Mountin would be reappointed. Motion/Second: Miller/Jones to appoint Commissioner Zollner as Vice-Chair for 1990. 6 ayes 0 nays Motion Carried Chair Mountin advised she would not be present at the February 7 meeting. Ms. Hren passed out a memo to the Council con- cerning redevelopment, and advised this is in the discussion stage, and if it develops into anything, it will be sent on to the Planning Commission for their input. Mounds View Planning Commission January 3,. 1990 Regular Meeting Page Four ' 410Councilmember Wuori explained the Council would like input back, of creative ways to encourage commercial property owners to keep their property up. Chair Mountin stated that would include mobile home parks, apartments, and some scattered home sites. It was agreed the Planning Commission would discuss the issue further. The attendees at the December 20 meeting were Commissioners Burgers, Colleen, Dian, Jones, Miller and Chair Mountin, Councilmember Wuori and City Planner Hren. Commissioner Zollner had an excused absence. There being no further business before the Planning 9. Adjournment Commission, Chair Mountin adjourned the meeting at 8:34 PM. Respectfully submitted, i - • U Michelle Hren City Planner • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 276-90 • CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING TO THE CITY COUNCIL DENIAL OF THE REQUEST BY TJB BUILDERS FOR A WAIVER OF THE HIGHWAY 10 MORATORIUM DISTRICT REQUIREMENTS, PLANNING CASE NO. 286-89 WHEREAS, the Mounds View Planning Commission has reviewed the request by TJB 'Builders to allow reconstruction of their existing sign on their property at 2704 Highway 10, legally known as : NELY 275 FT OF PART OF SE 1/4 LYING SWLY OF CL OF HWY NO 10 AND BET 2 PAR LINES RUN SWLY AT RA FROM SD CL AND FROM POINTS MEASURED THEREON 765. 9 FT AND 865. 9 FT NW FROM S LINE OF SD 1/4 (SUBJ TO HWY) IN SEC 6, TN 30,, RN 23; and WHEREAS, the Planning Commission has reviewed Ordinance No. 466 addressing the Highway 10 Moratorium District requirements ; and • WHEREAS, the Planning Commission has reviewed the appeal provision which is Section 6 of Ordinance No. 466; and WHEREAS, Ordinance No. 466 expires April 24, 1990; and WHEREAS, the Planning Commission states the following reason for their denial : 1. Applicant has not demonstrated undue hardship. 2. Approval would impair the integrity of the moratorium district. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends to the City Council denial of the requested waiver of the Highway 10 Moratorium District requirements for TJB Builders. BE IT FURTHER RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 3rd day of January, 1990. MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 277-90 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE CONCEPT PLAN STAGE, MOUNDS VIEW BUSINESS PARK PHASE III (WEST) PLANNING CASE NO. 287-89 WHEREAS, Everest Development has requested general concept stage approval to construct two buildings as follows : Building K 111, 995 square feet Building L 53, 058 square feet The site is located at the northwest intersection of Highway 10 and Woodale Drive; and WHEREAS, the Developer of this development, as requested, requires the following approvals : 1. General Concept Plan 2. Development Stage • 3. Final Plan; and WHEREAS, the Developer shall enter into a development agreement with the City of Mounds View; and WHEREAS, the Planning Commission has reviewed the Staff recommendation and information submitted by the applicant which includes the following: 1. Site Master Plan dated October 26, 1989. 2. Boundary and topographic survey (west) dated December 8, 1989. 3. S ' te plan (west) . 4. Landscape plan (west) . 5. Grading, drainage and utility plans (west ) dated December 13, 1989. 6. Preliminary plat of Mounds View Business Park West dated December 12, 1989. 7. Preliminary site lighting plan (west) . WHEREAS, the applicant has submitted a project that meets the requirements of City Code Chapter 40. 24, Subd. C(2) , commercial or industrial planned unit development ; and RESOLUTION NO. 277-90 PAGE TWO WHEREAS, the applicant has provided the information PP required by Chapter 40. 24, Subd. E(1) , general concept stage; and WHEREAS, the Planning Commission has reviewed the Concept Plan taking into consideration Chapter 40. 24, Subd. D(2) ; and WHEREAS, the Planning Commission has reviewed the on-site circulation, there being no public streets or pedestrianways proposed; and WHEREAS, the Planning Commission has reviewed the location and extent of the ponding areas proposed; and WHEREAS, the Planning Commission has reviewed the land use proposed and recognizes it is appropriate given the site zoning and is in accordance with the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends rezoning the area in question to PUD and recommends approval of the concept stage of the PUD contingent upon the following: 1. Permits from the Rice Creek Watershed District, Army Corps of Engineers, and Department of Natural Resources are applied for and approved. • 2. The applicant present alternative site plans addressing the following: a) Alignment of Jackson Drive with the most westerly driveway. b) Access between sites must be evaluated. c) Truck traffic along County Road H-2 must be evaluated. d) The applicant pursue control of site access to Woodale Drive. 3. A public informational meeting be held prior to action on Development Stage. BE IT FURTHER RESOLVED that this resolution be forwarded to the City Council prior to approval of the minutes. General Concept Plan • 2. Development Stage 3. Final Plan; and WHEREAS, the Developer shall enter into a development agreement with the City of Mounds View; and WHEREAS, the Planning Commission has reviewed the Staff recommendation and information submitted by the applicant which includes the following: 1. ' .Adopted this 3rd day of January, 1990. • ATTEST: / ha rm- (SEAL) Ci..y Planner • • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 279-90 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA ESTABLISHING MEETING AND TIMELINE SUBMISSION DATES FOR 1990 WHEREAS, the Mounds View Planning Commission will be holding one regular business meeting per month during 1990 with the exception of Special Meetings; and WHEREAS, the Planning Commission has requested to review regular business meeting agenda items at their agenda session, two weeks prior to the regular business meeting; and WHEREAS, developers, citizens or other interested parties should be advised of deadlines for materials used by staff to prepare a report and used by the Planning Commissioners to decide on a particular development issue; and WHEREAS, a display of meeting dates and submission deadline dates be established to provide an orderly system for use by the Planning Commission, staff and general public; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View establishes meeting and submission timetable dates setting deadlines for submission of materials for agenda sessions of the Planning Commission and also setting the dates of the regular business meetings and agenda sessions; BE IT FURTHER RESOLVED that Exhibit 1 becomes an integral part of this resolution; BE IT FINALLY RESOLVED that if the Planning Commission is required to or desires to hold special meetings, they will do so in accordance with State law, Code requirements and the Bylaws. IN Thb CITY CUUNCIL CHEuviBERS 111 MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 280-90 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION FINDING THE CITY'S ADOPTION OF MODIFIED BOUNDARIES TO DEVELOPMENT DISTRICT NO. 2 AND THE ADOPTION OF THE MODIFIED TAX INCREMENT FINANCING PLAN FOR TAX INCREMENT FINANCING DISTRICT NO. 1 MODIFICATION NO. 2 TO BE CONSISTENT WITH THE COMPREHENSIVE PLAN OF THE CITY OF MOUNDS VIEW WHEREAS, the City's adoption of modified boundaries to Development District No. 2 and the adoption of the Modified Tax Increment Financing Plan for Tax Increment Financing District No. 1 within Development District No. 2 have been submitted to the Mounds View Planning Commission pursuant to Minnesota Statutes, Section 469.124 to 469.134, as amended and Minnesota Statutes, Sections 469 . 174 to 469.179; and WHEREAS, the Planning Commission has reviewed the proposed boundary modification and proposed Modification No. 2 to the Tax Increment Financing Plan to determine the consistency of the Plans to the Comprehensive Plan of the • City; and WHEREAS, the Planning Commission of the City of Mounds View determines that the Plans are consistent with the Mounds View Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval to the City Council. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 7th day of March, 1990.
