Call to order by Chair Mountin at 8:48 PM on Wednesday, Order March 21, 1990, following an agenda session. . MEMBERS PRESENT: Commissioners Burgers, Colleen, 2. Roll Call Dian, Jones, Zollner and Chair Mountin. It was noted Commissioner Miller had an excused absence. ALSO PRESENT: Councilmember Wuori and City Planner Hren. He explained they have heat pads planned, and the car wash will be closed anytime the temperature drops below 10 . He stated they will be losing income with the denial of access, and he feels the blower requirement would punish them for something • they have not yet done. Chair Mountin explained the blower requirement is a standard imposed on all car washes constructed in the city. Ms. Hren explained the drain would be required, but the heating pad wouldn ' t. Mr. Bakus stated he would not withdraw the request for a variance. Chair Mountin noted the Planning Commission finds no hardship in the request of the applicant, and that finding is supported by the letter from City Attorney Karney. The letter will be attached to the resolution as an exhibit. She also requested the resolution about to be acted on by the Planning Commission be forwarded to the City Council prior to approval of the minutes. Commissioner Jones noted the exit onto Bronson Drive rather than Long Lake Road provides greater safety. Motion/Second: Dian/Jones to adopt Resolution No. 282-90, denying the variance request by Phillips 66 for curb cut location setback, 2525 Highway 10, Planning Case 288-90, and waive the • reading . 6 ayes 0 nays Motion Carried Motion/Second: Zollner/Dian to table proposed Resolution No. 283-90, the conditional use permit request of Phillips 66, until the site plan is presented. 6 ayes 0 nays Motion Carried Chair Mountin noted the Planning Commission needs to look at the site plan and adopt a resolution approving the site plan, before granting the requested conditional use permit . It was agreed the revised site plan could be reviewed by the Planning Commission and acted on at its next meeting, on April 4. Miscellaneous been requested by the Council to address the proposed new Highway 10/610 and County Road J realignment . She noted considerable discussion had occurred on this at various levels of the City in the past years. She further noted the Planning Commission is an advisory board and they will be addressing the alternates proposed as to how they fit into the Comp Plan. City Engineer/Public Works Director Minetor pre- sented a basic overview of the project, showing 0 the proposed alternates, and addressed how they would impact existing County Road J. He also reviewed the traffic count data for the area. He also noted no plan was ever formally approved by the City. Chair Mountin reviewed the history of the proposed road upgrade, and the Planning Commission ' s input in that process . She stated it is hoped the Planning Commission will be able to have a recommen- dation to pass on to the Council on a policy statement . Mr. Minetor reviewed MSA requirements for streets. A suggestion was made from an unidentified resi- dent who was present, to close off all streets for a one week study, to see where those cars go. However, Mr.Minetor explained it would take mini- mally a few months to establish patterns. There was also discussion on closing off Radisson Road to the airport, but it was noted nothing is permanent and while the road could be closed now, it could be opened later. • Other concerns expressed included safety, access for emergency vehicles, noise and noise abatement, environmental issues, sidewalks and increased traffic on residential streets. Mounds View Planning Commission March 21, 1990 Regular Meeting Page Four • Chair Mountin reminded the Planning Commission the issues raised must be addressed with reference to the Comp Plan, and they must establish a policy statement, and are not in a position to recommend a plan. It was noted a community of four square miles does not have to give access to every person at every point . Commissioner Colleen left the meeting at 10:44 PM. The Planning Commission ranked issues they felt need to be addressed, as A and B issues . The A issues are the safety of all pedestrians, drivers and emergency vehicles, and to maintain the character of low density single family residential areas. B issues include limiting access to and from the north part of the City, strategically locating access points, minimizing impact while maximizing access for Mounds View residents, preserving the existing traffic patterns, and minimizing negative environ- mental impact . Commissioner Dian left the meeting at 10:58 PM. Hren City Planner • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 281-90 411 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT FOR TWIN CITY SCHOOL OF PET GROOMING FOR A PET GROOMING SCHOOL AT 2540 HIGHWAY 10, SILVER VIEW PLAZA, MOUNDS VIEW PLANNING CASE NO. 291-90 WHEREAS, Twin City School of Pet Grooming has requested a conditional use permit to allow a pet grooming use in the Silver View Plaza; and WHEREAS, the property is zoned B-2, Limited Business District; and WHEREAS, other pet related activities have been allowed in the B-2 District by Conditional Use Permit; and WHEREAS, the Planning Commission has reviewed the proposal and found it in keeping with the intent of the Code; and WHEREAS, the Planning Commission has reviewed the City Attorney's interpretation of the Code as it relates to the definition of Pet Store. The City Attorney's interpretation is attached to this resolution; and WHEREAS, the Planning Commission is aware that the Mounds View Zoning Code will be updated in 1990 at which time the pet store definition will be revised; and WHEREAS, the Planning Commission has determined that the proposed use is in keeping with the B-2 District and compliments the existing uses in Silver View Plaza. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of a conditional use permit for a pet grooming school contingent upon the following: a. Noise and odor are effectively confined to the premises in accordance with Ordinance No. 90, Public Nuisances. b. Boarding of animals over night is prohibited. c. That the space occupied includes a negative air pressure system. RESOLUTION NO. 281-90 PAGE TWO 411 d. That a separate ventilation system is used by this tenant. e. The space used will be sound-proofed so as not to cause hardship to the other tenants in the building. f. That the tenant and/or property owner will be responsible for accidental feces dropping at this site. g. A mechanical ventilation or exhaust system shall be installed to control, capture and remove emissions or odors generated by such use. Such system shall be separate from the other ventilation systems in the building. Such system shall be designed to prevent the migration of emissions or odors to other parts of the building. Installation must comply with the Minnesota State Building Systems, Chapter 1345 . h. The use meets all Ramsey County Health Codes for a use of that type. • BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. You've asked whether a facility which is engaged primarily in training individuals to groom pets would fall under the definition of pet stores for that zoning within the City. I 've read the ordinance which you forwarded to me. It strictly defines a pet store as a structure intended primarily for the sale of small domesticated animals. It appears that grooming . is only allowed as an adjunct to the main purpose of a pet store which is the sale of animals. Since the facility that is proposed is intended primarily for educational purposes as opposed to retail sale of animals it does not appear that that use would be permitted without a conditional use permit within a 82 area. The definition of pet store in our current city ordinances may not be adequate to define the number of permitted activities that we would like to seg pet store owners or other facilities engage in within a 82 area. Since the grooming services are allowed it was my initial opinion that such an educational facility would be permitted within the city until the zoning ordinances ware cha'iged to hopefully include ! .10' a '~ tviciaa . S louts t%v1Y° \ Sarney 141,seA N, MOUNDS VIEW PLANNING COMMISSION 411 RESOLUTION NO. 282-90 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION DENYING VARIANCE REQUEST BY PHILLIPS 66 FOR CURB CUT LOCATION SETBACK, 2525 HIGHWAY 10, PLANNING CASE NO. 288-90 WHEREAS, the Planning Commission has reviewed the request by Phillips 66 Company for a variance from the curb cut location setback requirements; and WHEREAS, the Planning Commission has reviewed and taken into consideration the applicant's hardship statement as required for a variance request; and WHEREAS, the Planning Commission has reviewed the zoning ordinance section requiring fifty (50) feet from the intersection of lot lines; and WHEREAS, the Planning Commission has reviewed the City Engineer's recommendation to relocate the Long Lake Road 411 access to Bronson Drive; and WHEREAS, the Planning Commission has reviewed and taken into consideration the City Attorney's opinion of the hardship statement presented by the applicant as outlined in the Planning Commission minutes of March 7, 1990; and WHEREAS, the Planning Commission has reviewed the criteria for granting a variance per Section 40.26; and WHEREAS, the Planning Commission has considered alternatives to the proposed site plan; and WHEREAS, the Planning Commission determines that there are reasonable alternatives to the proposed site plan. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View denies the variance request for the following reasons: 1. The Planning Commission finds that no hardship exists. 2. Action is supported by City Attorney's letter. 3. Bronson Drive provides greater safety. RESOLUTION NO. 282-900 PAGE TWO BE IT FURTHER RESOLVED that the applicant has the right to appeal to the Mounds View City Council as allowed for in Section 40.26, Subds. e and f, of the Mounds View Municipal Code. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 21st day of May, 1990.
