The Mounds View Planning Commission was called to order 1. Call to
by Chair Mountin at 7:32 PM on Wednesday, April 4, 1990. Order
MEMBERS PRESENT: Commissioners Dian, Jones, Miller 2. Roll Call
and Chair Mountin.
Commissioners Zollner and Burgers were noted as absent,
with excused absences. Commissioner Colleen was noted
as absent with an unexcused absence, but joined the
meeting later in progress.
ALSO PRESENT: City Planner Hren.

City Planner Hren reported the Planning Commission 5. Consideration
had discussed the variance request of the applicant of Resolution
at the last agenda session, and the applicant has No. 285-90
presented a hardship statement. Regarding
Variance Request
Tom Plumb, 7359 Park View Terrace, explained his by Tom Plumb,
hardship statement is based on four points. His 7359 Park View
lot has a curved frontage, which required additional Terrace,
setback, and is only one of three lots in this Planning Case
development with a curved front, with his lot being No. 293-90
the smallest of the three and also being the only
one unable to build an addition without a variance.
Mr. Plumb stated he does not have a feasible alter-
native for placement of this addition on his home.
He also added he has the support of all his immediate
neighbors .

411 Mr. Plumb clarified that his rear lot adjoins another
rear lot.
Commissioner Jones stated he had received a variance
on his home, which is in the same area, and can
empathize with Mr. Plumb.
Commissioner Dian stated she understands the intent
of the ordinance and the requirements, but she has
a problem with being too rigid, and she would much
rather allow someone to enhance their home.
Chair Mountin explained the work of the Planning
Commission is to review the request in comparison
to what the code says, in both spirit and intent.
She added she personally has a very conservative
approach.
Commissioner Miller stated the job of the Planning
Commission is to see where various requests meet
the code. She added she feels a 52 ° variance is
more than she would like to see.
Mr. Plumb stated he does have a time constraint,
with the contractor he is dealing with. He added
he would also like direction on the bay window he

is proposing .
As it appeared the vote would be split equally on
whether or not to grant a variance, it was agreed
to table the item and discuss again later on the
agenda, once Commissioner Colleen arrived, at which
time there would not be a tie vote.
Motion/Second: Jones/Dian to table this item until
later on the agenda.

Chair Mountin noted the revised site plan has been 6. Consideration

John Bakus, representing the applicant, reviewed Regarding CUP
the revised site plan briefly. Request by
Phillips 66,
Ms . Hren advised Phillips 66 may have to do some 2525 Highway 10
temporary measure now with the curb on Bronson Planning Case
Drive. That area would be redone later with the No. 288-90
Long Lake Road work.

283-90, recommending approval of the site plan and
conditional use permit request by Phillips 66,
2525 Highway 10, Mounds View Planning Case No.
288-90, and waive the reading.

Ms. Hren advised Multi-Tech Systems has requested 7. Consideration

410 Terrace, Commissioner Colleen stated she did not of Resolution
have a problem with granting the requested No. 285-90
variance.
Chair Mountin reminded the Planning Commission
that if a variance is granted, it will be setting
a precedence to follow with future requests. She
noted the Planning Commission then creates another
set of standards.
Commissioner Dian stated she does not want to weaken

in the future. She noted, however, the applicant ' s "
house was set back 4' due to being on a curve, but
she does not favor granting a variance.
Motion/Second: Miller/Dian to adopt Resolution
No. 285-90, denying the setback variance request
by Tom Plumb, 7359 Park View Terrace, Planning
Case no. 293-90, and waive the reading.

Commissioner Jones voted against the motion,
stating he believes the curvature of the street
411 which required an additional 4 ' setback at the
front of the lot created a hardship, as the small
size of the lot prevents a reasonable alternative
to building in any other direction, and the variance
process is to allow residents alternatives.

Commissioner Colleen stated she believes the curve
presents a unique situation, and it seems the size
of the house is already scaled down. She also stated
she believes builders may tell people they can add on
later when that isn 't necessarily so.
Ms. Hren explained a temporary building inspector 8. Consideration

and requested the Planning Commission call to order
at that time to act on it.
Chair Mountin stated there will be a special
meeting on April 18, and requested that Staff post
notice in the lobby of City Hall .
The attendees at the March 21 agenda session were 10. Report of
Commissioners Burgers, Colleen, Dian, Jones, Chair
Zollner, Chair Mountin, City Planner Hren and
Councilmember Wuori . Commissioner Miller had an
excused absence for that meeting.
There being no further business before the 11 . Adjournment
Planning Commission, Chair Mountin adjourned the
meeting at 9:11 PM.

411 RESOLUTION NO. 283-90
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RECOMMENDATION TO THE CITY COUNCIL APPROVING
CONDITIONAL USE PERMIT AND SITE PLAN DESIGN REQUEST BY PHILLIPS 66,
2525 HIGHWAY 10, MOUNDS VIEW PLANNING CASE NO. 288-90
WHEREAS, Phillips 66 has requested City approval to
construct a gas station/convenience store/self-service car
wash in the City of Mounds View; and
WHEREAS, the Zoning Ordinance allows gas station and
car wash uses in the B-3, Highway Commercial District; and
WHEREAS, the development, as proposed, requires two
conditional use permits and site development approval; and
WHEREAS, the Planning Commission has reviewed the
following documents regarding this development proposal:
a) Site Plan Dated 3/27/90
b) Landscape Plan Dated 3/27/90
c) Grading/Drainage Plan Dated 3/27/90
d) Boundary and Topography Survey Dated 12/27/89
e) Drainage Analysis Dated 2/5/90
f) Lighting Plan Dated 2/1/90
g) Corrective Action Design Approved by the Mn PCA
Dated 2/14/90
WHEREAS, the Planning Commission has determined that
the development proposal is in conformance with the
requirements of the Municipal Code, specifically Chapters 40,
42, 49 and 49A and State Statutes; and
WHEREAS, the development proposal may require permits
from the Rice Creek Watershed District, Ramsey County, the
Minnesota Department of Transportation (MnDOT) , and the
Minnesota Department of Public Safety, Office of State Fire
Marshall; and
WHEREAS, the storm water controls for the project have
been determined to be adequate by the City Engineer.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
- Planning Commission recommends approval of the conditional use
permits with the following conditions:

1. The facility must, at all times, be in compliance
with State Laws and Minnesota Pollution Control
Agency Standards for air quality and noise.
2. The hours of operation shall be 24 hours. After
one year of operation the City shall hold a public
hearing to solicit input on the hours of opera-
tion. If there are any negative comments, the
hours of operation may be reduced.
3. Outside loud speakers shall be utilized for
clearing pumps only.
4. Outside merchandising shall be limited to the
concrete entrance slabs to the building. Outside
merchandise stacking shall not exceed four feet.
5. The single pedestal sign and all others shall be
located on the site plan. Signage shall be in
conformance with Municipal Sign Code.
• 6. If for any reason the gasoline sales portion of
the business closes for a one year period, the
conditional use permit shall be null and void and
the underground tanks shall be emptied and filled
with sand or removed.
7. The car wash facility shall include a blower
system designed to remove as much water as
feasible from the vehicle before it is allowed to
exit the facility. This equipment shall operate
as a customer option from April 16 to October 14
and as a mandatory service from October 15 through
April 15.
8. That a Development Agreement be entered into
between the City and the Developer.
9 . That all appropriate permits are obtained
including, but not limited to, MnDot, Rice Creek
Watershed District, Army Corps of Engineering,
Fire Department and Pollution Control Agency.

BE IT FINALLY RESOLVED THAT the Planning Commission
directs Staff to forward this resolution to the City Council
prior to approval of the minutes.

RESOLUTION NO. 285-90
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION DENYING SETBACK VARIANCE REQUEST BY
TOM PLUMB, 7359 PARK VIEW TERRACE, PLANNING CASE NO. 293-90
WHEREAS, the Mounds View Planning Commission has
reviewed the request of Mr. Tom Plumb for a variance to allow
the construction of a three season porch into the rear yard
setback; and
WHEREAS, the Mounds View Planning Commission has
reviewed the criteria used to evaluate all variance requests;
and
WHEREAS, the applicant has presented a hardship
statement to the Planning Commission; and
WHEREAS, the Planning Commission does not find that a
411 hardship exists on the property; and
WHEREAS, the Mounds View Planning Commission has
determined that the requested variance is not the minimum
amount variance needed; and
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission denies the variance request of Mr. Tom
Plumb for a 5.5 foot variance into the rear yard setback.
BE IT FURTHER RESOLVED that the Planning Commission
recognizes that the applicant has the right to the appeal
process as outlined in Section 40.26, Subd. E, of the Mounds
View Zoning Code.
