CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA Regular Meeting May 2, 1990 Mounds View City Hall 2401 Hwy. 10, Mounds View, MN 55112 The Mounds View Planning Commission was called to 1 . Call to order by Chair Mountin at 7:33 PM. Order MEMBERS PRESENT: Commissioners Colleen, Dian, Jones, 2. Roll Call Miller, Zollner and Chair Mountin. It was noted Commissioner Burgers had an unexcused absence. ALSO PRESENT: City Planner Hren and Councilmember Wuori . Motion/Second: Jones/Dian to approve the April 4, 3. Forester Wriskey and City Request by Engineer/Public Works Director Minetor have both Multi-Tech, reviewed the plans and recommend approval . 2205 Woodale Drive, Planning A representative from Multi-Tech reviewed the site Case No. 292-90 plan of the proposed facility, explaining they are proposing to add 50, 000 square feet of office/ warehouse space to the southwest of their property, in addition to a parking garage. This proposal 411 will meet their expansion needs for the next four years. He also reviewed the plans for the parking ramp. Mounds View Planning Commission May 2, 1990 Special Meeting Page Two The applicant further noted they do not plan on 411building for one year, at which time he was reminded of the one year limitation for the building period, and that an extension must be requested before the time expires. Motion/Second: Miller/Jones to adopt Resolution No. 284-90, recommending approval of the planned unit development amendment and site design plans for a proposed building expansion for Multi-Tech Systems, Inc. , 2200 Woodale Drive, Planning Case No. 292-90, and waive the reading of the resolution. Motion Carried 6 ayes 0 nays The applicant was advised this item would be discussed by the Council at their May 21 agenda session, and May 29 regular meeting. 6. Consideration of Resolution Ms. Hren reviewed the request of the applicant for No. 287-90 a variance from the setback requirement to allow the Regarding construction of a temporary building on the site. Planning Case No. 295-90 411Joel Strapella of Dahl & Associates explained the spill is of unknown volume and duration, and the PCA has requested emergency correction actions be taken. The system to be used has been approved by the PCA and installation would be immediate. They anticipate 18-24 months to completely pump all the gasoline out of the ground, and he reviewed the process that is used for recovery. Mr. Strapella explained the enclosure requested is to house the equipment used to decontaminate the water and a storage tank. He also reviewed the history of the underground tanks, reporting they were installed in 1983, and the other tanks there have been tested and determined to be okay. Chair Mountin inquired whether the City can require the remaining tanks to be relined, as a safety precaution, and she asked Staff to check with the City Attorney to see if the City could impose preventive actions on the three remaining tanks . Mr. Strapella explained tightness testing is required at least once every five year for leak detection. The life of this type of tank is usually 030 years, and it is possible the tank that experienced the leak was a reconditioned tank. He assumes the other three tanks were installed new. Mounds View Planning Commission May 2, 1990 Regular Meeting Page Three Mr. Strapella reported there is a monitoring well 411installed within the tank basin, and they have conducted a survey of the wells in the area, and up to six water levels within 3000' of the site have tested okay, and they do not see any health threat. Commission Jones asked about the possibility of leaving the monitoring well in after the clean up is completed. Mr. Strapella replied it could be arranged, but it would have to be an agreement between Kunz and Fina. It was noted the Planning Commission is interested in protecting the community. A representative of Dahl & Associates reviewed the placement of the building on the site, and the layout of the precautions which are planned. The building itself will be 10' x 10' . They do have a permit already from the fire department. Chair Mountin stated she would like to see a bond or security posted. She explained if a variance is granted this does not go on to the Council. She also advised the variance is removed at the time the condition ends and the shed is removed. She • suggested tabling action on this item until the next meeting of the Planning Commission, at which time they could call to order at the agenda session in two weeks to take action. She requested that in the meantime Staff check with the City Attorney, and see if a variance is the proper remedy rather than a conditional use permit, and that the variance should include the time and assure them that at the end of the time everything be removed, and also address concerns about the well, and whether anything additional can be required of the other three tanks . She also recommended this be brought to the Council at their agenda session. She also reminded everyone that if a variance is the vehicle to use, the Planning Commission is the final authority'. Mr. Strapella stated the PCA would like the removal to begin as soon as possible, and he is concerned with the vapors and the leakage getting into the sanitary sewer system and the possibility of an explosion. He emphasized the importance of beginning this work as quickly as possible. Councilmember Wuori pointed out they are dealing with two corporate entities, Kunz Oil for anything • predating the sale of Fina, and Fina for everything that is okay at this time, and issues into the future. Mounds View Planning Commission May 2, 1990 Regular Meeting Page Four 111 Mr. Strapella stated one possibility would be to see if the fire department would issue a special permit to allow a temporary removal tank on the site until a storage building could be built. It was agreed by the Planning Commissioners that they would meet with the City Council at 7 PM on Monday, May 7, at the Council agenda session, and if the City Attorney says it is a variance issue, the Planning Commission will call to order for a special meeting . If it is determined to be a conditional use permit, they will have to have notices published in the next newspaper, to proceed with the required public hearings. The applicant was requested to be present at the Council agenda session on May 7 at 7 PM. Hren City Planner MOUNDS VIEW PLANNING COMMISSION j • RESOLUTION NO. 284-90 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE REQUESTED PLANNED UNIT DEVELOPMENT AMENDMENT AND SITE DESIGN PLANS FOR A PROPOSED BUILDING EXPANSION FOR MULTI-TECH SYSTEMS, INC. , 2200 WOODALE DRIVE, PLANNING CASE NO. 292-90 WHEREAS, the Mounds View Planning Commission has reviewed the requested planned unit development amendment by Multi-Tech Systems, Inc. that would allow a building expansion and additional parking that includes an above and below grade parking ramp; and WHEREAS, the Planning Commission has determined that the proposal meets the minimum yard setbacks, exceeds the parking requirements and provides for a revised landscaping plan; and WHEREAS, the Planning Commission has reviewed the potential access issue to the property to the west and recognize that the proposed plan does not provide an easement to the west • property through the Multi Tech site; and , WHEREAS, the Planning Commission has reviewed City Forester, Wriskey's memo dated March 29, 1990, regarding the proposed landscaping on this site and agrees with the comments and suggestions made; and WHEREAS, the Planning Commission has reviewed City Engineer, Minetor's memo dated March 29, 1990, regarding the grading, utilities and drainage on this site and agrees with the comments and suggestions made; and WHEREAS, the Fire Department has reviewed the proposed expansion and requires a direct route around the entire building; and WHEREAS, in order to meet this requirement, the applicant has proposed a below grade road on the west side of the building in order to allow emergency vehicles around the perimeter of the building; and ( WHEREAS, the proposed below grade road has been found to be conceptually acceptable to the City Engineer; and WHEREAS, details of the below grade road must be submitted for review prior to final action; and I RESOLUTION NO. 284-90 PAGE TWO WHEREAS, the Planning Commission has determined that the proposed Planned Unit Development Amendment is in keeping with the original Planned Unit Development for the Mounds View Business Park; and WHEREAS, the Planning Commission has conducted a plan review of the proposed building addition and parking ramp and find it to be acceptable. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends to the Mounds View City Council approval of the requested Planned Unit Development Amendment and plan review for the building expansion and parking ramp contingent upon the following: 1. Revised landscape plan per City Forester's memo 2. Revised utility plan per City Engineer's memo 3. The amendment isrecorded with Ramsey County BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. • Adopted this 2nd day of May, 1990. Cha rm n (SEAL) Rag AL/ City Planner MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 288-90 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A REQUEST BY TERRY JO AND JAY SHERMAN TO ALLOW ORIGINAL PRINCIPAL STRUCTURE TO TEMPORARILY REMAIN AT 8443 RED OAK DRIVE WHEREAS, the Planning Commission has reviewed the applicant's request to allow the original principal structure to remain on the lot while the new home is being constructed; and WHEREAS, the applicant will remove the original structure at the time the new home is completed; and WHEREAS, the Planning Commission has reviewed the request which does not require any special approvals; and WHEREAS, the applicant currently lives in the existing house. 411 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends to the City Council approval of the request contingent on the following: 1. The front yard setback be in compliance with the Zoning Ordinance. 2 . A bond be submitted to the City covering the cost of demolition of the original structure. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 2nd day of May, 1990.
