The Mounds View Planning Commission was called to 1. Call to Order
order by Chair Mountin at 7:18 p.m. on Monday, May 7,
1990.
MEMBERS PRESENT: Commissioners Dian, Jones, Miller, 2 . Roll Call
and Chair Mountin.
MEMBERS ABSENT: Commissioners Zollner, Burgers, and
Colleen.
ALSO PRESENT: City Planner Hren, Councilmembers
Wuori, Blanchard, Quick, Paone, Mayor Hankner,
Engineer Minetor and Clerk-Administrator Pauley.
•City Planner Hren reviewed the request by Kunz Oil 3 . Consideration
for a variance to locate a temporary building within of Resolution
the setback requirement. The Planning Commission and No. 289-90
City Council reviewed City Attorney Mark Karney's Regarding
letter dated May 7, 1990, regarding the processing of Variance
this request as a variance or a conditional use Request by Kunz
permit. There was general discussion on which tank Oil, 2280
leaked and whether it was a reconditioned tank or a County Road I,
new tank. There was also general discussion Planning Case
regarding the possibility of a dangerous situation No. 295-90
with the location of the sanitary sewer lines.
However, it was explained that there is not an
immediate threat to the surrounding residents.
There was also discussion on the process of cleaning
up the contamination spill and the length of time
needed to do this.
The Planning Commission discussed a monitoring well
that possibly would remain once the clean up is
complete. There was also discussion regarding the
future clean up for cases that come before the City
and that the public needs to be notified.
Dahl & Associates explained that there is a test once
every five years on tanks required by the Minnesota
"'Pollution Control Agency. City Engineer Minetor

restrictive than the MPCA and the EPA. The Planning
Commission and City Council discussed the possibility
of pursuing legislation to allow the cities to be
more restrictive and/or have more control over spills
such as this one.
The Planning Commission stated that it was their
intent to have the monitoring wells stay in place
once the clean up is complete.
Motion/Second: Jones/Dian to approve Resolution No.
289-90 approving the variance request by Kunz Oil to
allow a temporary structure in the set back.

There being no further business before the Planning
Commission, Chair Mountin adjourned the meeting at Motion Carried
8: 10 p.m.

RESOLUTION NO. 289-90
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING VARIANCE SETBACK REQUEST BY
KUNZ OIL, 2280 COUNTY ROAD I, PLANNING CASE NO. 295-90
WHEREAS, the site plan is attached and shown as Exhibit
A and dated April 16, 1990; and
WHEREAS, the Planning Commission has reviewed the
applicant's request for a variance from the side yard setback
to allow the construction of a temporary accessory building on
the site at 2280 County Road I; and
WHEREAS, the accessory building would be used only for
the purpose of housing the contamination clean up equipment;
and
WHEREAS, the building would be removed once the
contamination clean up is completed; and
• WHEREAS, the Planning Commission has reviewed the
criteria used when evaluating all variance requests; and
WHEREAS, the Planning Commission determines that the
requested variance meets the evaluation criteria; and
WHEREAS, the Planning Commission determines that a
situation exists on the property that affects the general
health, safety and welfare of the community.
NOW, THEREFORE, BE IT RESOLVED that the Planning
Commission approves the variance request based on the
following:
1. The building is temporary in nature.
2 . Documentation will be supplied to the City from
the Minnesota Pollution Control Agency when the
clean up has been completed.
3. The clean up will be completed by May, 1993.
4. If the clean up takes longer than anticipated, a
time extension may be applied for.
5. The monitor wells will remain in place after the
clean up.

6. When the temporary building is removed, the site
will be restored to its original condition.
7 . At the owner's expense, signage will be posted on
the temporary structure indicating the use of the
structure.
8. At the owner's expense, a mailing to all
properties within 350 feet of the site will be
sent indicating the nature of the clean up work.
