Respectfully submitted, "ema , Ric Minetor Acting Clerk/Administrator • • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 298-90 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE CONDITIONAL USE PERMIT FOR ADDITIONAL ACCESSORY BUILDING SQUARE FOOTAGE FOR RICHARD AND DEBRA OMAN, 8205 GROVELAND ROAD, PLANNING CASE NO. 306-90 WHEREAS, the Mounds View Planning Commission has reviewed the request of Richard and Debra Oman for additional accessory building square footage; and WHEREAS, the Mounds View Zoning Ordinance allows by Conditional Use up to 1,264 square feet of accessory building square footage on one lot; and WHEREAS, the proposed building meets all applicable setback requirements; and WHEREAS, the proposed total building square footage is 0 1,112 square feet which is below the maximum allowed; and WHEREAS, in the past there had been a proposal to subdivide this lot and extend the road through this area; and WHEREAS, the proposed subdivision was never pursued and subsequently dropped by the applicant. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of the requested conditional use permit for additional accessory building square footage by Richard and Debra Oman, 8205 Groveland Road, contingent upon the following: a. That the conditional use permit is recorded with Ramsey County. b. That the applicant understands that no other accessory building will be allowed on this property. c. No motor vehicles other than licensed collectors vehicles allowed. d. There will be no improved or unimproved driveway access to the accessory structures . • e. That the building shall be a permanent structure and maintain a uniform appearance with the principal structure. • RESOLUTION NO. 298-90 PAGE TWO OF TWO f. That if the use should change from what the permit was granted for, the permit will be null and void. Acting Cit Pla • • • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 293-90 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION DENYING THE REQUEST FOR MORE THAN ONE ACCESSORY BUILDING, ACCESSORY BUILDING SETBACK, AND SWIMMING POOL FENCE HEIGHT VARIANCE FOR DARYL MADISON, 5200 JEFFERY DRIVE, PLANNING CASE NO. 297-90 WHEREAS, the Mounds View Planning Commission has reviewed the request by Daryl Madison, 5200 Jeffery Drive, for an accessory building setback variance to allow three sheds existing on his lot to be at the property line and less than six (6) feet from each other; and WHEREAS, the Mounds View Planning Commission has reviewed the request by Mr. Madison for a variance in the fence height requirements for swimming pools from the required 5 feet to 3.5 feet; and IIIWHEREAS, the Planning Commission has reviewed the conditions of the property in relation to this request; and WHEREAS, the Planning Commission has taken into consideration the fact that the sheds have existed for a number of years; and WHEREAS, the Planning Commission has reviewed the criteria used when evaluating all variance requests; and NOW, THEREFORE BE IT RESOLVED that the Mounds View Planning Commission denies the variance request to allow the sheds to be at the property line and less than 6 (six) feet from each other ba.,cd on the following: 1. No hardship exists. BE IT FURTHER RESOLVED that the Mounds View Planning Commission denies the request to keep the perimeter fence 3.5 feet high based on the following: 1. No hardship exists . NOW, THEREFORE, BE IT RESOLVED that the Mounds View . Planning Commission recommends to the City Council approval of the requested subdivision.
