The Mounds View Planning Commission was called to 1. Call to Order
order by Chair Mountin at 7 :35 p.m. on Wednesday,
April 3, 1991.
MEMBERS PRESENT: Commissioners Burgers, Peterson, 2 . Roll Call
Miller, Jones and Chair Mountin.
Commissioners Zollner and Colleen had excused
absences .
ALSO PRESENT: Planner Harrington had an excused

The Mounds View Planning Commission was called to 1. Call to Order
order by Chair Mountin at 7:35 p.m. on Wednesday, May
1, 1991.

Commissioner Burgers had an excused absence.

ALSO PRESENT: Planning Technician Harrington and
Parks, Recreation & Forestry Director Saarion.

The Floor
Resolution No. 312-91 was reviewed by the Planning 5 . Consideration
Commission. It was noted that Sandi Pidel, of Resolution
representing the Estate of Arlien Newton, was No. 312-91
present. Planner Harrington stated that this case Regarding

the City for a road easement would be agreeable to

It was agreed that a road easement is necessary to
allow for future road construction. Chair Mountin
indicated that in keeping with past practice, the
City would not take any more easements than needed.
It was noted that the 30 foot easement that Code
requires would not be consistent with existing
properties . The need for an 8 foot easement along
Groveland Road was also questioned.
The issue regarding the existing garage being on the
property line was discussed. Ms. Pidel indicated
that the park land was dedicated to the City 25 years
ago and the garage was built 3 years ago. A permit
had been obtained for the garage and it had been
inspected. It was agreed by the Planning Commission
that 10 feet should be dedicated back to the
applicant in order to remedy the non-conforming
structure.
It was questioned whether or not a park dedication
fee would be required since the applicant dedicated
the park land. Planner Harrington stated that
according to State Statutes a fee would be required.
Oltwas noted that the applicant would be scheduled at
the May 13th regular City Council meeting for action.
Motion/Second: Zollner/Colleen to approve Resolution
No. 312-91 with the amendment of the first
contingency on the resolution to deed back 10 feet of
land along the southern most line of Tract A to
remedy the non-conforming structure and the second
contingency that 15 feet be deeded over to the City
by the applicant for road right-of-way.

6 . Consideration
It was noted that the applicant, John Engberg, was of Resolution
not present. No. 313-91
Regarding
Resolution No. 313-91 was discussed by the Planning Conditional Use
Commission. Planner Harrington stated that the Permit Request
request regarding the oversized garage could be by John
considered a conditional use permit request according Engberg, 3030
to an ordinance that had recently been passed. County Road J,
Planner Harrington noted that the Code Book he was Planning Case
issued was not up-to-date and, therefore, did not No. 304-90
contain the ordinance change. The ordinance change
states that a garage is allowed up to 1,264 square
feet. However, if it exceeds 1,000 square no other
accessory buildings on the lot are allowed. Planner

Harrington stated that the request of the 900 square
foot garage meets the spirit and intent of this
ordinance and with the conditional use permit he will
be allowed to keep the garage as it now exists.
Motion/Second: Peterson/Zollner to approve
Resolution No. 313-91 regarding the conditional use
permit request of John Engberg, 3030 County Road J.

It was noted that the attendees at the April 17, 7 . Report of Chair
1991, Agenda Session were Commissioners Miller,
Peterson, Burgers and Chair Mountin. Also present
was Planner Harrington.

7:41 p.m.

0 RESOLUTION NO. 312-91
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF THE MINOR SUBDIVISION
REQUEST BY THE ESTATE OF ARLIEN NEWTON,
8300 FAIRCHILD AVENUE, PLANNING CASE NO. 322-91
WHEREAS, the Planning Commission has reviewed the proposed minor
subdivision request by the Estate of Arlien Newton for the property located at
8300 Fairchild Avenue, legally known as Auditor's Subdivision No. 89, Lot 5,
Block 1, Gustafson's 1st Addition and in said Auditor's Subdivision No. 89 the
north 95.07 feet (subject to roads and easements) of Lot 68, as shown on the
Certificate of survey dated March 25, 1991; and
WHEREAS, each of the proposed lots meet the minimum lot area and
width requirements as outlined in the zoning and subdivision ordinances.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the
City of Mounds View recommends approval of the requested minor subdivision
contingent upon the following:
1. That the City deed back to the estate of Arlien Newton 10'- 0" of
land along the southern most line of Tract A.
III 2. That the most easterly 15 feet of the most southerly 95.07 feet of
Tract A be deeded over to the City for road right-of-way.
3. That a 10 foot utility easement, centered on the rear lot lines of
the newly created tracts, be provided.
4. This resolution and the Certificate of Survey be recorded with
Ramsey County within sixty (60) days of final adoption.
5. The applicant pay a park dedication fee of $100.00
BE IT FINALLY RESOLVED that the Planning Commission directs Staff
to forward this resolution to the City Council prior to approval of the
minutes.

STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE
PERMIT REQUEST BY JOHN ENGBERG TO CONSTRUCT AN
OVERSIZED GARAGE AT 3030 COUNTY ROAD J,
PLANNING CASE NO. 304-90
WHEREAS, Mr. John Engberg, 3030 County Road J, has
requested a conditional use permit to allow for the construction
of an oversized garage (900 square feet) ; and
WHEREAS, Mounds View Municipal Code, Chapter 40 . 10,
Subdivision C(D) provides that the maximum size of a garage in an
R-1 District shall be 864 square feet unless a conditional use
permit is granted by the City; and
WHEREAS, Mounds View Municipal Code, Chapter 40 . 10,
Subdivision D( 6) A through F, provides a garage may be up to
1,264 square feet when said building is designed and maintained
• to provide a uniform appearance with the principle dwelling unit,
and if the garage is over 1,000 square feet no other accessory
building will be allowed on the lot; and
WHEREAS, the Mounds View Planning Commission has
reviewed the applicant's request for a conditional use permit and
determines that it is in conformance with the aforementioned
conditions .
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of a conditional use
permit to allow for an oversized garage of 900 square feet
requested by John Engberg, 3030 County Road J, contingent upon
the followin
1. The accessory building must conform with Section 40 . 04,
Subdivision F, and 40 . 10, Subdivision C(1) , of the
Zoning Code.
2 . The combined square footage of all accessory building
on the lot cannot exceed one thousand two hundred
sixty-four (1,264) square feet.
3 . If the garage square footage is greater than one
thousand (1,000) square feet, no other accessory
building is allowed.
• 4 . The building shall be designed and maintained to
provide a uniform appearance with the dwelling unit.

5 . The width of the building cannot exceed thirty-five
(35) feet nor allow for more than a three (3) vehicle
access .
6 . Should the use for which the permit wasgranted be
changed, the permit shall be subject to
reconsideration, revocation or other action regulated
by Chapter 40 .25 of the Zoning code.
7 . The conditional use permit shall be filed with Ramsey
County for recording on the title of the subject
property.
BE IT FINALLY RESOLVED that the Planning Commission
-directs- Staff to forward this resolution to the City Council
prior to approval of the minutes .
