The Mounds View Planning Commission was called to 1. Call to Order
order by Chair Mountin at 7:40 p.m. on Wednesday,
August 7, 1991.
MEMBERS PRESENT: Commissioners Peterson, Jones, 2 . Roll Call
Colleen, Burgers and Chair Mountin.
Commissioner Miller had an excused absence.
ALSO PRESENT: Planner Harrington, Councilmember
Blanchard, and Planning Intern Asleson.
Motion/Second: Mountin/Burgers to table the minutes 3 . Approval of
to the next agenda session. Minutes:

The Floor
Chair Mountin noted that she had received a call from
City Administrator Samantha Orduno regarding the
minutes. She went on to state that the minutes must
include vote, major outlines of motion, why a member
may have voted "no", specific questions entertained
by constituents, and concessions made by the
applicants. She noted that the Planning Commission
will review this issue at the next agenda session and
review the Bylaws as they relate to the cases
discussed.
Planner Harrington outlined the case. It was noted 5. Consideration
that the applicant, Norb Yenish, was not present of Resolution
because he was out of town. No. 316-91,
Variance
Commissioner Burgers inquired as to the minimum Request by
height needed for the sign. Planner Harrington Norb Yenish,
0 stated that due to the increase in the elevation of 2149 Program,
the adjoining property, the 15'0" variance is the Planning Case
minimum needed to alleviate the hardship. No. 324-91

Planner Harrington outlined the case. It was noted 6. Consideration
that Mr. Alan Brevitz, representing Conoco, Inc. , was of Resolution
unable to attend the meeting. It was also noted that No. 317-91,
Mr. George Winiecki, owner of 2740 Highway 10, and Rezoning
Mr. Roger Kolstad, Realtor, were present. Request for
Conoco, Inc. ,
Mr. George Winiecki presented his case regarding the 2740 Hwy. 10,
rezoning of his property from B-2, Limited Business, Planning Case
to B-3, Highway Business. Mr. Winiecki stated that No. 326-91
he was unable to build on his property due to a
moratorium placed on it by the City in the past.
Chair Mountin explained the five characteristics
specified by Code that must be addressed for all
rezonings. She clarified that the resolution is only
citing City Code.
0 Mr. Winiecki stated to the Planning Commission that
others in Mounds View, such as Super America, have
done what he is proposing. He also stated the market
is depressed and there are no buyers for B-2 zoned
property and that when he did have an offer at a B-2
zoning, the property was under a building moratorium.
Mr. Winiecki commented that there will be a need for
gasoline/convenience stores when the "dinosaur" gas
stations die off; Conoco would be successful because
people want a clean, service-oriented operation. He
stated that he believes Highway 10 will always be a
heavily travelled road, even with Highway 610 going
in. He stated that the station will not increase
traffic; people buy gas on the way to their
destination.
Mr. Winiecki stated to the Planning Commission that
his use is not unique and that there are other
stations in Mounds View like the one he is proposing
and that he should not be treated any differently
than Super America.
Chair Mountin noted that Mr. Winiecki had received a
copy of Resolution No. 317-91.

Chair Mountin noted the members present at the July 9. Report of Chair
17, 1991, Agenda Session were Commissioners Colleen,
Peterson, Miller and Chair Mountin. Commissioners
Burgers and Jones had excused absences.
There being no further business before the Planning 10. Adjournment
Commission, Chair Mountin adjourned the meeting at
8: 10 p.m.

RESOLUTION NO. 316-91
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING VARIANCE REQUEST BY NORB YENISH,
2149 PROGRAM AVENUE, PLANNING CASE NO. 324-91
WHEREAS, Mr. Norb Yenish has requested a variance to
allow the construction of a sign at a height which is grater than
that which is allowed by the Municipal Code; and
WHEREAS, Mr. Yenish is requesting a 15 '-0" variance
from the height limits for a sign on his property; and
WHEREAS, the Planning Commission has determined that
the property has a uniqueness to it not of the applicant's
making; specifically, properties adjacent to the parcel were
allowed to increase their elevations by 10'-0" , thus, creating a
hardship for the applicant; and
WHEREAS, no reasonable alternatives for the height of
0 the sign exist; and
WHEREAS, the requested variance is the minimum needed
to alleviate the hardship; and
WHEREAS, the granting of the variance will not confer a
privilege to the owner which is not enjoyed by other residents .
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission grants a 15 '-0" variance for height of a sign
at 2149 Program Avenue.

MOUNDS VIEW PLANNING COMMISSION
RESOLUTION NO. 317-91
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING DENIAL OF A REZONING REQUEST FOR
2740 HIGHWAY 10, CONOCO, INC. , PLANNING CASE NO. 326-91
WHEREAS, Conoco, Inc. has made application to rezone the
property located at 2740 Highway 10 from B-2, Limited Business, to B-
3, Highway Business; and
WHEREAS, Chapter 40.25, Subdivision A(5) , provides that the
Planning Commission shall consider possible adverse effects of the
proposed amendment. it further states that judgement shall be based
upon, but not limited to, the following factors:
1. Relationship to Municipal Comprehensive Plan
2 . The geographical area involved
3 . Whether such use will tend to or actually depreciate
the area in which it is proposed
4 . The character of the surrounding area
5 . The demonstrated need for such use; and
WHEREAS, the Mounds View Planning Commission has reviewed
the request in relation to the aforementioned criteria; and
WHEREAS, the rezoning request is inconsistent with the
City's current Comprehensive Land Use Plan designation for this
property which is mixed use planned unit development; and
WHEREAS, the request is inconsistent with the proposed
Comprehensive Land Use Plan designation for this property which is
Limited Business.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends denial of t, - -

BE IT FINALLY RESOLVED that the Planning Commission directs
Staff to forward this resolution to the City Council prior to approval
of the minutes .
