Adjournment Respectfully Submitted, / / - 77 (-- Paul Harrington City Planner • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 331-92 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW AN OVERSIZED GARAGE FOR TOM EDWARDS, 8315 PLEASANT VIEW DRIVE, PLANNING CASE NO. 340-92 WHEREAS, the Mounds View Planning Commission has reviewed the request of Tom Edwards for additional accessory square footage; and WHEREAS, the Mounds View Zoning Ordinance allows by conditional use permit up to 1,264 square feet of accessory building square footage on one lot; and WHEREAS, the proposed total accessory building square footage on the lot is 1, 184 square feet which is below the maximum allowed; and WHEREAS, the proposed building meets all applicable setback requirements. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends to the City Council approval of the requested conditional use permit for additional accessory building square footage by Tom Edwards, 8315 Pleasant View Drive, contingent upon the following: a) The conditional use permit be recorded with Ramsey County. b) The building be designed and maintained to provide a uniform appearance with the dwelling unit. c) Should the use change for what the permit was granted for, the permit will become null and void. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 4th day of March 1992 . ATTEST: G ' La C (SEAL) 411 - anner • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 333-92 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING SETBACK VARIANCE REQUEST BY HERBST AND SONS CONSTRUCTION CO. , INC. 2299 COUNTY ROAD H, PLANNING CASE NO. 336-92 WHEREAS, the Mounds View Planning Commission has reviewed the request of Herbst and Sons Construction Co. , Inc. for a variance to allow the construction of an addition to their existing facility at a five foot (5' ) side yard setback where a twenty foot (20') setback is required by Municipal Code; and WHEREAS, the Planning Commission has reviewed the criteria used to evaluate all variance requests; and WHEREAS, the applicant has presented a hardship statement to the Planning Commission; and WHEREAS, the literal interpretation of the provisions • of this code would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this Code; and WHEREAS, the special conditions of the property do not result from the actions of the applicant; and WHEREAS, granting the variance would not confer special privileges on the applicant that are not enjoyed by other property owners in the same district; and WHEREAS, the variance requested is the minimum necessary to alleviate the hardship. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission approves the variance request of Herbst and Sons Construction Co. , Inc. for a fifteen foot (15') variance into the side yard setback.
