PROCEEDINGS OF THE PLANNING COMMISSION CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA Regular Meeting December 2, 1992 Mounds View City Hall 2401 Highway 10, Mounds View, MN 55112 The Mounds View Planning Commission was 1. The building is unique in that there are two buildings on the property which share a common wall. One of the buildings has been vacant for over six months, which means that it has lost its grandfather rights as a non- conforming use. In order for a new tenant to use the building, current code requirements regarding off-street parking must be met. Staff estimates that roughly 30 spaces for customers plus one space for each employee on shift would be needed in order to meet the current code requirements. Staff also estimates that about 15 spaces • could be placed on site, although that Mounds View Planning Commission December 2, 1992 Regular Meeting Page 4 is just an estimate, as the applicant has not had the property surveyed. The applicant, Simon T. Simon, stated that he has a party interested in open- ing a bottle shop, which was what was on the site prior to it losing its grand- father rights. Mr. Simon stated that he had never had parking problems when it was previously used as a bottle shop. Planner Harrington confirmed that a bottle shop is an allowed use on the property. However, staff has two concerns regarding the placement of a new business on the site. The first is that there is uncontrolled access from the Groveland Road side of the property. The second is that Highway 10 right-of- way is currently being used by the applicant for parking and vehicle circulation. If a variance were to be approved, staff would recommend that a curbing plan for Groveland Road be developed and that the applicant be required to obtain MnDOT approval for using their right-of-way for parking purposes. MnDOT has said that they will study the situation, but ordinarily, they do not allow their right-of-way to be used for parking purposes. Commissioner Stevenson asked why the east side of the building could not be used for parking. Planner Harrington answered that the area was needed for drive aisles and general vehicle circulation. Chair Mountin reminded the Commission that a variance stays with a property indefinitely, rather than expiring when the use. changes. Commissioner Nelson stated his uneasiness about granting a permanent 411 Mounds View Planning Commission December 2, 1992 Regular Meeting Page 5 variance without having a specific parking plan available. Commissioner Burgers concurred, saying that without an engineering diagram and without knowing if MnDot will allow usage of their right-of-way, one cannot really be certain of how many spaces will fit on the site. Chair Mountin asked what uses of the property would be possible given the amount of parking that is available. Planner Harrington replied that he could not think of any uses that would meet current code requirements. Commissioners The next meeting is scheduled for January 14, 1993 . Chair Mountin asked about the status of the outdoor storage of vehicles at Bumper to Bumper. Planner Harrington indicated that he had spoken with representatives from Bumper 410 to Bumper. The attendees at the November 18, 1992 Agenda Session were Commissioners Colleen, Miller, Nelson, Peterson, Stevenson, and Chair Mountin. Commissioners Burgers and Ruggles had excused absences. BENNETT, 8308 KNOLLWOOD DRIVE, PLANNING CASE NO. 355-92 WHEREAS, the Mounds View Planning Commission has reviewed the request of Randy D. Bennett for an oversized accessory building (garage) ; and WHEREAS, the Mounds View Zoning Ordinance allows, by conditional use permit, up to 1,264 square feet of accessory building square footage on one lot; and WHEREAS, the proposed total accessory building square footage on the lot is 996 square feet which is below the maximum allowed; and WHEREAS, the proposed building meets all applicable setback requirements. NOW, THEREFORE, BE IT RESOLVED that the Mounds View 411Planning Commission recommends to the City Council approval of the requested conditional use permit for an oversized accessory building by Randy D. Bennett, 8308 Knollwood Drive, contingent upon the following: a) The conditional use permit be recorded with Ramsey County. b) The building be designed and maintained to provide a uniform appearance with the dwelling unit. c) Should the use change for what the permit was granted for, the permit will become null and void. ATTEST: /// Chair an,40Y (SEAL) / > //Z Planner • MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 353-92 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA ESTABLISHING MEETING AND TIMELINE SUBMISSION DATES FOR 1993 WHEREAS, the Mounds View Planning Commission will be holding two business meetings per month during 1993 with the exception of Special Meetings; the first being a regular meeting and the second an agenda session; and WHEREAS, the Planning Commission has requested to review regular business meeting agenda items at their agenda session, a minimum of two weeks prior to the regular business meeting; and WHEREAS, developers, citizens or other interested parties should be advised of deadlines for materials used by staff to prepare a report and used by the Planning Commissioners to decide on a particular development issue; and WHEREAS, a display of meeting dates and submission deadline dates be established to provide an orderly system for use by the Planning Commission, staff and general public; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View establishes meeting and submission timetable dates setting deadlines for submission of materials for agenda sessions of the Planning Commission and also setting the dates of the regular business meetings and agenda sessions; BE IT FURTHER RESOLVED that Exhibit 1 becomes an integral part of this resolution; BE IT FINALLY RESOLVED that if the Planning Commis- sion is required to or desires to hold special meetings, they will do so in accordance with State law, Code requirements and the Bylaws. The location of a large number of utility easements along side property lines within the City would require the removal and replacement of impervious surface in the event maintenance is needed. 2 . The five foot (5' ) side yard setback provides necessary area for the storage of snow from the impervious surface. BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 2nd day of Decemb-r, 1992 .
