The Mounds View Planning Commission was 1. Call To Order
called to order by Chair Mountin at 8:48
p.m. on June 16, 1993.
MEMBERS PRESENT: Commissioners Nelson, 2 . Roll Call
Peterson, Ruggles, Colleen, and Chair
Mountin. Commissioners Stevenson and
Miller had excused absences.
ALSO PRESENT: Planner Harrington,
Recording Secretary Asleson, and
Councilmember Rickaby.
Chair Mountin noted for the minutes that 3 . Consideration

order at the request of the applicant's No. 363-93 ,
representative, Tom Boulay of Husky, Regarding
Inc. The applicant, Keith Carlson, was Variance and
not present. Conditional Use
Permit Request
Planner Harrington stated the facts of of Gateway
the case for the minutes. Gateway Foods Foods, 2390
is requesting a Conditional Use Permit Highway 10,
to allow a car wash as an accessory use Planning Case
at 2390 Highway 10. The applicant also No. 362-93
is requesting a variance to locate the

residential area where a 40' setback is
required by code. This case had been
previously discussed by the Planning
Commission at agenda sessions.
Mr. Boulay explained that a car wash has
become a basic function of a convenience
store and that a store's competitive
position is weakened without one. He
explained that the only way that a 40'
setback requirement could be met would
be to move the car wash to the center of
the lot - something that can't be done
• because that is where underground gas

tanks are located. Mr. Boulay stated
that he felt that this use is a
reasonable one for the property and that
the impact to the adjoining properties
does not require a 40' setback. He
restated that a car wash is a necessary
part of the convenience store business.
Motion/Second: Colleen/Peterson to
approve Resolution No. 363-93, denying
the variance and conditional use permit
request of Gateway Foods, 2390 Highway
10.
4 ayes 1 nay Motion Carried
Commissioner Ruggles voted against the
resolution, stating that he felt the
shape of this particular property made
it difficult for the owner to make use
of his land. He also felt that a car
wash is a necessary part of the success

of a convenience store.
Commissioners Nelson and Peterson asked
if the car wash could be placed directly
against the concrete pad. This idea was
dismissed after Planner Harrington
pointed out that this placement would
still impact the adjacent residential
areas, because the cars would be stacked
and idling very near the lot line.
Planner Harrington said that it would be
a mistake to place the car wash only to
meet the setback requirement, without
considering the other factors of the
case.
Commissioner Colleen asked if the
applicant would consider closing off one
of their Highway 10 curb cuts to
alleviate some of the stacking problems.
Mr. Boulay replied that the proposal as
presented makes the most sense overall.

There being no further business before 5. Adjournment
the Commission, Chair Mountin adjourned
the meeting at 9: 02 p.m.

411 RESOLUTION NO. 363-93
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RECOMMENDATION TO THE CITY COUNCIL REGARDING
CONDITIONAL USE PERMIT AND VARIANCE REQUEST BY GATEWAY FOODS,
2390 HIGHWAY 10, MOUNDS VIEW PLANNING CASE NO. 362-93
WHEREAS, Gateway Foods has requested City approval
to construct an automated car wash in the City of Mounds View;
and
WHEREAS, the Zoning Ordinance allows car wash uses
in the B-3 , Highway Commercial District; and
WHEREAS, the development, as proposed, requires a
conditional use permit and variance; and
WHEREAS, the Planning Commission has reviewed the
following document regarding this development proposal:
a) Site Plan Dated June. 15, 1993
• (shown as boundary and topography survey)
WHEREAS, the Planning Commission has determined that
the conditional use permit request is in conformance with the
requirements of the Municipal Code, specifically Chapters 40,
42 , 49 and 49A and State Statutes; and
WHEREAS, the Planning Commission has determined that
the requested variance to allow placement of a structure 20
feet from an adjacent residential property where 40 feet is
required by Municipal Code does not meet the minimum necessary
requirements for hardship.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends denial of the conditional use
permit and variance request based upon the following:
1. No hardship has been presented by the
applicant.
2 . Reasonable use of the property does exist.
3 . The request for variance is not unique to this
property.
4 . The need is self created by the applicant.
